Amending and supplementing Circular No. 56/2015/TT-BGTVT dated October 8 the

Pursuant to the Environmental Protection Law on June 23, 2014;

of Vietnam; N |||Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport; For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.On the proposal of the Director of the Department of Environment,

The Minister of the Ministry of Transport issues this Circular amending and supplementing Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of the Ministry of Transport on the management of environmental tasks funded by the state budget carried out by the Ministry of Transport.

Article 1. Amending and supplementing some articles of Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of the Ministry of Transport on the management of environmental tasks funded by the state budget carried out by the Ministry of Transport

"a) For environmental tasks where the products are issued in the form of legal regulations, technical standards, or applied and implemented in environmental protection activities, specifically: organizing specialized training courses on environmental protection, disseminating and popularizing laws on environmental protection; publishing articles in newspapers, magazines, and online portals; reviewing strategic environmental impact assessments; inspecting environmental protection work; convening selection boards and review boards for project proposals; preparing annual environmental protection reports; the Department of Environment shall base on the content of implementation to seek additional opinions from experts from relevant agencies and organizations and conduct reviews;"

2. Amend the title of Clause 1, Article 9 as follows: "Basis for establishment, allocation, and transfer of state budget estimates."

1. Amending and supplementing Point a of Clause 2 of Article 7 as follows:

3. Amending and supplementing Point a and b of Clause 2, Article 9 as follows:

"a) Based on Clause 1 of Article 9, prepare a list of environmental tasks for the planning year according to Model No. 02 of the Appendix attached hereto and submit it to the leadership of the Ministry for approval;

b) Review and submit the detailed outline and budget estimates of the environmental tasks for the planning year at Point a of Clause 2 of Article 9 before December 31 according to Model No. 03 of the Appendix attached hereto;"

"3. Responsibilities of the Financial Department: Based on the list of environmental tasks and the Decision approving the detailed outline and budget estimates of the environmental tasks as specified in Points a and b of Clause 2 of Article 9, draft a Decision allocating the state budget estimate to the leading agency for submission to the leadership of the Ministry for approval."
"b) One set of evaluation forms, comments from members of the Board, minutes of the Board's acceptance meeting at the grassroots level, and the task leader's report on the Board's acceptance conclusions at the grassroots level (copies);"

4. Amend and supplement Clause 3 of Article 9 as follows:

6. Replace Appendix 3, 5, 6, 7, 10 of Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of the Ministry of Transport with Models No. 01, 02, 03, 04, 05 of the Appendix attached hereto.

5. Amend Point b Clause 2 Article 13 as follows:

7. Repeal Clause 5, Article 9, and Article 17 of Circular No. 56/2015/TT-BGTVT dated October 8, 2015 of the Minister of the Ministry of Transport.

1. This Circular takes effect from November 30, 2017.

2. The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular in accordance with their assigned functions and tasks./.

Article 2. Implementation clause

1. This Circular takes effect from November 30, 2017.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of agencies and organizations, and individuals concerned shall be responsible for implementing this Circular in accordance with their assigned functions and tasks./.
