CIRCULAR

Guidelines for competition and reward work,

 in the Labor - War Invalids and Social Affairs sector

Pursuant to the Competition and Reward Law on November 26, 2003 and the Law amending and supplementing certain articles of the Competition and Reward Law on June 14, 2005;

Pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain articles of the Competition and Reward Law and the Law amending and supplementing certain articles of the Competition and Reward Law;

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;

The Minister of Labor - War Invalids and Social Affairs hereby issues guidelines for competition and reward work in the Labor - War Invalids and Social Affairs sector as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides on the subjects of competition and reward; organization of competition and standards for commendation titles; forms, standards for rewards; authority to decide, lines of recommendation for rewards, files, procedures for examination and granting of rewards, and award ceremonies; competition and reward councils at all levels; competition and reward funds, management, archiving, and reporting on competition and reward work in the Labor - War Invalids and Social Affairs sector.

Article 2. Subjects of competition and reward

1. Subjects of competition:

a) Individuals who are officials, civil servants, public officials, and workers currently working at units within the Labor - War Invalids and Social Affairs sector (including civil servants and public officials during their probationary period, employees with indefinite-term labor contracts, and employees with labor contracts of one year or more);

b) Units under and directly subordinate to the Ministry of Labor - War Invalids and Social Affairs;

c) Departments of Labor - War Invalids and Social Affairs of provinces and centrally governed cities, units under and directly subordinate to Departments, and Labor - War Invalids and Social Affairs offices of districts and counties;

d) Small collectives under units under and directly subordinate to the Ministry of Labor - War Invalids and Social Affairs, Departments of Labor - War Invalids and Social Affairs of provinces and centrally governed cities, and units under and directly subordinate to Departments;

đ) Collectives and individuals outside the Labor - War Invalids and Social Affairs sector engaged in Labor - War Invalids and Social Affairs work.

2. Recipients of rewards

The subjects specified in Clause 1, Article 2 and collectives and individuals of Vietnamese citizens abroad and foreigners are eligible for consideration for rewards if they have made contributions to the Labor - War Invalids and Social Affairs sector that meet the criteria set forth in this Circular.

Article 3. Purpose of competition and reward work

Competition and reward aim to encourage and honor collectives and individuals who strive for creative labor, fulfill their tasks well, achieve outstanding results, and contribute to achieving the development goals of the Labor - War Invalids and Social Affairs sector and the national economic and social development goals.

Article 4. Principles of competition and reward

Competition and reward work must ensure general principles such as having specific objectives and purposes, appropriate forms, avoiding any manifestations of ostentation and formalism in competition and reward work. Specifically:

1. Principles of Competition

a) Voluntary, conscientious, public;

b) Unity, cooperation, and joint development.

2. Principles of Reward

a) Ensuring accuracy, timeliness, fairness, democracy, and transparency based on a correct assessment of the work results of collectives and individuals;

b) Achievements at what level should be rewarded at that level, not necessarily following the sequence of being rewarded at a lower level before receiving a higher reward; achievements obtained under difficult conditions and with a wider scope of influence should be considered for a higher reward level;

c) Emphasizing rewards for collectives and individuals directly performing tasks, combining spiritual encouragement closely with material incentives;

d) A reward form can be given multiple times to a subject but not twice in a year for the same content and degree of achievement;

đ) Results of rewards for outstanding achievements and achievements in specific fields of work are considered as factors increasing when examining rewards for comprehensive annual achievements as well as achievements in each phase.

Article 5. Benefits for individuals and groups receiving awards

1. Individuals receiving commendation titles and award forms shall be granted certificates, medals, commendation letters, and a monetary reward or tangible items as stipulated in Articles 71, 72, 73, 74, 75, 76, and Article 77 and Section 2 Chapter V of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Encouragement and Awards and the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Awards; they shall be considered for salary advancement ahead of schedule according to regulations; they shall be given priority for research, study, training, and professional upgrading both domestically and internationally; commendation titles and award forms are among the criteria for evaluation when planning or considering the appointment of cadres.

