Issuing National Technical Regulations on safety for industrial explosive products - non-electric delay detonators used in underground mines/tunnels without explosive dust 

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Management and Use of Weapons, Explosives, and Supporting Tools dated June 20, 2017;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions Decree No. 78/2018/NĐ-CPdated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Standards and Technical Regulations;

On the basis of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality; Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality; Decree No. 154/2018/NĐ-CPdated November 9, 2018 of the Government amending, supplementing, and abolishing certain provisions regarding investment and business conditions in the field of management under the Ministry of Science and Technology and certain provisions on specialized inspection;

At the proposal of the Director of the Department of Safety Technology and Industrial Environment;

The Minister of Industry and Trade issues this Circular to issue National Technical Regulations on safety for industrial explosive products - non-electric delay detonators used in underground mines/tunnels without explosive dustnon-electric delay detonators used in underground mines/tunnels without explosive dust.

Article 1. Issuance of the National Technical Regulation

Accompanying this Circular are National Technical Regulations on safety for industrial explosive products - non-electric delay detonators used in underground mines/tunnels without explosive dust. Code: QCVN 12-22:2023/BCT.

Article 2. Effective Date

1. This Circular takes effect from July 1, 2024.

2. National Technical Regulations on safety for industrial explosive products - non-electric delay detonators used in underground mines/tunnels without explosive dust, number QCVN 12-22:2023/BCT shall take effect from July 1, 2024.

3. Non-electric delay detonators used in underground mines/tunnels without explosive dust that have been declared compliant according to National Technical Regulations on non-electric delay detonators, number QCVN 07:2012/BCT before July 1, 2024 may continue to be used within their declared shelf life.

Article 3. Implementation Organization

The Head of the Office of the Ministry, Directors of the Departments: Industrial Safety and Environmental Technology, Chemicals; Director of the Department of Science and Technology; Directors of Provincial Departments of Industry and Trade under central cities and provinces; Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
