At the request of the Director of the Transport Department and the Director General of the Vietnam Highway Administration,
The Minister of Transport shall issue a Circular to provide provisions on training, examination, issuance of driver's licenses; issuance and use of international driver's licenses; training, examination, and issuance of certificates for legal knowledge enhancement on road traffic.
Part I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the model of driver's license, training, examination, issuance, replacement, reissuance, revocation of driver's licenses, use of driver's licenses, and standards for driving practice grounds for motorcycle driving examinations; the model of international driver's license, issuance and use of international driver's licenses; training, examination, issuance, and reissuance standards for certificates for legal knowledge enhancement on road traffic, and standards for training institutions for specialized vehicle drivers implementing legal knowledge enhancement programs and issuing certificates.
Article 2. Applicability
1. This Circular applies to organizations and individuals related to training, examination, issuance, replacement, reissuance, revocation of driver's licenses, use of driver's licenses, and standards for driving practice grounds for motorcycle driving examinations; issuance and use of international driver's licenses; training, examination, issuance, and reissuance of certificates for legal knowledge enhancement on road traffic, and standards for training institutions for specialized vehicle drivers implementing legal knowledge enhancement programs and issuing certificates.
2. This Circular does not apply to the use of driver's licenses, training institutions, organizations conducting driver training and examination; issuance, replacement, reissuance, and revocation of driver's licenses; issuance and reissuance of certificates for legal knowledge enhancement on road traffic for military and police forces performing national defense and security duties.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Safe driving time is the period during which the holder of a valid driver's license does not cause serious or particularly serious consequences from road traffic accidents.
2. Driver's license blank number is the code number recorded on the back of the driver's license by the manufacturer of the blank, consisting of two letters followed by subsequent numbers.
3. DAT Data is a collection of information about identification and practical driving training process on the road of trainees, transmitted from the DAT device installed on the training car to the training institution's server.
4. DAT Management Data is a collection of information about identification and practical driving training process on roads of trainees, transmitted from the server of the driver training institution to the server of the Vietnam Highway Administration.
5. Study Time Night driving time is calculated from 18:00 of the previous day to 05:00 of the following morning.
6. International Driver's License has the English name International Driving Permit, hereinafter referred to as IDP.
7. National Driver's License is a driver's license issued by authorized agencies of countries, valid within their respective territories.
8. Electronic file of international driver's license is a collection of electronic documents related to the issuance of IDP.
9. Information system on training, examination, issuance of driver's licenses, and certificates for legal knowledge enhancement on road traffic is a collection of hardware, network, and software serving the management of information on training, examination, issuance of driver's licenses, and certificates for legal knowledge enhancement on road traffic, including: Training information system, examination information system, driver's license information system, and certificate issuance information system for legal knowledge enhancement on road traffic.
10. Training information system includes the training information system at the training institution and the training information system at the Department of Transport.
11. Examination information system includes the examination information system at the examination center and the examination information system at the Department of Transport.
12. Driver's license information system includes the driver's license information system at the Vietnam Highway Administration and the driver's license information system at the Department of Transport.
13. Certificate issuance information system for legal knowledge enhancement on road traffic includes the certificate issuance information system for legal knowledge enhancement on road traffic at the Vietnam Highway Administration, the certificate issuance information system for legal knowledge enhancement on road traffic at the Department of Transport, and the certificate issuance information system for legal knowledge enhancement on road traffic at the training institution.
14. Information system on motor vehicle drivers and specialized vehicle drivers includes hardware, network, and software serving the management of information on driver's licenses and certificates for legal knowledge enhancement on road traffic.
Article 4. Reporting System
1. The Department of Transport shall submit reports on training, examination, and issuance of driver's licenses to the Vietnam Highway Corporation, including:
a) Report title: report on training, examination, and issuance of driver's licenses;
b) Content required for reporting:
Regarding training activities, it includes the number of driving schools under management, training licenses, practice vehicle permits, certificates for practical driving instructors; evaluation of the management of driving training.
Regarding examination and issuance of driver's licenses, it includes the number of examination centers under management, examination permits, approvals for practice fields for motorcycle driving examinations, issued driver's licenses for various categories; evaluation of the management of driving examinations;
c) Method of sending the report: direct delivery or through postal services or electronic environment;
d) Deadline for submitting the report: before June 20 each year for the mid-year report; before December 20 each year for the annual report;
d) Frequency of reporting: periodic reports every six months and annual reports;
e) Deadline for data consolidation: for the mid-year periodic report, from December 15 of the previous year to June 14 of the reporting period. For the annual summary report, from December 15 of the previous year to December 14 of the reporting year;
g) Reporting form: according to Form No. 01 in Appendix I issued together with this Circular.
2. Legal knowledge training institutions shall submit reports on training and issuing certificates for legal knowledge training on road traffic to the Department of Transport, including:
a) Report title: report on training and issuing certificates for legal knowledge training on road traffic;
b) Content required in the report: report on the number of training classes, the number of trainees trained, the number of certificate examinations conducted, the number of certificates issued;
c) Method of sending the report: direct delivery or through postal services or electronic environment;
d) Deadline for submitting the report: before June 20 each year for the mid-year report; before December 20 each year for the annual summary report;
d) Frequency of reporting: periodic reports every six months and annual reports;
e) Deadline for data consolidation: for the mid-year periodic report, from December 15 of the previous year to June 14 of the reporting period. For the annual summary report, from December 15 of the previous year to December 14 of the reporting year;
g) Reporting form: according to Form No. 02 in Appendix I issued together with this Circular.
3. The Department of Transport shall submit reports on training and issuing certificates for legal knowledge training on road traffic to the Vietnam Highway Corporation, including:
a) Report title: report on training and issuing certificates for legal knowledge training on road traffic;
b) Content required in the report: the number of training institutions, training management activities, the number of trainees trained, the number of certificates issued;
c) Method of sending the report: direct delivery or through postal services or electronic environment;
d) Deadline for submission of reports: before June 25 each year for the mid-year periodic report; before December 25 each year for the annual summary report;
đ) Frequency of reporting: semi-annual report for the first six months of the year and annual report;
e) Deadline for data consolidation: for the mid-year periodic report, from December 15 of the previous year to June 14 of the reporting period. For the annual summary report, from December 15 of the previous year to December 14 of the reporting year;
g) Reporting form: according to Form No. 03 in Appendix I issued together with this Circular.
Part II
TRAINING, EXAMINATION, AND ISSUANCE OF MOTOR VEHICLE DRIVER'S LICENSES FOR ROAD TRAFFIC
PART I
Training institutions referred to in this Regulation are schools and centers established by authorized agencies with the function of training drivers, possessing the necessary conditions regarding textbooks, teaching staff, and facilities as prescribed by the Ministry of Transport, and having been granted a Professional Practice Permit for Driver Training by the Minister of Transport.
Article 5. Training Forms
1. Individuals seeking a motorcycle driver's license for categories A1, A, and B1:
a) For theoretical study, they must complete the training program as prescribed in this Circular and may choose one of the following learning methods: self-study of theoretical subjects in accordance with laws on training and examination of drivers or concentrated study at a driving school;
b) For practical driving lessons: concentrated study at a driving school.
2. Individuals seeking a driver's license for categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, and DE are trained:
a) For theoretical study, they must complete the training program as prescribed in this Circular and may choose one of the following learning methods: concentrated study at a driving school or distance learning, guided self-study in accordance with laws on training and examination of drivers;
b) For practical driving training content: through concentrated training at a driving school.
Article 6. Training for motorcycle drivers of categories A1, A, B1

2. Organization of Training Courses
a) The training institution bases its curriculum on the contents including: the volume of the program and the time allocation for training as stipulated in Clause 1 of this Article and Appendix II issued together with this Circular; the review period, final examination time to establish the total duration of the training course within the driver training program not exceeding ten days (excluding public holidays and Tet holidays);
b) The number of trainees allowed to practice driving on one training vehicle for category B1 shall not exceed five trainees; the distance practiced by each trainee and the time spent practicing on the training ground by the group of trainees on the training vehicle shall be calculated separately.
3. Report on registration for examination
The training institution accepts the application files of trainees who meet the conditions and file components as prescribed in Articles 14 and 15 of this Circular; prepares a report on registration for examination (report 1) and sends it to the Department of Transport via one of the following methods: direct submission, postal service, or electronic environment while simultaneously transmitting data through the driver's license information system:
a) For motorcycle driver training of categories A1, A: the training institution prepares a report on registration for examination according to the model prescribed in Appendix III issued together with this Circular and sends it to the Department of Transport; the report must bear the seal of the training institution;
b) Report 1 for categories A1, A must be submitted at least four working days before the examination date; for category B1, it must be submitted immediately after the commencement of the course; the head of the unit assigned by the Department of Transport to manage examinations and issue driver’s licenses must check and sign each page (including all pages of report 1);
c) For category B1 driver training: the training institution prepares a report on registration for examination, a list of trainees (report 1), and a training plan according to Model 01, Model 02, and Model 04 in Appendix IV issued together with this Circular and sends them to the Department of Transport; the report must bear the seal of the training institution;
d) For category A1 driver training for ethnic minority people who cannot read or write Vietnamese, the report on registration for examination must be sent to the Department of Transport at least thirty days before the examination date.
4. Examination upon completion of the training course
a) Category B1 must undergo theoretical and practical examinations at the training institution to be considered as having completed the training course, including: theoretical subjects based on the examination question bank (the content of the question bank includes subjects such as road traffic laws; vehicle structure and routine maintenance; driving techniques); practical driving subjects with the reverse parking test;
b) The evaluation score for trainees' learning results is on a scale of 10 points (from 1 to 10), with one decimal place considered. Each subject examination score must reach 5.0 points or higher;
c) To be considered as having completed the training course: the trainee must achieve a passing score of 5.0 points or higher in all subject examinations at the end of each course in the training program.
Article 7. Training for drivers of categories B, C1

2. Organization of Training Courses

b) The number of trainees allowed to practice driving on one training vehicle: for category B, it shall not exceed five trainees; for category C1, it shall not exceed eight trainees; the distance practiced by each trainee and the time spent practicing on the training ground by the group of trainees on the training vehicle shall be calculated separately.
3. Report on registration for examination
The training institution accepts the application files of trainees who meet the conditions and file components as prescribed in Articles 14 and 15 of this Circular; prepares a report on registration for examination (report 1) and sends it to the Department of Transport via one of the following methods: direct submission, postal service, or electronic environment while simultaneously transmitting data through the driver's license information system:
a) For categories B, C1 driver training: the training institution prepares a report on registration for examination, a list of trainees (report 1), and a training plan according to Model 01, Model 02, and Model 04 in Appendix IV issued together with this Circular and sends them to the Department of Transport; the report must bear the seal of the training institution;
b) Report 1 for categories B, C1 must be submitted within seven working days after the commencement of the course; the head of the unit assigned by the Department of Transport to manage examinations and issue driver’s licenses must check and sign each page (including all pages of report 1).
4. Completion Course Examination
Examinations of theoretical subjects and practical driving at the training institution, to be considered as having completed the training course, include:
a) Final examination of theoretical subjects according to the theoretical examination question bank, which includes subjects such as road traffic laws; vehicle structure and routine maintenance; traffic ethics and culture, prevention of alcohol harm when participating in traffic, fire prevention and rescue skills; driving techniques; simulation of traffic situations;
b) Final examination of practical driving subjects with sequential tests, reverse parking tests, and driving on roads;
c) The content and form of the final examination of theoretical subjects are decided by the head of the training institution; trainees must attend at least seventy percent of the theoretical subject classes; complete the required practical driving hours on the training ground and at least fifty percent of the driving hours on the road;
d) The evaluation score for trainees' learning results in theoretical subjects is on a scale of 10 points (from 1 to 10), with one decimal place considered; for practical driving subjects with sequential tests, the evaluation is based on Appendix XV issued together with this Circular;
e) To be considered as having completed the training course: the trainee must achieve a passing score of 5.0 points or higher in all subject examinations at the end of each course in the training program.
5. If the trainee does not meet the conditions to be considered as having completed the training course within one year from the date the training institution first organizes the examination, the trainee must be retrained in a new training course.

2. Organization of Training Courses
a) The training institution bases on the contents, including: the volume of the program and the allocation of training time prescribed in Clause 1 of this Article, Appendix II issued together with this Circular, review time, final examination time, and holiday time to build the total duration of the training course in the driver training program for upgrading not exceeding 60 days;
b) The number of trainees allowed on one training vehicle for upgrading: from B to BE not more than 5 trainees; from B to C1, from B to C, from C1 to C, from C1 to C1E, from C to CE not more than 8 trainees; from B to D1, from B to D2, from C1 to D1, from C1 to D2, from C to D1, from C to D2, from C to D, from D1 to D2, from D1 to D, from D1 to D1E, from D2 to D, from D2 to D2E, from D to DE not more than 10 trainees. Among them, the distance driven by each trainee and the training time on the driving practice field are counted for the group of trainees on the training vehicle.

The training institution accepts the application files of trainees who meet the conditions and file components as prescribed in Articles 14 and 15 of this Circular; prepares a report on registration for examination (report 1) and sends it to the Department of Transport via one of the following methods: direct submission, postal service, or electronic environment while simultaneously transmitting data through the driver's license information system:
a) Driver training for categories BE, C1E, C, CE, D1, D1E, D2, D2E, D, DE: the training institution establishes a report to register for the driving test, a list of trainees (report 1), a list requesting verification of previously issued driving licenses for upgrading cases, and a training plan according to Model 01, Model 02, Model 03, and Model 04 in Appendix IV issued together with this Circular, and sends it to the Department of Transport; the report must have the stamp of the training institution;
b) Report 1 for categories BE, C1E, C, CE, D1, D1E, D2, D2E, D, DE must be submitted within 7 working days after the commencement of classes; the head of the unit assigned by the Department of Transport to manage testing and issuing driving licenses shall check, sign each page (including all pages of report 1);
4. Examination upon completion of the training course
Testing theoretical subjects and practical driving at the training institution to be considered as completing the training course, including:
a) Final examination of theoretical subjects according to the set of questions for the theoretical test, the content of which includes subjects such as road traffic laws; morality, traffic culture, prevention of the harmful effects of alcohol when participating in traffic, fire-fighting skills and rescue; simulation of traffic situations; new knowledge about upgraded vehicles;
b) Final examination of practical driving subjects with sequential tests, reverse parking tests, and driving on roads;
c) The content and form of the final examination of theoretical subjects are decided by the head of the training institution. A student is eligible for the final examination of theoretical subjects if they attend at least 70% of the theoretical subject class time; complete the required driving practice time and at least 50% of the driving practice mileage on the driving practice field; complete the required mileage and at least 50% of the driving practice time on the road;
d) The evaluation score for the theoretical learning content of trainees is based on a scale of 10 (from 1 to 10), taking into account one decimal place; for the practical driving subject examination with continuous tests, the evaluation is based on Appendices XV, XVI, and XVII issued together with this Circular;
e) To be considered as having completed the training course: the trainee must achieve a passing score of 5.0 points or higher in all subject examinations at the end of each course in the training program.
5. If the trainee does not meet the conditions to be considered as having completed the training course within one year from the date the training institution first organizes the examination, the trainee must be retrained in a new training course.
Article 9. Standards for motorcycle driving training institutions
1. Specialized classrooms system:
a) Theoretical classroom: equipped with teaching aids for teaching content such as road traffic laws; where information technology equipment does not describe the traffic signal system, diagrams, then a drawing system must be provided;
b) Driving technique classroom: equipped with information technology equipment for teaching content such as structure; there must be a cutaway model of the engine, power transmission system, and electrical system; where information technology equipment does not describe, then a drawing system must be provided; equipped with information technology equipment for teaching driving techniques; where information technology equipment does not describe, then a drawing system must be provided;
c) Practical maintenance and repair classroom for category B1: equipped with ventilation and lighting systems ensuring safety and hygiene requirements; the floor must not cause dust; equipped with specialized tools for maintenance and repair; equipped with disassembly and assembly tables, boards, chairs for teaching and practice; equipped with specialized tools to guide students in practicing tire disassembly and assembly, oil and coolant checks;
2. Training vehicles: suitable for the categories of vehicles specified in point a, point b, point c of Clause 1 of Article 57 of the Road Traffic Law;
3. Motorcycle driving practice field: technical specifications of practice tracks must comply with the dimensions of the examination tracks according to the National Technical Regulations for motor vehicle driving test centers for each corresponding vehicle category.
