DECREE
Regulations on the criteria for leadership and management positions of civil servants in state administrative agencies
On the basis of 61/2014/QH13;
On the basis of Law on Cadres and Civil Servants No. 80/2025/QH15;

The Government promulgates this Decree to stipulate the criteria for leadership and management positions of civil servants in state administrative agencies.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decree stipulates the criteria for leadership and management positions of civil servants in administrative agencies and organizations under ministries and ministerial-level agencies (hereinafter referred to collectively as "ministries"); administrative agencies and organizations under provincial People's Committees and municipal People's Committees directly under the central government, and Offices of Delegations of National Assembly Members and Provincial People's Councils and municipal People's Councils directly under the central government (hereinafter referred to collectively as "departments and equivalents"); administrative agencies and organizations under district-level People's Committees, town People's Committees, and special economic zones (hereinafter referred to collectively as "district-level departments") and other state administrative agencies established in accordance with the law.
2. The competent authority managing civil servants in the administrative agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, and political-social organizations shall decide on the application of the position criteria prescribed in this Decree for corresponding leadership and management positions within their respective jurisdictions.
3. The Standing Committee of the National Assembly, the Office of the President, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the State Auditor General, and the heads of agencies under the Government shall decide on the application of the position criteria prescribed in this Decree for corresponding leadership and management positions in agencies and administrative machinery assisting them within their respective jurisdictions.
4. The Minister of National Defense and the Minister of Public Security shall decide on the application of the position criteria prescribed in this Decree for civil servants working in agencies, organizations, and units under their respective jurisdictions.
Article 2. List of leadership and management positions of civil servants in state administrative agencies
1. In administrative agencies under ministries:
a) Deputy Minister, Deputy Head of a ministry-level agency (hereinafter referred to collectively as "Deputy Minister");
b) Director of Class 1 Department;
c) Director of Division, Director of Class 2 Department, Director of Ministry's Office, Director of Ministry's Inspectorate, and equivalents (hereinafter referred to collectively as "Division Director and equivalents");
d) Deputy Director of Class 1 Department;
đ) Deputy Director of Division, Deputy Director of Class 2 Department, Deputy Director of Ministry's Office, Deputy Director of Ministry's Inspectorate, and equivalents (hereinafter referred to collectively as "Deputy Division Director and equivalents");
e) Head of regional office, Head of department, Director of Office, Director of Inspectorate established pursuant to international treaties, Director of Branch or equivalent under Class 1 Department (hereinafter referred to collectively as "Head of department and equivalents under Class 1 Department");
g) Head of division under division, Director of Ministry's Office; Head of department, Director of Office, Director of Inspectorate established pursuant to international treaties, Director of Regional State Bank Inspectorate, Director of Branch or equivalent under Class 2 Department (hereinafter referred to collectively as "Head of department and equivalents under Ministry");
h) Deputy Head of regional office, Deputy Head of department, Deputy Director of Office, Deputy Director of Inspectorate established pursuant to international treaties, Deputy Director of Branch or equivalent under Class 1 Department (hereinafter referred to collectively as "Deputy Head of department and equivalents under Class 1 Department");
i) Deputy Head of division under division, Director of Ministry's Office; Deputy Head of department, Deputy Director of Office, Deputy Director of Inspectorate established pursuant to international treaties, Deputy Director of Regional State Bank Inspectorate, Deputy Director of Branch or equivalent under Class 2 Department (hereinafter referred to collectively as "Deputy Head of department and equivalents under Ministry");
k) Head of department, Team Leader and equivalents under branch under department under ministry (hereinafter referred to collectively as "Head of department and equivalents under branch under department under ministry");
l) Deputy Head of department, Deputy Team Leader and equivalents under branch under department under ministry (hereinafter referred to collectively as "Deputy Head of department and equivalents under branch under department under ministry").
