DIRECTS THE GOVERNMENT TO INSTRUCT THE COMPETENT AUTHORITIES TO PROMPTLY IMPLEMENT THE NECESSARY ACTIONS TO SIGN THE PROTOCOL ON BOUNDARY DELIMITATION, MARKING, AND DETAILING THE MAP; ALLOCATE THE BUDGET TO IMPLEMENT THE TREATY; AMEND AND SUPPLEMENT CURRENT REGULATIONS RELATED TO BORDER MANAGEMENT; LOCAL ADMINISTRATIVE BOUNDARIES; STABILIZE THE LIVES OF THE POPULATION IN BORDER AREAS; AND SERIOUSLY IMPLEMENT THE TREATY AND PROPERLY AND TIMELY HANDLE ANY ISSUES THAT ARISE IN COLLABORATION WITH THE COMPETENT AUTHORITIES OF THE PEOPLE'S REPUBLIC OF CHINA.
THE GOVERNMENT SHALL PROCEED WITH THE FOREIGN RELATIONS PROCEDURES FOR THE APPROVAL OF THE TREATY AND NOTIFY AND GUIDE THE RELEVANT AUTHORITIES TO IMPLEMENT THIS TREATY.
THIS RESOLUTION WAS PASSED BY THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM AT ITS SEVENTH SESSION ON JUNE 9X, session seventh session adopted on September 09 6 6.Implements one-time payments for those who have contributed to the revolution according to Ordinance No. 19/2000/PL-UBTVQH10 dated February 4, 2000, of the Standing Committee of the National Assembly; provides housing support for those who were active in the revolutionary movement before 1945 according to Decision No. 20/2000/QĐ-TTg dated February 8, 2000, of the Prime Minister./.

THE PEOPLE'S REPUBLIC OF CHINA
THE SOCIALIST REPUBLIC OF VIETNAM AND THE PEOPLE'S REPUBLIC OF CHINA (HEREINAFTER REFERRED TO AS "THE CONTRACTING PARTIES"), WITH THE AIM OF MAINTAINING AND DEVELOPING ALL NEIGHBORLY FRIENDSHIP RELATIONS BETWEEN THE TWO COUNTRIES AND THEIR PEOPLES; WITH THE DESIRE TO BUILD A PEACEFUL, STABLE, AND PERMANENT BORDER BETWEEN THE TWO COUNTRIES; BASED ON RESPECT FOR EACH OTHER'S INDEPENDENCE, SOVEREIGNTY, AND TERRITORIAL INTEGRITY, NON-AGGRESSION AGAINST EACH OTHER, NON-INTERFERENCE IN INTERNAL AFFAIRS, MUTUAL BENEFIT, AND COEXISTENCE IN PEACE; IN THE SPIRIT OF EMPATHY, MUTUAL CONCESSION, AND FRIENDLY NEGOTIATION;
HAVE DECIDED TO SIGN THIS TREATY AND AGREE ON THE FOLLOWING PROVISIONS:
ARTICLE I.THE CONTRACTING PARTIES TAKE THE HISTORICAL BOUNDARY TREATIES BETWEEN VIETNAM AND CHINA AS THE BASIS, REFERRING TO THE RECOGNIZED PRINCIPLES OF INTERNATIONAL LAW AS WELL AS THE AGREEMENTS REACHED DURING THE NEGOTIATIONS ON THE VIETNAM-CHINA BOUNDARY ISSUE, AND HAVE RESOLVED THE BOUNDARY ISSUE FAIRLY AND REASONABLY AND REDRAWN THE BOUNDARY BETWEEN THE TWO COUNTRIES.
Article II.The two Parties agree on the direction of the land border between the Socialist Republic of Vietnam and the People's Republic of China from west to east as follows:
Point number 1 at the location with an elevation of 1875 meters on Mount Khoan La San (Ten Tier Great Mountain), this point is approximately 2.30 kilometers west-northwest from the point with an elevation of 1439 meters within the territory of Vietnam, approximately 3.70 kilometers west-northwest from the point with an elevation of 1691 meters within the territory of Vietnam, and approximately 2.00 kilometers south from the point with an elevation of 1203 meters within the territory of China.
