Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating "Tasks, Powers, State Management Responsibilities, and Organizational Structure of the Ministry of Transport";

Pursuant to Decree No. 80/CP dated December 5, 1996 of the Government stipulating "Organization and Operation of Specialized Traffic Inspection";

Based on the proposal of the Director of the Legal Transportation Department after consultation with the Director of the Cadre Organization and Labor Department and the leadership of the Vietnam Highway Administration, Vietnam Inland Waterway Administration, and Vietnam Railways Corporation;

DECISION:

PART 1
GENERAL PROVISIONS

Article 1.- The Traffic Inspection Force performs the function of inspecting, supervising, urging, and reminding organizations, economic entities, social organizations, and all citizens, including foreign organizations and individuals residing and operating within the territory of Vietnam, to comply with laws concerning the protection of traffic works and traffic safety, and handling administrative violations related to the protection of traffic works and traffic safety.

Article 2.

The Traffic Inspection Force has the authority to impose administrative penalties for violations concerning the protection of traffic works and traffic safety according to the Ordinances on Protection of Traffic Works, Administrative Violation Handling, and Government Decrees No. 49/CP dated July 26, 1995, No. 39/CP dated July 5, 1996, and No. 40/CP dated July 5, 1996 on Ensuring Order and Safety in Road, Urban, Railway, and Inland Waterway Traffic, as well as other relevant legal regulations.

Article 3.

When performing their duties, the Traffic Inspection Force must act impartially, objectively, truthfully, civilly, courteously, openly, and in accordance with the law. Any harassment and negative behavior is strictly prohibited.

Chapter 2
TASKS AND POWERS OF THE TRAFFIC INSPECTION FORCE

Article 4.- The Traffic Inspection Force shall perform the following tasks:

1. Cooperate with local authorities at various levels, the People's Police force, other legal protection agencies, related sectors, and social organizations in promoting, disseminating, guiding, and educating about the implementation of laws on the protection of traffic works and traffic safety issued by competent state authorities so that all domestic organizations and individuals, including foreign organizations and individuals residing and operating within the territory of Vietnam, strictly comply with them.

2. Inspect, investigate, and handle acts of infringing upon traffic works, encroaching upon the protected zones of traffic works; construction, use, and exploitation of airspace, land, and water areas within the scope of protection of traffic works without permits or in violation of permits issued by competent state management authorities.

3. Inspect, investigate, and prevent construction, use, and exploitation of airspace, land, and water areas outside the scope of protection of traffic works but affecting traffic works or traffic safety without the opinion of competent state management authorities regarding the protection of traffic works.

4. Participate in the protection forces for particularly important traffic works as specified by the Ministry of Transport in coordination with the Ministries of Home Affairs and National Defense and submitted to the Government for approval.

5. Inspect and handle wheeled vehicles running on public roads without permits or in violation of permits issued by competent state management authorities regarding the protection of traffic works.

6. Inspect and handle at fixed vehicle weighing stations cargo and passenger transport vehicles operating on public roads when there are signs of overloading beyond the design load limit of bridges and roads.

7. In cases where it is necessary to promptly prevent potential consequences for traffic works such as: Overloaded vehicles exceeding bridge and road design limits; vehicles dragging cargo on the road surface, causing traffic safety hazards; large inland waterway vessels operating on routes with restricted navigation channels; motorized vehicles exceeding speed limits affecting the quality of traffic works; and vessels showing signs of unsafe overloading threatening navigation channels, the Traffic Inspection Force may stop these transport vehicles to take appropriate measures within its authority and bear responsibility under the law for its decisions.

8. Inspect, investigate, and handle administrative violations concerning the management of sidewalks, streets, other traffic works, and public works in urban areas, including above-ground and underground structures.

9. Inspect, investigate, and handle administrative violations within the jurisdiction as stipulated in Government Decrees on ensuring order and safety in road, urban, railway, and inland waterway traffic.

10. Inspect, investigate, and handle violations concerning the construction, repair, and management of traffic works both inside and outside the sector, and assist management units in marking boundary markers.

