Decision No. 35/2017/QĐ-TTg amends and supplements certain provisions of Decision No. 75/2013/QĐ-TTg on the system of allowances, policies, and support for organizations and individuals performing the mission of searching for and collecting the remains of revolutionary martyrs. AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF DECISION NO. 75/2013/QĐ-TTg OF THE GOVERNMENT PRIME MINISTER ON REGULATIONS, POLICIES, AND SUPPORT WORK FOR ORGANIZATIONS AND INDIVIDUALS PERFORMING MISSIONS OF SEARCHING FOR AND COLLECTING REMAINS OF REVOLUTIONARY SOLDIERS
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to Decree No. 31/2013/ND-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Contributing to the Revolution;i Pursuant to Decree No. 204/2004shall /NQ-CP dated July 11, 2017 of the Government on the regular meeting in June 2017;
The Prime Minister issues this Decision amending and supplementing certain articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on regulations, policies, and support work for organizations and individuals performing missions of searching for and collecting remains of revolutionary soldiers./NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, officials, and armed forces personnel;
Pursuant to ResolutionArticle 1. Amending and supplementing certain articles of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of the Prime Minister on regulations, policies, and support work for organizations and individuals performing missions of searching for and collecting remains of revolutionary soldiers, as follows:1. Point đ Clause 1 Article 3 is amended as follows:
"Based on the proposal of the Minister of National Defense;"
"đ) Health allowance: Amount of 500,000 VND/person (not exceeding two times/year)."
2. Points b, c, and đ Clause 2 Article 3 are amended as follows:
"b) Direct mission allowance for surveying, exhuming, and collecting remains of revolutionary soldiers: Amount of 220,000 VND/person/day actually performed. During the time performing the mission, if receiving direct mission allowance, then stop receiving travel expenses;
c) Health allowance: Amount of 500,000 VND/person (not exceeding two times/year);
đ) Provided with specialized uniforms in kind according to Appendix I attached hereto."
3. Clause 1 Article 4 is amended as follows:
"1. Living expense allowance: Amount of 220,000 VND/person/day actually spent when directly inspecting and directing the search and collection of remains of revolutionary soldiers within and outside the country. In case of receiving living expense allowance, then stop receiving accommodation allowance according to regulations for officials and civil servants traveling domestically."
4. Point a Clause 1 Article 5 is amended as follows:
"a) Amount of 220,000 VND/person/day actually mobilized to perform the mission of searching for and collecting remains of revolutionary soldiers within and outside the country."
5. Point a Clause 2 Article 5 is amended and supplemented as follows:
"a) Receiving an allowance of 3,000,000 VND for accurate information leading to the discovery and collection of one set of remains of a revolutionary soldier; 5,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing from two to five sets of remains of revolutionary soldiers; 10,000,000 VND for accurate information leading to the discovery and collection of a collective grave containing six or more sets of remains of revolutionary soldiers."
"1. Search and collection teams performing missions of searching for and collecting remains of revolutionary soldiers within and outside the country shall be provided with:
a) Specialized equipment, means of transport, logistics, and living conditions according to Appendix II attached hereto;
b) Fuel cost;
6. Clause 1 of Article 6 shall be amended and supplemented as follows:
c) Construction cost for temporary houses at 150,000,000 VND/house/team;
d) Exhumation cost for graves containing remains at 1,000,000 VND/grave;
đ) Cost for repair and replacement of automobile parts at 40,000,000 VND/car/year;
e) Support cost for special task teams and provincial task forces of the host country for farewell ceremonies for remains of revolutionary soldiers at 30,000,000 VND/time, not exceeding two times/year;
g) Support cost for mobilizing the local population of the host country at 30,000,000 VND/team/year for one province of the host country;
h) Cost for purchasing common medicines at 20,000,000 VND/team/year (excluding medicines supplied by the Ministry of Defense under regulations);
i) Cost for purchasing gifts for foreign relations when visiting the host country to implement tasks at 30,000,000 VND/time, not exceeding two times/team/year for one province of the host country;
k) Cost for hospital fees, patient transportation; purchasing water filtration equipment; passport fees, other fees and charges; renting vehicles, compensation for damage to infrastructure, crops, and vegetables (if any) during the performance of tasks;
l) Cost for purchasing excavation tools (shovels, spades, crowbars, knives, machetes, and other items) at 10,000,000 VND/team/year."
7. Point a Clause 2 Article 7 is amended as follows:
"a) Equipment and means of operation according to Appendix III attached hereto."
1. This Decision takes effect from September 10, 2017.
2. Specialized uniforms in kind for military personnel, civilian employees of the defense sector assigned to search and collection teams; specialized equipment, means of transport, logistics, and living conditions provided for search and collection teams; equipment and means of transport provided for the Steering Committee, Special Task Teams, Provincial Committees, Office, and specialized agencies at all levels specified in Appendices I, II, and III issued together with Decision No. 75/2013/QĐ-TTg that are still within their service life shall continue to be applied and implemented according to Appendices I, II, and III issued together with this Decision.
The Minister of National Defense shall adjust, manage, and use strictly, purposefully, and effectively the UOAT and Xitec fuel transport vehicles already allocated according to Appendix II issued together with Decision No. 75/2013/QĐ-TTg, which are no longer equipped for search and collection teams according to Appendix II issued together with this Decision.

3. Abolish Circular Joint No. 66/2014/TTLT-BQP-BTC dated June 13, 2014 of the Ministry of National Defense and the Ministry of Finance guiding the implementation of Decision No. 75/2013/QĐ-TTg dated December 6, 2013 of
the Prime Minister on regulations, policies, and support work for organizations and individuals performing missions of searching for and collecting remains of revolutionary soldiers.
1. The Minister of National Defense is responsible for guiding the implementation of Decision No. 75/2013/QĐ-TTg.
3. Repeal Circular Joint Circular No. 66/2014/TTLT-BQP-BTC dated June 13, 2014, issued by the Ministry of National Defense and the Ministry of Finance guiding the implementation of Decision No. 75/2013/QĐ-TTg dated December 6, 2013, of the Prime Minister regarding the regime, policies, and support work for organizations and individuals performing tasks related to searching for and collecting烈士遗骸。 1. The Minister of National Defense is responsible for guiding the implementation of Decision No. 75/2013/QĐ-TTg.
Article 3. Responsibility for Implementation
1. The Minister of National Defense is responsible for guiding the implementation of Decision No. 75/2013/QD-TTg.
2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