2. In administrative agencies under departments and equivalents:
a) Director of Department, Director of Office of Delegation of National Assembly Members and People's Council, Director of People's Committee's Office, Director of Inspectorate, Director of Industrial Zone Management Board, Economic Zone Management Board of provinces and centrally-administered municipalities and equivalents (hereinafter referred to collectively as "Director of Department and equivalents");
b) Deputy Director of Department, Deputy Director of Office of Delegation of National Assembly Members and People's Council, Deputy Director of People's Committee's Office, Deputy Director of Inspectorate, Deputy Director of Industrial Zone Management Board, Economic Zone Management Board of provinces and centrally-administered municipalities and equivalents (hereinafter referred to collectively as "Deputy Director of Department and equivalents");
c) Director of Branch, Head of department, Director of Office under department; Head of department under Office of Delegation of National Assembly Members and People's Council, Head of department under People's Committee's Office, Head of department under Industrial Zone Management Board, Economic Zone Management Board of provinces and centrally-administered municipalities and equivalents; Head of regional office under provinces and centrally-administered municipalities (hereinafter referred to collectively as "Head of department and equivalents under department");
d) Deputy Director of Branch, Deputy Head of department, Deputy Director of Office under department; Deputy Head of department under Office of Delegation of National Assembly Members and People's Council, Deputy Head of department under People's Committee's Office, Deputy Head of department under Industrial Zone Management Board, Economic Zone Management Board and equivalents; Deputy Head of regional office under provinces and centrally-administered municipalities (hereinafter referred to collectively as "Deputy Head of department and equivalents under department");
đ) Head of department and equivalents under branch under department;
e) Deputy Head of department and equivalents under branch under department.
3. In district-level departments:
a) Director of People's Council and People's Committee's Office, Head of department, Director of Public Service Center (hereinafter referred to collectively as "Head of department and equivalents at district level");
b) Deputy Director of People's Council and People's Committee's Office, Deputy Head of department, Deputy Director of Public Service Center (hereinafter referred to collectively as "Deputy Head of department and equivalents at district level").
4. Leadership and management positions in other state administrative agencies not specified in this Article shall be determined based on the name of such agency or organization and equivalent titles shall be determined according to the level of management or pursuant to the decision of the competent authority when establishing such agency or organization.
Chapter II
STANDARDS FOR LEADERSHIP AND MANAGEMENT PUBLIC SERVICE POSITIONS
Section 1
GENERAL STANDARDS
Article 3. Political and ideological standards
1. Absolute loyalty to the Party, the country, and the people; firm in revolutionary ideals, Marxism-Leninism, Ho Chi Minh Thought, the goals of national independence and socialism, and the Party's reform policies. Actively study, learn, grasp the Party’s guidelines, policies, and State laws; regularly update new knowledge and creatively apply it to practice.
2. Have a firm political stance, viewpoint, and political resolve, unwavering in the face of all difficulties and challenges; resolutely defend the ideological foundation, Program, guidelines of the Party, the Constitution, and State laws; unify thoughts and actions regarding political ideology, organization, and morality; resolutely combat false views and distorted statements from hostile forces. Strictly adhere to speaking discipline in accordance with Party principles and State laws.
3. Have a spirit of patriotism; always prioritize the interests of the Party, the nation, the ethnic group, the people, and the collective over personal interests; ready to sacrifice for the noble cause of the Party, for the independence and freedom of the country, and for the happiness of the people; always maintain close ties with the people, frequently pay attention to and understand their thoughts and aspirations. Absolutely comply with organizational assignments, be content with work, and complete all assigned tasks well.
Article 4. Moral character, lifestyle, and organizational discipline awareness
1. Possess good moral character; live honestly, modestly, sincerely, simply; be thrifty, honest, upright, impartial, and dedicated; strictly follow regulations on exemplary conduct and prohibitions for Party members; have a sense of self-discipline in moral cultivation and improvement. Leaders and managers, especially those in top positions, must set examples in moral character, lifestyle, and sense of responsibility, creating trust and positive influence within the organization, locality, or unit; at the same time, they must be diligent, hardworking, dynamic, innovative, brave in thinking, speaking, and acting, unifying thought and action, achieving results, taking responsibility, facing difficulties and challenges, sacrificing personal interests for the common good. Not be fame-seeking; politically opportunistic, power-hungry, using any means to obtain positions, power, rewards for planning and appointment. Have a spirit of building and maintaining unity, promoting democracy, setting examples, loving comrades and colleagues.