11. Prevent, inspect, and handle the issuance of operation permits or the use of transport means not meeting technical standards at railway stations, bus terminals, technical inspection stations, port areas, inland waterway ports, or when the means are parked or docked.

12. Inspect and handle drivers of transport means violating cargo and passenger transportation rules issued by the Ministry of Transport or jointly by the Ministry of Transport and related ministries at railway stations, bus terminals, ferry terminals, port areas, inland waterway ports, or when the means are parked or docked. In cases where it is necessary to prevent repeated violations of transportation rules or to promptly prevent potential consequences for transportation safety, the Traffic Inspection Force may stop these transport means to handle them within its authority and bear responsibility under the law for its decisions.

13. Regularly patrol on roads to prevent violations of laws protecting traffic infrastructure and ensuring safe transportation; identify damaged traffic works, missing signs and markers... and request the management units of such works to take timely measures for repair and supplementation. Participate with the management units of traffic works to resolve traffic congestion and ensure safe passage for vehicles.

14. Within their scope of responsibility, participate with legal authorities to address traffic accidents caused by traffic works or other traffic accidents on railways, roads, and inland waterways.

Article 5.- The Traffic Inspector has the following powers:

1. Remind, inspect, audit, and handle the implementation of legal provisions regarding the protection of traffic works and safe transportation according to the tasks specified (as per Article 4 of this Decision).

2. Record violations of laws concerning the protection of traffic works and safe transportation; decide to temporarily suspend or halt serious violations of laws related to the protection of traffic works and safe transportation.

3. Administer administrative penalties for acts violating laws concerning the protection of traffic works and safe transportation according to state regulations on administrative penalties for the protection of traffic works and ensuring traffic safety and order, and transfer the fines to the nearest responsible authority.

4. Compel organizations and individuals to restore the original condition of traffic works that have been altered due to violations; compel compensation for damages; compel the removal of unauthorized constructions or immediately clear items prohibited by law placed on auxiliary works managed by the Transport sector.

5. Seize evidence and means of transport according to regulations on administrative penalties; retain driving licenses and vehicle registration certificates based on the severity of the violation when handling cases.

6. Resolve disputes, complaints, and accusations regarding violations of laws concerning the protection of traffic works and safe transportation.

7. Recommend superiors to resolve and handle issues related to the protection of traffic works and safe transportation that exceed their own authority to resolve and handle.

Chapter 3
POSITIONS AND REQUIREMENTS FOR TRAFFIC INSPECTORS

Article 6.- Positions of Traffic Inspectors:

1. Director, Deputy Director of Traffic Inspection.

Team Leader, Deputy Team Leader of Traffic Inspection.

Traffic Inspector.

2. The Director of Traffic Inspection under specialized state management agencies shall be appointed and relieved of duty by the Minister of Transport upon the proposal of the leadership of Vietnam Highway Administration, Vietnam Inland Waterway Administration, and Vietnam Railway Corporation.

The Director of Traffic Inspection under Provincial Departments of Transport (Transport and Communications Departments) shall be appointed and relieved of duty by the Chairman of the People's Committee of the province or centrally-administered city upon the proposal of the Director of the Provincial Department of Transport (Transport and Communications Departments).

3. Deputy Directors of Traffic Inspection under specialized state management agencies shall be appointed and relieved of duty by the leadership of Vietnam Highway Administration, Vietnam Inland Waterway Administration, and Vietnam Railway Corporation upon the proposal of the Director of Traffic Inspection.

Deputy Directors of Traffic Inspection under Provincial Departments of Transport (Transport and Communications Departments) shall be appointed and relieved of duty by the Director of the Provincial Department of Transport (Transport and Communications Departments) upon the proposal of the Director of Traffic Inspection.

4. Team Leaders and Deputy Team Leaders of Traffic Inspection under specialized state management agencies (at Sub-District Highway Management Units, Central Section of Inland Waterway Management, and Inland Waterway Management Enterprises) shall be appointed and relieved of duty by the leadership of Vietnam Highway Administration, Vietnam Inland Waterway Administration, and Vietnam Railway Corporation upon the proposal of the Director of Traffic Inspection.

