Pursuant to the Price Law number 11/2012/QH13 dated June 20, 2012;

Pursuant to the Law on Fees and Charges No. 97/2015/QH13 dated November 25, 2015;

Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

Pursuant to the Government Decree Decision No. 149/2016/NĐ-CP dated November 11, 2016 amending and supplementing Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law;

BASED ON THE DECREE NUMBER 05/2022/ND-CP dated January 7, 2022 amending and supplementing certain provisions of the Decree Number 53/2019/ND-CP dated June 17, 2019 of the Government; Decision No. 107/2012/NĐ-CP dated November 20 2018 of the Minister of Education and Training 2012 Decree of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Based on the proposal of the Director of the Department of Finance;Director of the Finance Department;

The Minister of Transport Issuing this Circular prescribing the framework for the price of ferry service on national highway routes funded by state budget capital and managed by the central government. ferry service charge on national highway routes funded by state budget funds managed by the central authority.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular prescribes the framework for the price of ferry service on national highway routes funded by state budget capital and managed by the central government.

Clause 2. This Circular applies to pedestrians; drivers of non-motorized vehicles, motorized vehicles, special-purpose motorcycles, and similar types of vehicles; units providing ferry service on national highway routes funded by state budget capital and managed by the central government, and related organizations and individuals.

Article 2. Subjects required to pay for ferry service and persons settling the price of ferry service

Clause 1. The subjects required to pay for ferry service include: pedestrians, non-motorized vehicles, motorized vehicles, special-purpose motorcycles, and similar types of vehicles.

Clause 2. Persons settling the price of ferry service include: pedestrians; drivers of non-motorized vehicles, motorized vehicles, special-purpose motorcycles, and similar types of vehicles.

1. The framework for the price of ferry service, as set out in Tables 01 to 09 of the Appendix attached hereto, is the framework price issued for each ferry station on national highway routes.

Clause 1. The maximum price for ferry service at the ferry terminals specified in Appendices I, II, III, IV, V, VI, VII, and VIII attached to this Circular. Based on actual conditions, service provision units shall determine specific prices for ferry services at the terminals they manage. In cases where the determined specific price is lower than the maximum price mentioned above, the reduction rate shall not exceed 5% compared to the maximum price and must ensure convenience in settling the price of ferry service.

Clause 2. The price of ferry service prescribed in Article 3 of this Circular includes Value Added Tax.

Article 4. Subjects exempted from paying for ferry service

4. Flood control vehicles; emergency vehicles for flood and storm prevention;

5. Special-purpose vehicles serving national defense and security, including: tanks, armored vehicles, artillery tractors, vehicles carrying armed forces on maneuvers;

6. Funeral vehicles;

7. Vehicle convoys with escort vehicles;

8. Vehicles transporting medicines, machinery, equipment, supplies, and goods to disaster-stricken areas or epidemic zones;

Clause 9. War invalids, disabled veterans, students, children under ten years old (including those riding bicycles). When using ferry service in these cases, necessary documents such as War Invalid Certificates, Disabled Veteran Certificates, Student Cards, or school certificates issued by educational institutions, and birth certificates for children must be presented.

1. The printing, issuance, management, and use of ferry service fee tickets shall comply with current laws governing invoice management.

a) Single-use ticket: a ticket valid for one-time use of ferry service by a person required to pay the ferry service fee.

Clause 2. Ferry service revenue tickets at ferry terminals include two types: single trip tickets, monthly tickets.

b) Monthly ticket: a ticket valid for multiple uses of ferry service within thirty days, from the date of sale specified on the ticket to the end date specified on the ticket. The monthly ticket only applies to objects with specified monthly ticket fees as set out in the Appendix attached hereto.

Sub-clause b) Monthly ticket: a ticket with the value to use ferry service multiple times within thirty days, starting from the date specifically noted on the ticket until the end date specifically noted on the ticket. Monthly tickets only apply to subjects with stipulated monthly ticket fees as specified in the appendices attached to this Circular.

For pedestrian subjects, their full name and ID number must be clearly stated on the ticket. For vehicle subjects without license plates, the type of vehicle and the driver's full name and ID number (or citizen identification card) must be clearly stated on the ticket. For vehicle subjects with license plates, the type of vehicle and the license plate number must be clearly stated on the ticket.

3. Ticket purchased for a subject who must pay for service using a ferry wharf shall only be valid for use by that subject at the ferry wharf where the ticket was sold.

Article 6. Responsibilities of units entrusted with providing ferry service

Clause 1. To issue specific prices ensuring they fall within the framework for the price of ferry service prescribed in Article 3 of this Circular.

2. Publicly disclose and post information about the prices of ferry service usage fees in accordance with laws governing pricing.

Article 7. Implementation Organization

Clause 1. This Circular takes effect from January 1, 2017.

2. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Director of the Vietnam Road Administration, and the Heads of related agencies and organizations are responsible for implementing this Circular.

Clause 3. During the implementation process, agencies, organizations, and individuals should promptly report any difficulties or issues to the Ministry of Transport for consideration and resolution./.