2. Not engage in corruption, waste, opportunism, or self-interest; not allow family members, relatives, or others to exploit their positions and powers for personal gain. Actively combat and prevent signs of ideological, moral, and lifestyle degeneration, "self-evolution," and "self-transformation" within the organization. Resolutely fight against bureaucracy, favoritism, corruption, waste, negativity, individualism, luxurious lifestyles, pragmatism, factionalism, localism, and group interests.
3. Strictly implement organizational and disciplinary principles of the Party, particularly democratic centralism, self-criticism, and criticism, adherence to speaking discipline; strictly follow State laws, local regulations, agency, and unit rules; properly exercise rights, responsibilities, and principles, regulations, systems, and procedures concerning cadre work; resolutely combat behaviors and actions that violate Party and State regulations in cadre work.
Article 5. Regarding Qualifications
1. Professional qualifications: Graduation from university or higher, suitable for the position according to the regulations of the ministry, sector, or locality where working.
2. Political theory:
a) Graduation from a bachelor's degree in political science or advanced political theory or advanced political theory - administration, or recognized as equivalent to the advanced level of political theory by the competent authority: Applies to the positions at points a, b, c, d, đ Clause 1 and points a, b Clause 2 of Article 2 of this Decree;
b) Graduation from intermediate political theory or intermediate political theory - administration, or recognized as equivalent to the intermediate level of political theory by the competent authority: Applies to the remaining positions under Article 2 of this Decree;
c) The recognition of equivalence in political theory shall be carried out in accordance with the provisions of the competent authority.
3. State management and science and technology:
a) Must complete the program of training knowledge and skills in state management according to the requirements of the leadership and management position appointed within twelve months from the date the appointment decision becomes effective;
b) Possess professional qualifications or have experience in implementing scientific and technological projects, innovation, digital transformation, meeting the requirements of the position (if applicable) according to the regulations of the ministry, sector, or locality where working.
4. Information technology and foreign languages:
Possess information technology and foreign language qualifications suitable for the position according to the regulations of the ministry, sector, or locality where working, or able to use ethnic minority languages for positions directly related to ethnic minorities or positions working in areas with ethnic minorities.
Article 6. Regarding Competence, Reputation, and Ability to Unite and Cohere
1. Have innovative thinking, strategic vision, flexible and effective problem-solving methods; possess the ability to grasp, synthesize, analyze, evaluate, forecast, and make timely and accurate decisions; contribute to formulating policies and leading the effective implementation of common development goals of the locality, agency, or unit.
2. Possess practical capabilities, understand the situation well to concretize and effectively implement Party guidelines, policies, and state laws in the assigned field or area. Able to identify new issues and limitations in practice; proactively propose appropriate, feasible, and effective policies, tasks, and solutions to promote innovation and development.
3. Possess leadership, management, and administrative experience, leverage strengths, build, and develop teams; capable of using, evaluating the effectiveness of civil servants and public officials under their authority in compliance with regulations; possess coordination and management capabilities for inter-sectoral and inter-level work to meet requirements and tasks.
4. Have a good reputation, trusted and supported by cadres, civil servants, public officials, workers, and the people in the locality, agency, or unit.
5. Possess the ability to unite and cohere internally, without forming cliques or factions; achieve unity, harness collective strength; maintain discipline and administrative integrity, prevent corruption, waste, and negativity within the organization, and build a clean and strong collective.
Article 7. Regarding work results
Achievements and results in leadership, guidance, and management work tied to specific products according to the assigned position and tasks for managerial civil servants, or criteria for work results tied to job positions for specialized and vocational civil servants as prescribed by the relevant ministry, sector, or locality; evaluated and rated by the competent authority as having satisfactorily completed tasks for at least three consecutive years.