Team Leaders and Deputy Team Leaders of Traffic Inspection under units under Provincial Departments of Transport (Transport and Communications Departments); districts, counties, or equivalent units shall be appointed and relieved of duty by the Director of the Provincial Department of Transport (Transport and Communications Departments) upon the proposal of the Director of Traffic Inspection.

Article 7. Requirements for positions of Traffic Inspectors:

1. The Director and Deputy Director of Traffic Inspection must be at least 35 years old, have at least five years of experience in the field, hold a bachelor’s degree in technical specialization or law.

2. Team Leaders and Deputy Team Leaders of Traffic Inspection must be at least 25 years old, have at least three years of experience in the field, hold a bachelor’s or technical college degree in a relevant specialization. They must previously have served as Traffic Inspectors according to the prescribed standards.

3. Traffic Inspectors must be at least 20 years old, have at least two years of experience in the field, hold a technical college degree in a relevant specialization.

Specialized state management agencies, Provincial Departments of Transport (Transport and Communications Departments) should limit the transfer of Traffic Inspection staff at all levels.

Article 8.- Regarding the qualities of Traffic Inspectors:

1. Traffic Inspectors must have good political qualities, clear background; good morals, calm temperament, not impulsive or weak-willed.

2. When performing duties, they must have a sense of responsibility, organizational discipline awareness, and honesty towards assigned tasks; cannot be careless, afraid of difficulties, autocratic, or rude; handle cases accurately, punish the right person for the right violation; have a spirit of defending the law with reason and emotion so that violators recognize their mistakes and do not repeat them.

3. When performing duties, they must not drink alcohol or still have alcohol in their system; maintain a serious demeanor. If Traffic Inspectors are found to violate social evils, they must be dismissed immediately.

Article 9.- Regarding the knowledge of Traffic Inspectors:

1. Traffic Inspectors must have knowledge of psychology and ethics; specialized technical knowledge in highway, railway, and inland waterway sectors; be familiar with traffic laws and regulations of their respective sectors; have legal knowledge related to their tasks.

2. Have inspection and investigation skills, grasp and apply correctly the policies, laws of the State, and have research, discovery, analysis, synthesis, and proposal-making abilities for solutions at each level of Traffic Inspection.

3. To meet immediate requirements, Traffic Inspectors must complete training programs issued by the Ministry of Transport and obtain a certificate upon graduation. Based on the certificate, a "Traffic Inspector Card" will be issued to confirm their legal status when performing official duties.

The Ministry of Transport issues "Traffic Inspection Cards" to Team Leaders and above, and the Vietnam Highway Administration, Vietnam Inland Waterway Administration, Vietnam Railway Corporation, and Departments of Transport (Transport and Communications) issue "Traffic Inspection Cards" to Deputy Team Leaders of Traffic Inspectors and Traffic Inspectors under their management; "Traffic Inspection Cards" follow a uniform model throughout the country issued by the Ministry of Transport and have usage regulations.

To standardize the qualifications of Traffic Inspectors at all levels, the Ministry assigns the Personnel and Labor Affairs Department to continue drafting a training program to enhance knowledge and inspection skills (equivalent to a junior college level).

Article 10.- Regarding the health of Traffic Inspectors:

Traffic Inspectors must be in good health to perform their duties, they must pass a medical examination, not have disabilities, and not suffer from infectious or social diseases.

The minimum height for Traffic Inspectors is 1.60 meters, and the minimum weight is 50 kilograms; hair must be neatly styled, not covering the neck or ears. For female Traffic Inspectors, the minimum height is 1.55 meters, and the minimum weight is 45 kilograms.