Article 10. Training materials and training management documents of driving schools
1. Driving training textbooks that comply with the framework training program for drivers stipulated in Appendix II issued together with this Circular; driving schools shall implement the procedures for compiling, reviewing, and issuing textbooks as prescribed in Article 11 of this Circular.
2. Forms and record books used by automobile driving schools include:
a) Report on examination registration;
b) Training plan;
c) Teacher assignment book and driving practice vehicle participation in teaching according to the model prescribed in Appendix V issued together with this Circular;
d) Model progress of automobile driver training according to the model prescribed in Appendix VI issued together with this Circular;
đ) Student academic performance tracking book according to the model prescribed in Appendix VII issued together with this Circular;
e) Instructor handbook according to the provisions in Appendix VIII issued together with this Circular;
g) Student tracking book for completion of training courses according to the provisions in Appendix IX issued together with this Circular.
3. Motorcycle driving schools for categories A1, A, and B1 shall use the documents specified in points a and e of Clause 2 of this Article as training management documents.
4. Automobile driving schools shall use the training materials prescribed in Clause 2 of this Article, theoretical study time data on traffic laws (for centralized learning), student management data on the management software (for distance learning, self-study with guidance), monitoring data on driving time and distance on roads, and practical driving training data on automobile driving simulators as training management documents.
Article 11. Procedures for compiling, reviewing, and issuing textbooks and training programs
1. Preparation of training textbooks and detailed training programs.
2. Review of training textbooks and detailed training programs.
3. Issuance of training textbooks and detailed training programs.
4. The procedures for compiling, reviewing, and issuing driving training textbooks and detailed training programs shall be implemented in accordance with the provisions in Appendix X issued together with this Circular.
Article 12. Training for persons with disabilities
1. Training for examination and issuance of Class A1 driving licenses for persons with disabilities who operate three-wheeled motorcycles designed for persons with disabilities
a) The learner selects the training method according to the provisions of Clause 1 of Article 5 of this Circular;
b) Must complete all content and programs as prescribed in Article 6 of this Circular.
2. Training for examination and issuance of automatic transmission Class B driving licenses
a) Training for examination and issuance of automatic transmission Class B driving licenses for persons with disabilities affecting their right foot or right hand or left hand:
The learner selects the training method according to the provisions of Clause 2 of Article 5 of this Circular.
The learner must complete all content and programs as prescribed in Article 7 of this Circular; the driving simulator training content can be replaced with actual driving practice content.
b) Training for examination and issuance of automatic transmission Class B driving licenses for persons with disabilities except those affecting their right foot or right hand or left hand:
The learner selects the training method according to the provisions of Clause 2 of Article 5 of this Circular.
The learner must complete all content and programs as prescribed in Article 7 of this Circular.
Article 13. Training for Class A1 motorcycle licenses for ethnic minority people who cannot read or write Vietnamese
1. Training format: individuals requiring a driving license must register at a driving school to undergo training according to the training program for driving licenses stipulated in Article 6 and Section A of Appendix II issued together with this Circular. Classes for ethnic minorities who cannot read or write Vietnamese must be conducted separately and include an interpreter for the ethnic language.
2. Training methods: using visual aids, road sign illustrations, models, diagrams, and traffic situation handling skills; question-and-answer sessions and practical demonstrations to fulfill the training program content.
Article 14. Requirements for learners
1. Vietnamese citizens or foreigners permitted to reside or work, study in Vietnam.
2. Learners seeking to upgrade their driving license categories must comply with the provisions set forth in Clause 4, Article 60 of the Road Traffic Safety Law; specifically, the safe driving time for each driving license category is specified as follows:
a) From B to C1, B to C, B to D1, B to BE, C1 to C, C1 to D1, C1 to D2, C1 to C1E, C to D1, C to D2, D1 to D2, D1 to D, D1 to D1E, D2 to D, D2 to D2E, D to DE: at least two years of safe driving experience;
b) From B to D2, C to CE, C to D: a safe driving period of three years or more.
3. Individuals who already hold an automatic transmission driving license category B may register to learn and obtain a new manual transmission driving license category B (stick shift); individuals who already hold a driving license category B may register to learn and obtain a new driving license category C1 and must complete the entire training program as prescribed, the learner's application materials shall be carried out according to the provisions of Clause 1, Article 15 of this Circular; in case they pass the examination, the examination organizing agency will issue a written request to the issuing authority to cut the old driving license and issue a written request to the Vietnam Highway Department to delete the management number of the issued driving license.
Article 15. Application Materials for Learners
1. First-time learners shall prepare one set of application materials, submit directly to the training institution, and take direct photographs for storage in the driving license database. The application materials include:
a) An application form for learning and taking the examination to obtain a driving license as stipulated in Appendix XI attached to this Circular;
b) A certified copy or electronic certified copy from the original or an electronic certified copy issued from the original record book of one of the following documents: residence permit, permanent residence certificate, diplomatic identification card, official identification card (for foreigners).
2. Upgrading learners shall prepare one set of application materials, submit directly to the training institution, and take direct photographs for storage in the driving license database. The application materials include:
a) Documents stipulated in Clause 1 of this Article;
b) A certified copy of the secondary school graduation certificate or equivalent or higher for upgrading to categories D1, D2, and D (presenting a certified copy along with the original for verification or a certified copy or an electronically certified copy from the original or an electronic copy from the original record book);
c) A declaration of safe driving time as stipulated in Appendix XII attached to this Circular.
3. Ethnic minority learners who cannot read or write Vietnamese applying for motorcycle driving license category A1 shall prepare one set of application materials and submit directly to the training institution. The application materials include: a health certificate of the driver issued by a medical facility meeting the legal requirements for medical examinations and treatments.
Article 16. Storage of Training Materials and Management of Trainees by Driving License Training Institutions that Cease Operations or Have Their Licenses Revoked
1. Training institutions shall store relevant records and materials of training courses
a) Indefinitely for the student tracking book of completed training courses; operational plans for motorcycle training categories A1, A, and B1;
b) Three years for: completion course examination files, data on managing theoretical study time for traffic laws for automobile trainees, data on practical driving training time on driving simulators for automobiles, data on monitoring driving time and distance on roads for trainees, data on managing theoretical study time for remote and self-study with guidance as stipulated in points a, b, c, and e of Clause 2, Article 10 of this Circular.
2. Departments of Transport shall store training-related materials including:
a) Examination registration reports of training institutions;
b) Lists of requests to verify issued driving licenses for upgrading driving license categories by training institutions;
c) Training plans of training institutions;
d) Inspection reports of training institutions by Departments of Transport;
đ) The retention period for the materials mentioned in points a, b, c, and d of this clause is three years.
3. Management of Trainees by Driving License Training Institutions that Cease Operations or Have Their Licenses Revoked
a) Training institutions that cease operations have the responsibility:
Within ten days (excluding training institutions ceasing operations before the effective date of this Circular) from the effective date of the cessation decision, hand over all files to the approved continuing training institution, including: examination registration reports, student lists (report 1), and learner application materials; report to the Department of Transport for monitoring and management.
Within ten days (excluding training institutions ceasing operations before the effective date of this Circular) from the effective date of the cessation decision, review and compile a list of candidates who have been issued a basic vocational qualification certificate or training certificate or confirmation of completing a training course, and hand over the current managed student files to the Department of Transport for continued monitoring and management.
b) Training institutions whose licenses are revoked have the responsibility:
Within ten days (excluding training institutions whose licenses were revoked before the effective date of this Circular) from the effective date of the revocation decision, review, consolidate, and compile a list of currently managed students; develop a plan to address the rights of students still in training and report to the Department of Transport for monitoring and management.
Ensure the rights of learners according to the training contract. If students agree to continue training under the proposed plan, negotiate with other training institutions in the area to transfer training obligations. If students do not agree to continue training, negotiate with the students and terminate the contract.
Within twenty days (excluding driving schools whose training licenses were revoked before this Circular takes effect), from the date on which the decision to revoke the training license becomes effective, transfer the list of current students under management along with the file including: student list (report 1), application for driving test registration and file, data (if any) to the receiving driving school; simultaneously report to the Department of Transport for monitoring and management.
c) Driving schools receiving students from dissolved driving schools or those whose training licenses have been revoked shall accept the files and documents specified in points a and b of this clause and be responsible for continuing to manage the students according to current regulations. The handover must be recorded in a protocol, including the following contents: fully and clearly record the transferred documents; commitments and responsibilities of each party (both the transferring and receiving parties have obligations and responsibilities related to the transferred files, documents, and assets).
Chapter II
DRIVING LICENSE EXAMINATION
Article 17. Forms, contents, and procedures for driving tests
1. Theory test
a) Theory test: includes questions related to traffic laws and regulations concerning road traffic order and safety, vehicle operation techniques; contents related to vehicle structure and common repairs (for category B1 driving licenses and for car driving licenses from category B upwards); driver ethics, traffic culture, and prevention of the harmful effects of alcohol when participating in traffic, fire prevention, firefighting, and rescue skills (for car driving licenses from category B upwards).
Candidates taking the theory test for category A1 driving license who hold valid car driving licenses issued by the transport sector are exempted from the theory test.
b) The theory test is conducted on a computer.
2. Practical driving test in a simulated environment
a) For categories A1 and A
Conduct the test using an automatic scoring device.
Test candidates must drive a motorcycle through four test sections: driving in an 8-shaped pattern, passing a straight line, passing a lane with obstacles, and passing a bumpy road;
b) For category B1
Conduct the test using direct scoring methods. Test candidates must drive forward through a chi-shaped figure and reverse back;
c) For categories B, C1, C, D1, D2, D
Conduct the test using an automatic scoring device; there will be no examiner seated in the examination vehicle.
Test candidates must follow the correct sequence and drive through the arranged test sections at the driving test center, including: starting, yielding to pedestrians, stopping and starting on a slope, passing tire tracks and a perpendicular turn, passing an intersection controlled by traffic lights, passing a winding road, parking parallel (category B and C1 perform longitudinal parking; categories B, C, D1, D2, and D perform lateral parking), temporarily stopping where railway tracks pass, handling dangerous situations, changing gears on flat roads, and ending;
d) For categories BE, D1E, D2E, DE
Conduct the test using direct scoring methods. Test candidates must drive through the test section: driving forward through a figure with five standard poles and returning;
đ) For categories C1E, CE
Conduct the test using direct scoring methods. Test candidates must drive through two test sections: driving forward through a figure with five standard poles and returning; performing longitudinal parking into a space.
3. Practical driving test on public roads
a) For categories B, C1, C, D1, D2, D
Conduct the test using an automatic scoring device, with an examiner seated in the examination vehicle. Test candidates must drive the examination car, handle traffic situations, and follow the instructions of the examiner;
b) For categories BE, C1E, CE, D1E, D2E, DE
Conduct the test using direct scoring methods, with an examiner seated in the examination vehicle.
4. Driving test using software simulating traffic scenarios for categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE: test candidates identify potential traffic safety risks through observing simulated scenarios appearing on the computer.
5. Examination procedure for driving tests
a) Categories A1 and A are conducted according to the provisions set out in Appendix XIII attached to this Circular;
b) Category B1 is conducted according to the provisions set out in Appendix XIV attached to this Circular;
c) Categories B, C1, C, D1, D2, D are conducted according to the provisions set out in Appendix XV attached to this Circular; categories BE, D1E, D2E, DE are conducted according to the provisions set out in Appendix XVI attached to this Circular; category C1E, CE are conducted according to the provisions set out in Appendix XVII attached to this Circular.
Article 18. Technical standards for driving practice fields used for driver examinations
1. For driving practice fields equipped with computers to conduct theoretical examinations and automatic scoring devices for practical driving examinations in simulated environments:
Driving practice fields for motorbike driver examinations must meet technical requirements as stipulated in the National Technical Regulations on Driver Examination Centers for Road Motor Vehicles, including: examination course layouts, examination vehicles, theoretical examination equipment, practical driving examination equipment in simulated environments, waiting rooms for examinations, theoretical examination rooms, and control rooms for automatic scoring of practical driving examinations in simulated environments.
2. For driving practice fields used to conduct theoretical examinations through paper-based multiple-choice tests:
Driving practice fields for motorbike driver examinations must meet technical requirements as stipulated in the National Technical Regulations on Driver Examination Centers for Road Motor Vehicles, including: examination course layouts, examination vehicles, waiting rooms for examinations, theoretical examination rooms.
Article 19. Examination Board
1. The Examination Board shall be established by the Department of Transport.
a) The Examination Board must have at least two-thirds of its members present to operate; decisions are made by majority vote; in case of equal opinions among members, the decision follows the conclusion of the Chairman of the Board;
b) The Examination Board dissolves itself upon completion of the examination period.
2. Composition of the Examination Council
a) The Chairman of the Board is a civil servant and an examiner from the Department of Transport, holding a driver's license for automobiles;
b) Members include: leaders of the driver examination center, leaders of the driving training institution, Head of the Examination Team, and Secretary Member. The Secretary Member is an employee of the unit entrusted by the Department of Transport with the task of managing examinations and issuing driver's licenses. If the leader of the driver examination center is also the leader of the driving training institution, an additional leader must be appointed as a member of the Examination Board.
3. Duties of the Examination Board
a) Directing inspections and requiring completion of conditions for organizing the examination period;
b) Assigning and scheduling plans for conducting examination periods;
c) Disseminating and guiding regulations and examination rules, announcing examination fees and issuance fees for driver's licenses, and necessary regulations to examiners and candidates;
d) Organizing the examination period according to regulations;
đ) Preparing records of violations for handling according to authority or reporting and recommending competent authorities to handle violations as prescribed;
e) Requiring candidates to compensate for damages if accidents occur due to the candidate's fault during the examination process;
g) Summarizing examination results and signing confirmation on the record;
h) Sending examination documents and materials for storage at the driving training institution, driver examination center, and the unit entrusted by the Department of Transport with the task of managing examinations and issuing driver's licenses;
i) The duties and powers of members of the Examination Board as prescribed in Appendix XVIII issued together with this Circular.
Article 20. Examination Team
1. The Examination Team shall be established by the Department of Transport.
a) The Examination Team is directly under the direction of the Examination Board. The Examination Team issuing Class A1 and A driver's licenses is directly under the direction of the unit entrusted by the Department of Transport with the task of managing examinations and issuing driver's licenses;
b) The Examination Team dissolves itself upon completion of the examination period.
2. The Examination Team consists of a Team Leader and examiners.
The Team Leader is an examiner and an employee of the unit entrusted by the Department of Transport with the task of managing examinations and issuing driver's licenses; when performing tasks during automobile driving examinations, they must hold an automobile driving examiner card.
3. Duties of the Examination Team
a) Inspecting examination vehicles, scoring devices, examination fields, and safety assurance plans during the examination process;
b) Requiring candidates to comply with examination rules; not allowing unauthorized persons to enter theoretical examination rooms, traffic simulation examination rooms, and examination fields;
c) Preparing records and handling violations within the scope of assigned duties and powers, or reporting to the Examination Board;
d) Conducting examinations, summarizing results, evaluating examination periods, and reporting to the Examination Board or the unit entrusted by the Department of Transport with the task of managing examinations and issuing driver's licenses (for examinations issuing Class A1 and A driver's licenses);
đ) Examiners are directly responsible for examination results. The Team Leader of the Examination Team is responsible for the overall results of the examination period.
Article 21. Examiner
1. Requirements for examiners
a) Examiners shall be staff members of the Department of Transport (excluding traffic inspectors under the Department of Transport's Inspectorate) and instructors from driving schools. Instructors from driving schools must have at least three consecutive years of teaching experience and mandatory social insurance contributions, and they may not examine students directly trained by their own school.
b) They shall be trained in examination procedures and issued an examiner card according to the model specified in Appendix XIX attached to this Circular, with the examiner card having a maximum validity period of three years and not exceeding the validity period of the corresponding driver's license of the examiner.
2. Standards for examiners
a) Good moral character, not currently undergoing disciplinary action;
b) Hold a college degree or higher;
c) Possess a driver's license corresponding to the category of vehicle being examined.
3. Training organization:
a) Regularly every three years or upon request from the Departments of Transport, the Vietnam Highway Corporation shall organize training to issue examiner cards;
b) The Vietnam Highway Corporation shall notify the training plan for examiners to the Departments of Transport;
c) The Departments of Transport shall review and compile a list (including a white background passport-sized photograph) of officers, civil servants, employees, and instructors from driving schools who meet the standards stipulated in point a Clause 1 and Clause 2 of this Article to participate in training, and send it to the Vietnam Highway Corporation via electronic means or postal service;
d) The Vietnam Highway Corporation shall accept the list, issue a decision to organize the training class, and announce the list of trainees meeting the conditions to attend the training, organize the training, and issue an examiner card to those who successfully complete the training.