From point number 1, the boundary follows the watershed between the upper branches of rivers Nam Mo Phi and Nam Sa Ho flowing into the territory of Vietnam and the upper branches of river Chinh Khang flowing into the territory of China, generally heading north-northeast then turning east, passing through points with elevations of 1089, 1275, 1486 to the point with an elevation of 1615, then continuing along the aforementioned watershed, generally heading north then turning northeast, passing through the point with an elevation of 1221 to the point with an elevation of 1248, then following the mountain ridge, heading southeast
to the point with an elevation of 1248, then following a small mountain ridge, heading northeast to point number 2. This point is located in the middle of River Nam Nap (Thap Non), approximately 0.70 kilometers southwest from the point with an elevation of 1369 meters within the territory of Vietnam, approximately 0.87 kilometers northwest from the point with an elevation of 1367 meters within the territory of Vietnam, and approximately 0.80 kilometers east-southeast from the point with an elevation of 1256 meters within the territory of China.
From point number 2, the boundary follows River Nam Nap (Thap Noa), heading north then turning northeast until it reaches the confluence of this river with River Ta Lo Phi Ma (Nam Ma), then continues downstream along the river, heading north until it reaches the confluence with River Da (Ly Tien), then follows River Da (Ly Tien) downstream, heading east until it reaches the confluence with River Nam La (Tieu Hac), then reverses upstream along River Nam La (Tieu Hac) to point number 3. This point is located at the confluence of River Nam La (Tieu Hac) and stream Nam Na Pi, approximately 1.87 kilometers west-southwest from the point with an elevation of 978 meters within the territory of Vietnam, approximately 0.50 kilometers north-northwest from the point with an elevation of 620 meters within the territory of China, and approximately 4.40 kilometers east-northeast from the point with an elevation of 1387 meters within the territory of China.
From point number 3, the boundary leaves the river and enters a mountain ridge, heading northwest to the point with an elevation of 1933, then follows the watershed between the upper branches of streams La Po, La Si, Ah Hu, Nam Sau, Nam Ko Ma, Nam Ha Xi, Nam Ha Ne, Nam Xi Lung, Nam Ha, Nam Nghe, Nam Den Thang, Nam Pang flowing into the territory of Vietnam and the upper branches of rivers Che Dong, Ha Luo Luo Ba, Da Tou Luo Ba, Mo Wu Luo Ba, Na Bang, Ge Jie, Da Luo, Nan Bu, Giao Beng Bang, Giao Cai Ping, Nan Yan, Jin Chui flowing into the territory of China, generally heading northeast then turning southeast and then northeast again, passing through points with elevations of 1690, 1975, 1902, 2121, 2254, 2816, 1831, 3074, 2635, 2199, 2133, 2002, 1800 to the point with an elevation of 1519, then follows the mountain ridge, generally heading
east to the unnamed peak, then follows a small mountain ridge, heading east to point number 4. This point is located in the middle of stream Nam Le (Cach Gioi), approximately 2.05 kilometers northeast-northeast from the point with an elevation of 1451 meters within the territory of Vietnam, approximately 2.90 kilometers southeast from the point with an elevation of 845 meters within the territory of China, and approximately 1.62 kilometers southwest from the point with an elevation of 1318 meters within the territory of China.
From point number 4, the boundary follows stream Nam Le (Cach Gioi), generally heading northeast then turning northwest until it reaches the confluence of this stream with River Nam Na, then follows River Nam Na downstream, heading southeast then turning east until it reaches the confluence with River Nam Cum (Dang Dieu), then reverses upstream along River Nam Cum (Dang Dieu), heading northeast until it reaches the source of stream Phin Ho (Dang Dieu), then follows a small ravine, generally heading east-northeast to point number 5. This point is located where the aforementioned ravine meets the mountain ridge, approximately 0.62 kilometers northeast-northeast from the point with an elevation of 2283 meters within the territory of Vietnam, approximately 0.45 kilometers southeast from the point with an elevation of 2392 meters within the territory of China, and approximately 1.50 kilometers west from the point with an elevation of 2361 meters within the territory of China.