Chapter 4
BADGES, RANK BADGES, NAME BADGES, UNIFORMS AND NECESSARY EQUIPMENT FOR PERFORMING DUTIES

Article 11.- General provisions:

1. When performing duties, Traffic Inspectors must wear the correct uniform; including badges, rank badges, name badges, and Traffic Inspector cards as prescribed;

2. Strictly prohibit erasing, modifying, lending Traffic Inspector cards or uniforms, badges, rank badges, name badges, and necessary equipment for performing duties for personal use;

3. After duty hours, Traffic Inspectors at all levels must leave badges, rank badges, name badges, and necessary equipment for performing duties at the office;

4. Traffic Inspectors are responsible for maintaining and preserving uniforms, badges, rank badges, name badges, Traffic Inspector cards, and necessary equipment for performing duties. If lost or damaged, they must immediately report to the office and bear full responsibility for the consequences. Upon transfer or dismissal, they must return all uniforms, badges, name badges, Traffic Inspector cards, work equipment provided, and other necessary documents to the Traffic Inspector office.

Article 12.- Badges of Traffic Inspectors:

1. Badges are symbols of Traffic Inspector organizations. Road Traffic Inspectors and Departments of Transport (Transport and Communications), Railways, and Inland Waterways each have their own badges;

2. Large badges with a diameter of 35 mm (raised design) made of metal, worn on the cap along with silver-plated pine branches on both sides (centered on the front of the cap, above the brim);

3. Small badges with a diameter of 10 mm made of metal, similar to large badges, raised or recessed, worn together with rank badges on both shoulders;

4. Badges of Road Traffic Inspectors and Departments of Transport (Transport and Communications) follow the current models being used;

Badges of Inland Waterway Traffic Inspectors are redefined by the Vietnam Inland Waterway Administration to suit the current tasks of the Administration;

Badges of Railway Traffic Inspectors are defined by the Vietnam Railway Corporation.

Article 13.- Rank Badges of Traffic Inspectors:

1. Rank badges of Traffic Inspectors are worn on the shoulders (lapels) of the coat to distinguish the ranks of Traffic Inspectors when performing duties;

2. Rank badges of Traffic Inspectors are made of dark navy blue velvet (dark blue) with a metallic thread border (gold for Team Leaders and above, white for Traffic Inspector Officers) and include small Traffic Inspector badges specific to road, railway, inland waterway sectors, and horizontal or diagonal V stripes;

3. - Head of Traffic Inspector Board: 4 gold metallic thread horizontal stripes.

Deputy Head of Traffic Inspector Board: 3 gold metallic thread horizontal stripes;

Team Leader of Traffic Inspector Team: 2 gold metallic thread horizontal stripes;

Deputy Team Leader of Traffic Inspector Team: 1 gold metallic thread horizontal stripe.

4. - Traffic Inspector Officer:

Less than 2 years: 1 white metallic thread V stripe. - More than 2 years: 2 white metallic thread V stripes.

Article 14.- Name Badges of Traffic Inspectors:

1. Name badges of Traffic Inspectors clearly display the inspector's name and number in the office roster, with the initials of the locality or specialized transport administration; if there is a violation of the law, organizations or individuals have grounds to report or appeal to the Traffic Inspector office or higher authority;

2. Name badges of Traffic Inspectors are made of paper, laminated with plastic and clipped into acrylic, worn on the left chest of the coat.

The upper part of the signboard: A dark blue background with the white text "THANH TRA GIAO THONG" (or "THANH TRA GIAO THONG CONG CHINH" for Departments of Transport and Communications) in uniform, sharp-edged letters, standing upright, with all marks present.

The lower part of the signboard: A white background, on the left is a color half-length photograph measuring 3x4 inches of a person wearing Traffic Inspector attire complete with insignia, rank badge, and signboard; it has the agency's stamp placed over the corner of the photo; on the right: The top row contains the surname, middle name, and given name (as recorded in the Traffic Inspector identity card), in dark blue letters, uniform, sharp-edged, standing upright, with all marks present, easy to read. The bottom row: The first character of the province or centrally governed city name (for Traffic Inspectors at Departments of Transport or Departments of Transport and Communications).

For specialized state management agencies responsible for roadways, the name shall be "Khu" (II, IV, V, VII).

For specialized state management agencies responsible for inland waterway transport, the name shall be "Đoạn" (1, 2, 3,..., 14).

