CIRCULAR

Guidelines for Implementing Decision No. 237/1999/QĐ-TTg dated December 24, 1999 of the Prime Minister

on rice export management and fertilizer import in 2000

Pursuant to Decision No. 237/1999/QĐ-TTg dated December 24, 1999 of the Prime Minister on rice export management and fertilizer import in 2000;

After reaching consensus with the Ministry of Agriculture and Rural Development;

The Ministry of Trade hereby provides guidelines for implementing the aforementioned Decision as follows:

I. ON RICE EXPORTS

Rice exports shall be carried out in accordance with Decision No. 237/1999/QĐ-TTg dated December 24, 1999 of the Prime Minister. Certain points in the Decision are understood and implemented specifically as follows:

1. Key Enterprises for Rice Export:

As per Appendix No. 01 attached hereto.

2. Allocation of 1.2 million tons of rice export quota for Central State-owned Enterprises, enterprises with foreign investment capital operating in the production and processing of rice for export:

As per Appendix No. 02 attached hereto.

3. Exporting Rice to New Markets:

Enterprises outside key enterprises of all economic sectors, which have registered business codes for import and export, if they find new markets for consumption (outside countries such as the Philippines, Indonesia, Malaysia, and Iraq, Iran), sign contracts under favorable commercial terms and prices equal to or higher than the guidance prices during each period, shall submit written documentation (including the contract) to the Ministry of Trade for consideration to allow export.

4. Entrusted Rice Exports:

- Entrusted export and acceptance of entrusted export between key enterprises shall be conducted based on the provisions of Circular No. 18/1998/TT-BTM dated August 28, 1998 of the Ministry of Trade guiding the implementation of Decree No. 57/1998/NĐ-CP dated July 31, 1998 of the Government. The quota will be deducted from the entrusting enterprise's quota, but the export turnover will be counted for the accepting entrusted export enterprise.

- In cases where key enterprises are permitted to participate in entrusted export for contracts exporting rice to concentrated markets, the quota will be deducted from the entrusting enterprise's quota and the export turnover will be counted for the entrusting enterprise.

5. Export of Rice Produced in Northern and Central Provinces:

Encouragement is given to the export of rice produced in Northern and Central provinces. Enterprises of all economic sectors which have registered business codes for import and export, if they have customers and markets, sign export contracts for delivery at Northern and Central port areas, shall submit written documentation (including the contract) to the Ministry of Trade for consideration to allow export.

II. ON FERTILIZER IMPORTS

Fertilizer imports shall be carried out in accordance with Decision No. 237/1999/QĐ-TTg dated January 24, 1999 of the Prime Minister;

The Ministry of Trade announces the list of key enterprises for fertilizer import in 2000 as per Appendix No. 03 attached hereto.

Key enterprises are allowed to import fertilizers according to their production and business needs.

III. ON REPORTING REGIME

Enterprises engaged in rice export and fertilizer import shall implement the reporting regime as stipulated in Decision No. 0248/1999/QĐ-BTM dated March 11, 1999 on guiding the implementation of Decision No. 20/1999/QĐ-TTg dated February 13, 1999 of the Prime Minister. The Standing Management Team is responsible for compiling reports from enterprises to report to the Ministry of Trade as prescribed.

IV. IMPLEMENTATION PROVISIONS

The Ministry of Trade requests Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-administered cities, central agencies of mass organizations to notify the contents of this Circular to enterprises under their management to be aware and implement, and simultaneously reflect any issues arising during implementation to the Ministry of Trade for timely adjustment.

This Circular takes effect from January 1, 2000 to December 31, 2000.