Article 8. Regarding health, age, and experience
1. Having sufficient health to fulfill assigned tasks.
2. Meeting the age requirement for appointment as stipulated by the Party and the law.
3. Possessing leadership and management experience or time working in the corresponding field or industry according to the specific position as prescribed in this Decree.
a) In the case of appointing from internal personnel
If the current workplace has constituent units: Ensuring that they have held a leadership or management position within the constituent unit; the time spent in the current position or an equivalent position immediately preceding the proposed appointment must be at least one year (12 months); if not continuous, it can be accumulated (only accumulation applies to the time spent in an equivalent position).
If the current workplace does not have constituent units: Ensuring continuous work time in the corresponding field or industry according to the specific position as prescribed.
b) In the case of appointing personnel from external sources
If the current workplace has constituent units and the proposed appointment is at a workplace without constituent units: Ensuring the time spent in an equivalent position immediately preceding the proposed appointment as stipulated in point a of this clause or ensuring continuous work time in the corresponding field or industry according to the specific position as prescribed.
If the current workplace has constituent units and the proposed appointment is at a workplace with constituent units: Ensuring the time spent in an equivalent position immediately preceding the proposed appointment as stipulated in point a of this clause.
If the current workplace does not have constituent units and the proposed appointment is at a workplace with constituent units: Ensuring continuous work time in the corresponding field or industry according to the specific position as prescribed.
c) If prior to the appointment, there was a period of holding a position determined to be lower, equal, equivalent, or higher than the proposed appointment position, then that time will be counted towards the time spent in an equivalent position immediately preceding the proposed appointment as stipulated in point a of this clause; this does not apply in cases of removal from office.
Article 9. Special Cases Applying Position Standards When Appointing
1. In the case of being transferred or rotated from another place, it is not necessarily required to meet the standard "having held a lower-level leadership or management position" applicable to the corresponding position as stipulated in this Decree.
2. In the case of appointing civil servants to leadership or management positions according to the Party's policies on attracting and utilizing talented individuals and experts, it is not necessarily required to fully meet the position standards stipulated in this Decree, but they must complete these requirements within 36 months from the date of appointment.
3. When considering and appointing new positions not included in this Decree, the competent authority for appointment shall apply general standards and adapt specific standards of equivalent positions with similar positions and nature.
4. In the case of first-time appointments to leadership or management positions at various levels, it is not necessarily required to fully meet the standards regarding leadership and management achievements and experience in lower-level leadership or management positions.
5. Other special cases shall be decided by the competent authority upon consideration.
Section 2
SPECIFIC STANDARDS FOR EACH POSITION OF LEADERSHIP AND MANAGEMENT CIVIL SERVANTS UNDER THE MINISTRY
Article 10. Deputy Minister
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Possess a deep understanding of state administration, be well-versed in Vietnamese laws, international laws, and practices. Have the ability to concretize the Party's guidelines, policies, and state laws into programs, plans, and directives for implementation in the assigned sector or field.
2. Possess the ability to coordinate between ministries and sectors, and between central and local levels, ensuring consistency in implementing the Party's guidelines, policies, and state laws.
3. Have leadership experience, management skills, and decisiveness in promptly resolving difficult and complex issues within the assigned sector or field. Have the capability to direct the development and improvement of institutional frameworks; directly lead or participate in drafting proposals and policies authorized by competent authorities.
4. Possess the ability to implement digital transformation programs, administrative reform, human resource development, productivity enhancement, or improve the efficiency of state administration in the assigned field.
5. Have served and successfully completed tasks at the position of Department Director or equivalent, Member of the Provincial Party Committee Standing Committee or equivalent level.
Article 11. Director of Class 1 Bureau
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Be thoroughly familiar with Party and state documents, have a deep understanding of the legal system, mechanisms, and policies on industry and sector management, and international practices; possess experience in summarizing practical experiences; propose timely solutions to resolve difficulties and obstacles in the work area.