For specialized state management agencies responsible for railway transport, the name shall be "LHĐS".

The letters are red, bold, standing upright, sharp and clear.

Across the names of localities, Khu, Đoạn, and LHĐSVN are the serial numbers (consisting of three digits) in red, standing upright, sharp and clear.

The data recorded from the Head of the Board to the Traffic Inspectors at each locality (Departments of Transport or Departments of Transport and Communications), each Khu (including all Sub-Khus within the Khu), each Đoạn (including all Stations within the Đoạn), Railway Joint Stock Company (at the LH), and each XNLH (including all Bridge and Road Management Enterprises, Traffic Inspection Training Enterprises, and Transport Hubs under each XNLH region).

Article 15.- The insignia is worn on the upper part of the sleeve near the shoulder.

All levels of Traffic Inspectors must wear the insignia on the upper part of the left sleeve near the shoulder (sewn directly or securely attached to the shirt).

The insignia is made of fabric, embroidered with the letters T.T.G.T or T.T.G.T.C.C in gold thread, below which is embroidered the insignia of each department, all on a navy blue velvet background.

Article 16.- The attire of Traffic Inspectors:

1. The attire of Traffic Inspectors is used uniformly across all levels throughout the entire transportation industry.

2. Cap: The top part is dark navy blue (dark blue), the visor is light blue, the bill and straps are black plastic, around the top part of the cap and the junction between the top and the visor are golden velvet trim; above the junction of the bill and the visor are two wide velvet trim lines.

3. Summer clothing:

Ao short-sleeved shirt (with elastic cuffs on the sleeves) or long-sleeved, stiff collar, two chest pockets with elastic flaps in the center, shoulder patches for rank badges (galloon), navy blue fabric, tucked into trousers.

Long trousers, moderately wide legs, navy blue fabric (dark blue) with two straight side pockets and one back pocket.

4. Winter clothing:

Ao navy blue (dark blue) suit with two large lapels, four buttoned pockets (with elastic flaps in the center), yellow metal buttons, shoulder patches for rank badges (galloon), cuffs with golden trim (1 cm wide) for Deputy Heads of Traffic Inspection Teams and above, white trim (1 cm wide) for Traffic Inspectors. Worn with a white long-sleeved shirt, stiff collar, long sleeves.

Long trousers, moderately wide legs, navy blue fabric (dark blue) with two straight side pockets and one back pocket.

In cold weather, wear a wool-lined jacket or a navy blue (dark blue) wool coat with large yellow metal buttons, shoulder patches for rank badges (galloon), cuffs with golden trim for Deputy Heads of Traffic Inspection Teams and above, and white trim for Traffic Inspectors.

Ao life jackets for inland waterway traffic inspectors working on inland waterways.

5. Navy blue (dark blue) necktie. Worn regularly in winter, may only be worn during national holidays and festivals in summer.

6. Black or brown leather belt, short black leather shoes, socks to match the shoes; rubber boots with raincoats. If frequently traveling long distances, wear a plastic helmet (with reflective paper or painted letters TTGT or TTGTCC on both sides of the helmet).

Article 17.- Necessary equipment for performing duties:

1. Work notebook (when used up, return to the agency to exchange for a new one) stamped by the Traffic Inspection Board on the cover and glued to the pages; ballpoint pen or fountain pen and a black faux leather document holder (satchel) for Traffic Inspectors, leather briefcase for levels from Team Leaders of Traffic Inspection Teams and above.

2. Sedans, trucks, cranes, boats, motorcycles, walkie-talkies, cameras, video cameras (cameras), fixed or portable truck scales, horns, signals to stop vehicles, and self-defense tools when performing duties.

Article 18.- Distribution system and usage period:

1. The distribution system for uniforms, insignias, rank badges, and signboards for all levels of Traffic Inspectors is the same.

2. Usage period:

Cap (1 piece), large insignia + pine branch with silver plating worn on the cap (1 set), rank badges worn on both shoulders (2 pieces), insignia worn on the upper left sleeve near the shoulder (1 piece): Usage period of 18 months.

