Regulations on the establishment and implementation of power supply plans when the national power system lacks power sources.

Pursuant to Decree No. 189/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; Decree No. 44/2011/NĐ-CP dated June 14, 2011 of the Government amending and supplementing Article 3 of Decree No. 189/2007/NĐ-CP;

Pursuant to the Electricity Law dated December 3, 2004;

Pursuant to Decree No. 105/2005/NĐ-CP dated August 17, 2005 of the Government detailing and guiding the implementation of certain provisions of the Electricity Law;

The Ministry of Industry and Trade stipulates regulations on the establishment and implementation of power supply plans when the national power system lacks power sources as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates:

1. Method, procedure, and process for allocating electricity and capacity to power corporations and provincial power companies when the national power system lacks power sources.

2. Content, procedure, and process for establishing and implementing power supply plans when the national power system lacks power sources.

Article 2. Applicability

This Circular applies to the following entities:

1. Vietnam Electricity Corporation.

2. National Power System Dispatch Center.

3. Power Corporation.

4. Provincial Power Company.

5. Electricity Distribution and Retail Unit.

6. Electricity Consumers.

7. Relevant organizations and individuals.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Maximum feed-in capacity. is the maximum capacity that power corporations and provincial power companies receive from the national power system and import at metering boundary points.

2. Available system capacity. is the total available capacity of all generating units in the power system converted to the generator terminal and imported electricity at metering boundary points within a specified time period.

3. Capacity allocated to power corporations and provincial power companies. is the maximum capacity that power corporations and provincial power companies are permitted to use when the national power system lacks capacity.

4. Provincial Power Company. is a provincial power company under the central government.

5. System security assessment. is the evaluation of the stability and safety of power supply based on the balance between the available capacity and energy of the system and the anticipated load of the system, taking into account constraints in the power system and reserve capacity requirements within a specified time period.

6. Short-term system security assessment. is the daily assessment of the power system's security for each hour of the next fourteen days from the assessment date.

7. Medium-term system security assessment. includes annual assessments of the power system's security for the fifty-two weeks of the following year and weekly assessments of the power system's security for the next eight weeks from the assessment date.

8. Available system energy. is the total amount of electricity that can be generated by all generating units in the power system converted to the generator terminal and imported electricity at metering boundary points calculated annually, monthly, weekly, or daily.

9. Distribution and Retail Companies is an electricity enterprise licensed to operate in the distribution and retail of electricity, purchasing wholesale electricity from power corporations or provincial power companies to sell retail electricity to electricity consumers.

10. National power system lacking capacity. is the situation where the capacity reserve ratio of the power system during peak hours is lower than three percent and occurs for at least three (03) days in a week.

11. National power system lacking energy. is the situation where the available energy of the power system is lower than the forecasted energy demand of the system's load (including exported electricity) converted to the generator terminal.

12. National power system lacking power sources. is the situation where the national power system lacks energy or capacity or both energy and capacity.

13. Feed-in energy. is the energy received by power corporations and provincial power companies from the national power system at metering boundary points.

14. Monthly, weekly, and daily energy allocation to power corporations and provincial power companies. is the largest amount of energy that power corporations and provincial power companies are permitted to use in a month, week, or day when the national power system lacks energy and must allocate energy.

15. Load reduction. is the cessation or reduction of the supplied capacity and energy to electricity consumers when the national power system lacks power sources.

16. Regional Power Corporation. is the Northern, Central, or Southern Power Corporation.

17. Week W. is the current week.

18. Week W - / +i. is the week before or after the current week by i weeks.

19. Metering boundary point. is the location for measuring the exchange of energy between power corporations, provincial power companies, and the national power system and the location for measuring imported energy by power corporations, provincial power companies.

Chapter II

METHOD FOR ALLOCATING ENERGY AND CAPACITY AND

PRINCIPLES OF LOAD REDUCTION WHEN THE NATIONAL

POWER SYSTEM LACKS POWER SOURCES

Article 4. Method for Determining Total Electric Energy and Distributed Capacity for Electricity Corporations when the National Power System is Short of Power Supply

1. The allocation of electric energy and capacity to electricity corporations and provincial electricity companies shall only be carried out when the national power system is short of power supply, based on the following grounds:

a) Allocation of electric energy based on the approved annual and monthly operation plan of the national power system;

b) Allocation of capacity based on the approved monthly and weekly operation plan of the national power system.