From point number 5, the boundary follows the mountain ridge, heading south to the point with an elevation of 2413, then follows the watershed between streams Ta Ao Ho, Then Theo Ho, Panh Ho, Nam Nung, Nam Lon within the territory of Vietnam and rivers San Cha, Tai Yang Zhai, Man Jiang, Wu Tai, Shi Dong, Ping, Zhong Liang, and Cha within the territory of China, generally heading southeast, passing through points with elevations of 2468, 3018, 2539, 2790 to point number 6.
This point is located at the point with an elevation of 2836, approximately 1.40 kilometers north from the point with an elevation of 2881 meters within the territory of Vietnam, approximately 3.00 kilometers northeast-northeast from the point with an elevation of 2581 meters within the territory of Vietnam, and approximately 3.05 kilometers south-southwest from the point with an elevation of 2510 meters within the territory of China.
From point number 6, the boundary follows the mountain ridge, heading southwest to a point near a horse stable northeast of the point with an elevation of 2546 meters within the territory of Vietnam, then follows a ravine, heading southeast until it reaches the source of stream Lung Po (Hong Nham), then follows stream Lung Po (Hong Nham) and its lower course, heading northeast until it reaches the confluence of this stream with River Hong, from which the boundary follows River Hong downstream, heading southeast until it reaches the confluence of River Hong with River Nam Thi (Nam Ke), then reverses upstream along River Nam Thi (Nam Ke), heading northeast until it reaches the confluence of River Nam Thi (Nam Ke) with River Ba Ket (Ba Cat), then reverses upstream along River Ba Ket (Bat Tu), heading north until it reaches the confluence of this river with an unnamed stream, then reverses upstream along this unnamed stream, heading north to point number 7. This point is located in the middle of the aforementioned unnamed stream, approximately 2.00 kilometers northwest from the point with an elevation of 614 meters within the territory of Vietnam, approximately 1.20 kilometers northeast from the point with an elevation of 595 meters within the territory of China, and approximately 0.65 kilometers east from the point with an elevation of 463 meters within the territory of China.
From boundary point number 7, the border follows the riverbank, heading Northeast to the point at an elevation of 143, then heading Northeast, crossing a ravine and entering a mountain ridge, heading North through points at elevations 604, 710, 573, 620, 833, 939, 1201 to the point at an elevation of 918, then following the watershed between branches of rivers within Vietnamese territory and branches of rivers within Chinese territory, heading generally Northeast through points at elevations 1158, 1077, 997, 1407, 1399, 1370, 1344, 1281, 1371, 1423, 1599, 1528, 1552, 1372, 1523, 1303 to the point at an elevation of 984, then following a small mountain ridge, heading generally South to boundary point number 8. This boundary point is located at the confluence of the Blue River (Qua Sach) with its western branch, approximately 3.85 km east from the point at an elevation of 1521 within Vietnamese territory, approximately 3.82 km south-southwest from the point at an elevation of 1346 within Chinese territory, approximately 2.27 km west-northwest from the point at an elevation of 1596 within Chinese territory.
From boundary point number 8, the border follows the Blue River (Qua Sach), heading generally South to its confluence with the Chay River, then upstream along the Chay River, heading generally Southeast, to boundary point number 9. This boundary point is located at the confluence of the Chay River with the Xiao Bai River, approximately 2.95 km east from the point at an elevation of 1424 within Vietnamese territory, approximately 2.00 km northeast from the point at an elevation of 1031 within Vietnamese territory, approximately 1.40 km south from the point at an elevation of 1076 within Chinese territory.
