THE MINISTER OF POST AND TELECOMMUNICATIONS

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

On the basis of Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Department of Information Technology Industry.

Clause 4 of Article 6The Department of Information Technology Industry is the advisory body assisting the Minister in performing state management functions over hardware industry, software industry within the electronics, postal, telecommunications, and information technology sectors (hereinafter collectively referred to as the information technology industry) throughout the country.

Article 2. The Department of Information Technology Industry shall perform the following tasks and powers:

1. To take the lead in drafting draft laws and ordinances on the information technology industry.

2. To study, propose, and develop mechanisms and policies for managing the information technology industry.

3. To review the information technology industry component in planning and development plans for socio-economic development of ministries, sectors, and localities.

4. To organize the implementation of work related to managing programs for developing the information technology industry.

5. To manage the issuance, temporary suspension, suspension, and revocation of various licenses and certificates concerning the information technology industry.

6. To participate with relevant units under the Ministry in reviewing the information technology industry component in investment projects in the postal, telecommunications, and information technology sectors.

7. To participate with relevant units under the Ministry in formulating and reviewing fees, charges, prices, and tariffs for information technology products and services.

8. To participate with relevant units under the Ministry in formulating quality standards for information technology.

9. To participate with relevant units under the Ministry in implementing state management over the application of information technology and carrying out information technology development programs.

10. To propose to the Minister of Posts and Telecommunications to request the Minister or head of a ministerial-level agency managing another sector or field to suspend the enforcement or revoke regulations issued by that ministry or ministerial-level agency that contravene legal normative documents on the information technology industry; to suspend enforcement and propose the Prime Minister to revoke regulations issued by provincial People's Councils and People's Committees at the central city level that contravene legal normative documents on the information technology industry.

11. To participate with relevant units under the Ministry in disseminating, educating, and popularizing laws on information technology.

12. To manage the activities of associations and non-governmental organizations in the information technology industry.

13. To manage organization, cadres, civil servants, public officials, assets, files, and documents in accordance with the law and the delegation of the Minister.

14. Performing other tasks assigned by the Minister.

Article 3. The Department of Information Technology Industry shall be headed by a Director and have Deputy Directors, specialized staff, civil servants, and public officials to assist.

The Director shall be responsible to the Minister for the results of performing the functions, tasks, and powers stipulated in Article 1 and Article 2 of this Decision.

Deputy Directors assist the Director and are responsible to the Director for the tasks assigned to them.

The tasks and powers of cadres, civil servants, and public officials in the Department of Information Technology Industry shall be defined and assigned by the Director.

Article 4. This Decision shall take effect from the date of signing.

Article 5. The Head of the Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Department of Information Technology Industry, and the heads of units under the Ministry of Posts and Telecommunications shall be responsible for implementing this Decision./.
