Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Prime Minister's Decisions: Decision No. 30/QD-TTg dated January 10, 2007 approving the Project to Simplify Administrative Procedures in the Fields Under State Management for the period 2007-2010; Decision No. 07/QD-TTg dated January 4, 2008 of the Prime Minister approving the Implementation Plan for the Project to Simplify Administrative Procedures in the Fields Under State Management for the period 2007-2010;
Pursuant to Decision No. 2131/QD-BNN-TCCB dated July 14, 2008 of the Minister of Agriculture and Rural Development establishing the Working Group to Implement the Project to Simplify Administrative Procedures in the Fields Under State Management of the Ministry of Agriculture and Rural Development;

DECISION:
Article 1. The operational regulations of the Working Group to Implement the Project to Simplify Administrative Procedures in the Fields Under State Management of the Ministry of Agriculture and Rural Development are hereby issued together with this Decision.
Article 2. This Decision takes effect from the date of signature.
Article 3. The Director of the Ministry's Office, Heads of Departments under the Legal Department, Heads of units directly under the Ministry, and members of the Working Group are responsible for implementing this Decision./.

OPERATIONS OF THE WORKING GROUP IMPLEMENTING THE PROJECT TO SIMPLIFY ADMINISTRATIVE PROCEDURES IN THE FIELDS UNDER STATE MANAGEMENT OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
(Issued together with Decision No. 3459/QD-BNN-VP dated November 4, 2008 of the Minister of Agriculture and Rural Development)

