Pursuant to the Law on the State Bank of Vietnam 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam 2003;
Pursuant to the Law on Credit Organizations 1997 and the Law Amending and Supplementing Certain Provisions of the Law on Credit Organizations 2004;
Pursuant to Decree No. 52/2003/ND-CP dated May 19, 2003, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;
Pursuant to Decree No. 64/2001/NĐ-CP dated September 20, 2001 of the Government on payment activities through organizations providing payment services;
At the proposal of the Head of the Payment Department,
DECISION:
Article 1. Amend and supplement Clause 1, Article 1 of Decision No. 1014/2005/QĐ-NHNN dated July 11, 2005 of the Governor of the State Bank of Vietnam on the amendment and supplementation of certain provisions of the technical procedures for electronic fund transfer operations within the State Bank system issued pursuant to Decision No. 134/2000/QĐ-NHNN2 dated April 18, 2000 of the Governor of the State Bank of Vietnam as follows:
"1. The control time points applicable in electronic fund transfers shall be specified as follows:
a) For State Bank A (Bank A): - Regarding the acceptance of transfer documents from customers who are credit organizations and the National Treasury: only accepted on working days; and only accepted until 15:45 daily; In exceptional cases, if transfer documents are received after 15:45, they will be processed for transfer on the morning of the next working day. - Regarding the processing of outgoing transfers of Bank A daily: only process outgoing transfers up to the time of 16:00, except on year-end settlement days and in cases of technical transmission issues or other objective reasons, specifically as follows: + All transfer documents received before 11:30 and high-value transfers, urgent transfers shall be processed for transfer to State Bank B (Bank B) on the same day, except in cases where technical issues, transmission problems, or other objective reasons prevent processing on the same day; + Transfer documents received after 11:30 until 15:45 will continue to be processed for transfer to Bank B on the same day or on the next working day; + In cases of technical issues, transmission problems, or excessive volume of documents generated at the end of trading hours, transfer units may request the Accounting and Finance Department to extend the outgoing transfer time of the system (by telephone or other agreed methods) to process the payment documents received on the same day, but the extended time shall not exceed 15 minutes from the time of stopping outgoing transfer processing.
b) The Accounting and Finance Department stops accepting incoming transfer orders from Banks A at 16:00 and stops sending outgoing transfer orders to Banks B at 16:15.
c) From 16:15, the Accounting and Finance Department and electronic fund transfer units perform reconciliation and confirmation of outgoing and incoming transfer amounts for the day. After completing reconciliation and confirmation with the Accounting and Finance Department, the electronic fund transfer unit is considered to have completed the day's work, except in cases of technical issues, transmission problems that cannot be reconciled and confirmed on the same day, then reconciliation and confirmation will be carried out in the morning of the next working day.
d) The Head of the Payment Department is responsible for guiding the application of control time points in electronic fund transfers within the State Bank system during year-end settlement days and in cases of technical issues, transmission problems, or other objective reasons, but must ensure asset safety and fully and promptly implement the supervision and reconciliation of fund transfers according to the prescribed regulations.
đ) Electronic fund transfer payments are urgent tasks that cannot be delayed. Electronic fund transfer units and the Accounting and Finance Department need to regularly arrange personnel to receive and process transfer orders to ensure smooth and safe operation of the system. Bank of Vietnam staff engaged in accounting, payment, and information technology operations, assigned the task of operating, monitoring, and supervising the electronic fund transfer system, are entitled to overtime allowances not exceeding 300 hours per year and other allowances as stipulated."
Article 2. This Decision takes effect 15 days after its publication in the Official Gazette.
Article 3. The Director of the Office, the Head of the Payment Department, the Director of the Information Technology Department of the State Bank, the Heads of Units under the State Bank, the Directors of the State Bank Branches, the Chairmen of the Management Boards, and the General Managers (Directors) of organizations providing payment services are responsible for implementing this Decision./.