4. Training Content
a) Theoretical and practical training
Professional ethics and conduct of examiners when performing duties; communication skills.
Legal regulations, standards, norms, procedures, and guidance related to driving license examinations, including: tasks, powers of examination boards, examination teams, and examiners; examination procedures for theoretical knowledge, simulation, on-screen, and on-road; responsibilities, tasks, and powers of organizations and individuals involved in examination activities; public service supply in the examination field; regulations on violations and handling of violations in the driving license examination field.
General knowledge about: structure, operating principles, technical maintenance of automatic scoring equipment; methods for checking examination equipment including: examination vehicles, supporting equipment, automatic scoring devices; safety assurance measures during examination organization; guidance on using software systems related to automatic scoring equipment, scoring methods for various examination contents of different vehicle categories through multiple-choice tests, automatic tests, for ethnic minorities who cannot read or write Vietnamese; steering wheel protection methods during on-road driving license examinations on public roads;
b) Practical training at driving license examination centers
Trainees shall undergo practical training as examiners at driving license examination centers, including the following content: practical inspection of supporting equipment and automatic scoring devices; practical performance of examiners' duties during theoretical examinations, computer simulation examinations, on-screen driving examinations, and on-road driving examinations; practical driving skills and steering wheel protection methods during on-road driving examinations; practical handling of simulated technical failures during examinations;
c) Duration of training and examination

Trainees must ensure full attendance to qualify for examination. The final examination score will be graded out of ten points, with a score of five points or higher required to pass the written test; the multiple-choice test on computers according to the questions specified in point b Clause 2 Article 61 of this Circular and practical driving tests based on the requirements set forth in Appendices XIII, XIV, XV, XVI, and XVII attached to this Circular.
Examination form: centralized.
Issuance of examiner cards: trainees who pass the examination requirements will be issued an examiner card; if trainees fail the examination, they must participate in the next training session to be re-examined and issued an examiner card.
Article 22. Preparation for the examination period
The unit assigned by the Department of Transport to manage examinations and issue driving licenses shall perform the following tasks:
1. For motorcycle driving examination periods for categories A1 and A
a) Check the conditions and files of candidates for the examination in accordance with Articles 28 and 29 of this Circular;
b) The person assigned to check and approve candidate files shall prepare a record of file inspection according to Model No. 01 Appendix XX issued together with this Circular;
c) For training and examination courses for ethnic minority candidates who cannot read or write Vietnamese, the following procedures shall be implemented:
The Department of Transport shall send a document according to Model No. 02 Appendix XX issued together with this Circular to the People's Committee of the commune where ethnic minority candidates who cannot read or write Vietnamese reside to seek their opinions, while also notifying the candidates; the deadline for seeking opinions shall not exceed 15 days from the date the Department of Transport sends the document.
During the opinion-seeking period, if the Department of Transport receives a document from the People's Committee of the commune, it shall include eligible candidates in the list of candidates permitted to take the examination; if the Department of Transport does not receive a document from the People's Committee of the commune beyond the opinion-seeking period, it shall not include such candidates in the list of candidates permitted to take the examination.
In case the Department of Transport receives a document from the People's Committee of the commune after the 15-day deadline, it shall include eligible candidates in the list of candidates permitted to take the next nearest examination period.
d) Based on the list of valid candidate files for the examination, along with the record of file inspection and examination conditions of candidates applying for a driving license according to Model No. 01, the reply document from the People's Committee regarding the cultural level of ethnic minority candidates who cannot read or write Vietnamese, and the results of checking driving licenses of examiners ensuring they still have points and remain valid, the Department of Transport shall issue a decision to organize the examination according to Model No. 05 and the list of candidates for the examination to issue a driving license according to Model No. 06 Appendix XX issued together with this Circular;
đ) For invalid files, the Department of Transport shall issue a notification document with detailed lists sent to the driving school to inform individuals.
2. For driving examination periods for categories B1, B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE
a) Receive reports requesting organization of the driving examination along with the list of candidates for the examination (report 2) from the driving school according to Model No. 08, Model No. 09 Appendix XX issued together with this Circular; report 2 shall be sent through postal service and data transmission to the driver training information system at the Department of Transport seven working days before the examination period;
b) Check the conditions and files of candidates for issuing driving licenses for categories B1, B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE in accordance with Articles 28 and 29 of this Circular, and candidates must be listed in the student roster (report 1);
c) Verify issued driving licenses (for cases of upgrading driving licenses);
d) The person assigned to check and approve candidate files for the examination shall prepare a record of file inspection according to Model No. 01 Appendix XX issued together with this Circular;
đ) Based on the list of valid candidate files for the examination, along with the record of file inspection and examination conditions of candidates applying for a driving license according to Model No. 01 Appendix XX issued together with this Circular, and the results of checking driving licenses of examiners ensuring they still have points and remain valid, the Department of Transport shall review and issue a decision to organize the examination according to Model No. 05 and the list of candidates for the examination to issue a driving license according to Model No. 06 Appendix XX issued together with this Circular, and the list of candidates for the examination to reissue driving licenses for various categories according to Model No. 07 Appendix XX issued together with this Circular;
e) For invalid files, the Department of Transport shall issue a notification document with detailed lists sent to the driving school to inform individuals.
Article 23. Procedures for organizing examinations
1. Holding the Examination Board meeting and opening the examination period
a) Prior to organizing the examination, the Chairman of the Examination Board convenes a meeting with the Examination Team, the Supervision Team (if any), and assigns tasks to each member during the examination period;
b) Organizing the opening ceremony of the examination period to announce the decision on organizing the examination period and disseminate relevant contents of the examination period to the examinees.
2. Conducting the examination according to the content and procedures stipulated in Article 17 and Appendices XIII, XIV, XV, XVI, XVII issued together with this Circular.
3. Concluding the examination period
a) For the examination periods for driving categories B1, B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE: The Chairman of the Examination Board convenes a meeting with the Examination Board, the Examination Team, the Supervision Team (if any). The Head of the Examination Team reports the examination results and agrees to sign the consolidated examination result record. The Chairman of the Examination Board signs and stamps the consolidated examination result record for successful candidates as prescribed in Form No. 01 of Appendix XXI issued together with this Circular;
b) For the examination periods for motorcycle driving categories A1, A: The Head of the Examination Team convenes a meeting with members of the Examination Team, the head of the driving training institution, the Supervision Team (if any) to review the examination results and agree to sign the consolidated examination result record. The head of the unit assigned by the Department of Transport to manage examinations and issue driver's licenses signs and stamps the confirmation on the consolidated examination result record for successful candidates as prescribed in Form No. 02 of Appendix XXI issued together with this Circular.
The consolidated examination result record is the original file, handed over to the successful candidates for safekeeping.
Article 24. Supervising the examination period
1. Based on actual circumstances, the Department of Transport establishes a Supervision Team to organize surprise supervision of the examination period.
2. Examination supervisors are civil servants under the Department of Transport Inspectorate. The minimum number of supervisors for motorcycle driving examinations is two, and for car driving examinations is three, including one inspector as the Team Leader.
3. When performing supervisory duties for examination periods, inspection civil servants must wear uniforms as prescribed.
4. Tasks of the Supervision Team when supervising driving examinations
a) Supervising the implementation of the examination content and procedures by the Examination Board and the Examination Team; ensuring transparency, objectivity, and fairness during the examination process;
b) Supervising the identification check of examinees before entering the theoretical examination room and practical driving examination rooms; persons without examination duties are not allowed to enter the theoretical examination room;
c) Supervising the organization of practical driving examinations on the designated road sections announced by the Department of Transport; monitoring and collecting information related to the examination period;
d) Supervisors work independently, do not enter the theoretical examination room, do not board the examination vehicle, and do not perform the duties of an examiner.
5. Tasks of the Supervision Team when supervising driving examinations at training grounds specified in Clause 2, Article 18 of this Circular
In addition to the tasks prescribed in Points a, b, d of Clause 4 of this Article, they must also supervise the preparation of theoretical examination questions in accordance with regulations, without being marked.
6. Powers of the Supervision Team
a) When discovering violations, they must prepare a record and promptly request the Examination Board and the Examination Team to handle them in accordance with regulations;
b) Report to the Director of the Department of Transport for consideration and handling.
7. At the conclusion of the examination period, the Team Leader of the Supervision Team reports in writing the supervision results to the Director of the Department of Transport.
Article 25. Recognition of Examination Results
1. Examination results recognition for candidates taking the driving license examination for category A1, A, and B1:
a) Candidates who pass both the theoretical and practical driving examinations in a simulated environment shall be recognized as successful;
b) Candidates not recognized as successful may reapply for the examination from the next session with the same examination authority;
c) Candidates who fail the theoretical examination shall not be allowed to take the practical driving examination in a simulated environment;
d) Candidates who pass the theoretical examination but fail the practical driving examination in a simulated environment shall have their theoretical examination results preserved for one year from the date of passing the examination; if they wish to retake the examination, they must be listed in the minutes of absence or failure of the previous examination board or examination team and must provide a valid health certificate issued by a qualified medical facility in accordance with the law on medical examination and treatment;
đ) Candidates who bring mobile phones or communication devices into the theoretical examination room or engage in other fraudulent acts that distort examination results will be suspended from continuing the examination and their examination results will be invalidated.
2. Examination results recognition for candidates participating in the driving license examination for categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE:
a) Candidates who pass the theoretical examination, traffic situation simulation examination, practical driving examination in a simulated environment, and road driving examination shall be recognized as successful;
b) Candidates not recognized as successful may reapply for the examination from the next session with the same examination authority;
c) Candidates who fail the theoretical examination may continue with the traffic situation simulation examination; those failing both the theoretical and traffic situation simulation examinations shall not be allowed to take the practical driving examination in a simulated environment; those failing the practical driving examination in a simulated environment shall not be allowed to take the road driving examination;
d) Candidates who pass the theoretical examination, traffic situation simulation, and practical driving examination in a simulated environment shall have their examination results preserved for one year from the date of passing the examination at the most recent examination session; if they wish to retake the examination, they must provide a valid health certificate issued by a qualified medical facility in accordance with the law on medical examination and treatment and must be listed in the minutes of absence or failure of the previous examination board or examination team;
đ) Candidates who bring mobile phones or communication devices into the theoretical examination room, traffic situation simulation examination room, examination vehicle, or engage in other fraudulent acts that distort examination results will be suspended from continuing the examination and their examination results will be invalidated.
3. Within three working days from the end of the examination period, the Department of Transport shall review and compile the results, issue a decision recognizing successful candidates in the examination along with a list of successful candidates eligible for a driver's license according to the model specified in Appendix XXII attached to this Circular.
Article 26. Driving License Examination for Persons with Disabilities
1. Examination for issuing a driving license for category A1 to operate a three-wheeled motorcycle
a) Candidates shall conduct the theoretical examination and practical driving examination in a simulated environment according to the content and procedures stipulated in Clause 1 and Clause 2 of Article 17 and Appendix XIII attached to this Circular; the examination shall be conducted at a driving examination center or training ground suitable for motorcycle driving examinations, with two examiners directly scoring the candidate;
b) The examination scenario shall comply with the national technical standards for driving examination centers for motor vehicles.
2. Examination for issuing a driving license for category B automatic transmission
a) Examination for issuing a driving license for category B automatic transmission for persons with disabilities: right foot, right hand, or left hand
Candidates must have complete documentation and follow the examination content and procedures stipulated in Article 17 of this Circular; the examination shall be conducted at a driving examination center, with two examiners sitting in the vehicle directly scoring the practical driving examination in a simulated environment and on the road;
b) Examination for issuing a driving license for category B automatic transmission for persons with disabilities except those with a disability in the right foot, right hand, or left hand
Candidates must have complete documentation and follow the examination content and procedures stipulated in Article 17 of this Circular; the examination shall be conducted at a driving examination center.
Article 27. Examination for Issuing a Motorcycle License Class A1 for Ethnic Minority People Who Cannot Read or Write Vietnamese
1. Content and examination process: carried out according to the content and examination process for Class A1 license as stipulated in Clause 1 and Clause 2 of Article 17 of this Circular.
2. The organization of the examination shall be conducted as follows: separate examination sessions. The theoretical examination will be conducted through a question-and-answer format; using a paper-based multiple-choice method; the examination time is 30 minutes. Two (2) examiners will conduct the examination sequentially for each candidate; each candidate randomly selects one examination set from the set; one examiner reads the questions and observes the candidate, the other examiner marks the corresponding box that the candidate chooses on the theoretical examination sheet; Examiners score, sign to confirm the theoretical examination sheet, the summary record of the driving examination results, and notify the examination results to the candidates. The examination content is conducted through an interpreter; the interpreter must accurately translate the questions of the examiner and the answers of the candidate; the driving training institution is responsible for hiring an interpreter.
3. Candidates sign their name or fingerprint at the designated signature position in the summary record of the driving examination results, the theoretical examination sheet, and the practical driving examination record.
Article 28. Persons Participating in Driving Examinations
1. Age requirement (as of the date of the driving examination) and health status as stipulated in Clause 1 and Clause 2 of Article 59 of the Road Traffic Safety Law.
2. Completion of the prescribed training content and program; recognized by the driving training institution as having completed the driving training course according to the model specified in Appendix XXIII issued together with this Circular for Classes B1, B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE.
3. Persons participating in the examination must be listed in the student report of Report 1 for first-time examinees.
Article 29. Application Documents for Driving Examinations
1. The driving training institution prepares one set of application documents, directly submitted to the Department of Transport. The documents include:
a) Documents as stipulated in Clause 1 of Article 15 of this Circular;
b) Primary certificate or training certificate or confirmation of completion of the training course for persons participating in the Class B1, B, C1 driving examinations;
c) List of examination requests from the driving training institution including the names of the examinees;
d) Health certificate of the driver issued by a medical facility meeting the standards prescribed by laws on medical examination and treatment, still valid.
2. For persons participating in the examination to upgrade their driving license to Class C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE
The driving training institution prepares one set of application documents, directly submitted to the Department of Transport. The documents include:
a) Documents as stipulated in Clause 2 of Article 15 of this Circular;
b) Training certificate or confirmation of completion of the training course;
c) List of examination requests from the driving training institution including the names of the upgraded examinees;
d) Health certificate of the driver issued by a medical facility meeting the standards prescribed by laws on medical examination and treatment, still valid.
3. For persons participating in the examination due to expired driving licenses
The driver prepares one set of application documents, directly submitted to the Department of Transport. The documents include:
a) Documents as stipulated in Point b of Clause 1 of Article 15 of this Circular;
b) Request form according to the model specified in Appendix XXVI issued together with this Circular;
c) Health certificate of the driver issued by a medical facility meeting the standards prescribed by laws on medical examination and treatment, still valid.
Article 30. Storage of Examination Result Files
1. After each examination period, the Department of Transport shall be responsible for storing the examination files, including:
a) List of trainees (Report 1);
b) List of candidates participating in the examination (Report 2);
c) Record of candidate file inspection;
d) Decision to organize the driving license examination period;
đ) Record of task assignment of the Examination Board;
e) Record of task assignment of the examiner;
g) Summary record of examination results;
h) List of candidates who passed, were absent, or failed in various examination sections;
i) Decision recognizing successful candidates in the examination period;
k) List of successful candidates eligible for issuance of driving licenses;
2. Driving training institutions shall store examination files including:
a) Documents at points a, b, c, d, g, h, i, k of Clause 1 of this Article;
b) Storing and preserving theoretical examination questions, practical driving examinations on traffic situation simulation software, and records of practical driving examinations in simulated environments with signatures of candidates and examiners;
c) Storing and preserving records of practical driving examinations on roads, including: signatures of candidates on the automatic scoring device printout from the road driving examination vehicle or records of practical driving examinations on roads with signatures of examiners;
d) In cases where driving training institutions have practice fields for motorcycle driving examinations, they must store monitoring data and examination result data for theoretical and practical driving examinations in simulated environments for three years.
3. Driving examination centers shall store examination files including:
a) Documents specified at points d, g, and h of Clause 1 of this Article;
b) Monitoring data and examination result data for theoretical and practical driving examinations in simulated environments, traffic situation simulation software, and road driving examinations;
c) Lists and results of driving examinations on traffic situation simulation software.