Article 1. Functions and Tasks
The Working Group to Implement the Project to Simplify Administrative Procedures in the Fields Under State Management of the Ministry of Agriculture and Rural Development (hereinafter referred to as the Working Group of the Ministry) is an organization established by the Minister, operating for a term of three years (2008-2010), directly and comprehensively directed by the Minister and the Deputy Minister in charge of administrative reform; directly managed by the Director of the Ministry's Office.
The Working Group of the Ministry has the following functions and tasks:
- Drafting plans to implement the Project over three years, annually submitting them to the Minister for approval and organizing their implementation.
- Guiding, inspecting, and urging subordinate units of the Ministry to collect statistical data, thoroughly review all administrative procedures, forms, and administrative declaration templates within their jurisdiction and scope of management according to the directives of the Government, the Prime Minister, the Minister, and the guidance of the specialized working group of the Prime Minister.
- Independently reviewing and evaluating the results of the statistical reviews of administrative procedures, forms, and administrative declaration templates after subordinate units have completed their reviews.
- Compiling, reporting to the Minister, the Prime Minister, and the specialized working group of the Prime Minister on the progress and results of the Project implementation according to the plan.
- Entering, managing, and transferring the database on the software for streamlining administrative procedures according to the guidance of the specialized working group of the Prime Minister.
- Consulting opinions from experts and associations; collecting opinions from citizens, organizations, and businesses regarding administrative procedures.
- Recommending to the competent authority to amend, abolish, cancel, or simplify procedures that subordinate units cannot prove to be lawful, necessary, and friendly to citizens and businesses.
- Submitting to the Ministry's Council on Awards and Disciplinary Actions a list of awards and disciplinary actions for units and individuals during the implementation of Project 30 at the Ministry.
- Implementing other tasks related to the content of simplifying administrative procedures of the Ministry and sector assigned by the Minister.
Article 2. Assignment of tasks for members
1. The Team Leader:
- Directing and managing the activities of the Working Group; assigning specific tasks to each member of the Working Group.
- Approving plans of the Working Group; providing final comments on draft reports, statistical results, and reviews submitted by the Ministry to the Prime Minister's specialized Working Group.
- Directing the updating and management of the Ministry's database into the software for streamlining administrative procedures; being responsible for approving and transferring the database to the Prime Minister's specialized Working Group.
- Chairing meetings of the Ministry's Working Group; attending meetings convened by the Prime Minister's Working Group.
- Regularly reporting to the Ministry's leadership on the progress and results of work implementation.
2. Deputy Head in Charge:
- Assisting the Head in directly directing the development and implementation of plans and managing the Working Group's general activities.
- Resolving daily emerging tasks of the Working Group.
- Directly managing specialized staff.
- Overseeing statistical work, reviews, and data updates into the software for streamlining administrative procedures, forms, and administrative declaration templates for forestry and water resources sectors.
- Performing other tasks assigned by the Head.
3. Deputy Head is the Deputy Director of the Legal Department:
- Coordinating work between the Working Group and the Legal Department.
- Participating in opinions on the implementation of the Working Group's activities; directly participating in some Working Group activities at the request of the Head.
- Responsible for proposing measures, procedures, and steps to amend, supplement, abolish, and simplify administrative procedures, forms, and administrative declarations based on statistical results and reviews.
- Performing other tasks assigned by the Head.
4. Mr. Nguyen Van Chu, specialized staff:
- Overseeing statistical work, reviews, and data updates into the software for streamlining administrative procedures, forms, and administrative declarations for the fisheries sector.
- Performing other tasks assigned by the Head.
5. Mr. Nguyen Hung Hue, specialized staff:
- Overseeing statistical work, reviews, and data updates into the software for streamlining administrative procedures, forms, and administrative declarations for agriculture, rural development, salt, rural industries, and various departments.
- Compiling and preparing reports on statistical results and reviews of the Ministry.
- Performing regular duties of the Ministry's Working Group and carrying out other tasks assigned by the Head.
Article 3. Internal Work Relationships within the Working Group
1. The Head of the Ministry's Working Group is responsible to the Minister and Deputy Ministers for all outcomes of the Working Group's activities; members of the Working Group are responsible to the Ministry's leadership and the Head for the results of their assigned tasks.
2. The Deputy Head in Charge is responsible for assisting the Head in reviewing and examining reports, proposing the implementation of Working Group tasks before submitting them to the Head for approval or to the Ministry's leadership for approval; directly managing team members.
3. Specialized members must regularly report to the Head on the progress of their assigned tasks and propose solutions to any difficulties; weekly reports to the Deputy Head, with immediate reports for important matters.
4. Depending on work requirements, the Working Group may propose the use of consulting experts or temporarily assigned civil servants according to current regulations.
- Experts perform tasks according to contracts.
- Temporarily assigned civil servants perform tasks assigned by the Head.
Article 4. Work relations with units
1. With the Office of the Permanent Steering Committee for Administrative Reform: The activities of the Ministry's Task Force are part of the Ministry's administrative reform program, funded from the administrative reform budget and project support funds with administrative reform components, but have relative independence in implementing the content of their work plans and programs.
2. With the Department of Legal Affairs: The Ministry's Task Force leads and coordinates with the Department in statistics and review of administrative procedures. For contents requiring simplification, modification, or abolition, the Ministry's Task Force prepares reports to be approved by the Ministry's leadership and transferred to the Department of Legal Affairs and relevant units for implementation according to prescribed procedures.
3. With the Bureaus, Departments, Committees, Inspection Units of the Ministry and other subordinate units of the Ministry (hereinafter referred to as units): The Ministry's Task Force is responsible for guiding business operations, inspecting, and urging units to carry out self-implemented contents; directly working with the units' Task Forces on Project 30 contents; coordinating with units to solicit customer opinions on administrative procedures, forms, and administrative declarations within their areas of state management.
Article 5. Responsibilities of Units
1. Department of Legal Affairs:
- A Deputy Director of the Department of Legal Affairs serves as the Deputy Head of the Task Force;
- When the Task Force works directly with units, the Department of Legal Affairs assigns staff to monitor the unit during the work;
- Implement the supplementation, amendment, abolition, and simplification of administrative procedures according to the requirements of the Prime Minister's Task Force and the Ministry's Task Force (approved by the Ministry's leadership) in accordance with the procedures stipulated in the Law on Enacting Regulatory Legal Documents and related laws.
2. Units:
- Establish a unit Task Force according to Decision No. 2131/QĐ-BNN-TCCB dated July 14, 2008.
- Nominate officials to participate in vocational training courses, seminars, and workshops convened by the Ministry's Task Force.
- Compile a list of administrative procedures, forms, and administrative declarations and detail all required information according to the specialized Task Force's forms of the Prime Minister and the Ministry's Task Force.
- Transfer all files related to administrative procedures under the unit's state management scope along with all forms, declaration templates, fees, and charges as required by the Ministry's Task Force.
- Bear responsibility for the accuracy, quality, and content of administrative procedures, forms, and administrative declarations compiled and reviewed by the unit according to the requirements of the Prime Minister's specialized Task Force and the Ministry's Task Force.
- Update the database of administrative procedures under the unit's state management scope and transfer it to the Ministry's Task Force.
- Review all administrative procedures under the unit's state management scope and propose recommendations based on the forms requested by the Prime Minister's specialized Task Force and the Ministry's Task Force.
- Maintain regular communication with the Ministry's Task Force.
- Respond promptly and meet the content and deadline requirements set by the Ministry's Task Force.
- Nominate the most knowledgeable officials about the unit's state management authority to participate in the Ministry's Task Force's planned work at the unit.
- Lead or coordinate to organize solicitation of customer opinions on the review and simplification of administrative procedures within the unit's state management scope.
- Participate in meetings with experts and stakeholders as required by the Ministry's Task Force.
- Amend, supplement, abolish, and simplify administrative procedures according to the requirements of the Prime Minister's specialized Task Force and the Ministry's Task Force (approved by the Ministry's leadership) in accordance with prescribed procedures.
Article 6. Conditions and Means of Operation
1. Budget:
- The Office of the Permanent Steering Committee for Administrative Reform shall be responsible for preparing the annual budget estimate for implementing the Project to be included in the annual state budget allocation for administrative reform of the Ministry.
- Projects with administrative reform content shall be responsible for supporting the activities of the Working Group at the request of the Director of the Ministry's Office - Head of the Working Group.
2. Equipment and Working Conditions:
The Ministry's Office shall be responsible for ensuring necessary conditions to serve the operations of the Ministry's Working Group.
Article 7. Implementation Provisions
The Head of the Ministry's Working Group shall be responsible for organizing the dissemination, guidance, monitoring, and inspection of the implementation of this Regulation; receiving and compiling suggestions for amendments and supplements, and proposing to the Minister to improve this Regulation.
Heads of units strictly implement this Regulation during the process of implementing the Project on Simplifying Administrative Procedures in their respective areas of state management.
This Regulation ceases to be effective when the Ministry's Working Group is dissolved./.