2. The total allocated electric energy for electricity corporations each month shall be determined as follows:

 

Where:

- : Total primary electric energy allocated to electricity corporations in month m;

- : Ratio coefficient between the total primary electric energy allocated to electricity corporations in month m and the available electric energy of the system in month m. The ratio coefficient is determined based on the estimation of:

(i) Self-consumed electric energy and transmission loss on the step-up transformers of power plants in month m;

(ii) Total electric energy of local loads supplied by power plants in month m;

(iii) Transmission loss on the transmission grid in month m;

(iv) Total exported electric energy through the transmission grid of the entire system in month m (exported electric energy not executed by electricity corporations).

- : Available electric energy of the system in month m according to the approved monthly operation plan of the national power system (including small power plants with power purchase contracts with electricity corporations or provincial electricity companies).

3. The total allocated capacity for electricity corporations each week shall be determined as follows:

 

Where:

- : Maximum primary capacity allocated to electricity corporations in week w;

- : Ratio coefficient between the maximum primary capacity allocated to electricity corporations in week w and the available capacity of the system in week w. The ratio coefficient is determined based on the estimation of:

(i) Self-consumed capacity and transmission loss on the step-up transformers of power plants in week w;

(ii) Maximum capacity of local loads supplied by power plants in week w;

(iii) Transmission loss on the transmission grid in week w;

(iv) Maximum exported capacity through the transmission grid of the entire system in week w (exported capacity not executed by electricity corporations).

- : Available capacity of the system in week w according to the approved monthly and weekly operation plan of the national power system (including small power plants with power purchase contracts with electricity corporations or provincial electricity companies).

4. Vietnam Electricity Corporation shall be responsible for determining the coefficients  and  based on updating information on the operation of the national power system to ensure the maximum allocation of available electric energy and capacity of the system to electricity corporations and report to the Ministry of Industry and Trade for supervision.

Article 5. Method for Allocating Electric Energy Production to Electricity Corporations

1. The monthly allocation of electric energy production to each electricity corporation shall be determined based on the total primary electric energy allocated to electricity corporations and proportionate to the planned primary electric energy demand of each electricity corporation according to the approved annual and monthly operation plan of the national power system, taking into account priority power supply to Electricity Corporation of Hanoi and Electricity Corporation of Ho Chi Minh City.

2. The monthly allocation of electric energy production to each electricity corporation shall be calculated as follows:

- : Primary electric energy allocated to Electricity Corporation i in month m;

- : Planned primary electric energy demand of Electricity Corporation i in month m;

- : Adjustment factor for Electricity Corporation i.

- : Total planned primary electric energy demand of electricity corporations in month m;

- : Total primary electric energy allocated to electricity corporations in month m.

3. Vietnam Electricity Corporation shall be responsible for determining the adjustment factor  for each electricity corporation to ensure the full allocation of total primary electric energy in month m, notify the calculation method and results of the adjustment factor to electricity corporations, and simultaneously report to the Ministry of Industry and Trade for supervision.

4. The weekly allocation of electric energy production to electricity corporations shall be based on the monthly allocation plan of electric energy production.

5. The daily allocation of electric energy production to electricity corporations shall be determined for working days and Saturdays, Sundays based on the weekly allocation plan of electric energy production.

In case the actual primary electric energy of an electricity corporation in a week exceeds the allocated amount, the excess electric energy shall be deducted from the allocated amount for that electricity corporation in subsequent weeks' allocation plans.

Article 6. Method for allocating electricity generation to provincial power companies

1. The monthly allocation of electricity generation for each provincial power company shall be determined based on the allocated electricity generation at the source for the total power company in that month and in proportion to the planned demand for electricity generation at the source of such provincial power company during the month of allocation.

2. The monthly allocation of electricity generation for each provincial power company shall be calculated as follows:

 

Where:

- : Electricity generation at the source allocated to power company j in month m;

- : Adjustment factor for power company j;

- : Planned demand for electricity generation at the source of power company j in month m, calculated by power company j (including all electrical loads connected to the 110kV grid), registered with the Total Power Company of the region. The Total Power Company of the region is responsible for accurately determining the planned demand for electricity generation at the source of provincial power companies under its jurisdiction to implement the allocation of electricity generation;

- : Loss factor of electricity on the distribution network of Total Power Company of region i in month m, from the point of delivery/receipt of Total Power Company of region i with the national power system to the point of delivery/receipt with provincial power companies under its jurisdiction;

- : Electricity generation at the source allocated to Total Power Company of region i in month m.

3. The Total Power Company of region i is responsible for determining the adjustment factor  for each power company under its jurisdiction to ensure the full allocation of electricity generation at the source in month m, notifying the calculation method and results of the adjustment factor to provincial power companies under its jurisdiction, and simultaneously reporting to Vietnam Electricity Corporation for guidance and supervision of implementation.