2. Possess the ability to propose strategic development issues for the industry or sector; advise on the construction and take responsibility for effectively implementing regulatory legal documents, research topics, proposals, programs, and annual work plans of the industry or sector; advise on resolving difficult and complex issues within the industry or sector; implement inspections, audits, and handling according to legal regulations; advise on resolving emerging cases, complaints, and petitions within jurisdiction; direct the resolution of unexpected situations and urgent matters; advise on coordination between ministries and sectors, and between central and local levels to ensure consistent, unified, and effective implementation of the Party's guidelines, policies, and state laws; implement and advise on administrative reform, digital transformation to enhance operational efficiency; study and apply modern scientific and technological knowledge; have innovative models of administrative reform, information technology application, digital transformation, or propose effective and breakthrough solutions that create clear changes and are applied in the assigned field.
3. Have served and successfully completed tasks at the position of Deputy Department Director or equivalent, or Director of a provincial department or equivalent level.
Article 12. Department Director and Equivalent
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Be thoroughly familiar with Party and state documents, have a deep understanding of the legal system, mechanisms, and policies on industry and sector management, and international practices; possess experience in summarizing practical experiences; propose timely solutions to resolve difficulties and obstacles in the work area.
2. Possess the ability to propose strategic development issues for the industry or sector; advise on the construction and take responsibility for effectively implementing regulatory legal documents, research topics, proposals, programs, and annual work plans of the industry or sector; advise on resolving difficult and complex issues within the industry or sector; implement inspections, audits, and handling according to legal regulations; advise on resolving emerging cases, complaints, and petitions within jurisdiction; direct the resolution of unexpected situations and urgent matters; advise on coordination between ministries and sectors, and between central and local levels to ensure consistent, unified, and effective implementation of the Party's guidelines, policies, and state laws; implement and advise on administrative reform, digital transformation to enhance operational efficiency; study and apply modern scientific and technological knowledge; have innovative models of administrative reform, information technology application, digital transformation, or propose effective and breakthrough solutions that create clear changes and are applied in the assigned field.
3. Have served and successfully completed tasks at the position of Deputy Department Director or equivalent, or Deputy Director of a provincial department or equivalent level.
Article 13. Deputy Director of Class 1 Bureau
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Be thoroughly familiar with Party and state documents, have a deep understanding of the legal system, mechanisms, and policies on industry and sector management, and international practices; possess experience in summarizing practical experiences; propose timely solutions to resolve difficulties and obstacles in the work area.
2. Possess comprehensive capability to advise on fundamental issues related to the development of the assigned sector or field; advise on the construction and effective implementation of regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; implement inspections, audits, and handling according to the law; advise on resolving emerging cases, complaints, and petitions within the scope of authority; direct the resolution of unexpected situations, urgent and complex tasks; advise on issues within the assigned sector or field; implement coordination work among ministries, sectors, and between central and local authorities to ensure consistent, unified, and effective implementation of Party policies and laws; advise on administrative reform, digital transformation to enhance operational efficiency of the administrative apparatus; study and apply modern scientific and technological knowledge; have innovative models for administrative reform, information technology application, digital transformation, or propose effective solutions with breakthroughs or clear changes that can be applied in the assigned field.
3. Have experience and successfully completed duties in the position of Department Head or equivalent at a Class 1 Bureau, Deputy Director of a Department or equivalent, or Secretary of a Village-level Party Committee or equivalent.
Article 14. Deputy Department Head and Equivalent
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Be thoroughly familiar with Party and state documents, have a deep understanding of the legal system, mechanisms, and policies on industry and sector management, and international practices; possess experience in summarizing practical experiences; propose timely solutions to resolve difficulties and obstacles in the work area.
2. Possess comprehensive capability to advise on fundamental issues related to the development of the assigned sector or field; advise on the construction and effective implementation of regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; implement inspections, audits, and handling according to the law; advise on resolving emerging cases, complaints, and petitions within the scope of authority; direct the resolution of unexpected situations, urgent and complex tasks; advise on issues within the assigned sector or field; implement coordination work among ministries, sectors, and between central and local authorities to ensure consistent, unified, and effective implementation of Party policies and laws; advise on administrative reform, digital transformation to enhance operational efficiency of the administrative apparatus; study and apply modern scientific and technological knowledge; have innovative models for administrative reform, information technology application, digital transformation, or propose effective solutions with breakthroughs or clear changes that can be applied in the assigned field.
