PART I
GENERAL PROVISIONS
Article 1. Scope and Objectives
1. THIS CIRCULAR REGULATES THE PROCEDURES AND FORMALITIES FOR DEVELOPING, REVIEWING, APPROVING PLANS; IMPLEMENTING PLANS; TEMPORARY ADVANCE PAYMENTS, SETTLEMENT, FINAL ACCOUNTING OF NATIONAL HANDICRAFT PROMOTION FUNDS.
2. THIS CIRCULAR APPLIES TO ORGANIZATIONS AND INDIVIDUALS INVOLVED IN THE IMPLEMENTATION, BENEFICIARIES AND MANAGEMENT OF NATIONAL HANDICRAFT PROMOTION PROGRAMS, PLANS AND PROJECTS AS PROVIDED FOR IN DECREE NO. 45/2012/NĐ-CP.
In this Circular, the following terms are understood as follows:
1. THE PROJECT IMPLEMENTING UNIT IS THE ORGANIZATION OR INDIVIDUAL THAT PREPARES THE NATIONAL HANDICRAFT PROMOTION PROJECT AND IMPLEMENTS IT AFTER APPROVAL.
4. Certified copy IS DOCUMENTS THAT HAVE BEEN CERTIFIED OR DUPLICATED FROM THE ORIGINAL BY AN AUTHORIZED AGENCY OR ORGANIZATION.
1. PROJECTS AND TASKS IMPLEMENTED UNDER THE BIDDING LAW (IF MEETING THE CONDITIONS AS PROVIDED) INCLUDE: ORGANIZING DOMESTIC AND INTERNATIONAL FAIRS AND EXHIBITIONS; SUPPORTING PARTICIPATION IN DOMESTIC AND INTERNATIONAL FAIRS AND EXHIBITIONS (USING NATIONAL HANDICRAFT PROMOTION FUNDS TO SUPPORT ONE FAIR OR EXHIBITION); SUPPORTING INFRASTRUCTURE INVESTMENT IN INDUSTRIAL CLUSTERS AND ENVIRONMENTAL POLLUTION TREATMENT SYSTEMS IN INDUSTRIAL CLUSTERS; COMMUNICATION PROJECTS.
2. OTHER THAN THE NATIONAL HANDICRAFT PROMOTION PROJECTS AND TASKS PROVIDED FOR IN SUB-CLAUSE 1 OF THIS ARTICLE, OTHER NATIONAL HANDICRAFT PROMOTION PROJECTS AND TASKS ARE IMPLEMENTED THROUGH SELECTION. EXCEPT IN CASES WHERE THE DIRECTOR OF THE LOCAL INDUSTRY DEPARTMENT DECIDES, BASED ON THE SCALE, NATURE, AND AMOUNT OF NATIONAL HANDICRAFT PROMOTION FUNDS SUPPORTED, THAT PROJECTS AND TASKS MUST BE IMPLEMENTED THROUGH BIDDING TO ENSURE THE MOST EFFECTIVE USE OF NATIONAL HANDICRAFT PROMOTION FUNDS.
Chapter II
PROCEDURE FOR DEVELOPMENT, REVIEW AND APPROVAL
OF NATIONAL HANDICRAFT PROMOTION PLANS
ARTICLE 4. PRINCIPLES FOR PREPARING NATIONAL HANDICRAFT PROMOTION PROJECTS
3. CONSISTENT WITH THE NATIONAL HANDICRAFT PROMOTION PROGRAM FOR EACH STAGE ISSUED BY
4. CONSISTENT WITH GUIDELINES AND LEGAL DOCUMENTS RELATED TO HANDICRAFT PROMOTION ACTIVITIES.
Article 5. Basic contents of the national craft promotion program
The national craft promotion program includes the following main contents:
1. Implementing unit, coordinating units, beneficiary units, location of implementation.
2. Necessity and basis for the program.
3. Objectives: Specify the specific objectives that the program aims to achieve.
4. Scale of the program: Describe the scale of the program; summarize the outstanding features of the main content of the program such as technology, machinery, products, or other proposed support content.
5. Content and schedule: Clearly define the work content to be implemented and the implementation schedule; organize and individuals to carry out according to the work content.
6. The budget estimate is detailed according to Model No. 1 of Appendix 1 of this Circular.
7. Implementation organization: Clearly state the implementation plan for the program.
8. Effectiveness of the program: Clearly state the economic, social, and environmental benefits, sustainability, and replicability (if applicable) of the program after the end of the support period.
Article 6. Procedure for building the national craft promotion plan
a) Results of the previous year's craft promotion activities; Evaluation of the implementation status of the current year's craft promotion plan; Objectives and directions for the next year's craft promotion activities.
b) A summary table of national craft promotion programs according to Model No. 2 of Appendix 1 of this Circular, accompanied by the files of national craft promotion programs.
1. When allocating the annual national craft promotion plan: prioritize national craft promotion projects at key points; consider priority by industry and area as prescribed in Article 6 of Circular No. 46/2012/TT-BCT dated December 28, 2012 of the Ministry of Industry and Trade detailing certain provisions of Decree No. 45/2012/NĐ-CP and the preferential financial support level as prescribed in Appendix 3 of this Circular.
2. In cases where national craft promotion projects are implemented in areas with similar conditions and industries, priority will be given to projects of units with more experience and better organizational implementation capabilities.
Article 8. Procedure for reviewing and approving the national promotion of industry plan
a) For national industrial promotion projects registered by the Department of Industry and Trade and projects implemented by other units at the scale of one province/city under the central government:
b) For projects and tasks carried out by the National Industrial Promotion Centers in regions and projects implemented by other units at the scale of multiple provinces/cities under the central government: The project dossier shall be directly submitted to the Local Industry Department for review.