4. The weekly allocation of electricity generation for provincial power companies shall be determined based on the allocation of electricity generation for provincial power companies in the monthly electricity generation allocation plan of the Total Power Company of the region.

5. The daily allocation of electricity generation for provincial power companies shall be determined for working days and Saturdays, Sundays based on the allocation of electricity generation for provincial power companies in the weekly electricity generation allocation plan.

In case the actual electricity generation at the source of a provincial power company in a week exceeds the allocated amount, the excess electricity generation shall be deducted from the allocation of electricity generation for that provincial power company in subsequent weeks of allocation.

Article 7. Method for allocating capacity to total power companies

1. The weekly allocation of capacity to each total power company in cases of insufficient capacity shall be determined based on the maximum capacity at the source allocated to total power companies in the corresponding week and in proportion to the planned demand for capacity at the source of the total power company during peak hours of the national power system operation plan for the month and week approved, taking into account priority power supply to the Total Power Company of Hanoi City and

the Total Power Company of Ho Chi Minh City.

2. The weekly allocation of capacity for each total power company shall be calculated as follows:

 

Where:

- : Maximum capacity at the source allocated to total power company I in week w during peak hours of the system;

- : Planned demand for capacity at the source of total power company i in week w during peak hours of the system;

- : Adjustment factor for total power company i;

- : Total planned demand for capacity at the source of total power companies in week w during peak hours of the system;

- : Total maximum capacity at the source allocated to total power companies in week w.

3. Vietnam Electricity Corporation is responsible for determining the adjustment factor  for each total power company to ensure the full allocation of maximum capacity at the source in week w, notifying the calculation method and results of the adjustment factor to total power companies, and simultaneously reporting to the Ministry of Industry and Trade for supervision of implementation.

Article 8. Method for allocating power capacity to provincial electricity companies

1. The weekly power capacity allocation for each provincial electricity company shall be determined based on the maximum power capacity allocated to the regional electricity corporation from the power source and in direct proportion to the peak system hour power demand of the provincial electricity company during the week when power capacity is being allocated.

2. The weekly power capacity allocation for each provincial electricity company shall be calculated as follows:

 

Where:

- : Maximum power capacity allocated to provincial electricity company j during week w at peak system hours;

- : Adjustment factor for provincial electricity company j.

- : Planned peak system hour power demand of provincial electricity company j in month m, calculated by provincial electricity company j (including all electrical loads connected to the 110kV grid), registered with the regional electricity corporation. The regional electricity corporation is responsible for accurately determining the peak system hour power demand of affiliated provincial electricity companies to implement power capacity allocation;

- : Power loss coefficient on the distribution network of regional electricity corporation i during week w, from the point of interconnection between regional electricity corporation i and the national power system to the point of interconnection with affiliated provincial electricity companies;

- : Maximum power capacity allocated to regional electricity corporation I during week w at peak system hours.

3. Regional electricity corporation i is responsible for determining the adjustment factor for each affiliated provincial electricity company to ensure the full allocation of maximum power capacity during week w, informing the calculation method and results of the adjustment factor to affiliated provincial electricity companies, and simultaneously reporting to Vietnam Electricity Corporation for guidance and supervision of implementation.

Article 9. Principles for implementing power regulation and conservation

1. In cases where the national power system lacks power supply, regional electricity corporations and provincial electricity companies have the responsibility to implement measures to minimize the impact of power conservation on production activities and people's lives, specifically as follows:

a) Implementing power-saving measures and managing electricity load demand;

b) Reaching agreements with electricity customers who have backup power sources to utilize these power sources when there is a power shortage;

c) Reaching agreements with industrial and construction customers regarding phased power reduction methods when the system lacks power or adjusting production plans to reduce power consumption during peak hours when the system lacks capacity; arranging reasonable production schedules, developing and implementing power demand reduction plans suitable for power supply capabilities.

2. In cases where measures stipulated in Clause 1 of this Article have been implemented but the power generation and consumption capacities of regional electricity corporations and provincial electricity companies still exceed the allocated power generation and consumption capacities, power conservation must be carried out according to the following principles:

a) Implementing power conservation for electricity customers except those deemed important electricity users approved by the People's Committee of the province in accordance with the Regulations on Conditions, Procedures, and Formalities for Interrupting and Reducing Electricity Supply issued pursuant to Decision No. 39/2005/QD-BCN dated December 23, 2005 of the Minister of Industry (Decision No. 39/2005/QD-BCN);

b) Prioritizing power supply for significant political and social events and other events as directed by the People's Committee of the province;

c) Implementing power conservation according to the plan approved by the People's Committee of the province, ensuring rotation, fairness, and not prolonging power conservation in one area or load, reasonably meeting the power needs for production, business operations, and daily life.