4. Candidates shall keep the summary record of examination results themselves.
5. Period of storage of files
a) Indefinite for documents specified at point i and point k of Clause 1 of this Article;
b) Five years for documents specified at points a, b, c, d, đ, e, g, h of Clause 1 of this Article;
c) Two years for documents specified at point b of Clause 3 of this Article.
Chapter III
ISSUE AND REVOKE DRIVING LICENSES
Article 31. Sample of Driving License
1. The Department of Transport shall issue driving licenses according to Model No. 01 Appendix XXIV issued together with this Circular from the date this Circular takes effect until December 31, 2025; the issuance of driving licenses according to Model No. 02 Appendix XXIV issued together with this Circular shall be implemented from January 1, 2026.
2. Recording restricted conditions of driving licenses applies to both Model No. 01 and Model No. 02, carried out according to the provisions of Item 2 of Model No. 03 Appendix XXIV issued together with this Circular.
3. Recording categories of driving licenses and restricted condition codes for driving licenses according to Model No. 02 shall be carried out according to the provisions of Items 1 and 3 of Model No. 03 Appendix XXIV issued together with this Circular.
Article 32. Use and Management of Driving Licenses
1. A driving license made of PET material issued to each individual must ensure that there is only one management number applicable to both unlimited-term and limited-term driving licenses.
2. If an individual wishes to integrate an unlimited-term driving license with a limited-term driving license, they shall register for a request to exchange (reissue) a driving license as prescribed in Appendix XXVI attached hereto, and follow the procedures for exchanging driving licenses as stipulated in Article 36 of this Circular.
3. The holder of a driving license may only drive the type of vehicle specified on the driving license.
4. When exchanging or issuing an upgraded driving license, the licensing authority shall collect the old driving license and destroy it in accordance with the laws on record keeping.
5. Holders of a Class B automatic transmission driving license may not drive manual transmission vehicles (stick shift).
6. Foreign individuals or Vietnamese residents abroad who wish to drive in Vietnam shall proceed as follows:
a) If they have a national driving license, they must apply to exchange it for a corresponding Vietnamese driving license;
b) In cases where an international treaty on driving licenses to which Vietnam is a party provides otherwise, such provisions shall be applied.
7. Driving licenses made of PET material and those issued from January 1, 2025 onwards are valid driving licenses issued by authorized authorities, bearing a serial number, issuance date, and expiration date printed on the license, which must match the serial number, issuance date, and expiration date recorded in the driving license management information system or integrated into the electronic identity account.
Article 33. Verification of Driving Licenses
1. Circumstances for conducting verification
a) Issuance, exchange of driving licenses by the Transport Industry
The Department of Transport must search and print information about the driving license in cases of upgrading, exchanging, or reissuing driving licenses from the driving license management information system; if there is no information, a written request must be made to the issuing authority to verify the issued driving license.
Without verification results of the driving license or with verification results not issued by the Department of Transport, the Department of Transport will not consider upgrading, exchanging, or reissuing the driving license;
b) Exchange of military driving licenses issued by the Ministry of National Defense for driving licenses issued by the Transport Industry
In case of suspicion, the issuing authority shall issue a written request to the Motor Vehicle Administration under the Ministry of National Defense to verify the issued driving license.
Without verification results of the driving license or with verification results not issued by the Ministry of National Defense, the Department of Transport will not exchange the driving license;
c) Exchange of driving licenses issued by the Public Security Sector for driving licenses issued by the Transport Industry
In case of suspicion, the issuing authority shall issue a written request to the Traffic Police Administration under the Ministry of Public Security managing driving licenses to verify the issued driving license.
Without verification results of the driving license or with verification results not issued by the Public Security Sector, the Department of Transport will not exchange the driving license.
2. Methods of verifying driving licenses
a) Within one working day from the date of receiving the list requesting verification of driving licenses from driving schools or valid applications as prescribed in Articles 36, 37, and 38 of this Circular, the Department of Transport shall issue a written request for verification of driving licenses according to Form No. 01 in Appendix XXV attached hereto, to be sent to the issuing authority;
b) Upon receipt of the verification request, the Department of Transport shall accept the verification of driving licenses and respond through telephone, email, or fax; within two working days, a written response shall be provided according to Form No. 02 as prescribed in Appendix XXV attached hereto.
Article 34. Issuance of Driving Licenses
1. Individuals who pass the examination shall be issued a driving license corresponding to the category they have successfully applied for; in cases of upgrading categories or issuance as stipulated in Clause 2 of this Article, the original driving license must be presented when collecting the new driving license.
a) Based on the decision recognizing successful examination results, the Department of Transport shall issue a driving license to the successful candidates. The date of success recorded on the back of the driving license is the date of signing the decision recognizing successful examination results.
b) The issuance of a driving license shall not exceed 10 days from the end date of the examination and the individual has completed the obligation of paying the fee for issuing a driving license.
2. Individuals holding expired driving licenses
a) Individuals holding driving licenses of categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE that have exceeded their validity period
If the expiration period is less than one year from the expiry date, they must take the theoretical examination as prescribed in Point a, Clause 1, Article 17 of this Circular to obtain a driving license.
If the expiration period is one year or more from the expiry date, they must take both the theoretical and practical driving examinations in traffic simulation and on-road driving as prescribed in Clauses 1, 2, and 3, Article 17 of this Circular to obtain a driving license.
The application for the examination shall comply with the provisions of Clause 3, Article 29 of this Circular.
b) Individuals holding driving licenses of categories B, C1, C, D1, D2, D, BE, C1E, CE, D1E, D2E, DE that are lost but still within the validity period, whose names are listed in the files of the Department of Transport, and who are not currently under the custody or processing by competent authorities, must take the following examinations:
If the expiration period is less than one year, they must take the theoretical examination as prescribed in Point a, Clause 1, Article 17 of this Circular to obtain a driving license.
If the expiration period is one year or more from the expiry date, they must take both the theoretical and practical driving examinations in traffic simulation and on-road driving as prescribed in Clauses 1, 2, and 3, Article 17 of this Circular to obtain a driving license.
The application for the examination shall comply with the provisions of Clause 3, Article 29 of this Circular.
The date of success recorded on the back of the driving license shall be calculated based on the date of success of the old driving license.
Individuals wishing to review and prepare for the examination must register with training institutions to receive guidance and must pay the review fees as prescribed, without having to retake the entire training program.
In case of failing to obtain a driving license, individuals holding expired driving licenses or those that are lost but still within the validity period must register with the Department of Transport to retake the examination.
3. Driving licenses shall not be issued to individuals who violate traffic regulations and safety on roads and have not yet fulfilled the requirements of state agencies regarding the handling and resolution of administrative violations in the field of traffic regulations and safety on roads.
Article 35. Reissuance of Driving Licenses
1. Individuals holding lost driving licenses that are still within the validity period may be considered for reissuance of driving licenses. The reissuance of lost driving licenses shall be carried out according to the provisions of Clauses 2, 3, and 4, Article 36 of this Circular..
2. The date of success recorded on the back of the driving license shall be calculated based on the date of success of the old driving license.
3. Driving licenses shall not be reissued in the following cases: if the driving license is not found in the vehicle driver's license information system at the Vietnam Highway Administration, or in the list of issued driving licenses (management book); driving licenses shall not be reissued to individuals who violate traffic regulations and safety on roads and have not yet fulfilled the requirements of state agencies regarding the handling and resolution of administrative violations in the field of traffic regulations and safety on roads.
Article 36. Exchange of Driving Licenses Issued by the Transport Industry
1. Requirements for exchanging driving licenses
a) Vietnamese citizens and foreigners trained, examined, and issued driving licenses in Vietnam;
b) Individuals holding driving licenses issued by the transport industry that are damaged and no longer usable;
c) Vietnamese citizens and foreigners with permanent residency cards in Vietnam who have exchanged Vietnamese driving licenses from foreign driving licenses, and if necessary, exchange their driving licenses upon expiration;
d) In cases where the date of birth, surname, given name, middle name, nationality, place of birth, and place of residence recorded on the driving license differ from those recorded in the citizen identification card or identification card, the driving license management agency shall process the exchange of a new driving license consistent with the information in the citizen identification card or identification card;
đ) Driving licenses shall not be exchanged in the following cases: driving licenses not found in the driving license information system at the Vietnam Highway Administration, list of issued driving licenses (management book); individuals violating traffic regulations and safety on roads who have not yet completed the requirements of competent state agencies regarding the resolution and handling of administrative violations in the field of traffic regulations and safety on roads;
2. Documents required for exchanging driving licenses issued by the transport industry include:
a) An application form for exchanging (reissuing) driving licenses according to the model prescribed in Appendix XXVI attached to this Circular;
b) A health check certificate of the driver issued by a medical facility meeting the standards set forth in the law on medical examination and treatment, still valid (except for drivers holding Class A, A1, B1 driving licenses);
c) A copy or electronic copy certified from the original or an electronic copy issued from the original record of the driving license or Decision on Administrative Violation Penalty in the field of road traffic for cases involving the suspension of the right to use a driving license;
d) Passport still within its validity period (for foreigners and Vietnamese residing abroad).
3. Implementation Procedures
a) Individuals must prepare one set of documents as stipulated in Clause 2 of this Article and submit them directly or through the online public service system to the Department of Transport.
In cases of direct submission, individuals must take a photograph directly at the driving license issuing authority and must complete the obligation to pay fees when the documents are accepted.
In cases of submission through the online public service system, individuals must declare according to the guidelines, bear responsibility for the accuracy and legality of the declared content, and must complete the obligation to pay fees for issuing a driving license through the payment function of the online public service system as prescribed and pay other service fees as needed; when receiving the driving license, they must return the old driving license to file the documents;
b) The Department of Transport shall inspect the documents upon receipt, search the software managing violations of the training, examination, issuance of driving licenses, and legal knowledge certificates about road traffic, access the software database on traffic order and safety of the Ministry of Public Security or search for violations of drivers through electronic identity accounts; in cases where the driving license does not fall under the category eligible for exchange or the documents do not comply with the regulations, they must notify the individual directly or in writing or through the online public service system about the contents that need to be supplemented or modified within two working days from the date of receipt of the documents;
c) Within five working days from the date of receiving all documents in accordance with the regulations (including verification of the electronic identity account through the electronic identity and authentication system), the Department of Transport shall carry out the exchange of driving licenses; in cases where the driving license is not exchanged, they must respond in writing and specify the reasons;
d) The driving license issuing authority shall store the original documents of the driving license exchange of the transport industry (except in cases of exchanging driving licenses through the online public service system) for two years from the date of issuing the driving license and collect the old driving license (in cases of fully online driving license exchanges, the driver is responsible for sending the old driving license to the driving license issuing authority for cancellation in accordance with the regulations) except in cases of exchanging driving licenses for individuals holding integrated driving licenses during the period of suspension of driving licenses;
đ) In cases where drivers wish to downgrade their driving licenses, they must clearly declare this in the application form for exchanging (reissuing) driving licenses prescribed in Appendix XXVI attached to this Circular and bear responsibility for the declared content;
4. The issuance of driving licenses shall be carried out at the document acceptance agency or through postal services at the request of the individual; in cases of submitting documents through the online public service system, the driving license shall be issued to the correct individual who has applied for the exchange of the driving license.
Article 37. Conversion of Military Driving Licenses Issued by the Ministry of National Defense to Driving Licenses Issued by the Transport Industry
Clause 1. Requirements for Converting Military Driving Licenses Issued by the Ministry of National Defense to Driving Licenses Issued by the Transport Industry
Point a) Individuals holding valid military driving licenses who have ceased service in the military (discharged, transferred to another sector, retired, terminated their labor contracts in the military) and wish to convert their driving licenses;
Point b) Valid military driving licenses allowing operation of multiple vehicle categories can be converted into driving licenses issued by the transport industry with corresponding vehicle categories; military driving licenses of category Cx can be converted into category C driving licenses issued by the transport industry;
Point c) Individuals holding military driving licenses issued by the Ministry of National Defense that are damaged and no longer usable;
Point d) Military driving licenses that have been altered or contain discrepancies in identification information will not be converted; individuals who have violated traffic regulations and have not completed the requirements set forth by competent state agencies regarding administrative violations in traffic regulations shall not be eligible for conversion;
2. The documents include:
a) An application form for exchanging (reissuing) driving licenses according to the model prescribed in Appendix XXVI attached to this Circular;
Point b) A copy of the Decision terminating military service signed by a Regiment-level Commander or higher. For contractual employees in defense enterprises: A copy of the decision terminating the labor contract, with a validity period not exceeding six months from the date of signature by the authorized authority of the defense enterprise;
Point c) A health certificate for the driver issued by a medical facility meeting the standards stipulated by laws on medical examination and treatment, still valid;
Point d) A copy or an electronic copy certified from the original or an electronic copy issued from the original record of the military driving license still within its validity period;
3. Implementation Procedures
Point a) The individual must prepare one complete application file according to the provisions of Clause 2 of this Article and submit it directly to the Department of Transport; the individual must have their photograph taken at the issuing authority and must present the original documents specified in Point b of Clause 2 of this Article for verification, and must fulfill the obligation to pay fees upon acceptance of the application;
Point b) The Department of Transport will review the application, check the database on traffic order and safety maintained by the police or verify the driver's violations through the electronic identity account; if the driving license does not qualify for conversion or the application does not comply with the regulations, the Department must notify the individual directly or in writing about the necessary supplements or corrections within two working days from the date of receipt of the application;
c) Within five working days from the date of receiving all documents in accordance with the regulations (including verification of the electronic identity account through the electronic identity and authentication system), the Department of Transport shall carry out the exchange of driving licenses; in cases where the driving license is not exchanged, they must respond in writing and specify the reasons;
Point d) The issuance of the new driving license will be conducted at the agency receiving the application or through postal services based on the individual's request;
Point đ) In cases where the driver wishes to convert to a lower category driving license, they must clearly declare this in the Application for Conversion (Reissue) of Driving License prescribed in Appendix XXVI accompanying this Circular and bear responsibility for the declared information;
Point e) The issuing authority will retain a copy of the application file for converting military driving licenses issued by the Ministry of National Defense for a period of two years from the date of issuance of the driving license and will cut the corner of the old driving license;
Clause 4. The application file for converting military driving licenses consists of the documents specified in Clause 2 of this Article and the military driving license which has been cut at the corner, to be kept by the driver.
Article 38. Exchange of driving licenses issued by the Public Security Sector for those issued by the Transport Sector
1. Requirements for exchanging driving licenses issued by the Public Security Sector for those issued by the Transport Sector
a) Individuals holding driving licenses issued by the Public Security Sector after July 31, 1995, which are still valid, who cease to serve in the Public Security Sector (discharged from military service, transferred to another sector, retired, terminated employment contracts with the People's Public Security), and wish to exchange their driving licenses;
b) Individuals holding motorcycle driving licenses issued by the Public Security Sector before August 1, 1995, which are damaged and no longer usable, and whose names are recorded in the logbook, may apply for an exchange of new driving licenses;
c) Driving licenses issued by the Public Security Sector that have been altered or erased information shall not be exchanged for new ones or those with discrepancies in identification; individuals violating traffic regulations and safety on roads who have not yet completed the requirements of competent state agencies regarding administrative violations in the field of traffic regulations and safety shall not be eligible for an exchange;
2. Documents required for exchanging motorcycle driving licenses issued by the Public Security Sector before August 1, 1995:
An application for exchange (reissue) of a driving license according to the model prescribed in Appendix XXVI attached to this Circular.
3. Documents required for exchanging driving licenses issued by the Public Security Sector from August 1, 1995:
a) An application form for exchanging (reissuing) driving licenses according to the model prescribed in Appendix XXVI attached to this Circular;
b) A copy of the driving license; a copy of the Decision to leave the sector or retire issued by the competent authority, or a copy of the Decision of the competent authority regarding termination of service in the public security force at the commune level, or a copy of the Decision terminating the labor contract and recruitment decision or labor contract of at least twelve months from units within the People's Public Security;
c) A health certificate of the driver issued by a medical facility meeting the standards stipulated by laws on medical examination and treatment, still valid.
4. Documents required for exchanging driving licenses issued by the Public Security Sector for civilian students of police schools before July 31, 2020:
a) The documents specified in points a and c of Clause 3 of this Article;
b) A copy or an electronically certified copy from the original or an electronically certified copy issued from the original record of the Graduation Recognition Decision of the Schools, Academies within the People's Public Security;
c) Original documents issued by the Public Security Sector, including: the application for examination, issuance, and exchange of driving licenses with confirmation by the head of the working unit; the driver's health certificate; the graduation certificate of the driving training program; the summary of the results of the driving examination.
