Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

At the proposal of the Minister of Home Affairs, the Minister of Science and Technology, and the Minister of Finance;

The Prime Minister issues this Decision to stipulate the adjustment factor for the minimum wage increase above the general minimum wage level for civil servants, public officials, and workers employed at the Hoa Lac High-Tech Park Management Board under the Ministry of Science and Technology,

Article 1. Scope of Regulation

This Decision stipulates the adjustment factor for the minimum wage increase above the general minimum wage level for civil servants, public officials, and workers employed at the Hoa Lac High-Tech Park Management Board under the Ministry of Science and Technology.

Article 2. Applicability

1. Civil servants, public officials, and workers employed under labor contracts as specified in Article 1 of this Decision who belong to organizations performing state management functions of the Hoa Lac High-Tech Park Management Board shall be assigned salaries according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government.

2. Civil servants, public officials, and workers employed under labor contracts as specified in Article 1 of this Decision who belong to units under the Hoa Lac High-Tech Park Management Board that are not self-financing all regular operating expenses according to Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government on the rights of autonomy and responsibility for implementing tasks, organizational structures, staffing, and finance for public service units or Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government on the mechanism of autonomy and responsibility for public scientific and technological organizations shall be assigned salaries according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government.

3. The subjects specified in Clause 1 and Clause 2 of this Article do not include the following cases:

a) Those working at project management boards under the Hoa Lac High-Tech Park Management Board;

b) Those working abroad on business trips, assignments, or studies receiving 40% of their salary as stipulated in Clause 4, Article 8 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government;

c) Those studying domestically for three consecutive months or more;

d) Those taking personal leave without pay for one month or more consecutively;

đ) Those on sick leave or maternity leave exceeding the period prescribed by laws on Social Insurance;

e) Those suspended from work or detained.

Article 3. Adjustment Factor for the Minimum Wage Increase Above the General Minimum Wage Level

The subjects specified in Clause 1 and Clause 2 of Article 2 of this Decision shall apply an adjustment factor for the minimum wage increase above the general minimum wage level of 0.8 times the general minimum wage level.

Article 4. Source of funding

The funds for paying the adjustment factor for the minimum wage increase above the general minimum wage level stipulated in this Decision shall be guaranteed by the State budget and allocated in the annual regular operating budget of the Hoa Lac High-Tech Park Management Board.

Article 5. Implementation of the Autonomy and Responsibility System for Organizations Under the Hoa Lac High-Tech Park Management Board

1. Units performing state management functions of the Hoa Lac High-Tech Park Management Board shall implement the autonomy and responsibility system as stipulated in Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government on the autonomy and responsibility system for using staffing and administrative management expenses for state agencies.

2. Public service units directly under the Hoa Lac High-Tech Park Management Board shall implement the autonomy system as stipulated in Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government or Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government.

Article 6. Effectiveness

1. This Decision takes effect from October 1, 2012. The adjustment factor for the minimum wage increase above the general minimum wage level stipulated in this Decision shall be applied from January 1, 2012 to December 31, 2015.

2. Those retiring, leaving their jobs, or transferring out of the Hoa Lac High-Tech Park Management Board from January 1, 2012 to before the effective date of this Decision shall not be entitled to back payment of the adjustment factor for the minimum wage increase above the general minimum wage level.

3. The Ministry of Science and Technology and the Hoa Lac High-Tech Park Management Board shall organize the payment of increased wages for civil servants, public officials, and workers within their jurisdiction.

Article 7. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.