Winter clothing (including white shirts worn underneath). One set/person/2 years, initially issued 2 sets.

Summer clothing: Two sets/person/year. Initially issued two sets.

Leather shoes One pair/person/12 months - Socks Two pairs/person/6 months. - Belt One/person/2 years

Necktie One/person/18 months

Raincoat One set/person/18 months

Document holder (or work briefcase for leaders) One/person/24 months - Wool lining (cold regions) One/person/24 months - Flashlight One/person/12 months - Overcoat (cold regions) One/person/24 months - Life jacket One/person/24 months

Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Rubber boots for rain One pair/person/18 months.

The above uniforms, insignias, and rank badges will be reviewed for cases where parts of Traffic Inspection Teams need to frequently travel on roads, reducing the usage time by one quarter compared to the regulations for items necessary to maintain the posture of Traffic Inspectors.

3. In cases of loss or damage due to valid reasons confirmed by the relevant authorities, replacements will be provided. If lost or damaged without valid reasons, a critique must be conducted, temporarily suspended from duty for review, and required to purchase replacement items after permission to resume duty is granted by superiors.

Article 19.

When performing Traffic Inspection duties, strict demeanor is required, hats must be worn (except in offices), clothing and neckties must be neat and not torn, dirty, wet (except raincoats); shoes must be polished and strictly prohibited:

Wearing sunglasses with dark lenses.

Wearing sandals of any kind.

Laughing, smoking cigarettes.

Being late for scheduled appointments to resolve traffic construction and transportation safety violations.

Sitting in automobiles, motorbikes, traffic inspectors shall impose penalties on violators of transportation works and transport safety.

Chapter 5
IMPLEMENTING PROVISIONS

Article 20.

Traffic Inspectors shall be remunerated according to the salary grade for specialists as stipulated in Decree No. 25/CP dated May 23, 1993 of the Government, and shall enjoy allowances such as those for fieldwork, river work, and hazardous work; night shift subsidies, holiday pay from the State, and all other benefits prescribed by the State.

The annual promotion system for Traffic Inspectors shall be in accordance with the general regulations of the State. Traffic Inspectors who achieve outstanding results shall be eligible for commendation and rewards at the discretion of competent authorities. The operational budget for Traffic Inspectors shall be provided by the State budget.

Article 21.

The Traffic Inspection Organization shall have full legal capacity to handle administrative violations concerning transportation works and transport safety in accordance with the provisions of the law and coordinate with relevant state agencies in performing their duties. They shall have offices and other facilities necessary for their operations at various levels.

Article 22.

The Traffic Inspection Organization shall open accounts at the National Treasury to receive State funds allocated for salaries, purchasing uniforms, insignias, badges, signs, and equipment for their tasks; disseminating laws and regulations on transportation; organizing training courses for professional and specialized skills; funding for clearing roadways, fuel for vehicles... Each year, the Traffic Inspection Board must prepare a comprehensive budget proposal for approval by higher authorities.

Article 23.

1. The Traffic Inspector seal shall only exist at the level of the Traffic Inspection Board, and only the Chairman and Vice-Chairman may use it.

2. Each Traffic Inspection Board shall be responsible for developing specific operational regulations suitable for the actual conditions of their units and localities, subject to approval by higher authorities with jurisdiction, but they must not contravene the provisions of this Decision.

Article 24.

This Decision shall take effect fifteen days after its signing. All previous provisions contrary to this Decision shall be abolished.

Provincial People's Committees and municipal people's committees directly under the central government may, depending on the situation in each locality, assign additional tasks and powers to Traffic Inspectors to meet the practical needs of the locality (in accordance with the Ordinance specifying the specific tasks and powers of the People's Councils and People's Committees at each level dated June 25, 1996).

Article 25.

The Heads of the Office of the Ministry, Heads of Departments for Traffic Safety, Human Resources and Labor, Finance and Accounting; the Head of the Ministry's Inspectorate, Directors of the Departments of Road Transport, Railways; General Director of Vietnam Railway Corporation, Directors of Departments of Transportation and Urban Transportation are responsible for implementing this Decision./.