5. Procedures for implementation
a) Individuals must prepare one set of documents as prescribed in Clause 2, Clause 3, or Clause 4 of this Article and submit them directly to the Department of Transport; individuals must take a direct photograph at the issuing authority and must fulfill the obligation to pay fees upon submission of the documents;
Point b) The Department of Transport will review the application, check the database on traffic order and safety maintained by the police or verify the driver's violations through the electronic identity account; if the driving license does not qualify for conversion or the application does not comply with the regulations, the Department must notify the individual directly or in writing about the necessary supplements or corrections within two working days from the date of receipt of the application;
c) Within five working days from the date of receiving all documents in accordance with the regulations (including verification of the electronic identity account through the electronic identity and authentication system), the Department of Transport shall carry out the exchange of driving licenses; in cases where the driving license is not exchanged, they must respond in writing and specify the reasons;
Point d) The issuance of the new driving license will be conducted at the agency receiving the application or through postal services based on the individual's request;
d) In cases where drivers wish to exchange their driving licenses for lower categories, they must clearly declare this in the application for exchange (reissue) of a driving license prescribed in Appendix XXVI attached to this Circular and bear responsibility for the declared information;
e) The issuing authority retains a copy of the documents for exchanging driving licenses issued by the Public Security Sector for two years from the date of issuance of the driving license and cuts the corner of the old driving license;
6. Original documents for exchanging driving licenses issued by the Public Security Sector include the documents specified in Clauses 2, 3, and 4 of this Article and the driving license issued by the Public Security Sector that has been cut at the corner, to be kept by the driver themselves.
Article 39. Conversion of foreign driving licenses to domestic driving licenses issued by the Department of Transport
1. Requirements for converting foreign driving licenses to domestic driving licenses issued by the Department of Transport
a) Foreign nationals residing, working, or studying in Vietnam with valid national driving licenses and holding one of the following documents: diplomatic identification card, official service identification card, temporary residence card, residence card, stay card, or permanent residence card for at least three months if they have a need to drive in Vietnam may be considered for conversion to corresponding Vietnamese driving license categories;
b) Vietnamese citizens (holding Vietnamese nationality) residing, studying, or working abroad who hold valid national driving licenses issued by foreign authorities, if they have a need to drive in Vietnam may be considered for conversion to corresponding Vietnamese driving license categories;
c) Temporary foreign driving licenses; international driving licenses; expired foreign driving licenses that have been altered, torn, or damaged and lack sufficient information for conversion; foreign driving licenses not issued by authorized agencies; Vietnamese citizens holding foreign driving licenses with less than three months of residence abroad and whose residence period does not match the training period required by the issuing country shall not be converted;
2. The documents include:
a) Application for conversion (reissue) of driving license (for Vietnamese citizens according to the form prescribed in Appendix XXVI attached hereto, for foreigners according to the form prescribed in Appendix XXVII attached hereto);
b) A certified Vietnamese translation of the foreign driving license by a Notary Public in Vietnam or a Vietnamese representative office abroad where the translator works, stamped across a copy of the driving license;
c) A health certificate of the driver issued by a medical facility meeting the legal requirements for medical examination and treatment, still valid (except for foreigners converting their driving license according to the entry visa or temporary residence permit duration);
d) A certified copy or electronic certified copy from the original or an electronic copy issued from the original record book of one of the following documents: temporary residence card, permanent residence card, diplomatic identification card, or official service identification card;
3. Implementation Procedures
a) Individuals must prepare one set of application documents as stipulated in Clause 2 of this Article and submit them directly to the Department of Transport at the place of registered residence, stay, temporary residence, or permanent residence; individuals must take a direct photograph at the driving license issuing authority and present the original documents (except those already submitted) for verification and must fulfill the obligation to pay fees upon submission of the application;
b) Within five working days from the date of receiving complete documents in accordance with the regulations (including electronic identity account verification through the electronic identity and authentication system), the Department of Transport will process the conversion of the driving license; if the driving license is not converted, a written response with specific reasons must be provided;
c) The issuance of the driving license will be conducted at the agency receiving the application or through postal services upon request of the individual;
4. The original file of the driving license conversion, including the documents specified in Clause 2 of this Article and the foreign driving license, is managed by the driver. For non-permanent residents of Vietnam, the driving license conversion file will be stored by the conversion agency for one year, including the documents specified in Clause 2 of this Article;
5. In cases where there are doubts about the entry or residence of foreigners in Vietnam, the driving license issuing agency will request the Ministry of Foreign Affairs, the Immigration Department under the Ministry of Public Security, or the Immigration Division of the Provincial Police to verify;
6. Validity period and vehicle categories permitted to operate
a) The validity period of the Vietnamese driving license converted for foreigners shall correspond to the validity period indicated on one of the documents specified in Point a of Clause 1 of this Article, consistent with the validity period of the foreign driving license but not exceeding the validity period stipulated for the Vietnamese driving license;
b) National driving licenses issued to individuals operating multiple categories of vehicles can be converted to Vietnamese driving licenses to operate corresponding categories of vehicles.
Article 40. Revocation of Driving License
1. The competent authority issuing driving licenses shall carry out revocation according to the following procedures:
a) Within three days from the date of discovering that the holder of a driving license falls under one of the cases stipulated in Clause 5, Article 62 of the Road Traffic Safety Law, the head of the competent authority issuing the driving license shall issue a decision to revoke and invalidate the driving license. The content of the decision clearly states the reasons for revocation and invalidation;
b) Within five working days from the date of receiving the Decision to Revoke the Driving License, the individual must submit the revoked driving license to the authority revoking the driving license and the competent authority issuing the driving license shall be responsible for revoking and invalidating the issued driving license according to the regulations;
c) In case the competent authority issuing the driving license has been merged, divided, separated, dissolved, or lost its licensing authority, the authority responsible for revoking and invalidating the driving license is the authority currently managing the original record of the driving license issuance;
2. Handling in cases where the driving license is revoked
a) For driving licenses revoked according to point a and point b, Clause 5, Article 62 of the Road Traffic Safety Law, the application materials, procedures for reissuing the driving license shall be carried out according to the provisions of Clause 2, Clause 3, and Clause 4, Article 36 of this Circular;
b) Driving licenses revoked according to point c, Clause 5, Article 62 of the Road Traffic Safety Law have no value for use. The management authority of the driving license updates data on violations onto the driving license information system at the Vietnam Highway Department from the date of discovering the violation; additionally, the violator may not be issued a driving license within five years from the date of discovery of the violation; after the five-year period from the date of discovery of the violation, if there is a need to reissue a driving license, the violator must study and take the examination again as in the case of issuing a driving license for the first time.
Part III
ISSUANCE AND USE OF INTERNATIONAL DRIVING LICENSE
PART I
ISSUANCE OF INTERNATIONAL DRIVING LICENSE
Article 41. Model of International Driving Permit (IDP)
1. IDP is a booklet with size A6 (148 mm x 105 mm), having security markings, gray cover, and white pages inside according to the model prescribed in Appendix XXVIII attached to this Circular.
2. Page 1 (cover page) records basic information of the IDP printed in both Vietnamese and English; Page 2 specifies the scope of use of the IDP printed in both Vietnamese and English, Page 3 specifies the driver's declaration section and IDP classification printed in Vietnamese, Page 4 is blank, Page 5 specifies the driver's declaration section and IDP classification printed in English, Page 6 specifies the driver's declaration section and IDP classification printed in Russian, Page 7 specifies the driver's declaration section and IDP classification printed in Spanish, Page 8 specifies the driver's declaration section and IDP classification printed in French, Page 9 specifies the vehicle categories permitted to drive printed in French.
3. The IDP number includes the country code for international traffic of Vietnam, which is VN, followed by twelve digits representing the national driving license number.
Article 42. Vehicle Categories Permitted to Drive with International Driving Permit (IDP)
The vehicle categories permitted to drive with the IDP correspond to the vehicle categories of the national driving license issued by Vietnam as prescribed in Appendix XXIX attached to this Circular.
Article 43. Issuance of International Driving Permit (IDP)
1. For Vietnamese citizens and foreigners holding a permanent residence card or temporary residence card in Vietnam who have a national driving license issued by Vietnam on PET material that remains valid, the following procedures shall be followed:
a) Application dossier for IDP
A request form for IDP in accordance with the model prescribed in Appendix XXX attached to this Circular;
b) Procedure for issuing IDP:
When individuals submit their application dossier directly to the Vietnam Highway Administration or Department of Transport, they must present the original national driving license issued by Vietnam, passport, and permanent residence card (for foreigners) for verification of the accuracy and legality of the issuance of IDP and must fulfill the obligation to pay fees upon acceptance of the dossier in accordance with regulations; when submitting the application through the online public service system, individuals must declare according to the guidelines and bear responsibility for the accuracy and legality of the declared content, and must complete the obligation to pay fees through the fee payment function of the online public service system and pay other service fees as needed. In cases where the application does not comply with regulations, the agency receiving the application has the responsibility to notify the individual directly or in writing or through the online public service system about the contents that need to be supplemented or modified within two working days from the date of receipt of the application.
Within five working days from the date of receipt of a properly submitted IDP application, the Vietnam Highway Administration or Department of Transport shall issue the IDP to the individual; if the IDP is not issued, it must be notified in writing and specify the reasons.
2. For Vietnamese citizens and foreigners holding a permanent residence card or temporary residence card in Vietnam who have a national driving license issued by member countries of international treaties to which the Socialist Republic of Vietnam is a party and remain valid, the following procedures shall be followed:
a) Application dossier for IDP: an international IDP application form in accordance with the model prescribed in Appendix XXX issued together with this Circular; a certified Vietnamese translation of the foreign driving license by a Notary Public or Embassy or Consulate of the country where the translator works in Vietnam, affixed with a matching stamp on a copy of the driving license; a copy of the temporary residence card or permanent residence card or diplomatic identification card or official identification card for foreigners;
b) Procedure for issuing IDP:
When individuals submit the dossier specified in point a of this clause directly to the Vietnam Highway Administration or Department of Transport, they must present the original national driving license issued by member countries of international treaties to which the Socialist Republic of Vietnam is a party, passport, and permanent or temporary residence card (for foreigners) for verification of the accuracy and legality of the issuance of IDP and must fulfill the obligation to pay fees upon acceptance of the dossier in accordance with regulations. In cases where the application does not comply with regulations, the agency receiving the dossier has the responsibility to notify the individual directly or in writing about the contents that need to be supplemented or modified within two working days from the date of receipt of the application.
Within five working days from the date of receipt of a properly submitted IDP application, the Vietnam Highway Administration or Department of Transport shall issue the IDP to the individual; if the IDP is not issued, it must be notified and specify the reasons.
3. The IDP shall not be issued in the following cases:
a) The national driving license has been tampered with and no longer contains all necessary information or there are discrepancies in identification;
b) The national driving license was not issued by an authorized agency in accordance with regulations.
Chapter II
USE OF INTERNATIONAL DRIVING LICENSE
Article 44. Use of the International Driving Permit (IDP) issued by Vietnam under the 1968 Convention on Road Traffic
The IDP issued by Vietnam has no validity within the territory of Vietnam.
Article 45. Use of an internationally recognized international driving permit pursuant to international treaties to which the Socialist Republic of Vietnam is a party
The use of a driving permit according to international treaties on mutual recognition to which the Socialist Republic of Vietnam is a party shall be carried out in accordance with such international treaties.
Part IV
TRAINING, INSPECTION, ISSUANCE OF CERTIFICATES FOR ENHANCED KNOWLEDGE IN ROAD TRAFFIC LAW FOR OPERATORS OF SPECIAL PURPOSE MOTORCYCLES PARTICIPATING IN ROAD TRAFFIC
PART I
TRAINING AND ENHANCEMENT OF KNOWLEDGE IN ROAD TRAFFIC LAW FOR OPERATORS OF SPECIAL PURPOSE MOTORCYCLES PARTICIPATING IN ROAD TRAFFIC
Article 46. Forms and Programs for Training Knowledge in Road Traffic Law
1. Persons undergoing training to enhance knowledge in road traffic law must be trained at automobile driving schools or special-purpose motorcycle driving schools.

Article 47. Standards for Training Institutions for Special-Purpose Motorcycle Operators Implementing Enhanced Knowledge Training, Inspection, and Issuance of Certificates in Road Traffic Law
Training institutions for special-purpose motorcycle operators implementing enhanced knowledge training, inspection, and issuance of certificates in road traffic law must have sufficient classrooms for road traffic law, adequate teaching materials, simulation models, and a system of road traffic signs as prescribed.
Article 48. Organization of Road Traffic Law Training for Special-Purpose Motorcycle Operators Participating in Road Traffic
1. Report on the commencement of enhanced knowledge training in road traffic law: automobile driving schools or special-purpose motorcycle driving schools accept individual applications that meet the requirements stipulated in point b, Clause 1 and Clause 2, Article 59 of the Road Traffic Safety Law and report to the Department of Transportation in accordance with the form prescribed in Appendix XXXI attached to this Circular.
2. Automobile driving schools or special-purpose motorcycle driving schools base on the training program prescribed in Article 46 of this Circular to develop course materials and detailed training program contents.
3. Organize inspections, prepare inspection records according to the form prescribed in Appendix XXXII attached to this Circular, and issue certificates for enhanced knowledge in road traffic law to students who meet the requirements. In cases where the requirements are not met, another inspection will be organized after seven working days.
4. Inspection
a) Inspection of subjects according to the training program for knowledge in road traffic law prescribed in Clause 2, Article 46 of this Circular;
b) Evaluation of student learning outcomes on a scale of 10 points (from 1 to 10), including one decimal place. A score of 5.0 or higher in each subject is considered satisfactory.
Article 49. Application Files of Students
Individuals submit one set of application files at automobile driving schools or special-purpose motorcycle driving schools. The application file includes:
1. Application for enrollment in enhanced knowledge training in road traffic law according to the form prescribed in Appendix XXXIII attached to this Circular.
2. Three color photographs measuring 2x3 cm taken within six months, in identification card format.
Article 50. Printing and Management of Certificates for Enhanced Knowledge in Road Traffic Law
1. Based on the model certificate for enhanced knowledge in road traffic law prescribed in Appendix XXXIV attached to this Circular, automobile driving schools or special-purpose motorcycle driving schools design a certificate template, including their own logo (if any).
2. The head of automobile driving schools or special-purpose motorcycle driving schools approves the certificate template of their institution and reports it to the Department of Transportation and provincial or centrally-administered city public security agencies where the school's main office is located; they are responsible for managing the certificate templates of their institution.
3. Printing of certificate templates must ensure strictness, safety, confidentiality, and must be recorded in a management ledger.
Article 51. Retention of Inspection Result Files
1. Driving schools for automobiles or training centers for specialized vehicle operators
a) Report on opening a legal knowledge training class on road traffic laws;
b) List of candidates participating in the examination;
c) Decision to organize the examination;
d) Certificate issuance record book.
2. Department of Transport
Shall retain files and documents specified in point a, Clause 1 of this Article and point a, Clause 2 of Article 4 of this Circular.
3. Storage period for documents
a) No time limit for the certificate issuance record book;
b) Two years for documents specified in points a, b, and d, Clause 1 of this Article.
Chapter II
ISSUANCE AND REISSUANCE OF ROAD TRAFFIC LAW KNOWLEDGE ENHANCEMENT CERTIFICATES FOR SPECIALIZED VEHICLE OPERATORS PARTICIPATING IN ROAD TRAFFIC
Article 52. Issuance of certificates
Within five working days from the date the inspection results meet the requirements, the head of the driving school for automobiles or the training center for specialized vehicle operators shall issue a certificate to the learner.
Article 53. Reissuance of certificates
1. Individuals whose certificates are damaged or contain incorrect information listed in the storage file at the issuing location shall be reissued according to the certificate number already issued.
a) The application for reissue, including: an application for reissue of the certificate in accordance with the form prescribed in Appendix XXXV attached to this Circular;
b) Three color photographs measuring 2x3 cm taken within six months.
2. Individuals whose certificates are lost and listed in the storage file at the issuing location shall be reissued according to the certificate number already issued.
The reissue procedures shall be carried out in accordance with point a, Clause 1 of this Article.