3. During the process of power regulation and conservation, Vietnam Electricity Corporation has the responsibility to update actual power generation, available power capacity, and load growth of the entire system in real-time to adjust power supply plans promptly; directing regional electricity corporations and provincial electricity companies to implement adjusted power supply plans to ensure stable operation of the national power system and provide maximum power supply when conditions permit.

Chapter III

PROCEDURES AND FORMALITIES FOR ESTABLISHING AND IMPLEMENTING PLANS

POWER ALLOCATION AND CONSERVATION WHEN

THE NATIONAL POWER SYSTEM LACKS POWER SUPPLY

Article 10. National Power System Generation Allocation Plan for the Following Year

1. Based on the approved national power system operation plan for the following year, in cases where there is a risk of insufficient electricity supply in the national power system, before November 15, Vietnam Electricity Corporation shall be responsible for organizing the preparation of the national power system generation allocation plan for the following year on a monthly basis for each regional electricity corporation according to the method prescribed in Article 5 of this Circular and report to the Ministry of Industry and Trade for guidance and supervision of implementation.

2. The national power system generation allocation plan for the following year shall include the following contents:

a) The expected time for implementing the generation allocation plan;

b) The upstream generation capacity requirement of each regional electricity corporation during months when the national power system lacks electricity;

c) The available electricity capacity of the national power system each month during the period when the national power system lacks electricity;

d) The monthly generation allocation for each regional electricity corporation corresponding to the available electricity capacity of the system each month during the period of electricity shortage.

3. Before November 25 each year, in cases where the national power system will lack electricity in the following year, Vietnam Electricity Corporation shall be responsible for approving and announcing the generation allocation plan for each regional electricity corporation on the Vietnam Electricity Corporation's electronic information website.

Article 11. Local Electricity Supply Plan for the Following Year

1. Before December 1 each year, based on the approved national power system generation allocation plan for the following year, the Northern, Central, and Southern Regional Electricity Corporations shall be responsible for calculating and allocating the generation capacity on a monthly basis for each provincial electricity corporation under their jurisdiction according to the method prescribed in Article 6 of this Circular, while reporting to Vietnam Electricity Corporation and the Electricity Regulatory Authority for monitoring and supervising implementation.

2. Before December 5 each year, based on the monthly generation allocation plans of the Northern, Central, and Southern Regional Electricity Corporations, each provincial electricity corporation shall be responsible for preparing the local electricity supply plan for the following year, to be submitted for approval by the provincial People's Committee.

3. Before December 5 each year, based on the approved national power system generation allocation plan for the following year, the Hanoi and Ho Chi Minh City Electricity Corporations shall be responsible for preparing the electricity supply plan for the following year, to be submitted for approval by the municipal People's Committee.

4. The local electricity supply plan for the following year must include the following contents:

a) The allocated generation capacity, the ratio of adjustable and reduced generation capacity, and the expected adjustment and reduction times at the local level;

b) The list of important customers exempt from electricity restrictions during shortages as stipulated in Decision No. 39/2005/QD-BCN;

c) The proposed adjustment and reduction measures for each category of electrical load and large electricity users according to the allocated generation capacity.

5. The Department of Industry and Trade shall be responsible for advising the provincial People's Committee to approve and announce the local electricity supply plan for the following year before December 15 each year.

Article 12. National Power System Electricity Generation Allocation Plan for the Upcoming Month

1. In cases where the national power system will be short of electricity in the upcoming month, before the 15th day of the current month, based on the approved annual electricity generation allocation plan of the national power system and the updated available electricity generation capacity of the entire system for the upcoming month, Vietnam Electricity Corporation shall be responsible for organizing the establishment and approval of the national power system electricity generation allocation plan for the upcoming month on a weekly basis for the power corporations and publishing it on the Vietnam Electricity Corporation's website, while reporting to the Electricity Regulatory Authority for monitoring and supervising implementation.

In cases where the national power system will be short of electricity in the upcoming month, which may lead to a reduction in the available capacity of hydropower plants and thus pose a risk of a total system capacity shortage, Vietnam Electricity Corporation shall be responsible for determining the available capacity of the system, the maximum total capacity allocated to the power corporations on a weekly basis according to the method prescribed in Article 7 of this Circular.