3. Have experience and successfully completed duties in the position of Division Head or equivalent at a Ministry or Division Head or equivalent at a Department, or Deputy Secretary of a Village-level Party Committee or equivalent, or have continuously worked in the assigned sector or field for at least seven years.
Article 15. Department Head and Equivalent at Class 1 Bureau
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, policies, laws, and specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; organize the implementation of inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Have experience and successfully completed duties in the position of Deputy Division Head or equivalent at a Ministry or Division Head or equivalent at a Department, or Member of the Standing Committee of a Village-level Party Committee or equivalent, or have continuously worked in the assigned sector or field for at least five years.
Article 16. Division Head and Equivalent at Ministry
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, policies, laws, and specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; organize the implementation of inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Have experience and successfully completed duties in the position of Deputy Division Head or equivalent at a Ministry or Deputy Division Head or equivalent at a Department or equivalent, or have continuously worked in the assigned sector or field for at least five years.
Article 17. Deputy Department Head and Equivalent at Class 1 Bureau
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, legal regulations of the assigned sector or field; skilled in specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; implement inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Have experience and successfully completed duties in the position of Division Head or equivalent at a Sub-Bureau under a Bureau under a Ministry, Division Head or equivalent at a Department, or Division Head or equivalent at a Village level or above, or have continuously worked in the assigned sector or field for at least three years.
Article 18. Deputy Head of Department and equivalent under the Ministry
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, legal regulations of the assigned sector or field; skilled in specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; implement inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Has experience and successfully completed duties in the position of Deputy Head of Department and equivalent under the provincial department or Deputy Head of Department and equivalent at the commune level or higher, or has continuously worked in the field for at least three years.
Article 19. Head of Department and equivalent under the branch office under the bureau under the Ministry
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, legal regulations of the assigned sector or field; skilled in specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; organize the implementation of inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Has experience and successfully completed duties in the position of Deputy Head of Department and equivalent under the branch office under the bureau under the Ministry, or Deputy Head of Department and equivalent under the provincial department, or Deputy Head of Department and equivalent at the commune level or higher, or has continuously worked in the field for at least four years.
Article 20. Deputy Head of Department and equivalent under the branch office under the bureau under the Ministry
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Proficient in state management content, legal regulations of the assigned sector or field; skilled in specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; organize the implementation of inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Has continuously worked in the field for at least three years.
Section 3
SPECIFIC STANDARDS FOR EACH POSITION OF LEADERSHIP AND MANAGEMENT UNDER THE PROVINCIAL DEPARTMENT AND EQUIVALENT
Article 21. Director of Provincial Department and Equivalent
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Thoroughly understands Party and State documents, has deep knowledge of the legal system, mechanisms, and policies on managing the sector and field in the locality under their responsibility; has experience in summarizing practical experiences; proposes timely solutions to resolve difficulties and issues in the field of work.
2. Possesses the ability to advise and direct the effective implementation of central regulatory legal documents; advises on drafting regulatory legal documents applicable in the locality regarding the sector and field; directs the development of annual and term plans for the sector and field in the locality; directs or directly resolves difficult and complex issues within the sector and field in the locality; directs the execution of inspections, examinations, and handling according to legal provisions; directs the resolution of newly arising cases, complaints, and petitions within jurisdiction; directs the handling of emergent situations and complex tasks; advises on leadership coordination with central agencies; implements consistent, unified, and effective policies and guidelines of the Party and laws throughout the province; directs the organization to implement administrative reform, digital transformation to increase operational efficiency of the administrative machinery; studies and applies modern scientific and technological knowledge; has innovative models of administrative reform, information technology application, digital transformation, or proposes effective, breakthrough solutions or clear changes that are applied in the responsible field.
3. Has experience and successfully completed duties in the position of Deputy Director of Provincial Department and Equivalent or Secretary of the Party Committee at the Commune Level and Equivalent.