3. Procedures for implementation:
a) Individuals submit one set of application documents to the driving school or specialized vehicle operator training center that issued the certificate; if the training center that issued the certificate is no longer operational, then submit to the Department of Transport managing the issuing center;
b) The driving school for automobiles or specialized vehicle operator training center or the Department of Transport shall review the submitted documents upon receipt; in cases where the certificate does not fall within the scope for reissue or the documents do not comply with the regulations, they must directly notify or inform in writing the individual of the required supplements or corrections within two working days from the date of receiving the documents;
c) Within three working days from the date of receiving complete and valid documents, the head of the driving school for automobiles or specialized vehicle operator training center or the Department of Transport shall reissue the certificate; in cases where the certificate is not reissued, a written response must be provided with clear reasons stated;
d) The issuance of driver's licenses shall be conducted at the driving school for automobiles or specialized vehicle operator training center or the agency receiving the application or through postal services based on the individual's request.
Part V
INFORMATION SYSTEM FOR TRAINING, TESTING, ISSUING DRIVER'S LICENSES, AND ROAD TRAFFIC LAW KNOWLEDGE ENHANCEMENT CERTIFICATES
PART I
MANAGEMENT OF THE INFORMATION SYSTEM
Article 54. Requirements for the Information System on Training, Testing, Issuing Driver's Licenses, and Road Traffic Law Knowledge Enhancement Certificates
1. Information system for driver training at the training center
a) Shall manage at least the following information of trainees: name; personal identification number; date of birth; place of residence; health certificate; information on each test session and the results of each session for each trainee; confirmation of completion of the training course; driver's license number, license category, safe driving time for upgrading license categories;
b) Shall manage at least the following training information: training course; name of the training center; completion time of the course; training results; management data (DAT); theoretical study time for traffic law subjects; practical driving test results on driving simulators; list of candidates eligible to participate in the examination sessions; list of absentees and failures in examination sessions;
c) Shall have the capability to connect and transmit management data (DAT) to the driver training information system of the Vietnam Highway Administration;
d) Shall have the capability to receive the list of candidates eligible to participate in the examination sessions and the list of absentees and failures in examination sessions from the Department of Transport;
đ) Shall have the capability to generate and provide to the Department of Transport: registration reports for examinations, reports requesting organization of examinations;
e) Shall have the capability to accurately store all managed information;
g) Shall have the capability to connect and share data with related information systems;
h) Shall ensure provisions regarding information security and network security as stipulated by law.
2. Information system for driver training at the Department of Transport
a) Shall manage at least the following information: report 1; report 2; trainee information as specified in points a and b, Clause 1 of this Article; examination candidate eligibility list approval results;
b) Shall have the capability to approve lists of candidates eligible for examinations, transfer results to the driver training information system at the training center and the driver examination information system;
c) Shall have the capability to accurately store all managed information;
d) Shall have the ability to connect and share data with related information systems;
đ) Shall ensure provisions regarding information security and network security as stipulated by law.
3. Information system for driver training at the Vietnam Highway Administration
a) Shall have the capability to store at least the following information on management data (DAT) as prescribed in Appendix XXXXI attached to this Circular;
b) Shall have the capability to receive, aggregate, and analyze management data (DAT) according to the model prescribed in Appendix XXXVI attached to this Circular;
c) Shall have the capability to accurately store all managed information;
d) Shall have the ability to connect and share data with related information systems;
đ) Shall ensure provisions regarding information security and network security as stipulated by law.
4. Examination information system at the examination center
a) Shall manage at least the following information: examination session; examination candidates; examination supervision data; examination results;
b) Shall have the capability to receive examination session information and candidates eligible to take the examination from the driver examination information system of the Department of Transport;
c) Shall have the capability to provide examination results to the Department of Transport's information system;
d) Shall have the capability to immediately share examination supervision data with the Department of Transport, Provincial Public Security Traffic Police Departments, and the National Traffic Police Corps;
đ) Shall have the capability to accurately store all managed information;
e) Shall have the capability to connect and share data with related information systems;
g) Ensure compliance with current laws' provisions on information security and cybersecurity.
5. Driver Examination Information System at the Department of Transport
a) Manage at least the following information: results of candidate lists approved for examination participation; examination sessions; candidates participating in examination sessions; examination supervision data; examination session results;
b) Be capable of creating examination sessions, updating examination session information and candidate lists, and providing this information to the driver examination center's information system;
c) Be capable of receiving examination supervision data from the driver examination center's information system;
d) Be capable of providing successful candidate information to the driver license information system at the Department of Transport;
đ) Be capable of remote access for authorized agencies to access and exploit the system;
e) Shall have the capability to accurately store all managed information;
g) Shall have the capability to connect and share data with related information systems;
h) Ensure compliance with current laws' provisions on information security and cybersecurity.
6. Driver License Information System at the Vietnam Highway Administration
a) Manage at least the following information: driver license number; confirmation of completion of training course; full name; personal identification number; date of birth; nationality; place of residence; driving school; vehicle category trained; training course; date of passing; examination authority; examination location (driver examination center or training ground for examination); date of issuance, renewal, reissuance of driver license; issuing authority; driver license category; expiration date; driver license form number;
b) Be capable of receiving the information listed in point a of this clause from the driver license information system at the Department of Transport;
c) Have the function of issuing international driver licenses as stipulated in Clause 1 and Clause 2, Article 43 of this Circular;
d) Have the function of revoking driver licenses;
đ) Be capable of searching for driver license information and performing tasks related to driver training, examination, and license issuance on the electronic information website;
e) Be capable of connecting and sharing data with the national public service portal, provincial public service portals, and other relevant information systems to handle administrative procedures related to driver license management and international driver licenses;
g) Be capable of accurately storing all managed information;
h) Be capable of connecting and sharing data with relevant information systems;
i) Ensure compliance with current laws' provisions on information security and cybersecurity.
7. Driver License Information System at the Department of Transport
a) Manage at least the following information: driver license number; confirmation of completion of training course; full name; personal identification number; date of birth; nationality; place of residence; driving school; vehicle category trained; training course; date of passing; examination authority; examination location (driver examination center or training ground for examination); date of issuance, renewal, reissuance of driver license; issuing authority; driver license category; expiration date; driver license form number;
b) Be capable of providing the information listed in point a of this clause to the driver license information system at the Vietnam Highway Administration;
c) Be capable of receiving successful candidate information from the driver examination information system at the Department of Transport;
d) Have the function of issuing new, renewing, reissuing, and revoking driver licenses;
đ) Have the function of converting foreign driver licenses or foreign resident Vietnamese driver licenses according to the regulations stipulated in Article 39 of this Circular;
e) Have the function of converting driver licenses issued by the transport sector, military driver licenses issued by the Ministry of Defense, and driver licenses issued by the police;
g) Have the function of issuing and revoking international driver licenses;
h) Be capable of accurately storing all managed information;
i) Be capable of connecting and sharing data with relevant information systems;
k) Ensure compliance with current laws' provisions on information security and cybersecurity.
8. Information System for Issuing Certificates of Traffic Law Training at Driving Schools or Specialized Vehicle Operator Training Centers
a) Manage at least the following information: full name; date of birth; training course; completion time; certificate examination result; date of certificate examination result; certificate number; date of certificate issuance; training and certificate issuing institution; date of certificate renewal or reissuance; certificate renewal or reissuance issuing authority for each trainee;
b) Be capable of creating training courses, examination sessions, and printing traffic law training certificates;
c) Have the function of issuing, renewing, and reissuing traffic law training certificates;
d) Be capable of providing the information listed in point a of this clause to the information system for motor vehicle operators and specialized vehicle operators;
đ) Shall have the capability to accurately store all managed information;
e) Shall have the capability to connect and share data with related information systems;
g) Ensure compliance with current laws' provisions on information security and cybersecurity.
9. Information System for Issuing Certificates of Traffic Law Training at the Department of Transport
Organize the management and use of at least the following information: traffic law training certificate number; automobile driving school or specialized vehicle operator training center issuing the traffic law training certificate; information about regular health check-up results of vehicle operators.
10. Information System for Issuing Certificates of Traffic Law Training at the Vietnam Highway Administration
a) Be capable of receiving and storing the information listed in point a of Clause 8 of this Article;
b) Be capable of providing accounts to the Department of Transport to manage and exploit traffic law training certificate information issued by training centers under its jurisdiction;
c) Be capable of connecting and sharing data with relevant information systems.
Article 55. Requirements for the Information System on Motor Vehicle Operators and Specialized Vehicle Operators
1. Manage at least the following information: full name; personal identification number; date of birth; nationality; place of residence; driver license number, driver license category, issuing authority of the driver license, traffic law training certificate number, training and certificate issuing institution; information about regular health check-up results of vehicle operators.
2. Possess the capability to receive information from the vehicle driver's license information system at the Vietnam Highway Administration, the system for issuing certificates of traffic law training, the database on the health status of drivers and operators of specialized motor vehicles of the Ministry of Health, and other specialized information systems as provided in Clause 1 of Article 2 of this Decree.
3. Possess the capability to connect and share with the National Population Database, the Road Transport Database, and other related databases.
Article 56. Principles and Forms of Data Exploitation on the Information System
1. Principles of exploitation
a) The exploitation of driver’s license data shall be carried out in accordance with the laws on information technology and network security;
b) The management agency of the driver’s license information system as stipulated in Articles 61 and 62 of this Circular shall have the responsibility to protect personal information in the driver’s license database on the internet in accordance with the laws on information technology;
c) Services for exploiting driver’s license information data shall be provided to agencies, organizations, and individuals on the internet in accordance with the laws on information technology and network security.
2. Forms of Exploitation
a) Direct exploitation
Agencies, organizations, and individuals may directly exploit driver’s license data or certificates of traffic law training from the electronic driver’s license information website (https://www.gplx.gov.vn) in accordance with the regulations on security levels and permissions for using and exploiting driver’s license data or certificates of traffic law training.
b) Indirect exploitation
Agencies, organizations, and individuals requiring the exploitation of driver’s license data or certificates of traffic law training shall be provided with information extracted from the driver’s license database or the certificate of traffic law training database, including: information recorded on the driver’s license (in cases where authorized agencies request additional information beyond what is printed on the license, such as training, examination results, and traffic law violations); information recorded on the certificate of traffic law training (in cases where authorized agencies request additional information beyond what is printed on the certificate, such as training, testing, and traffic law violations).
Article 57. Time for Retaining Data on the Information System
The head of the agency or organization shall be responsible for directing the implementation of electronic document management in accordance with the regulations.
1. The retention period for training and examination data for issuing driver’s licenses at driving schools and examination centers shall be a minimum of five years.
2. The retention period for training, examination, issuance, and renewal of driver’s licenses at provincial Departments of Transportation under central cities shall be a minimum of fifty years.
3. The retention period for driver’s license data at the Vietnam Highway Administration shall be a maximum of seventy years.
4. The retention period for training, examination, and issuance of certificates of traffic law training shall be a minimum of three years.
Chapter II
PROCEDURE FOR EXPLOITING THE INFORMATION SYSTEM
Article 58Procedure for exploiting the information system in relation to issuing driver’s licenses
1. For new driver’s licenses
a) Driving school: Receive applications for learning to drive and implement procedures on the driving training information system to create reports for registration for examinations to be sent to the Department of Transportation for updating the driving training information system with examination results and completion of the training course, and creating reports requesting examinations to be sent to the Department of Transportation;
b) Department of Transportation: Exploit information on examination registration reports and examination requests on the driving training information system to approve lists of candidates eligible for examinations; based on decisions to organize examination sessions, create lists of trainees eligible to participate in examinations to be sent to examination centers and driving test sites for coordination in organizing examination sessions; receive examination result data from examination centers and driving test sites synchronized on the driving examination information system to create lists of individuals eligible for driver’s licenses on the driver’s license information system at the Department of Transportation; verify the digital signature of the authorized person signing the driver’s license and print the driver’s license; check the quality of the driver’s license after printing and synchronize the data into the driver’s license information system at the Vietnam Highway Administration in accordance with the regulations.
c) Trung tâm sát hạch lái xe và sân tập lái dùng để sát hạch lái xe: tiếp nhận danh sách thí sinh dự sát hạch do Sở Giao thông vận tải đồng bộ trên Hệ thống thông tin và thực hiện quy trình sát hạch trên hệ thống thông tin sát hạch lái xe; đồng bộ dữ liệu kết quả kỳ sát hạch vào hệ thống thông tin sát hạch lái xe;
d) Cục Đường bộ Việt Nam: tiếp nhận dữ liệu giấy phép lái xe đã được các Sở Giao thông vận tải đồng bộ vào hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam để tổ chức quản lý và sử dụng dữ liệu theo quy định.
2. Đối với cấp đổi giấy phép lái xe
a) Sở Giao thông vận tải: tiếp nhận hồ sơ và thực hiện các quy trình đổi giấy phép lái xe trên hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải; kiểm tra, cập nhật, xác thực hồ sơ điện tử vào hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải; xác thực chữ ký số của người có thẩm quyền ký trên các hồ sơ điện tử cấp giấy phép lái xe và thực hiện quy trình in giấy phép lái xe; kiểm tra chất lượng giấy phép lái xe sau khi in và đồng bộ dữ liệu vào hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam;
b) Cục Đường bộ Việt Nam: tiếp nhận dữ liệu giấy phép lái xe đã được các Sở Giao thông vận tải đồng bộ vào hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam để tổ chức quản lý và sử dụng dữ liệu theo quy định.
Điều 59. Quy trình khai thác hệ thống thông tin đối với cấp, quản lý giấy phép lái xe quốc tế
1. Sở Giao thông vận tải: tiếp nhận hồ sơ và thực hiện các quy trình cấp giấy phép lái xe quốc tế trên hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải; kiểm tra, cập nhật, xác thực hồ sơ điện tử vào hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải; xác thực chữ ký số của người có thẩm quyền ký trên các hồ sơ điện tử cấp IDP và thực hiện quy trình in giấy phép lái xe quốc tế; kiểm tra chất lượng giấy phép lái xe sau khi in và đồng bộ dữ liệu vào hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam.
2. Cục Đường bộ Việt Nam:
a) Tiếp nhận dữ liệu IDP đã được các Sở Giao thông vận tải đồng bộ vào hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam để tổ chức quản lý và sử dụng dữ liệu theo quy định;
b) Trường hợp tiếp nhận hồ sơ đề nghị cấp IDP của cá nhân, thì thực hiện như quy trình tại khoản 1 Điều này.
Điều 60. Quy trình khai thác hệ thống thông tin đối với cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ
1. Cơ sở đào tạo lái xe ô tô hoặc cơ sở đào tạo người điều khiển xe máy chuyên dùng: Tiếp nhận hồ sơ học để được cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ và sử dụng hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ để tạo lập khoá đào tạo; cập nhật kết quả kiểm tra và danh sách học viên đạt kết quả kiểm tra hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ; xác thực chữ ký số của người có thẩm quyền ký và in chứng chỉ; kiểm tra chất lượng chứng chỉ sau khi in và đồng bộ dữ liệu vào hệ thống thông tin theo quy định.
2. Sở Giao thông vận tải: tổ chức quản lý, sử dụng dữ liệu theo quy định và gửi báo cáo Cục Đường bộ Việt Nam theo quy định tại Điều 4 Thông tư này.
3. Cục Đường bộ Việt Nam: tiếp nhận, quản lý dữ liệu chứng chỉ trên hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ.
Phần VI
TỔ CHỨC THỰC HIỆN
Điều 61. Cục Đường bộ Việt Nam
1. Đối với công tác đào tạo lái xe
a) Hướng dẫn chuyên môn, nghiệp vụ đối với công tác đào tạo để thực hiện thống nhất trong phạm vi cả nước;
b) Ứng dụng công nghệ thông tin trong công tác quản lý đào tạo lái xe; xây dựng, chuyển giao bộ câu hỏi, phần mềm mô phỏng các tình huống giao thông cho các cơ sở đào tạo lái xe;
c) Ứng dụng công nghệ thông tin trong công tác quản lý đào tạo lái xe, quản lý hệ thống thông tin đào tạo lái xe của Cục Đường bộ Việt Nam đảm bảo việc tiếp nhận, tổng hợp, phân tích dữ liệu quản lý DAT phục vụ cho việc khai thác dữ liệu quản lý DAT và quản lý công tác đào tạo lái xe của các Sở Giao thông vận tải; đảm bảo hệ thống thông tin đào tạo lái xe của Cục Đường bộ Việt Nam hoạt động liên tục, ổn định và lưu trữ dữ liệu quản lý DAT tối thiểu là 03 năm;
d) Công bố và thực hiện cập nhật danh sách các cơ sở đào tạo lái xe ô tô được cấp hoặc bị thu hồi giấy phép đào tạo lái xe trên trang thông tin điện tử.