From boundary point number 9, the border leaves the river, enters a mountain ridge, and follows it, heading generally Southeast through the point at an elevation of 741 to the point at an elevation of 1326, then follows the watershed between branches of the Chay River flowing into Vietnamese territory and branches of the Xiao Bai River flowing into Chinese territory, heading generally Northeast through points at elevations 1681, 1541, 1716, 2002, 1964, unnamed peak (Da Nham Dong) to the point at an elevation of 1804, from there, following the red line on the map attached to the Treaty to the point at an elevation of 1623, then following the watershed between Nan Xin stream in Vietnamese territory and the Xiao Bai River in Chinese territory, heading Northeast through the point at an elevation of 1638 to the point at an elevation of 1661, then following a ravine, heading Northeast down between Hu Pa stream, then downstream along this stream to its confluence with another branch of it, then leaving the stream and entering a mountain ridge, then following it heading West-Northwest through the point at an elevation of 1259 to boundary point number 10. This boundary point is located on a mountain ridge, approximately 1.25 km north-northwest from the point at an elevation of 1461 within Vietnamese territory, approximately 0.90 km east from the point at an elevation of 1692 within Chinese territory, approximately 2.10 km south from the point at an elevation of 1393 within Chinese territory.
From boundary point number 10, the border follows the red line on the map attached to the Treaty to the point at an elevation of 948, then follows a mountain ridge, heading Northeast turning East through the point at an elevation of 1060 to boundary point number 11. This boundary point is located at the confluence of the Red Stream (Nam Bac) with its southwestern branch (Qua Gai), approximately 0.70 km northeast from the point at an elevation of 841 within Vietnamese territory, approximately 1.50 km southeast from the point at an elevation of 982 within Chinese territory, approximately 1.15 km south-southwest from the point at an elevation of 906 within Chinese territory.
From boundary point number 11, the border follows the Red Stream (Nam Bac) downstream to its confluence with Nam Cu stream (Nam Giang), then upstream along Nam Cu stream (Nam Giang) to boundary point number 12. This boundary point is located at the confluence of Nam Cu stream (Nam Giang) with its northwestern branch, approximately 2.80 km north-northwest from the point at an elevation of 1151 within Vietnamese territory, approximately 1.40 km southeast from the point at an elevation of 986 within Chinese territory, approximately 0.80 km west from the point at an elevation of 858 within Chinese territory.
From boundary point number 12, the border leaves the stream, enters a mountain ridge, and follows it, heading generally Southeast through the point at an elevation of 1071 to the point at an elevation of 1732, then follows the watershed between branches of rivers within Vietnamese territory and branches of rivers within Chinese territory, heading generally East turning North then Northeast through points at elevations 1729, 2071, 1655, 1705, 1423 to boundary point number 13..This boundary point is located on an unnamed hill, approximately 1.55 km west-northwest from the point at an elevation of 993 within Vietnamese territory, approximately 1.15 km north-northwest from the point at an elevation of 1044 within Vietnamese territory, approximately 0.70 km southeast from the point at an elevation of 1060 within Chinese territory.
From boundary point number 13, the border continues to follow the aforementioned watershed, heading East to the point 70 meters southwest from the point at an elevation of 1422, then following the red line on the map attached to the Treaty to a point lying on the watershed and 90 meters north-northeast from the point at an elevation of 1422 (area of 7700 square meters between the aforementioned red line and the watershed belonging to China), from here the border continues to follow the aforementioned watershed, heading generally East through points at elevations 1397, 1219, 657, 663 to an unnamed hill southeast of this elevation point, then following a ravine, heading North to Nà La stream, then downstream along this stream heading Northeast to boundary point number2 This boundary point is located at the confluence of Nà La stream with the Lo River (Pan Long), approximately 3.20 km west-northwest from the point at an elevation of 922 within Vietnamese territory, approximately 0.50 km north-northeast from the point at an elevation of 183 within Vietnamese territory, approximately 0.65 km east from the point at an elevation of 187 within Chinese territory. 14. From boundary point number 14, the border follows the red line on the map attached to the Treaty through the point at an elevation of 428 to the saddle between the point at an elevation of 1169 within Vietnamese territory and the point at an elevation of 1175 within Chinese territory, then follows a mountain ridge, heading generally North turning Northwest through points at elevations 1095, 1115, 1022, 1019, 1094, 1182, 1192, 1307, 1305, 1879 to the point at an elevation of 1397, then continuing to follow the mountain ridge, heading generally North through points at elevations 1497, 1806, 1825, 1952, 1967, 2122, 2038 to boundary point number 15.