Article 22. Deputy Director of Provincial Department and Equivalent
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Thoroughly understands Party and State documents, has deep knowledge of the legal system, mechanisms, and policies on managing the sector and field in the locality under their responsibility; has experience in summarizing practical experiences; proposes timely solutions to resolve difficulties and issues in the field of work.
2. Possesses the ability to advise on the effective implementation of central regulatory legal documents; advises on drafting regulatory legal documents applicable in the locality regarding the assigned sector and field; develops annual and term plans for the assigned sector and field in the locality; directs or directly resolves difficult and complex issues within the assigned sector and field in the locality; handles emergent situations and urgent tasks; implements inspection, examination, and handling according to legal provisions; resolves complaints and petitions within jurisdiction; coordinates with central agencies to implement consistent, unified, and effective policies and guidelines of the Party and laws in the locality. Possesses the ability to advise on the organization to implement administrative reform, digital transformation to increase operational efficiency of the administrative machinery; studies and applies modern scientific and technological knowledge; has innovative models of administrative reform, information technology application, digital transformation, or proposes effective, breakthrough solutions or clear changes that are applied in the responsible field.
3. Has experience and successfully completed duties in the position of Head of Department and Equivalent under the Provincial Department or Member of the Standing Committee of the Party Committee at the Commune Level and Equivalent, or has continuously worked in the field for at least seven years.
Article 23. Heads of Departments and equivalent positions
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration, policies, laws regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess the ability to advise on the construction and effective implementation of regulatory legal documents, research topics, projects, programs, and annual work plans for the term of office of the industry and field; organize the implementation of inspections, examinations, and handling according to the provisions of the law; compile, propose solutions to recommendations, complaints, and accusations within their jurisdiction; possess leadership, management, and coordination abilities; utilize and evaluate the effectiveness of civil servants within their jurisdiction in accordance with regulations; maintain administrative discipline, prevent corruption, waste, and negative practices within the organization.
3. Have experience and successfully completed duties in the position of Deputy Head of Department and equivalent positions at the Department level or Head of Department and equivalent positions at the commune level or higher, or have continuously worked in the industry or field for at least five years.
Article 24. Deputy Heads of Departments and equivalent positions
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration and legal provisions regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess advisory capabilities to construct and effectively implement regulatory legal documents, research topics, projects, programs, and annual work plans for the assigned sector or field; implement inspections, audits, and handling according to the law; compile and propose solutions for complaints, petitions from organizations and citizens within the scope of authority.
3. Have experience and successfully completed duties in the position of Head of Department and equivalent positions at the Sub-Department level under the Department or Deputy Head of Department and equivalent positions at the commune level or higher.
Article 25. Heads of Sub-Departments and equivalent positions under Departments
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration and legal provisions regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess the ability to advise on the construction and effective implementation of regulatory legal documents, research topics, projects, programs, and annual work plans for the term of office of the industry and field; organize the implementation of inspections and handling according to the provisions of the law; compile, propose solutions to recommendations, complaints, and accusations within their jurisdiction; possess leadership, management, and coordination abilities; utilize and evaluate the effectiveness of civil servants within their jurisdiction in accordance with regulations; maintain administrative discipline, prevent corruption, waste, and negative practices within the organization.
3. Have experience and successfully completed duties in the position of Deputy Head of Sub-Department and equivalent positions under the Department or Deputy Head of Department and equivalent positions at the commune level or higher, or have continuously worked in the industry or field for at least four years.
Article 26. Deputy Heads of Sub-Departments and equivalent positions under Departments
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration and legal provisions regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess the ability to advise on the construction and effective implementation of regulatory legal documents, research topics, projects, programs, and annual work plans for the term of office of the industry and field; implement inspections and handling according to the provisions of the law; compile, propose solutions to recommendations, complaints, and accusations within their jurisdiction.