Article 13. Local Electricity Supply Plan for the Upcoming Month

1. In cases where the national power system will be short of electricity in the upcoming month, before the 17th day of the current month, based on the approved national power system electricity generation allocation plan for the upcoming month as stipulated in Article 12 of this Circular, North, Central, and South Power Corporations must allocate electricity generation on a weekly basis for the upcoming month to provincial power companies under their jurisdiction according to the method prescribed in Article 6 of this Circular, publish it on their websites, and report to Vietnam Electricity Corporation and the Electricity Regulatory Authority for monitoring and supervising implementation.

2. Before the 19th day of each month, in cases where the national power system will be short of electricity in the upcoming month, based on the approved local electricity supply plan for the year as stipulated in Article 11 of this Circular and the electricity generation allocated by the regional power corporation for the upcoming month, provincial power companies shall be responsible for establishing the local electricity supply plan for the upcoming month to be submitted for approval by the provincial People's Committee.

3. Before the 19th day of each month, in cases where the national power system will be short of electricity in the upcoming month, based on the approved local electricity supply plan for the year as stipulated in Article 11 of this Circular and the approved national power system electricity generation allocation plan for the upcoming month, Hanoi and Ho Chi Minh City Power Corporations shall be responsible for establishing the local electricity supply plan for the upcoming month to be submitted for approval by the municipal People's Committee.

4. The local electricity supply plan for the upcoming month shall be established according to the principles prescribed in Article 9 of this Circular and must include the following contents:

a) List of important customers who are not subject to electricity rationing when there is a shortage, as specified in Decision No. 39/2005/QD (if there are any changes);

b) Electricity generation allocated to various electrical load components and large electricity users using distribution and retail electricity units;

c) Methods of adjusting and reducing electricity consumption for various electrical load components and large electricity users.

5. The Department of Industry and Trade shall be responsible for advising the provincial People's Committee to approve and publish the local electricity supply plan for the upcoming month before the 22nd day of the current month.

2. Before the 19th day of each month, in cases where the national power system will be lacking power in the following month, based on the annual local power supply plan approved according to Article 11 of this Circular and the power generation volume allocated by the Power Corporation of the region for the following month, provincial power companies shall be responsible for establishing the local power supply plan for the following month to submit for approval by the Provincial People's Committee.

3. Before the 19th day of each month, in cases where the national power system will be lacking power in the following month, based on the annual local power supply plan approved according to Article 11 of this Circular and the approved national power system power allocation plan for the following month, the Hanoi Power Corporation and the Ho Chi Minh City Power Corporation shall be responsible for establishing the local power supply plan for the following month to submit for approval by the Municipal People's Committee.

4. The local power supply plan for the following month shall be established in accordance with the principles stipulated in Article 9 of this Circular and must include the following contents:

a) A list of important customers who are not subject to power restrictions when there is a power shortage, as specified in Decision No. 39/2005/QD (if there are any changes);

b) The power generation volume allocated to various electricity load components and large electricity consumers using distribution electricity and distribution and retail units;

c) Methods for regulating and conserving electricity for various electricity load components and large electricity consumers.

5. The Department of Industry and Trade shall be responsible for advising the Provincial People's Committee to approve and announce the local power supply plan for the following month before the 22nd day of the current month.

Article 14. Establishment and Implementation of Weekly Electricity Supply Plans at Local Level

1. In cases where the national power system lacks electricity, before 11:00 on Friday of week W, based on the approved national power system operation plan for week W as stipulated in Article 16 of Circular No. 09/2010/TT-BCT dated March 3, 2010 on the procedures for establishing, approving, and supervising the implementation of the national power system operation plan (Circular No. 09/2010/TT-BCT), the Power Corporation of each region shall be responsible for completing the plan to allocate electricity generation volume to provincial power companies under its jurisdiction for week W+2 and updating and adjusting the allocation plan for week W+1 if necessary, while reporting to Vietnam Electricity Group and the Electricity Regulatory Authority for monitoring and supervising the implementation.

2. In cases where the national power system lacks electricity, before 16:00 on Friday of week W, based on the allocation plan of electricity generation volume from the Power Corporation of each region, provincial power companies shall be responsible for completing the electricity supply plan for week W+2 and updating and adjusting the electricity supply plan for week W+1 if necessary, and reporting to the Department of Industry and Trade at the local level for monitoring and supervising the implementation.

3. Before 16:00 on Friday of week W, based on the approved national power system operation plan for week W, the Hanoi Power Corporation and the Ho Chi Minh City Power Corporation shall be responsible for completing the electricity supply plan for week W+2 and updating and adjusting the electricity supply plan for week W+1 if necessary, and reporting to the Department of Industry and Trade at the local level for monitoring and supervising the implementation.

