DECREE

Regarding the permission for the Public Security Office to arrest individuals dangerous to the Democratic Republic of Vietnam and place them in custody

CHAIRMAN OF THE PROVISIONAL GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM

Pursuant to the proposal by the Minister of Interior Affairs and the Minister of Justice,

After deliberation by the Council of Ministers on September 12, 1945,

ISSUES DECREE

Clause I: The Public Security Office may arrest individuals dangerous to the Democratic Republic of Vietnam and place them in custody.

Clause II: Upon making such arrests, the Public Security Office must immediately prepare a report for the People's Committee of North, Central or South Vietnam, depending on the locality, detailing reasons and evidence along with the duration of custody.

The local People's Committees will examine and issue a resolution to decide whether to release or place in custody at a designated location for a specified period.

This resolution must be communicated by the local People's Committee to the Minister of Interior Affairs and the Minister of Justice.

Clause III: The Ministers of Interior Affairs and Justice are authorized to implement this decree.