3. Has continuously worked in the field for at least three years.
Section 4
SPECIFIC STANDARDS FOR EACH POSITION OF LEADERS AND MANAGERS UNDER DEPARTMENTS AT THE COMMUNE LEVEL
Article 27. Heads of Departments and equivalent positions at the Commune Level
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration, policies, laws regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess the ability to advise on the construction and effective implementation of regulatory legal documents, programs, and annual work plans for the term of office of the industry and field; organize the implementation of policies and laws regarding the industry and field or assigned tasks; advise on the implementation of inspections and handling according to the provisions of the law in the local area; propose or directly resolve recommendations, complaints, and accusations from organizations and citizens within their jurisdiction; possess leadership, management, and coordination abilities; utilize and evaluate the effectiveness of civil servants within their jurisdiction in accordance with regulations; maintain administrative discipline, prevent corruption, waste, and negative practices within the organization.
3. Have experience and successfully completed duties in the position of Deputy Head of Department and equivalent positions at the Commune Level or Deputy Head of Department and equivalent positions at the Sub-Department level under the Department or higher, or have continuously worked in the industry or field for at least four years.
Article 28. Deputy Heads of Departments and Equivalent Positions at Commune Level
Shall meet the general criteria stipulated in Section 1 of this Chapter and the following provisions:
1. Master the content of state administration, policies, laws regarding the industry and field under management; be proficient in specialized knowledge and skills in the assigned field.
2. Possess the ability to advise on the construction and implementation of effective legal documents, programs, and annual work plans for the tenure period of their sector or field; organize the implementation of policies and laws related to their sector or field or assigned tasks; advise on inspection, handling, and resolution according to legal provisions within their jurisdiction; propose or directly resolve complaints, petitions, and grievances from organizations and citizens within their authority. Possess leadership, management, administrative operation capabilities; utilize and evaluate the effectiveness of civil servants under their authority in accordance with regulations; maintain discipline, administrative order, prevent corruption, waste, and negativity within the organization.
3. Has continuously worked in the field for at least three years.
Chapter III
IMPLEMENTING PROVISIONS
Article 29. Effective Date
1. This Decree takes effect from the date of signing and replaces Government Decree No. 29/2024/NĐ-CP dated March 6, 2024, which stipulates the standards for leadership and management positions in state administrative agencies.
2. In cases where competent authorities issue documents regulating cadre work that differ from the provisions of this Decree, they shall implement the new provisions of the competent authority.
Article 30. Transitional Provisions and Application
1. Individuals holding leadership and management positions who have not met the political theory standards as prescribed in this Decree must complete such requirements within 36 months from the effective date of this Decree, except in cases where the remaining time until retirement age is less than 36 months. During the period of completing the position standards as stipulated herein, if the individual reaches the reappointment term, they may still be considered for reappointment according to the regulations.
2. In cases where the appointment or reappointment procedures for leadership and management positions have been carried out according to Party and legal regulations before the effective date of this Decree but no appointment decisions have been made, the procedures should continue to be completed and the position standards must be fulfilled as specified in Clause 1 of this Article.
3. If individuals fail to meet the political theory standards as prescribed in this Decree within the time limit stipulated in Clause 1 of this Article, the competent authority shall consider and revoke the appointment decision and assign appropriate professional duties.
4. The Vietnam Social Security shall apply the leadership and management position standards of Class 1 Bureau as prescribed in this Decree.
Article 31. Responsibility for Implementation
1. Based on the provisions of this Decree, ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees, and centrally-administered city People's Committees are responsible for:
a) Specifying or delegating the specification of detailed standards for each leadership and management civil servant position to ensure compatibility with job positions and task requirements, characteristics of the ministry, sector, locality, agency, or organization under their authority, without being lower than the provisions of this Decree. In cases where higher standards are not required, there is no need to issue regulations and the provisions of this Decree shall be applied directly;
b) Based on Party regulations, specialized legal regulations, and this Decree, specify or delegate the specification of detailed standards for managerial positions in public service units under their management to ensure compatibility with the specific nature of each job position, occupational characteristics, and managerial task requirements.
2. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, heads of agencies stipulated in Clauses 2 and 3 of Article 1 of this Decree, Chairpersons of provincial People's Committees, centrally-administered city People's Committees, and relevant organizations and individuals are responsible for implementing this Decree.