4. The weekly electricity supply plan at the local level shall be established according to the principles stipulated in Article 9 of this Circular and based on the monthly electricity supply plan at the local level that has been approved by the People's Committee of the province, taking into account changes in electricity demand in previous weeks.

5. The weekly electricity supply plan at the local level includes the following contents:

a) The allocated electricity generation volume for weeks W+1 and W+2;

b) The daily electricity supply plan within the province/city including:

- The allocated electricity generation volume for different load components;

- The list of large electricity users subject to power rationing;

- The daily amount of electricity rationed for different load components, large electricity users using distribution networks, and power distribution and retail units;

- Areas subject to power rationing;

- The expected time for power rationing.

6. The procedures for implementing power rationing are carried out in accordance with Decision No. 39/2005/QĐ-BCN and Circular No. 09/2010/TT-BCT.

Chapter IV

PROCEDURES AND FORMALITIES FOR ESTABLISHING AND IMPLEMENTING PLANS

ALLOCATION OF CAPACITY AND POWER RATIONING WHEN

THE NATIONAL POWER SYSTEM LACKS CAPACITY

Article 15. National Power System Capacity Allocation Plan

1. In cases where the national power system faces a risk of lacking capacity based on short-term system security assessment results, the National Power System Dispatch Center shall be responsible for:

a) Determining the available capacity of the national power system each day over the next two weeks, the daily capacity shortfall, and the duration of the capacity shortfall;

b) Establishing the capacity allocation plan for power corporations according to the method prescribed in Article 7 of this Circular, and submitting it to Vietnam Electricity Group for approval.

2. The capacity allocation plan for power corporations includes the following contents:

a) The period during which the national power system lacks capacity;

b) The available capacity of the national power system each day in the week;

c) The capacity allocated to each power corporation;

d) An estimate of the daily capacity that will be rationed across the entire system.

3. The capacity allocation plan for power corporations is established simultaneously with the establishment of the national power system operation plan for the week as stipulated in Article 16 of Circular No. 09/2010/TT-BCT.

4. Vietnam Electricity Group shall be responsible for reporting to the Electricity Regulatory Authority about the capacity allocation plan for power corporations, and simultaneously publishing on the national power system website the status of capacity shortage and the capacity allocation plan for power corporations.

Article 16. Establishment and Implementation of Power Reduction Plans at Local Level

1. In cases where the national power system lacks capacity, before 9:00 on Friday of week W, based on the approved power allocation plan by Vietnam Electricity Corporation, the Northern, Central, and Southern Electricity Corporations shall complete the implementation of power allocation for week W+2 and update and adjust the power allocation level for week W+1 for provincial electricity companies under their jurisdiction according to the method prescribed in Article 8 of this Circular, while reporting to Vietnam Electricity Corporation for monitoring and supervision of implementation.

2. Before 16:00 on Friday of week W, the Hanoi Electricity Corporation, Ho Chi Minh City Electricity Corporation, and provincial electricity companies shall complete the local power reduction plan for week W+2 and update and adjust the power reduction plan for week W+1 according to the principles stipulated in Article 9 of this Circular, and report to the Department of Industry and Trade at the local level for monitoring and supervision of implementation.

3. The procedures and formalities for reducing power loads are carried out in accordance with Decision No. 39/2005/QĐ-BCN and Circular No. 09/2010/TT-BCT.

4. In cases where the actual operational power capacity of electricity corporations and provincial electricity companies exceeds the planned power allocation, the National Load Dispatch Center and regional system dispatch units are permitted to implement emergency load shedding measures to ensure power system security.

Article 17. Allocation of Power and Power Reduction When There Is a Local Power Shortage

1. In cases where there is a risk of grid congestion leading to a local power shortage or failure to meet system operation standards, the National Load Dispatch Center shall be responsible for:

a) Identifying areas with local power shortages and areas at risk of failing to meet system operation standards, and the time period during which the local power shortage occurs;

b) Determining the maximum power that can be supplied to the area with the power shortage and estimating the amount of power shortfall;

c) Establishing a power allocation plan for the area with the local power shortage for affected electricity corporations, submitting it for approval by Vietnam Electricity Corporation, and reporting to the Electricity Regulatory Authority for monitoring and supervision of implementation.

2. The power allocation plan for electricity corporations shall be established simultaneously with the national power system operation plan for the week as prescribed in Article 16 of Circular No. 09/2010/TT-BCT.

