JOINT CIRCULAR

GUIDELINES FOR IMPLEMENTING THE ALLOWANCE SYSTEM FOR SERVICE

Implementing Decision No. 144/2000/QĐ-TTg dated December 14, 2000 of the Prime Minister on the allowance system for service, following the opinions expressed in Circular No. 3040-CV/TCTW dated March 6, 2001 and Circular No. 3254-CV/TCTW dated April 18, 2001 of the Central Organization Board, the Ministry of Finance and the Government Organization-Civil Servants Board jointly issue these guidelines for implementation as follows:

1. APPLICABLE SUBJECTS AND AMOUNT OF SERVICE ALLOWANCE

a/ Subjects entitled to a monthly service allowance of VND 300,000.

- Members of the Standing Committee of the National Assembly; Chairman of the National Assembly's Ethnic Council; Chairmen of the National Assembly's Committees; Chairmen of the National Assembly's Office; Chairmen of the President's Office.

- Heads of Party bodies at the central level; Secretaries of the Central Party Office; Directors of the Ho Chi Minh National Academy of Political Studies.

- Ministers, heads of agencies equivalent to ministries; Directors of the National Center for Natural Sciences and Technology; Directors of the National Center for Social Sciences and Humanities.

- General Secretary of the Vietnam Fatherland Front Central Committee; Chairman of the Vietnam General Confederation of Labor; Chairman of the Vietnam Women's Union; Chairman of the Vietnam Farmers' Association; Chairman of the Vietnam Veterans' Association; First Secretary of the Communist Youth Central Committee.

- Editor-in-Chief of the People's Army Newspaper; Editor-in-Chief of the Communist Review.

- Secretaries of provincial and municipal party committees directly under the central government; Chairmen of the People's Councils, Chairmen of the People's Committees of Hanoi and Ho Chi Minh City.

- Acting Ministers, Acting Heads of Party bodies, Acting Heads of mass organizations at the central level, Acting Secretaries of provincial and municipal party committees directly under the central government who have been assigned salaries equivalent to those of Ministers, Heads of Party bodies, or Secretaries of provincial and municipal party committees.

- Deputy Vice-Presidents or Deputy First Vice-Presidents currently receiving salary coefficients equivalent to those of Ministers or Heads of Party bodies at the central level where the head is a member of the Politburo.

- Deputy Heads of Party bodies at the central level who were previously Ministers, Heads of Party bodies, Secretaries of provincial and municipal party committees directly under the central government, Chairmen of the People's Councils, Chairmen of the People's Committees of Hanoi and Ho Chi Minh City, currently receiving salary coefficients equivalent to those of Ministers or Heads of Party bodies.

- Senior experts of Class 3 currently receiving a salary coefficient of 8.5.

b/ Subjects entitled to a monthly service allowance of VND 150,000.

- Deputy Heads of Party bodies at the central level; Deputy Secretaries of the Central Party Office; Deputy Chairmen of the Central Inspection Committee, members of the Central Inspection Committee; Deputy Directors of the Ho Chi Minh National Academy of Political Studies; Deputy Editors-in-Chief of the People's Army Newspaper; Deputy Editors-in-Chief of the Communist Review; Directors of the State Political Publishing House, Secretaries of the Central Party Committee of State Agencies.

- Deputy Chairmen of the National Assembly's Ethnic Council; Deputy Chairmen of the National Assembly's Committees; Deputy Chairmen of the President's Office; Deputy Chairmen of the National Assembly's Office; Deputy Chief Justices of the Supreme People's Court, Deputy Procurators-General of the Supreme People's Procuracy.

- Deputy Ministers and deputy heads of agencies equivalent to ministries; Heads of government agencies.

- Members of the Executive Board, members of the Standing Committee of the Vietnam Fatherland Front Central Committee, Deputy Chairmen of mass political-social organizations at the central level (Vietnam General Confederation of Labor, Vietnam Women's Union, Vietnam Farmers' Association, Vietnam Veterans' Association), Deputy Secretaries of the Communist Youth Central Committee.

- Deputy Secretaries of provincial and municipal party committees directly under the central government; Chairmen of the People's Councils, Chairmen of the People's Committees of provinces and cities directly under the central government.

- Senior experts of Class 1 and 2 currently receiving salary coefficients of 7.5 and 8.0.

2. REGIME FOR PRESERVATION OF SERVICE ALLOWANCE

a/ In cases where civil servants and public officials belonging to the category entitled to service allowances are transferred from positions with higher service allowances to positions with lower service allowances, the preservation regime shall be implemented as follows:

- Preservation of service allowance for six months for those receiving election-based position salaries, in accordance with the guidance on preserving salaries provided in Joint Circular No. 10/LB-TT dated June 2, 1993 issued by the Ministry of Labor, Invalids and Social Affairs, the Government Organization-Civil Servants Board, and the Ministry of Finance regarding temporary regulations on new salary systems for administrative and public service officials and staff.

- Preservation of service allowance for three months for those receiving professional and technical salaries and leadership position allowances appointed according to the guidance provided in Joint Circular No. 11/LB-TT dated June 2, 1993 issued by the Ministry of Labor, Invalids and Social Affairs, the Government Organization-Civil Servants Board, and the Ministry of Finance regarding the implementation of leadership position allowances appointed in the administrative and public service sectors.

b/ In cases where organizational restructuring leads to changes in service allowance levels, the service allowance will be preserved for twelve months, equivalent to the period for preserving position allowances according to the spirit of Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government on streamlining personnel in administrative agencies and public service units.

After the preservation period, the person transferred or reassigned will enjoy the service allowance corresponding to their new position.

3. IMPLEMENTATION ORGANIZATION AND FUNDS

- Based on the guidelines in point 1 above, management agencies responsible for subjects entitled to service allowances must determine specific service allowance amounts for each subject to implement this system. For cases involving multiple concurrent positions, the highest position will be considered for determining the service allowance amount.

- The funds for implementing the service allowance system will be allocated within the annual state budget estimates of agencies authorized by competent authorities. For the year 2001, the funds for paying the service allowance will be arranged within the state budget estimates already allocated to the agencies for implementation.

This circular takes effect from January 1, 2001 and replaces previous guiding documents on service allowances.

During the implementation process, if there are difficulties or obstacles, please report them to the relevant ministries, sectors, and localities for study and resolution.
