Amending and supplementing Circular No. 04/2009/TT-BLDTBXH dated January 22, 2009

providing detailed guidance on the implementation of certain provisions of
the Social Insurance Law regarding Unemployment Insurance

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to Decree No. 127/2008/NĐ-CP dated December 12, 2008 of the Government providing detailed guidance on the implementation of certain provisions of the Social Insurance Law regarding unemployment insurance,
The Ministry of Labor, Invalids and Social Affairs amends and supplements Circular No. 04/2009/TT-BLDTBXH dated January 22, 2009 of the Ministry of Labor, Invalids and Social Affairs guiding the implementation of certain provisions of Decree No. 127/2008/NĐ-CP dated December 12, 2008 of the Government providing detailed guidance on the implementation of certain provisions of the Social Insurance Law regarding unemployment insurance (hereinafter referred to as Circular No. 04/2009/TT-BLDTBXH) as follows:
Article 1. Amending and supplementing Circular No. 04/2009/TT-BLDTBXH as follows:
1. Replacing the phrase "Labor, Invalids and Social Affairs Office at district level" with the phrase "Job Introduction Center under the Department of Labor, Invalids and Social Affairs".
2. Amending paragraph a point 1.3 clause 1 section II as follows: "Not reporting monthly in accordance with regulations to the Job Introduction Center under the Department of Labor, Invalids and Social Affairs of the province or centrally governed city (hereinafter referred to as Job Introduction Center) about job search activities".
3. In paragraph a point 4.1 clause 4 section III: Removing the phrase "monthly notification date stipulated by the Labor, Invalids and Social Affairs Office at district level where unemployment benefits are being received".
4. Replacing the phrase "temporarily suspended receipt" in the second paragraph point 4.3 clause 4 section III with the phrase "continued receipt".
5. Removing clause 3 section IV.
6. Clause 4 section IV is amended and supplemented as follows:
"4. Responsibilities of the Job Introduction Center:
4.1. Organizing the acceptance of applications for unemployment insurance benefits, examining and implementing procedures for resolving unemployment insurance benefits according to this circular.
4.2. Organizing information dissemination and propaganda on policies and laws related to unemployment insurance.
4.3. Providing counseling and job introduction services for those receiving unemployment insurance benefits; organizing appropriate vocational training for those receiving unemployment insurance benefits.
4.4. Implementing regular reporting systems:
- Before the 2nd day of each month, report to the Department of Labor, Invalids and Social Affairs, the Ministry of Labor, Invalids and Social Affairs (Employment Bureau) on the implementation of unemployment insurance policies, counseling, job introduction, and vocational training for unemployed individuals in the area;
- Annually before July 10 and every six months before January 10, report to the Department of Labor, Invalids and Social Affairs, the Ministry of Labor, Invalids and Social Affairs (Employment Bureau) on the implementation of unemployment insurance policies, counseling, job introduction, and vocational training for unemployed individuals in the area."
7. Amending some contents in the forms attached to Circular No. 04/2009/TT-BLDTBXH.
a. Amending the name of the circular in the names of the forms attached to Circular No. 04/2009/TT-BLDTBXH as follows: "Issued together with Circular No. 04/2009/TT-BLDTBXH dated January 22, 2009 of the Ministry of Labor, Invalids and Social Affairs".
b. Replacing the phrase "People's Committee ... " which is the managing authority of the document drafting agency with the phrase "Department of Labor, Invalids and Social Affairs...".
c. Replacing the phrase "Labor, Invalids and Social Affairs Office..." with the phrase "Job Introduction Center...".
d. Replacing the phrase "Director of the Labor, Invalids and Social Affairs Office..." with the phrase "Director of the Job Introduction Center..." in the basis for issuing the document.