3. Before 9:00 on Friday of week W, electricity corporations in the area with the local power shortage shall complete the implementation of power allocation for week W+2 and update and adjust the power allocation level for week W+1 for provincial electricity companies under their jurisdiction based on the approved power allocation plan for the area with the local power shortage, while reporting to Vietnam Electricity Corporation for monitoring and supervision of implementation.

4. Before 16:00 on Friday of week W, the Hanoi Electricity Corporation, Ho Chi Minh City Electricity Corporation, and provincial electricity companies in the area with the local power shortage shall complete the local power reduction plan for week W+2 and update and adjust the power reduction plan for week W+1 according to the principles stipulated in Article 9 of this Circular, and report to the Department of Industry and Trade at the local level for monitoring and supervision of implementation.

5. The procedures and formalities for reducing power loads are carried out in accordance with Decision No. 39/2005/QĐ-BCN and Circular No. 09/2010/TT-BCT.

6. During the dispatch operation of the power system, the National Load Dispatch Center and regional system dispatch units are permitted to implement emergency load shedding measures to ensure power system security in the following situations:

a) In urgent situations when grid congestion on the transmission network leads to a risk of local power shortage or failure to meet system operation standards;

b) The actual operational power capacity of electricity corporations and provincial electricity companies exceeds the planned power allocation.

Chapter V

REPORTING AND MONITORING THE IMPLEMENTATION OF POWER ALLOCATION AND SUPPLY WHEN THE NATIONAL POWER SYSTEM LACKS POWER SOURCES

Article 18. Reporting System for Provincial Power Companies

1. Weekly Report

By 11:00 on Friday of week W, provincial power companies shall report to the Electricity Corporation of the region, the People's Committee of the province, and the Department of Industry and Trade on the electricity supply situation in the locality from Friday of week W-1 to Thursday of week W, including the following contents:

a) Daily electricity generation, maximum power allocation, and implementation of the provincial power company during the week;

b) Estimated daily electricity generation and reduced load capacity during the week.

The weekly report of the provincial power company shall be carried out according to the Weekly Report Form on Electricity Supply and Reduction Situation prescribed in Appendix 1 attached to this Circular.

2. Monthly Report

By the 5th day of each month, provincial power companies shall report to the Electricity Corporation of the region, the People's Committee of the province, and the Department of Industry and Trade on the electricity supply and reduction situation in the locality of the previous month, including the following contents:

a) Monthly electricity generation, maximum power allocation, and implementation of the provincial power company;

b) Estimated electricity generation volume and load reduction capacity in the month;

c) Implementation of electricity generation allocation and load reduction for various electrical loads and large electricity users within the province;

d) Analysis and clarification of reasons in cases where actual electricity supply differs from the approved monthly electricity supply plan by the People's Committee of the province.

The monthly report of the provincial power company shall be carried out according to the Monthly Report Form on Electricity Supply and Reduction Situation prescribed in Appendix 1 attached to this Circular.

Article 19. Reporting System for Electricity Corporations

1. Weekly Report

a) The Electricity Corporation of Hanoi City and the Electricity Corporation of Ho Chi Minh City shall report to the People's Committee of the city and the Department of Industry and Trade on the local electricity supply situation in accordance with Clause 1 of Article 18 of this Circular;

b) By 14:00 on Friday of week W, the electricity corporation shall report to Vietnam Electricity Group and the Electricity Regulatory Authority on the electricity supply and reduction situation from Friday of week W-1 to Thursday of week W, including the following contents:

- Daily electricity generation, maximum power allocation, and implementation of the electricity corporation during the week;

- Electricity generation allocation for provincial power companies under its jurisdiction and the implementation of load reduction by these provincial power companies (for regional electricity corporations);

- Analysis and clarification of reasons in cases where actual electricity generation and power differ from the allocated amount by more than 10%.

The weekly report of the electricity corporation shall be carried out according to the Weekly Report Form on Electricity Supply and Reduction Situation prescribed in Appendix 2 attached to this Circular.

2. Monthly Report

a) The Electricity Corporation of Hanoi City and the Electricity Corporation of Ho Chi Minh City shall report to the People's Committee of the city and the Department of Industry and Trade on the local electricity supply situation in accordance with Clause 2 of Article 18 of this Circular;

b) By the 7th day of each month, the electricity corporation shall report to Vietnam Electricity Group and the Electricity Regulatory Authority on the electricity supply situation of the previous month. The report content includes:

- Weekly and monthly electricity generation, maximum power allocation, and implementation of the electricity corporation;

- Estimated weekly electricity generation and reduced load capacity;

- Electricity generation allocation for provincial power companies under its jurisdiction and the implementation of load reduction by these provincial power companies (for regional electricity corporations);

- Summary and estimation of total electricity generation and largest load reduction for various electrical loads within the management area of the electricity corporation throughout the month;

- Analysis and clarification of reasons in cases where total monthly electricity generation and maximum power differ from the allocated amount by more than 5%.

