CIRCULAR

Regulations on the Procedure for Announcing National Remote Sensing Metadata

Pursuant to the Government Decree No. 249/2013/NĐ-CP dated October 24, 2013 of the Ministry of Natural Resources and EnvironmentNo. 21/2013/NĐ-CP on November 4, 2013June 2024;The Minister of Natural Resources and Environment promulgates this Circular on technical regulations for assessing solid mineral resource potential on land in basic geological surveys for minerals."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation.""4. The Minister of Natural Resources and Environment issues this Circular to stipulate the procedure for announcing national remote sensing metadata;announcing national remote sensing metadata.This Circular stipulates the procedure for announcing national remote sensing metadata; responsibilities and authorities of agencies, organizations, and individuals in announcing national remote sensing metadata.aThis Circular applies to agencies under the Ministry of Natural Resources and Environment and organizations and individuals related to the announcement of national remote sensing metadata.inThis Circular does not apply to organizations and individuals engaged in activities specified in Clause 2, Article 3 of the Chemical Law dated November 21, 2007.

Article 3. Requirements for National Remote Sensing Metadatato1. National remote sensing metadata must ensure completeness, accuracy, timeliness, and convenience for exploiting and using remote sensing data.Pursuant to Decree No. 24/2018/NĐ-CP dated February 27, 2018 of the Government on handling complaints and reports in the fields of labor, vocational education, dispatching Vietnamese workers abroad under contracts, employment, occupational safety and health;2. Information on national remote sensing metadata must be constructed conveniently for access and use.Article 3. Principles for allocating central budget capital3. SHP (Shape file) is a data storage format for the geospatial database at the national level.

PART I
GENERAL PROVISIONS 

Article 1. Scope of Regulation

3. The language for announcing national remote sensing metadata is Vietnamese.

Article 2. Applicability

Article 4. Forms and Means of Announcing National Remote Sensing Metadata

1. National remote sensing metadata is announced annually in the form of a document and regularly in the form of electronic data.

2. National remote sensing metadata is announced on the electronic portal of the National Remote Sensing Center, Ministry of Natural Resources and Environment.

PROCEDURE FOR ANNOUNCING NATIONAL REMOTE SENSING METADATA

Article 5. Submission of National Remote Sensing Metadata

1. The Ministry of Natural Resources and Environment receives national remote sensing metadata collected from the following sources:

a) Remote sensing image stations managed by the Ministry of Natural Resources and Environment;

b) Storage at agencies, organizations, and individuals under the Ministry.

Chapter II
2. Remote sensing image stations managed by the Ministry of Natural Resources and Environment have the responsibility to submit national remote sensing metadata they have received monthly to the Ministry of Natural Resources and Environment through the National Remote Sensing Center. 

3. Agencies, organizations, and individuals under the Ministry have the responsibility to submit national remote sensing metadata purchased or received from abroad with state budget funds or through exchanges, cooperation, and foreign aid stored by their units to the Ministry of Natural Resources and Environment through the National Remote Sensing Center within three months from the date of receiving remote sensing data.

4. Agencies, organizations, and individuals specified in Clause 1 and Clause 2 of this Article are responsible for editing the content and form of national remote sensing metadata before submission according to Model I attached to this Circular and shall bear responsibility for the accuracy and completeness of the content of the submitted national remote sensing metadata.

5. The content of submitted national remote sensing metadata includes the following information:

a) Information on agencies, organizations, and individuals submitting national remote sensing metadata;

b) Summary information on submitted national remote sensing metadata (total quantity, total quantity with cloud cover below 10%, mosaic diagram, areas with remote sensing data);

c) Detailed information on submitted national remote sensing metadata (descriptive information about content, origin, quality, processing methods) and relevant information for producing remote sensing data.

6. Submitted national remote sensing metadata is in both text and digital formats.

7. The National Remote Sensing Center assists the Ministry of Natural Resources and Environment in compiling national remote sensing metadata submitted by agencies, organizations, and individuals.

a) Information on the agencies, organizations, and individuals submitting national remote sensing metadata;

b) Summary information on the submitted national remote sensing metadata (total quantity, total quantity with cloud cover under 10%, mosaic map diagram, areas with remote sensing data);

c) Detailed information on the submitted national remote sensing metadata (descriptive information about content, origin, quality, processing methods) and related information for producing remote sensing data.

6. National remote sensing metadata submitted in both textual and numerical formats.

7. The National Remote Sensing Agency assists the Ministry of Natural Resources and Environment in compiling national remote sensing metadata submitted by agencies, organizations, and individuals.

Article 6. Editing and processing national remote sensing metadata

The National Remote Sensing Agency assists the Ministry of Natural Resources and Environment in editing and processing national remote sensing metadata as follows:

1. Checking the accuracy and completeness of the content of remote sensing metadata information.

2. Updating, processing, and editing national remote sensing metadata information.

Article 7. Regular publication of national remote sensing metadata

1. The National Remote Sensing Agency regularly publishes national remote sensing metadata on its electronic portal. In case there is a change in the electronic portal address, it is necessary to notify the new address to agencies, organizations, and individuals concerned for their implementation.

2. The content of regular publication of national remote sensing metadata follows the model prescribed in Appendix I attached to this Circular, including the following information:

a) Information on the agencies, organizations, and individuals submitting national remote sensing metadata;

b) Total number of image scenes and map images of remote sensing submitted;

c) Total number of image scenes and map images of remote sensing with cloud cover under 10% submitted;

d) Area with remote sensing images;

đ) Layout diagram and groups of information about national remote sensing metadata.

3. Within thirty working days from the date of submission by agencies, organizations, and individuals, the National Remote Sensing Agency has the responsibility to publish national remote sensing metadata.

4. The National Remote Sensing Agency has the responsibility to correct and amend when there are errors in the published national remote sensing metadata.

Article 8. Annual periodic publication of national remote sensing metadata

1. The National Remote Sensing Agency assists the Minister of Natural Resources and Environment in updating, compiling, and preparing a report on national remote sensing metadata in writing before December each year.

2. The content of the annual periodic report on national remote sensing metadata follows the model prescribed in Appendix II attached to this Circular, including the following contents:

a) Situation of national remote sensing data from the time of publication last year to the time of publication this year;

b) Guidance on searching for national remote sensing metadata;

c) Technical characteristics of national remote sensing data;

d) Situation of exploitation and use of national remote sensing metadata.

3. The report on national remote sensing metadata must be approved by the authorized person before the publication process is carried out.

4. The Ministry of Natural Resources and Environment organizes the annual periodic publication of the report on national remote sensing metadata in December each year.

Article 9. Temporary suspension of publication of national remote sensing metadata

1. In cases where the publication of national remote sensing metadata cannot be carried out within the deadline due to force majeure reasons (natural disasters, fire, war), the publication of national remote sensing metadata must be implemented immediately after the force majeure event has been resolved.

2. The temporary suspension of the publication of national remote sensing metadata must be announced on the electronic portal of the National Remote Sensing Agency, clearly stating the reason for the suspension.

Chapter III
IMPLEMENTING PROVISIONS 

Article 10. Effective Date

This Circular takes effect from January 16, 2017.

Article 11. Implementation Organization

1. Agencies, organizations, and individuals related to the publication of national remote sensing metadata are responsible for implementing this Circular.

2. The National Remote Sensing Agency has the responsibility to assist the Ministry of Natural Resources and Environment in inspecting the implementation of this Circular.

3. During the implementation process, if there are difficulties, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for research and amendment./.
