Pursuant to the Health Insurance Law on November 14, 2008 which has been amended and supplemented with some articles according to the Health Insurance Law on June 13, 2014;Pursuant to Decree No. 146/2018/NĐ-CP dated October 17, 2018 of the Government detailing and guiding measures to implement certain provisions of the Health Insurance Law;
The Minister of Health issues this Circular amending and supplementing Clause 1 of Article 9 of Circular No. 30/2020/TT-BYT dated December 31, 2020 issued by the Minister of Health detailing and guiding measures to implement certain provisions of Decree No. 146/2018/NĐ-CP dated October 17, 2018 of the Government detailing and guiding measures to implement certain provisions of the Health Insurance Law.
Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the request of the Director of the Health Insurance Department,
Amending and supplementing Clause 1 of Article 9 of Circular No. 30/2020/TT-BYT dated December 31, 2020 issued by the Minister of Health detailing and guiding measures to implement certain provisions of Decree No. 146/2018/NĐ-CP dated October 17, 2018 of the Government detailing and guiding measures to implement certain provisions of the Health Insurance Law as follows:
a) Clinical support services belonging to the list of medical technical services approved by competent state authorities for medical examination and treatment facilities and currently being implemented at such facilities but at the time of the prescription for use by patients, the facility cannot perform them;
b) Clinical support services not belonging to the list of medical technical services approved by competent state authorities for medical examination and treatment facilities but actually necessary for professional activities as prescribed by the Minister of Health regarding management, diagnosis, and treatment in medical examination and treatment, except for cases stipulated in point c of this clause, shall be covered by the health insurance fund for inpatient treatment from district level hospitals upwards;
c) Clinical support services not belonging to the list of medical technical services approved by competent state authorities for medical examination and treatment facilities but actually necessary for professional activities as prescribed by the Minister of Health regarding management, diagnosis, and treatment in medical examination and treatment for certain infectious diseases, including: Tuberculosis, Hepatitis B, Hepatitis C, HIV/AIDS, SARS-CoV-2, Dengue Fever, shall be covered by the health insurance fund for outpatient and inpatient treatment from district level hospitals upwards for laboratory testing services listed in the Appendix attached hereto."
The head of health insurance medical examination and treatment facilities shall base on their functions, tasks, scope of professional activities approved by competent authorities and the provisions of points a, b, and c of this clause to compile a list of clinical support services to be transferred and send it to the social insurance agency where the health insurance medical examination and treatment contract is signed for knowledge and supplementary signing of the medical examination and treatment contract before implementation.
This Circular takes effect from February 15, 2022.
The Director of the Health Insurance Department, the Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Directors of Bureaus, the General Director of the General Bureau under the Ministry of Health, and related agencies, organizations, and individuals are responsible for implementing this Circular.

During the implementation process, if there are difficulties or obstacles, please promptly reflect them to the Ministry of Health (Health Insurance Department) for consideration and resolution./.
Article 3. Responsibility for Implementation
The Director of the Health Insurance Department, the Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of all Departments, the Directors of all Bureaus, the General Director of the General Administration under the Ministry of Health, and related organizations, entities, and individuals shall be responsible for implementing this Circular.
During the implementation process, if there are difficulties or obstacles, it is recommended that organizations, entities, and individuals promptly report to the Ministry of Health (Health Insurance Department) for consideration and resolution./.