From point number 14, the boundary line according to the red line on the map attached to the Treaty from the point at an elevation of 428 to the saddle between the point at an elevation of 1169 within the territory of Vietnam and the point at an elevation of 1175 within the territory of China, then following the mountain ridge generally in a northerly direction turning northwesterly, through points at elevations of 1095, 1115, 1022, 1019, 1094, 1182, 1192, 1307, 1305, 1879 to the point at an elevation of 1397, then continuing along the mountain ridge generally in a northerly direction, through points at elevations of 1497, 1806, 1825, 1952, 1967, 2122, 2038 to point number 15.
This point is located on an unnamed peak, approximately 2.90 km west-northwest from the point with an elevation of 1558 meters within the territory of Vietnam, about 1.55 km east from the point with an elevation of 2209 meters within the territory of China, and about 1.70 km south-southwest from the point with an elevation of 2289 meters within the territory of China.
From point number 15, the boundary follows the mountain ridge generally heading east, passing through the point with an elevation of 2076 meters, then crossing a stream to an unnamed peak, thereafter following the red line on the attached map of the Treaty, passing through points with elevations of 1887, 1672, and 1450 meters, then following the mountain ridge generally heading south-eastward and north-eastward, passing through points with elevations of 1438, 1334, 716, and 1077 meters to point number 16. Point number 16 is located at an elevation of 1592 meters, approximately 2.40 km north from the point with an elevation of 1079 meters within the territory of Vietnam, about 8.25 km southeast from the point with an elevation of 1026 meters within the territory of China, and about 1.05 km west-northwest from the point with an elevation of 1521 meters within the territory of China.
From point number 16, the boundary follows the mountain ridge generally heading southeast and then north, passing through points with elevations of 1578, 1503, 1493, 1359, 1342, and 1296 meters to the point with an elevation of 606 meters, then following a small mountain ridge generally heading north-northwest and then northeast to point number 17. Point number 17 is located between the Miện (Ba Bu) river, approximately 3.30 km northwest from the point with an elevation of 654 meters within the territory of Vietnam, about 4.10 km north-northwest from the point with an elevation of 1383 meters within the territory of Vietnam, and about 1.70 km south-southeast from the point with an elevation of 882 meters within the territory of China.
From point number 17, the boundary follows the red line on the attached map of the Treaty generally heading east-northeast to the point with an elevation of 799 meters, then following the mountain ridge generally heading northeast, passing through points with elevations of 998, 1096, 1029, 1092, and 1251 meters to the point with an elevation of 1132 meters, then following the red line on the attached map of the Treaty to the point with an elevation of 1628 meters, then following the mountain ridge generally heading southeast and then northeast, passing through points with elevations of 1647, 1596, 1687, 1799, 1761, and 1796 meters to point number 18. Point number 18 is located at an elevation of 1568 meters, approximately 0.90 km north from the point with an elevation of 1677 meters within the territory of Vietnam, about 0.70 km southeast from the point with an elevation of 1701 meters within the territory of China, and about 1.55 km southwest from the point with an elevation of 1666 meters within the territory of China.
