Providing templates for administrative violation penalty decision records and decisions in the civil aviation sector

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

Pursuant to the Law on Handling Administrative Offenses dated June 20, 2012;

the Government regarding Decree No. 81/2013/NĐ-CP amending and supplementing certain articles of Decree No.of July 19, 2013 of the Government detailing certain provisions and measures to implement the Law on Handling Administrative Violations; At the proposal of the Director of the Legal Department and the Director of the Civil Aviation Administration of Vietnam;

The Minister of the Ministry of Transport issues this Circular providing templates for administrative violation penalty decision records and decisions in the civil aviation sector.

This Circular provides templates for administrative violation penalty decision records and decisions in the civil aviation sector. This Circular applies to individuals and organizations that commit administrative violations in the civil aviation sector; persons authorized to record administrative violations and issue administrative penalty decisions in the civil aviation sector, and individuals and organizations related to the handling of administrative violations in the civil aviation sector.

Article 1. Scope of Regulation

Article 3. Templates for administrative violation penalty decision records and decisions in the civil aviation sector

Article 2. Applicability

1. Attached to this Circular are model templates for administrative violation penalty decision records and decisions in the civil aviation sector.

2. In addition to the templates for administrative violation penalty decision records and decisions provided for in Clause 1 of this Article, the authorized person may apply other templates for administrative violation penalty decision records and decisions issued together with Decree No. 97/2017/NĐ-CP of August 18, 2017 amending and supplementing certain provisions of Decree No. 81/2013/NĐ-CP of July 19, 2013 of the Government detailing certain provisions and measures to implement the Law on Handling Administrative Violations.

This Circular takes effect from July 15, 2018 and replaces Circular No. 53/2013/TT-BGTVT of December 13, 2013 of the Minister of the Ministry of Transport providing templates for administrative violation penalty decision records and decisions in the civil aviation sector.

The Head of the Ministry's Office, the Inspector General of the Ministry, Directors of Departments, the Director of the Civil Aviation Administration of Vietnam, Heads of agencies, units, and relevant individuals are responsible for implementing this Circular./.

Article 4. Effective date

This Circular takes effect from July 15, 2018, and replaces Circular No. 53/2013/TT-BGTVT dated December 13, 2013, issued by the Minister of Transport on the model of administrative violation penalty decision and record in the civil aviation sector.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Civil Aviation Authority of Vietnam, Heads of agencies and units, and individuals concerned are responsible for implementing this Circular./.