1. Đối với công tác sát hạch lái xe
a) Hướng dẫn chuyên môn, nghiệp vụ đối với công tác xây dựng trung tâm sát hạch lái xe lái xe, sát hạch lái xe để thực hiện thống nhất trong phạm vi cả nước;
b) Xây dựng bộ câu hỏi; phần mềm trong hệ thống thông tin quản lý đào tạo, sát hạch, quản lý giấy phép lái xe; phần mềm dùng cho sát hạch lý thuyết; phần mềm mô phỏng các tình huống giao thông để phục vụ công tác đào tạo, sát hạch lái xe, hướng dẫn thực hiện thống nhất trong cả nước và chuyển giao cho các Sở Giao thông vận tải, cơ sở đào tạo lái xe, trung tâm sát hạch lái xe và Cục cảnh sát Giao thông, Bộ Công an phục vụ công tác kiểm tra nội dung kiến thức pháp luật về trật tự an toàn giao thông đường bộ cho người có giấy phép lái xe bị trừ hết điểm;
c) Xây dựng chương trình, kế hoạch đào tạo, chỉ đạo, tổ chức tập huấn, cấp thẻ sát hạch viên cho đội ngũ sát hạch viên trong cả nước và lưu trữ hồ sơ sát hạch viên theo quy định;
d) Công bố và cập nhật danh sách các trung tâm sát hạch lái xe được cấp hoặc bị thu hồi giấy phép sát hạch trên trang thông tin điện tử.
3. Đối với công tác cấp giấy phép lái xe
a) Hướng dẫn chuyên môn, nghiệp vụ đối với công tác cấp giấy phép lái xe để thực hiện thống nhất trong phạm vi cả nước;
b) Thiết kế tính bảo mật, in, thống nhất phát hành, hướng dẫn và quản lý việc sử dụng phôi giấy phép lái xe trong phạm vi cả nước.
4. Đối với công tác cấp giấy phép lái xe quốc tế
a) Hướng dẫn chuyên môn, nghiệp vụ đối với công tác cấp IDP để thực hiện thống nhất trong phạm vi cả nước;
b) Thiết kế tính năng bảo mật của phôi ấn chỉ IDP; tổ chức in, phát hành, hướng dẫn và quản lý việc sử dụng phôi ấn chỉ IDP trong toàn quốc;
c) Công bố, cập nhật danh sách các nước tham gia Công ước Viên hàng năm theo thông báo chính thức của Liên hợp quốc trên trang thông tin điện tử của Cục Đường bộ Việt Nam;
d) Xây dựng, hướng dẫn các Sở Giao thông vận tải trang thiết bị phục vụ công tác cấp IDP;
đ) Tiếp nhận, thực hiện việc cấp IDP theo đúng quy định;
e) Triển khai thực hiện dịch vụ công về cấp IDP.
5. Đối với công tác đào tạo, kiểm tra, cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ cho người điều khiển xe máy chuyên dùng: hướng dẫn chuyên môn, nghiệp vụ đối với công tác đào tạo, kiểm tra, cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ để thực hiện thống nhất trong phạm vi cả nước.
6. Đối với công tác quản lý hệ thống thông tin
a) Xây dựng, nâng cấp và duy trì hoạt động của hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam; hệ thống dịch vụ công trực tuyến toàn trình đổi giấy phép lái xe do ngành Giao thông vận tải cấp trên cổng dịch vụ công quốc gia; hệ thống dịch vụ công trực tuyến toàn trình cấp giấy phép lái xe quốc tế; hệ thống thông tin DAT, hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ tại Cục Đường bộ Việt Nam; tích hợp, chia sẻ dữ liệu giấy phép lái xe theo yêu cầu của cơ quan có thẩm quyền; ứng dụng công nghệ chuyển đổi số trong đào tạo, sát hạch, cấp giấy phép lái xe;
b) Vận hành hoặc thuê đơn vị có năng lực để vận hành hệ thống thông tin của Cục Đường bộ Việt Nam tại điểm a khoản này;
c) Tiếp nhận dữ liệu cấp, đổi giấy phép lái xe từ hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải để xác thực và đồng bộ vào cơ sở dữ liệu giấy phép lái xe đặt tại Cục Đường bộ Việt Nam; bảo vệ thông tin, dữ liệu cá nhân trong cơ sở dữ liệu giấy phép lái xe trên môi trường mạng theo quy định của pháp luật về công nghệ thông tin và an toàn thông tin mạng;
d) Cung cấp tài khoản để các Sở Giao thông vận tải, các cơ sở đào tạo lái xe, cơ sở đào tạo người điều khiển xe máy chuyên dùng, đăng nhập, truyền dữ liệu và khai thác dữ liệu trên phần mềm hệ thống thông tin DAT và hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ của Cục Đường bộ Việt Nam;
đ) Xây dựng, tập huấn chuyển giao phần mềm nghiệp vụ trong hệ thống thông tin quản lý đào tạo, hệ thống thông tin sát hạch và hệ thống thông tin giấy phép lái xe tại cơ sở đào tạo lái xe, trung tâm sát hạch lái xe và Sở Giao thông vận tải;
e) Sử dụng dữ liệu trên hệ thống thông tin giấy phép lái xe tại Cục Đường bộ Việt Nam để phục vụ công tác báo cáo, thanh tra, kiểm tra;
g) Ban hành quy chế đảm bảo an toàn an ninh thông tin, quy chế sử dụng phần cứng, phần mềm, tài khoản để đảm bảo sử dụng hệ thống thông tin an toàn, hiệu quả.
7. Đối với công tác kiểm tra
a) Kiểm tra định kỳ hoặc đột xuất về công tác quản lý đào tạo, sát hạch, cấp, đổi, cấp lại giấy phép lái xe tại các Sở Giao thông vận tải; công tác chấp hành các quy định về hoạt động đào tạo, sát hạch lái xe theo quy định của pháp luật về hoạt động đào tạo và sát hạch lái xe;
b) Kiểm tra định kỳ hoặc đột xuất công tác tổ chức các kỳ sát hạch tại trung tâm sát hạch lái xe, xử lý hoặc báo cáo cơ quan có thẩm quyền để xử lý các vi phạm theo quy định hiện hành.
Điều 62. Sở Giao thông vận tải
1. Đối với công tác đào tạo lái xe
a) Chịu trách nhiệm quản lý công tác đào tạo lái xe trong phạm vi tỉnh, thành phố trực thuộc Trung ương;
b) Thực hiện tiếp nhận, rà soát, kiểm tra và thông báo danh sách cơ sở đào tạo lái xe hạng A1, A, B1 đủ hoặc không đủ điều kiện hoạt động trên địa bàn quản lý trên trang thông tin điện tử của Sở Giao thông vận tải;
c) Theo dõi, kiểm tra, khai thác và sử dụng dữ liệu quản lý DAT trên hệ thống thông tin đào tạo lái xe tại Cục Đường bộ Việt Nam và dữ liệu DAT trên hệ thống thông tin đào tạo lái xe tại cơ sở đào tạo lái xe để phục vụ công tác quản lý đào tạo;
d) Bảo mật tên đăng nhập và mật khẩu truy cập hệ thống thông tin đào tạo lái xe tại Cục Đường bộ Việt Nam và hệ thống thông tin đào tạo lái xe của cơ sở đào tạo lái xe;
đ) Kiểm tra, đánh giá hình thức tổ chức, chương trình đào tạo lái xe chi tiết của cơ sở đào tạo lái xe;
e) Sử dụng dữ liệu quản lý DAT trên hệ thống thông tin đào tạo lái xe tại Cục Đường bộ Việt Nam theo quy định tại Mẫu số 06 Phụ lục XXXVI ban hành kèm theo Thông tư này, giấy xác nhận được kết xuất trên ca bin học lái xe ô tô thông tin học viên đã học đủ thời gian và nội dung học thực hành lái xe trên ca bin học lái xe ô tô do cơ sở đào tạo lái xe cung cấp để duyệt danh sách học viên đủ điều kiện tham dự kỳ sát hạch. Trong trường hợp Cục Đường bộ Việt Nam có thông báo dừng hệ thống thông tin đào tạo lái xe để bảo trì hoặc bảo dưỡng hoặc xảy ra sự cố thì các Sở Giao thông vận tải sử dụng dữ liệu DAT của cơ sở đào tạo lái xe.
2. Đối với công tác sát hạch lái xe
a) Tổ chức thực hiện các quy định tại Thông tư này và hướng dẫn của Cục Đường bộ Việt Nam về nghiệp vụ sát hạch lái xe;
b) Xây dựng kế hoạch về nhu cầu đào tạo, bồi dưỡng và trực tiếp quản lý, lưu trữ hồ sơ của đội ngũ sát hạch viên;
c) Chỉ đạo xây dựng, quản lý hoạt động của trung tâm sát hạch lái xe thuộc địa phương;
d) Triển khai nối mạng với các trung tâm sát hạch lái xe, cơ sở đào tạo lái xe tại địa phương và Cục Đường bộ Việt Nam;
đ) Cung cấp tài khoản hệ thống thông tin giám sát sát hạch để Cục Đường bộ Việt Nam, các Sở Giao thông vận tải (đưa học viên đến tổ chức sát hạch tại trung tâm sát hạch lái xe không thuộc quyền quản lý trực tiếp), các trung tâm sát hạch lái xe đăng nhập, truyền và khai thác dữ liệu; đảm bảo hệ thống thông tin giám sát của Sở Giao thông vận tải hoạt động liên tục, ổn định và lưu trữ dữ liệu kết quả sát hạch tối thiểu trong thời gian 05 năm; dữ liệu kết quả sát hạch khai thác trên phần mềm của hệ thống thông tin giám sát được tổng hợp theo mẫu quy định tại Phụ lục XXXVII ban hành kèm theo Thông tư này;
e) Tổ chức các kỳ sát hạch đối với học viên học tại các cơ sở đào tạo lái xe do Sở Giao thông vận tải quản lý;
g) Công khai lịch, địa điểm tổ chức các kỳ sát hạch lái xe của tháng sau trước ngày 25 của tháng trước trên Trang thông tin điện tử của Sở Giao thông vận tải;
h) Sở Giao thông vận tải chịu trách nhiệm quản lý sát hạch, cấp giấy phép lái xe trong phạm vi tỉnh, thành phố trực thuộc Trung ương;
i) Chỉ đạo đơn vị được Sở Giao thông vận tải giao nhiệm vụ quản lý sát hạch, cấp giấy phép lái xe ban hành nội quy sát hạch để áp dụng tại các kỳ sát hạch lái xe.
3. Đối với công tác cấp giấy phép lái xe
a) Triển khai thực hiện dịch vụ công về đổi giấy phép lái xe;
b) Tiếp nhận, xử lý thông tin đổi giấy phép lái xe, cấp lại giấy phép lái xe quá thời hạn sử dụng do Sở Giao thông vận tải khác chuyển đến; tổ chức cấp mới, cấp lại giấy phép lái xe bị mất và đổi giấy phép lái xe cho người lái xe có nhu cầu;
c) Cập nhật các vi phạm của người lái xe vào Hệ thống thông tin giấy phép lái xe do cơ quan có thẩm quyền xử phạt vi phạm hành chính cung cấp.
4. Đối với công tác cấp giấy phép lái xe quốc tế
a) Đảm bảo các trang thiết bị phục vụ công tác cấp IDP theo quy định;
b) Tiếp nhận và chịu trách nhiệm về tính chính xác, hợp pháp của hồ sơ cấp IDP và thực hiện việc cấp IDP theo đúng quy định;
c) Triển khai thực hiện dịch vụ công về cấp IDP.
5. Đối với công tác đào tạo, kiểm tra, cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ cho người điều khiển xe máy chuyên dùng tham gia giao thông đường bộ
a) Cấp lại chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ theo quy định tại điểm a khoản 3 Điều 53 Thông tư này;
b) Tổ chức kiểm tra, thanh tra định kỳ hoặc đột xuất công tác bồi dưỡng kiến thức pháp luật về giao thông đường bộ trong phạm vi địa phương theo quy định;
c) Thực hiện tiếp nhận, rà soát, kiểm tra và thông báo danh sách cơ sở bồi dưỡng kiến thức pháp luật về giao thông đường bộ hoạt động trên địa bàn quản lý trên trang thông tin điện tử của Sở Giao thông vận tải;
d) Truy cập hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ của Cục Đường bộ Việt Nam để quản lý, khai thác dữ liệu chứng chỉ bồi dưỡng pháp luật về giao thông đường bộ của các cơ sở đào tạo thuộc quyền quản lý.
6. Đối với công tác quản lý hệ thống thông tin
a) Đầu tư, bảo trì, nâng cấp trang thiết bị phần cứng, phần mềm hệ thống và mạng truyền số liệu của hệ thống thông tin đào tạo lái xe, hệ thống thông tin sát hạch, hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải;
b) Vận hành hoặc thuê đơn vị có năng lực để vận hành hệ thống thông tin đào tạo lái xe, hệ thống thông tin sát hạch, hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải theo quy định;
c) Tiếp nhận, tổ chức thực hiện và chịu trách nhiệm đối với các phần mềm nghiệp vụ trong hệ thống thông tin đào tạo, hệ thống thông tin sát hạch và hệ thống thông tin giấy phép lái xe tại Sở Giao thông vận tải; cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ tại địa phương do Cục Đường bộ Việt Nam chuyển giao;
d) Sử dụng các phần mềm trong hệ thống thông tin đào tạo lái xe để tiếp nhận báo cáo 1, báo cáo 2; kiểm tra đối chiếu các thông tin người học lái xe, quá trình đào tạo, kết quả đào tạo để chuẩn bị kỳ sát hạch theo quy định;
đ) Sử dụng các phần mềm trong hệ thống thông tin sát hạch lái xe để thực hiện sát hạch lái xe, tổng hợp kết quả làm cơ sở cấp, cấp lại giấy phép lái xe theo quy định;
e) Sử dụng các phần mềm trong hệ thống thông tin giấy phép lái xe để cập nhật, xử lý, khai thác, xác thực và đồng bộ dữ liệu và quản lý giấy phép lái xe; thực hiện ký số để cấp mới, cấp lại giấy phép lái xe theo quy định;
g) Sử dụng dữ liệu trên hệ thống thông tin được cài đặt, chuyển giao tại Sở Giao thông vận tải, trung tâm sát hạch lái xe, cơ sở đào tạo lái xe để phục vụ công tác thanh tra, kiểm tra và cung cấp thông tin cho các đơn vị chức năng;
h) Ban hành quy chế đảm bảo an toàn an ninh thông tin, quy chế sử dụng phần cứng, phần mềm, tài khoản để đảm bảo sử dụng hệ thống thông tin an toàn, hiệu quả;
i) Chịu trách nhiệm về tính chính xác, hợp pháp của các hồ sơ điện tử đã gửi hoặc truyền dữ liệu về Cục Đường bộ Việt Nam;
k) Lưu trữ đầy đủ các thông tin theo quy định theo quy định của pháp luật về lưu trữ.
7. Đối với công tác kiểm tra
Kiểm tra định kỳ hoặc đột xuất về công tác đào tạo lái xe tại các cơ sở đào tạo lái xe; công tác quản lý đào tạo, kiểm tra, cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ tại các cơ sở đào tạo.