From point number 18, the boundary follows the mountain ridge generally heading east-southeast and then northeast, passing through points with elevations of 1771, 1756, 1707, 1500, 1683, 1771, 1651, 1545, 1928, and 1718 meters to the point with an elevation of 1576 meters, then heading northwest over two gorges to the point with an elevation of 1397 meters, then continuing along the mountain ridge generally heading northwest and then northeast to the point with an elevation of 1743 meters, then continuing along the mountain ridge generally heading east and then northeast, passing through points with elevations of 1806, 1650, 1468, 1516, 1344, and 1408 meters to an unnamed peak northwest of this point, then following the mountain ridge generally heading northeast to point number 19. This boundary point is at the point with an elevation of 705, approximately 1.80 kilometers East of the point with an elevation of 863 within Vietnamese territory, approximately 1.00 kilometers North-Northeast of the point with an elevation of 861 within Vietnamese territory, approximately 2.20 kilometers West-Southwest of the point with an elevation of 913 within Chinese territory.
From boundary point number 56, the border follows the watershed between branches of rivers within Vietnamese territory and branches of rivers within Chinese territory, generally heading Northeast through points with elevations of 652, 975, 875, 835, 1150, 1082 to boundary point number 57. This boundary point is at the point with an elevation of 882, approximately 3.55 kilometers Northeast of the point with an elevation of 638 within Vietnamese territory, approximately 1.95 kilometers South-Southwest of the point with an elevation of 1265 within Chinese territory, approximately 2.20 kilometers West-Southwest of the point with an elevation of 1025 within Chinese territory.
From boundary point number 57, the border follows the ridge, heading Southwest to a point where it meets a ravine, then follows the ravine, heading South-Southeast, to the middle of the Suối Tài Vằn stream, then follows this stream and its lower reaches, which is the Suối Nà Sa, to boundary point number 58. This boundary point is at the confluence of the Suối Nà Sa with a branch of a river located to the East, approximately 0.95 km east from a point with an elevation of 423 meters within the territory of Vietnam, approximately 0.75 km south from a point with an elevation of 447 meters within the territory of Vietnam, and approximately 2.45 km west from a point with an elevation of 320 meters within the territory of China.
From boundary point number 58, the border runs upstream along the eastern branch of the aforementioned river to the confluence of the Sông Đồng Mô, then follows the Sông Đồng Mô, Bỉ Lao, and Cao Lạn rivers upstream to boundary point number 59. This boundary point is at the confluence of the two streams Cao Lạn and Phai Lầu, approximately 2.10 km north from a point with an elevation of 1052 meters within the territory of Vietnam, approximately 0.57 km east from a point with an elevation of 600 meters within the territory of Vietnam, and approximately 1.00 km west from a point with an elevation of 602 meters within the territory of China.
At an elevation of 1052 meters within the territory of Vietnam, approximately 2.10 km north, approximately 0.57 km east from a point with an elevation of 600 meters within the territory of Vietnam, and approximately 1.00 km west from a point with an elevation of 602 meters within the territory of China.
From boundary point number 59, the border runs upstream along the Cao Lạn stream in a Southeast direction, then follows a straight line heading East-East-Southeast to an unnamed hill north of a point with an elevation of 960 meters within the territory of Vietnam, then follows the red line on the attached map to boundary point number 60. This boundary point is at an elevation of 1100 meters, approximately 2.10 km north-northwest from a point with an elevation of 1156 meters within the territory of Vietnam, approximately 2.65 km southwest from a point with an elevation of 683 meters within the territory of China, and approximately 0.95 km south-southwest from a point with an elevation of 1094 meters within the territory of China.
From boundary point number 60, the border follows a small ridge in an Northeast direction, then descends into a ravine, following the ravine generally in a Northeast direction turning East-Northeast, to a branch of the upper reaches of the Sông Ka Long, then follows this river downstream in an East-Northeast direction to boundary point number 61. This boundary point is at the confluence of the Sông Ka Long with another river (Bắc Luân), approximately 2.20 km northeast from a point with an elevation of 561 meters within the territory of Vietnam, approximately 0.95 km northwest from a point with an elevation of 117 meters within the territory of Vietnam, and approximately 1.60 km south-southwest from a point with an elevation of 224 meters within the territory of China.
From boundary point number 61, the border follows the mid-channel of the main navigation channel of the Sông Ka Long and Bắc Luân rivers to their end, connecting to boundary point number 62. This boundary point is the final point of the baseline used to determine the width of the territorial sea of both Vietnam and China.