The monthly report of the electricity corporation shall be carried out according to the Monthly Report Form on Electricity Supply and Reduction Situation prescribed in Appendix 2 attached to this Circular.

Article 20. Reporting System of Vietnam Electricity Corporation

1. Weekly Report

By 16:00 on Friday of week W, Vietnam Electricity Corporation shall be responsible for reporting to the Electricity Regulatory Authority on the situation of electricity supply and reduction in the national power system from Friday of week W-1 to Thursday of week W, including the following contents:

a) Electricity generation volume, available capacity of the system, and electricity generation volume, allocated capacity for each regional electricity corporation during the week;

b) Maximum capacity, daily electricity generation volume, and total electricity generation volume implemented by the entire system and each regional electricity corporation during the week.

The weekly report of Vietnam Electricity Corporation shall be carried out according to the Weekly Report Form on the situation of electricity supply and reduction prescribed in Appendix 3 issued together with this Circular.

2. Monthly Report

Before the 10th day of each month, Vietnam Electricity Corporation shall be responsible for reporting to the Ministry of Industry and Trade and the Electricity Regulatory Authority on the situation of electricity supply in the previous month, including the following contents:

a) Electricity generation volume, available capacity of the system, and electricity generation volume, allocated capacity for each regional electricity corporation every week in the month;

b) Maximum capacity, weekly electricity generation volume, and total electricity generation volume implemented by the system and each regional electricity corporation in the month;

c) Estimated electricity generation volume, maximum capacity reduced by each regional electricity corporation and the entire system every week in the month;

d) Summary and estimation of total electricity generation volume, maximum capacity reduced for each component of the load in the month of the entire system;

đ) Analysis and clarification of reasons in cases where the actual electricity generation volume of the entire system differs from the approved monthly and annual operation plan by 5% or more.

The monthly report of Vietnam Electricity Corporation shall be carried out according to the Monthly Report Form on the situation of electricity supply and reduction prescribed in Appendix 3 issued together with this Circular.

Article 21. Monitoring Electricity Supply When the Power System Lacks Power Sources

1. Regional Electricity Corporations shall be responsible for:

a) Supervising the implementation of the maximum allowable electricity generation volume and allocated capacity at provincial electricity corporations, ensuring that provincial electricity corporations implement the correct electricity generation volume and allocated capacity;

b) Supervising the electricity reduction work of provincial electricity corporations, ensuring that electricity reduction for each component of the load complies with the principles stipulated in Article 9 of this Circular.

a) Compiling the list of power plants providing ancillary services according to the transmission system regulations and the national black start and system recovery regulations issued by the Ministry of Industry and Trade;

a) Supervising the implementation of the maximum allowable electricity generation volume and allocated capacity at regional electricity corporations, ensuring that regional electricity corporations implement the correct electricity generation volume and allocated capacity;

b) Supervising the electricity supply work of regional electricity corporations and provincial electricity corporations, ensuring that electricity reduction for each component of the load complies with the principles stipulated in Article 9 of this Circular.

3. The Department of Industry and Trade is responsible for:

a) Supervising the electricity supply of the local electricity corporation according to the allocated electricity generation volume and capacity;

b) Supervising the electricity supply work at the local level according to the approved plan and electricity reduction principles stipulated in Article 9 of this Circular;

c) Supervising the electricity usage of electricity consumers with agreed load profiles with the provincial electricity corporation at the local level.

4. The Electricity Regulatory Authority shall be responsible for supervising the operation of the national power system and regions, generally monitoring the allocation and implementation of electricity generation volume and capacity when the national power system lacks power sources, in accordance with the principles stipulated in this Circular.

Chapter VI

IMPLEMENTATION

Article 22. Implementation organization

1. The Electricity Regulatory Authority shall be responsible for disseminating, guiding, and inspecting the implementation of this Circular.

2. During the implementation of this Circular, if there are any issues, relevant units must promptly report to the Electricity Regulatory Authority for research, proposal, and submission to the Ministry of Industry and Trade for amendment and supplementation of this Circular to ensure its appropriateness.

Article 23. Effectiveness of Implementation

This Circular takes effect from October 24, 2011./.
