REGARDING THE ESTABLISHMENT OF THE DEPARTMENT OF INTERNATIONAL LEGAL AFFAIRS UNDER THE MINISTRY OF JUSTICE

THE MINISTER OF JUSTICE

- Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
- Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Considering the proposal of the Department Head of the Organization and Cadres Department of the Ministry of Justice.

Article 1. Establish the Department of International Legal Affairs under the Ministry of Justice.

The Department of International Legal Affairs shall have the function of assisting the Minister of Justice in drafting and participating in drafting laws related to public international law, international judicial affairs, and international trade law as prescribed by law.

Article 2. The Department of International Legal Affairs shall have the following tasks and powers:

1. Proposing policies for the development and improvement of legal systems related to public international law, international judicial affairs, and international trade law;

2. Taking the lead or participating in drafting projects and draft regulatory legal documents related to public international law, international judicial affairs, and international trade law assigned to be submitted to competent authorities for issuance or issued within their authority;

3. Proposing plans and schemes for signing, joining, and implementing international treaties within the scope of state management of the Ministry; monitoring the implementation of these plans and schemes after approval;

Taking the lead in drafting, negotiating, and completing procedures to submit to competent authorities for signing mutual legal assistance agreements and other international treaties within the assigned scope;

4. Organizing the implementation, guiding, and evaluating the execution of regulatory legal documents and international treaties within the assigned scope;

5. Taking the lead or participating in reviewing projects and draft regulatory legal documents within the assigned scope; reviewing and providing comments on draft international treaties according to the provisions of law;

6. Preparing legal opinions for international treaties on ODA, foreign loan project files, foreign debt settlement, and other legal opinions as prescribed by law;

7. Reviewing and systematizing international treaties and regulatory legal documents related to public international law, international judicial affairs, and international trade law;

8. Participating in activities of international organizations and international forums as assigned by the Minister;

9. Participating in resolving international disputes involving Vietnam from a legal perspective as assigned by the Minister;

10. Implementing international mutual legal assistance activities as prescribed;

11. Managing the staff and assets of the Department;

12. Perform other tasks assigned by the Minister.

Article 3. The Department of International Legal Affairs shall consist of the Department Head, Deputy Department Heads, and specialized technical staff. The staffing of the Department belongs to the administrative staffing of the Ministry of Justice, decided by the Minister based on the proposals of the Department Head of the Organization and Cadres Department and the Department Head of the Department of International Legal Affairs.

The Department Head of the Department of International Legal Affairs shall be responsible for coordinating with the Department Head of the Organization and Cadres Department to develop the Regulations on the Organization and Operation of the Department of International Legal Affairs to be promulgated by the Minister.

The Department Head of the International Cooperation Department shall be responsible for completing the handover of work contents and relevant files and materials concerning the tasks stipulated in Article 2 of this Decision to the Department Head of the Department of International Legal Affairs before August 15, 2003.

Article 4. The Comrades in charge of the Office Director, Department Heads of the Organization and Cadres Department, Department of International Legal Affairs, International Cooperation Department, and Heads of units under the Ministry of Justice are responsible for implementing this Decision.

Article 5. This Decision shall take effect from the date of signing.

The Heads of the Office, the Directors of the Department of Organization and Cadres, the Department of International Law, the Department of International Cooperation, and the Heads of units under the Ministry of Justice shall be responsible for implementing this Decision.