The sandbanks and shoals lying on both sides of the red line of the sections of the border along the rivers and streams on the attached map are attributed according to the red line.
The land border between the two countries described herein is depicted by a red line on the map at a scale of 1/50,000 jointly determined by both parties, the length and area used in describing the border are measured from this map. The set of maps attached to this Agreement is an integral part that cannot be separated from the Agreement.
Article III.The two Parties agree that the exact location of the meeting point of the border between the three countries of the Socialist Republic of Vietnam, the People's Republic of China, and the Lao People's Democratic Republic will be determined through mutual agreement among the three countries.
Article IV. The plane standing along the land border between Vietnam and China mentioned in Article II of this Treaty shall delimit the airspace and underground space between the two countries.
Article V.The contracting Parties agree that, except where clearly provided for in this Treaty, the Vietnam-China border mentioned in Article II, for sections where rivers or streams form the boundary, shall follow the median line of the flow or main current where boats cannot navigate, and the median line of the main navigable channel where boats can navigate. The exact position of the median line of the flow, main current, or median line of the main navigable channel, and the attribution of sandbanks and shoals on the border rivers or streams shall be specifically determined by the contracting Parties when demarcating and setting up boundary markers.
The primary standard for determining the main current is the flow rate at the average water level.
The primary standard for determining the main navigable channel is the depth of the main navigable channel combined with its width and radius of curvature. The median line of the main navigable channel is the median line of the water surface between the corresponding equal-depth contour lines marking the main navigable channel.
Any changes that may occur to the border rivers or streams shall not alter the direction of the border line, nor affect the position of the Vietnam-China border line already established on the ground or the attribution of sandbanks and shoals, unless the contracting Parties reach a different agreement. New sandbanks and shoals appearing on the border rivers or streams after the border line has been established on the ground shall be delimited according to the already established border line. If new sandbanks and shoals appear on the border line already established on the ground, the contracting Parties will negotiate to determine their attribution based on fairness and reasonableness.
Article VI.
1. The contracting Parties decide to establish a Joint Commission for Delimitation and Setting Up Boundary Markers on the Land Border between Vietnam and China (hereinafter referred to as the Joint Commission for Delimitation and Setting Up Boundary Markers) and assign it the task of establishing on the ground the Vietnam-China border line as stated in Article II of this Treaty, carrying out delimitation and setting up boundary markers, specifically determining the exact positions of the mountain ridge line, watershed line, median line of the flow or main current, median line of the main navigable channel, and other sections of the border line, clarifying the attribution of sandbanks and shoals on the border rivers or streams, jointly setting up boundary markers, drafting a Memorandum of Understanding on the land border between the two countries including detailed records of the positions of boundary markers, attaching detailed maps showing the direction of the border line and the positions of boundary markers along the entire route, as well as resolving specific issues related to completing these tasks.
2. Immediately upon entry into force, the Memorandum of Understanding on the land border between the two countries mentioned in Clause 1 of this Article shall become part of this Treaty, and the detailed map attached to this Memorandum of Understanding shall replace the detailed map attached to this Treaty.
3. The Joint Commission for Delimitation and Setting Up Boundary Markers shall commence work immediately upon the entry into force of this Treaty and cease operations after signing the Memorandum of Understanding and the detailed map regarding the land border between the two countries.
Article VII.After the Protocol on the land border between the two countries and the attached detailed map come into effect, the two Contracting Parties shall conclude a Treaty or Agreement on the management regime of the border between the two countries to replace the Temporary Agreement on the settlement of matters in the border area between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 7, 1991.
Article VIII.This Treaty shall be ratified by the three Contracting Parties and shall enter into force from the date of exchange of the instruments of ratification. The instruments of ratification will be exchanged in Beijing.
This Treaty was signed in Hanoi, December 30, 1999, in two originals, each original in Vietnamese and Chinese, both texts being equally authentic./.