Điều 63. Cơ sở đào tạo
1. Đối với công tác đào tạo lái xe
a) Tổ chức tuyển sinh đào tạo bảo đảm các yêu cầu đối với người học lái xe theo quy định tại Điều 14 của Thông tư này;
b) Ký hợp đồng đào tạo với người học lái xe ô tô gồm các nội dung chính sau: Hạng giấy phép lái xe đào tạo; địa điểm đào tạo; thời gian hoàn thành khóa học; mức học phí và phương thức thanh toán học phí; trách nhiệm bồi thường thiệt hại của mỗi bên khi vi phạm hợp đồng; thanh lý hợp đồng; các thỏa thuận khác không trái pháp luật và đạo đức xã hội;
c) Công khai quy chế tuyển sinh, mức thu học phí và quản lý đào tạo trên trang thông tin của cơ sở đào tạo lái xe;
d) Cơ sở đào tạo lái xe mô tô các hạng A1, A, B1 phải duy trì tiêu chuẩn kỹ thuật nghiệp vụ chuyên môn theo quy định;
đ) Thông báo phương án hoạt động đến Sở Giao thông vận tải và tổ chức đào tạo lái xe mô tô các hạng A1, A, B1 đúng phương án hoạt động đào tạo đã đăng ký theo mẫu quy định tại Phụ lục XXXVIII ban hành kèm theo Thông tư này;
e) Tổ chức đào tạo mới và đào tạo nâng hạng giấy phép lái xe ô tô theo lưu lượng, thời hạn, địa điểm, hạng giấy phép lái xe ghi trong giấy phép đào tạo lái xe;
g) Ứng dụng công nghệ trong công tác quản lý đào tạo để nhận dạng và theo dõi thời gian học lý thuyết môn học pháp luật về giao thông đường bộ đối với học viên học lái xe ô tô theo hình thức học tập trung; bảo đảm cơ sở vật chất, trang thiết bị phục vụ giảng dạy, học tập để nâng cao chất lượng đào tạo lái xe; sử dụng phần mềm mô phỏng các tình huống giao thông để đào tạo lái xe;
h) Bảo đảm giáo viên khi dạy thực hành lái xe phải đeo phù hiệu “Giáo viên dạy lái xe” và mang theo giấy phép xe tập lái; học viên tập lái xe trên đường phải đeo phù hiệu “Học viên tập lái xe”. Phù hiệu do cơ sở đào tạo lái xe cấp, quản lý theo Mẫu số 01 và Mẫu số 02 quy định tại Phụ lục XXXIX ban hành kèm theo Thông tư này; niêm yết tên cơ sở đào tạo lái xe trên xe tập lái theo mẫu quy định tại Phụ lục XXXX ban hành kèm theo Thông tư này;
i) Tổ chức kiểm tra môn học: người đứng đầu cơ sở đào tạo lái xe căn cứ nội dung kiểm tra quy định tại khoản 4 Điều 6, khoản 4 Điều 7 và khoản 4 Điều 8 Thông tư này xây dựng quy trình kiểm tra;
k) Sử dụng kết quả theo dõi quá trình học; kết quả kiểm tra; kết quả học thực hành lái xe trên đường thông qua hệ thống thông tin đào tạo lái xe của cơ sở đào tạo lái xe hoặc Cục Đường bộ Việt Nam; kết quả học thực hành lái xe trên ca bin học lái xe được kết xuất từ ca bin học lái xe ô tô thông tin học viên đã học đủ thời gian và nội dung học thực hành lái xe trên ca bin học lái xe ô tô để xét khóa đào tạo cho người học lái xe ô tô;
l) Truyền dữ liệu quản lý DAT theo quy định tại Phụ lục XXXXI ban hành kèm theo Thông tư này và chịu trách nhiệm về tính chính xác, đầy đủ, trung thực dữ liệu DAT và dữ liệu quản lý DAT; bảo đảm an toàn dữ liệu, bảo mật cho hệ thống thông tin DAT; bảo mật tên đăng nhập và mật khẩu truy cập hệ thống thông tin đào tạo lái xe của Cục Đường bộ Việt Nam; cung cấp kịp thời, chính xác các thông tin, dữ liệu DAT cho cơ quan quản lý nhà nước có thẩm quyền khi có yêu cầu;
m) Theo dõi, khai thác dữ liệu DAT trên hệ thống thông tin đào tạo lái xe của cơ sở đào tạo lái xe để phục vụ công tác quản lý đào tạo lái xe; đảm bảo tính chính xác các thông tin về giáo viên, xe tập lái;
n) Cung cấp và chịu trách nhiệm đối với giấy xác nhận được kết xuất từ ca bin học lái xe ô tô thông tin học viên đã học đủ thời gian và nội dung học thực hành lái xe trên ca bin học lái xe ô tô cho cơ quan quản lý đào tạo, sát hạch, cấp giấy phép lái xe;
o) Xây dựng, phê duyệt hình thức, chương trình đào tạo lái xe chi tiết theo quy trình biên soạn, thẩm định ban hành chương trình đào tạo quy định tại Điều 11 và Phụ lục X Thông tư này, báo cáo Sở Giao thông vận tải để theo dõi và quản lý. Việc xây dựng hệ thống, học liệu, các phương pháp đào tạo từ xa, tự học có hướng dẫn và hệ thống ứng dụng quản lý đào tạo từ xa, tự học có hướng dẫn theo quy định tại Phụ lục XXXXII ban hành kèm theo Thông tư này;
p) Phối hợp với trung tâm sát hạch lái xe trong việc giải quyết khi xảy ra tai nạn quy định tại điểm e khoản 3 Điều 19 Thông tư này.
2. Đối với công tác quản lý hệ thống thông tin
a) Đầu tư, bảo trì, nâng cấp trang thiết bị phần cứng, phần mềm hệ thống và mạng truyền số liệu của hệ thống thông tin đào tạo lái xe đặt tại cơ sở đào tạo lái xe;
b) Tiếp nhận và tổ chức thực hiện phần mềm nghiệp vụ trong hệ thống thông tin đào tạo lái xe tại cơ sở đào tạo lái xe do Cục Đường bộ Việt Nam chuyển giao
Tạo lập, đối chiếu, chịu trách nhiệm về tính chính xác của thông tin học viên, quá trình đào tạo, kết quả đào tạo, báo cáo 1, báo cáo 2 theo quy định. Tiếp nhận thông tin kết quả sát hạch lái xe của học viên đào tạo tại cơ sở của mình để quản lý và tổ chức cho học viên sát hạch lại theo quy định;
c) Chịu trách nhiệm về tính chính xác, hợp pháp của các hồ sơ điện tử gửi hoặc truyền dữ liệu đến Sở Giao thông vận tải và Cục Đường bộ Việt Nam;
d) Lưu trữ đầy đủ các thông tin theo quy định tại khoản 1 Điều 57 Thông tư này;
đ) Ban hành quy chế đảm bảo an toàn an ninh thông tin, quy chế sử dụng phần cứng, phần mềm, tài khoản để đảm bảo sử dụng hệ thống thông tin an toàn, hiệu quả;
e) Khai thác dữ liệu trên hệ thống thông tin được cài đặt, chuyển giao tại cơ sở đào tạo lái xe để phục vụ công tác thanh tra, kiểm tra và cung cấp thông tin cho các đơn vị chức năng (khi có yêu cầu).
Điều 64. Trung tâm sát hạch lái xe
1. Đối với công tác quản lý sát hạch
a) Bảo đảm cơ sở vật chất, trang thiết bị kiểm tra, chấm điểm theo quy định để thực hiện các kỳ sát hạch đạt kết quả chính xác, khách quan; báo cáo về Sở Giao thông vận tải khi thiết bị, phương tiện dùng cho sát hạch hoạt động không chính xác, không ổn định hoặc khi thay đổi thiết bị, phương tiện dùng cho sát hạch để xử lý kịp thời;
b) Phối hợp và tạo mọi điều kiện để các cơ sở đào tạo lái xe đưa học viên đến ôn luyện và các Hội đồng sát hạch tổ chức sát hạch thuận tiện, đúng kế hoạch;
c) Chấp hành và phối hợp với cơ quan có thẩm quyền trong việc kiểm tra, trung tâm sát hạch lái xe;
d) Công khai mức thu phí sát hạch và giá các dịch vụ khác trên trang thông tin điện tử của trung tâm sát hạch lái xe;
đ) Bảo đảm an toàn cho các kỳ sát hạch lái xe; phối hợp các đơn vị, cơ quan liên quan giải quyết khi có các vụ việc tai nạn, mất an toàn xảy ra;
e) Thực hiện chế độ báo cáo, công khai lịch sát hạch trên Trang thông tin điện tử của trung tâm sát hạch lái xe, lưu trữ hồ sơ kết quả sát hạch theo quy định tại khoản 3 Điều 30 Thông tư này;
g) Truyền, chia sẻ dữ liệu giám sát sát hạch đến Sở Giao thông vận tải (cơ quan quản lý trực tiếp hoạt động trung tâm sát hạch lái xe) và Phòng Cảnh sát giao thông Công an tỉnh, thành phố trực thuộc Trung ương nơi đặt trụ sở trung tâm sát hạch lái xe và Cục Cảnh sát Giao thông, Bộ Công an; lưu trữ và chịu trách nhiệm về tính chính xác, đầy đủ, trung thực dữ liệu giám sát sát hạch; bảo đảm an toàn dữ liệu; bảo mật tên đăng nhập, mật khẩu truy cập và phần mềm cho hệ thống thông tin giám sát sát hạch của Sở Giao thông vận tải; cung cấp kịp thời, chính xác các thông tin, dữ liệu giám sát sát hạch cho cơ quan quản lý nhà nước có thẩm quyền khi có yêu cầu;
h) Tiếp nhận, sử dụng phần mềm sát hạch lý thuyết, phần mềm sát hạch mô phỏng các tình huống giao thông do Cục Đường bộ Việt Nam chuyển giao để sát hạch lái xe và phần mềm quản lý nghiệp vụ do Cục Đường bộ Việt Nam chuyển giao để phục vụ công tác tổ chức sát hạch lái xe.
2. Đối với công tác quản lý hệ thống thông tin
a) Đầu tư, bảo trì, nâng cấp trang thiết bị phần cứng, phần mềm hệ thống và mạng truyền số liệu của hệ thống thông tin sát hạch lái xe đặt tại trung tâm sát hạch lái xe;
b) Tiếp nhận và tổ chức thực hiện phần mềm nghiệp vụ trong hệ thống thông tin sát hạch lái xe tại trung tâm sát hạch lái xe do Cục Đường bộ Việt Nam chuyển giao;
c) Cài đặt các phần mềm do Cục Đường bộ Việt Nam chuyển giao; không được can thiệp, lắp đặt các thiết bị, cài đặt các phần mềm làm ảnh hưởng quá trình sát hạch hoặc làm sai lệch kết quả sát hạch lái xe;
d) Lưu trữ đầy đủ các thông tin theo quy định của pháp luật về văn thư lưu trữ;
đ) Ban hành quy chế đảm bảo an toàn an ninh thông tin, quy chế sử dụng phần cứng, phần mềm, tài khoản để đảm bảo sử dụng hệ thống thông tin an toàn, hiệu quả;
e) Khai thác dữ liệu trên hệ thống thông tin được cài đặt, chuyển giao tại trung tâm sát hạch lái xe để phục vụ công tác thanh tra, kiểm tra và cung cấp thông tin cho các đơn vị chức năng (khi có yêu cầu).
Điều 65. Cơ sở đào tạo lái xe ô tô hoặc cơ sở đào tạo người điều khiển xe máy chuyên dùng
1. Đối với công tác đào tạo, kiểm tra, cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ cho người điều khiển xe máy chuyên dùng
a) Tuyển sinh và bồi dưỡng kiến thức pháp luật về giao thông đường bộ theo chương trình quy định tại Thông tư này;
b) Báo cáo mở lớp bồi dưỡng kiến thức pháp luật về giao thông đường bộ với Sở Giao thông vận tải theo mẫu quy định tại Phụ lục XXXI ban hành kèm theo Thông tư này;
c) Lập Sổ quản lý cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ theo mẫu quy định tại Phụ lục XXXXIII ban hành kèm theo Thông tư này;
d) Cơ sở đào tạo lái xe ô tô hoặc cơ sở đào tạo người điều khiển xe máy chuyên dùng phải thông báo phương án hoạt động đến Sở Giao thông vận tải và tổ chức đào tạo bồi dưỡng kiến thức pháp luật về giao thông đường bộ đúng phương án hoạt động đào tạo đã đăng ký theo mẫu quy định tại Phụ lục XXXXIV ban hành kèm theo Thông tư này.
2. Đối với công tác quản lý hệ thống thông tin
a) Đầu tư, bảo trì, nâng cấp trang thiết bị phần cứng, phần mềm hệ thống và mạng truyền số liệu của hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ đặt tại cơ sở bồi dưỡng kiến thức pháp luật giao thông đường bộ;
b) Chịu trách nhiệm về tính chính xác, hợp pháp của các hồ sơ điện tử gửi hoặc truyền dữ liệu đến Sở Giao thông vận tải và Cục Đường bộ Việt Nam;
c) Lưu trữ đầy đủ các thông tin theo quy định tại khoản 4 Điều 57 Thông tư này;
d) Ban hành quy chế đảm bảo an toàn an ninh thông tin, quy chế sử dụng phần cứng, phần mềm, tài khoản để đảm bảo sử dụng hệ thống thông tin an toàn, hiệu quả;
đ) Khai thác dữ liệu trên hệ thống thông tin cấp chứng chỉ bồi dưỡng kiến thức pháp luật về giao thông đường bộ được cài đặt, chuyển giao tại cơ sở để phục vụ công tác thanh tra, kiểm tra và cung cấp thông tin cho các đơn vị chức năng (khi có yêu cầu).
Phần VII
ĐIỀU KHOẢN THI HÀNH
Điều 66. Hiệu lực thi hành
1. Thông tư này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2025.
2. Thông tư này bãi bỏ các Thông tư:
a) Thông tư số 06/2011/TT-BGTVT ngày 07 tháng 3 năm 2011 của Bộ trưởng Bộ Giao thông vận tải quy định về bồi dưỡng kiến thức pháp luật về giao thông đường bộ cho người điều khiển xe máy chuyên dùng tham gia giao thông đường bộ;
b) Thông tư số 07/2013/TT- BGTVT ngày 03 tháng 5 năm 2013 của Bộ trưởng Bộ Giao thông vận tải quy định về quản lý, vận hành và khai thác hệ thống thông tin giấy phép lái xe;
c) Thông tư số 29/2015/TT-BGTVT ngày 06 tháng 7 năm 2015 của Bộ trưởng Bộ Giao thông vận tải ban hành Thông tư quy định về cấp, sử dụng giấy phép lái xe quốc tế;
d) Thông tư số 12/2017/TT-BGTVT ngày 15 tháng 4 năm 2017 của Bộ trưởng Bộ Giao thông vận tải quy định về đào tạo, sát hạch, cấp giấy phép lái xe cơ giới đường bộ;
đ) Thông tư số 38/2019/TT-BGTVT ngày 08 tháng 10 năm 2019 của Bộ trưởng Bộ Giao thông vận tải sửa đổi, bổ sung một số điều Thông tư số 12/2017/TT-BGTVT ngày 15 tháng 4 năm 2017 của Bộ trưởng Bộ Giao thông vận tải quy định về đào tạo, sát hạch, cấp giấy phép lái xe cơ giới đường bộ;
e) Thông tư số 01/2021/TT-BGTVT ngày 27 tháng 01 năm 2021 của Bộ trưởng Bộ Giao thông vận tải sửa đổi, bổ sung một số điều Thông tư số 29/2015/TT-BGTVT ngày 06 tháng 7 năm 2015 của Bộ trưởng Bộ Giao thông vận tải quy định về cấp, sử dụng giấy phép lái xe quốc tế và Thông tư số 12/2017/TT-BGTVT ngày 15 tháng 4 năm 2017 của Bộ trưởng Bộ Giao thông vận tải quy định về đào tạo, sát hạch, cấp giấy phép lái xe cơ giới đường bộ;
g) Thông tư số 04/2022/TT-BGTVT ngày 22 tháng 4 năm 2022 của Bộ trưởng Bộ Giao thông vận tải sửa đổi, bổ sung một số điều Thông tư số 12/2017/TT-BGTVT ngày 15 tháng 4 năm 2017 của Bộ trưởng Bộ Giao thông vận tải quy định về đào tạo, sát hạch, cấp giấy phép lái xe cơ giới đường bộ;
h) Điều 2, Điều 4, Điều 10, Điều 12, Điều 15, Điều 20 và Điều 22 Thông tư số 05/2023/TT-BGTVT ngày 27 ngày 4 tháng 2023 của Bộ trưởng Bộ giao thông vận tải sửa đổi, bổ sung một số điều của các Thông tư liên quan đến lĩnh vực vận tải đường bộ, dịch vụ hỗ trợ vận tải đường bộ, phương tiện và người lái;
i) Điều 1, Điều 3 và Điều 4 Thông tư số 05/2024/TT-BGTVT ngày 31 tháng 3 năm 2024 của Bộ trưởng Bộ Giao thông vận tải sửa đổi, bổ sung một số điều của các Thông tư liên quan đến lĩnh vực vận tải đường bộ, dịch vụ hỗ trợ vận tải đường bộ, phương tiện và người lái.
Điều 67. Quy định chuyển tiếp
Người vắng, trượt trong các kỳ sát hạch trước ngày Thông tư này có hiệu lực được bảo lưu kết quả những nội dung đã sát hạch đạt để đăng ký sát hạch lái xe sau ngày Thông tư này có hiệu lực và được cấp giấy phép lái xe theo hạng giấy phép lái xe đổi, cấp lại quy định tại khoản 3 Điều 89 Luật Trật tự, an toàn giao thông đường bộ.
