DECISION OF THE MINISTER OF TRANSPORT

Issuing "Provisions on the Conditions for Training Institutions for Seafarers and Inland Waterway Vessel Operators"

Regarding Seafarer Training Institutions

 

THE MINISTER OF TRANSPORTATION

 

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Considering the proposal of the Director of the Organization and Cadre Department and the Director of the Vietnam Inland Waterways Administration,

 

DECISION:

 

PART I

GENERAL PROVISIONS

Article 1. Scope of application

These provisions regulate the material, technical, and professional conditions of schools and centers for training, upgrading, and enhancing seafarers for inland waterway vessels.

Article 2. Applicability

These provisions apply to all schools and centers for training, upgrading, and enhancing seafarers and inland waterway vessel operators throughout the country (hereinafter referred to collectively as training institutions).

Chapter II

CONDITIONS FOR TRAINING INSTITUTIONS

Section 1

STANDARDS FOR CLASSROOMS, WORKSHOPS, AND PRACTICE AREAS

Article 3. General Standards for Classrooms

1. The minimum area must be 50 square meters.2The general standard must be at least 2 square meters per student.2/student.

2. Must meet natural light standards and have lighting equipment.

3. Must have well-ventilated space, far from noisy areas and polluted environments.

4. Must have sufficient technical equipment, teaching aids, and instructional materials according to the requirements of each subject.

Article 4. Special Standards for Professional Classrooms

1. Foreign Language Classroom: Must have a sound system, radio, CD player for pronunciation and listening exercises.

2. Computer Classroom: Must have at least five operational computers installed on dedicated desks.

3. Law on Inland Waterway Traffic Classroom:

a) Must have a raised relief map or typical channel diagram, models of inland waterway traffic signs for teaching various scenarios when operating vessels;

b) Must have drawings of inland waterway traffic signs, maps of river systems and inland waterway routes in Vietnam.

4. Machinery-Electrical-Mechanical Classroom:

a) Must have models of machine parts with detailed drawings and operation diagrams of machines, measuring devices for machine and mechanical parameters;

b) Must have ship electrical panels, electrical measuring devices.

5. Inland Waterway Vessel Control Classroom:

a) Must have a simulation or at least a model of the control system;

b) Must have sufficient basic control operation teaching aids according to the specifications set out in Appendix 1.

6. Basic Seafaring Classroom: Must have sufficient teaching and learning equipment according to the specifications set out in Appendix 2.

Article 5. Standards for Practice Workshops

1. Workshop for Basic Craftsmanship Training (for institutions offering basic vocational training):

a) Area of at least 60 square meters;2 /second or more;

b) Equipment must be scientifically arranged, ensuring safety and convenience for teaching and learning, meeting the minimum quantity and specifications set out in Appendix 3.

2. Machinery-Electrical-Mechanical Workshop:

a) Area of at least 60 square meters;2 Must be equipped with scientific and reasonable arrangements, ensuring safety and convenience for teaching and learning;

b) Must have various types of ship machinery corresponding to the licenses being trained or upgraded;

c) Must have diagrams and models of ship electrical systems and onboard power networks, necessary electrical equipment on board;

d) Must have sufficient machine tools and repair equipment for ship machinery according to the minimum quantity and specifications set out in Appendix 4.

Article 6. Standards for Practical Driving and Machinery Operation Areas

1. Must have designated waters approved by the competent authority for inland waterway traffic management for practical driving and machinery operation training, with appropriate navigation channel markers installed for students' practice.

2. Must have permanent or temporary bridges, floating markers to delineate the water area for vessels to enter and exit the port under various scenarios, with sufficient mooring posts and anti-collision cushions for professional operations.

3. Must have sufficient practice vessels according to license and specialty categories.

4. During practice, vessels must display a "Training Vessel" sign.

Section 2

PROVISIONS ON TEACHING MATERIALSY

Article 7. Teaching materials

1. There must be program objectives, textbooks issued by competent authorities, and a system of specialized reference materials.

2. Students must be provided with all necessary books and materials.

3. There must be sufficient lesson plans and lectures for each subject, reviewed by the Department Head and the Vocational Training Board.

4. There must be sufficient ledgers and forms to serve teaching management and student monitoring activities as prescribed and recorded fully.

Section 3

PROVISIONS ON TEACHERS

Article 8. Teacher workforce

1. Includes full-time teachers assigned at training institutions, part-time teachers, and contractual teachers.

2. The training institution must ensure there are enough teachers to teach subjects according to the prescribed curriculum, with schedules announced for each semester (for basic vocational training) or the entire course (for supplementary courses).

3. The number of contractual teachers shall not exceed 50% of the required number of teachers.

Article 9. General standards for teachers

1. Must meet the standard level as stipulated in Decree No. 02/2001/NĐ-CP dated January 9, 2001, of the Government detailing the implementation of the Labor Code and the Education Law on vocational training.

2. Must have good political qualities and ethics.

3. Must be in good health as per current regulations.

Article 10. Specific standards for teachers

1. Teachers of theoretical subjects:

a) Must hold a diploma from a vocational high school or higher in the assigned teaching specialty.

b) Foreign language: Level A English or higher.

c) Computer skills: Level A computer or higher.

d) Teachers of English must hold a diploma in foreign language education or a bachelor's degree in foreign languages.

2. Teachers of practical subjects:

a) Must hold a diploma one rank higher than the rank of the diploma that the training institution is authorized to train or supplement.

b) Teachers of practical subjects such as ship captains and chief engineers must hold certificates of ship captain and chief engineer of the first class and have served in the first-class position for at least 36 months.

Chapter III

IMPLEMENTING PROVISIONS

Article 11. Effectiveness

This Decision takes effect 15 days after its publication in the Official Gazette and replaces Decision No. 446/2002/QĐ-BGTVT dated February 19, 2002, of the Minister of Transport promulgating "Technical and Professional Standards for Training Institutions and Supplementary Courses for Issuing Certificates for Inland Waterway Vessel Crew Members."

Article 12. Responsibility for Implementation

1. The Director of the Vietnam Inland Waterway Administration is responsible for guiding, monitoring, and inspecting the implementation of this Decision.

2. The Heads of the Office, Inspectorate, Cadre Organization Department, Legal Affairs Department, Transportation Department, Vietnam Inland Waterway Administration, Directors of Departments of Transport, Departments of Transport and Public Works, Heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision./.