2. Groups receiving commendation titles and award forms with accompanying commendation medals, certificates, and a monetary reward or tangible items as stipulated shall have the right to retain, display, and use symbols of the award forms on official documents and materials of their units.

Article 6. Obligations of individuals and groups receiving awards

1. Individuals and groups recognized with commendation titles and award forms have the obligation to properly manage and use awarded tangible items according to their intended purpose and regulations.

2. Continue to maintain and promote achievements worthy of the received commendation titles and award forms.

Chapter II

ORGANIZING COMPETITIONS, COMMENDATION TITLES, AND STANDARDS FOR COMMENDATION TITLES

Article 7. Organizing competition movements

1. Forms of organizing competitions

a) Competitions are carried out regularly to achieve goals, targets, and work programs set forth, applied between individuals within a group, groups within a unit, or between units with similar functions, tasks, and nature of work;

b) Competition campaigns are organized to implement key tasks, difficult tasks of the unit at each stage or to celebrate major national, sectoral, or unit anniversaries. Competition campaigns must clearly define objectives, contents, start, and end dates.

2. Initiating and directing competition movements

a) The Minister initiates and directs competition movements throughout the Sector and in areas managed by the Sector. The Ministry's Encouragement and Awards Council is responsible for advising the Minister on competition content and organizing competition movements;

b) Heads of agencies and units organize and direct competition movements within the agencies and units they manage;

c) Organizations and mass organizations at units need to closely coordinate with heads of units at the same level to initiate and mobilize members of their organizations to respond to competition movements, organize competition movements, and ensure that competition movements achieve high effectiveness;

d) News agencies, publishing houses, and communication media of the Sector have the responsibility to continuously publicize about encouragement and awards work: disseminate and set examples of typical models, good people, and good deeds, encourage competition movements; identify outstanding individuals and groups in competition movements, and combat and criticize violations of laws on encouragement and awards.

3. Content of organizing competition movements

a) Clearly define objectives, scope, and target groups of competition, based on which specific and practical competition indicators and contents are established for each locality and unit;

b) Have creative forms of initiating competition that emphasize the promotion of the significance of the competition period, the spirit of responsibility, and self-awareness of each cadre, civil servant, officer, and worker, diversifying competition initiation methods;

c) Develop plans and measures for initiating competition, monitor the competition organization process, guide pilot projects to draw lessons and disseminate experiences through each competition period;

d) Summarize and conclude competition movements, evaluate results

For short-term or periodic (less than one year) and long-term (one year or more) competition periods, units must organize summaries, conclusions, evaluations of results, draw lessons, and publicly assess to promptly select outstanding and excellent groups and individuals in the competition and award movement.

Article 8. Awards

1. Commendation titles for individuals

a) Advanced Worker;

b) Model Soldier at the Grassroots Level;

c) Model Soldier at the Ministry Level;

d) National Model Soldier.

2. Commendation titles for groups

a) Advanced Worker Group;

b) Excellent Worker Group;

c) Ministry Flag;

d) State Flag.

3. The granting of commendation titles to individuals and groups shall only be conducted once a year at the annual summary time.

Article 9. Criteria for awarding commendation titles to individuals

1. Criteria for the title of Advanced Worker

1.1. General criteria

For individuals specified in point a, Clause 1, Article 2 of this Circular and meeting the following criteria:

a) Successfully completing assigned tasks with high productivity and quality (reaching 100% or more of the plan);

b) Strictly adhering to the Party's guidelines and policies, state laws, internal regulations, and actively participating in various competitive movements;

c) Actively studying to enhance professional and vocational skills;

d) Possessing good moral character and a spirit of unity in building the unit;

đ) Having at least 10 months of work time according to the working system:

- Attending short-term training courses under one year, if achieving satisfactory academic results and strictly complying with the rules of the training institution, the study period can be combined with the working period at the sending organization to assess the title of Advanced Worker.