- Provincial-level Industrial Promotion Centers and units implementing projects on local territory shall prepare the national industrial promotion project dossier in accordance with Point a Clause 1 Article 10 of this Circular and submit it to the Department of Industry and Trade for local-level review;
- The Director of the Department of Industry and Trade shall organize the local-level review of national industrial promotion projects. The review work shall be conducted by a Review Board or the support staff of the Director of the Department of Industry and Trade. In case a Review Board is established, its members shall be selected and decided upon by the Director of the Department of Industry and Trade. After the review, the national industrial promotion projects shall be compiled according to Model No. 2 of Appendix 1 of this Circular. The project dossier shall be sent to the Local Industry Department for review; simultaneously, it shall be sent to the People's Committee of the province for reporting.
The Director of the Local Industry Department shall organize the ministry-level review of national industrial promotion projects and tasks. The review work shall be conducted by a Review Board or the support staff of the Director of the Local Industry Department. In case a Review Board is established, its members shall be selected and decided upon by the Director of the Local Industry Department. After the review, the national industrial promotion projects and tasks shall be compiled into the national industrial promotion plan.
After the ministry-level review, the Local Industry Department shall complete the dossier to submit to the Minister of Industry and Trade for approval of the national industrial promotion plan. The dossier submitted to the Minister includes:
- A request from the Local Industry Department to the Minister of Industry and Trade for approval of the national industrial promotion plan; Minutes of the ministry-level review (in case a Review Board is established);
- A draft decision of the Minister of Industry and Trade to approve the national industrial promotion plan, accompanied by a detailed summary table of national industrial promotion projects and tasks.
Article 9. Content of review
1. The degree of conformity of the project with the principles stipulated in Article 4 of this Circular.
2. Objectives, necessity, and effectiveness of the project; rationality in the use of funds, resources, and other facilities and equipment.
3. Capacity of the implementing unit, cooperating unit, and beneficiary unit.
4. Ability to integrate with other target programs and projects.
5. Completeness and adequacy of the project dossier and documents.
Article 10. Dossier and time limit for registering the national industrial promotion plan for review at the local level
a) Units shall submit three copies of the national industrial promotion project dossier to the Department of Industry and Trade for local-level review, including:
b) The deadline for submitting the national industrial promotion plan dossier by units registering with the Department of Industry and Trade is before May 20 each year (for other cases, follow the guidance of the Department of Industry and Trade).
- A letter requesting the implementation of the project;
- An industrial promotion project prepared in accordance with Article 5 of this Circular. For industrial promotion projects where the implementing unit is not simultaneously the beneficiary unit, a request for support from the beneficiary unit must be included;
- Certain types of national industrial promotion projects must include additional documents as specified in Appendix 2 of this Circular. For projects established in groups (without requiring specific locations, beneficiary units, or cooperating units when approving the national industrial promotion plan), during the review and approval process of the implementation plan, the Department of Industry and Trade will specify additional related documents as needed for the review work.
a) Departments of Industry and Trade, National Industrial Promotion Centers in regions, and units shall submit one set of project dossier and documents to the Local Industry Department, including:
b) The deadline for submitting the registration dossier for the national industrial promotion plan by the Departments of Industry and Trade, National Industrial Promotion Centers in regions, and units to the Local Industry Department is before June 15 each year (for other cases, follow the guidance of the Local Industry Department).
- A report on registering the national industrial promotion project as stipulated in Clause 1, Article 6 of this Circular;
- A local-level review form for projects and tasks registered by the Department of Industry and Trade or a local-level review form of the Department of Industry and Trade where the project is implemented for projects carried out by other units (not being National Industrial Promotion Centers in regions) at the scale of one province or city under the central government. The local-level review form shall be prepared according to Model No. 4a or Model No. 4b of Appendix 1 of this Circular;
- Certain types of national industrial promotion projects must include additional documents as specified in Appendix 2 of this Circular.
Article 11. Adjustment, supplementation, and cessation of implementation of the project
2. Based on the requests for adjustment, supplementation, or cessation of project implementation submitted by the implementing units, the Local Industry Bureau will consider and approve or report to the Minister of Industry and Trade for approval, specifically as follows:
a) The Local Industry Bureau reports to the Ministry of Industry and Trade for approval regarding requests for adjustment: increasing the total amount of financial support; changing the content of industrial promotion activities; extending the implementation period of the project to the following year; requesting supplementation or cessation of implementation of the national industrial promotion project.
b) The Local Industry Bureau approves requests for adjustment: changing the location, beneficiary unit, cooperating unit, time (within the fiscal year) of project implementation; adjustments that do not change or reduce the total amount of financial support from the national industrial promotion budget and other adjustments (except those specified in Clause 4 of this Article). Adjustments within the authority of the Local Industry Bureau are implemented through forms such as issuing a decision to adjust the assignment of tasks or adjusting the contents of the terms in the contract for implementing the national industrial promotion project.
Chapter III
ADVANCE PAYMENT, CONTRACT SETTLEMENT, AND FINANCIAL SETTLEMENT FOR NATIONAL INDUSTRIAL PROMOTION
AND DOCUMENTATION FOR EXPENSES IN RELATION TO CERTAININDUSTRIAL PROMOTION ACTIVITIES
CONTENT OF HANDICRAFT PROMOTION ACTIVITIES
Article 12. Principles of advance payment, contract settlement, and financial settlement
2. Advance payment, payment, and financial settlement must be based on the contract for implementing the industrial promotion project (hereinafter referred to as the project implementation contract), consistent with the progress of the project implementation, ensuring the provisions of the law on state budget management and the provisions of this Circular.
3. The purchase and sale of goods and services for contracts serving industrial promotion activities, the implementing unit must comply with the Law on Bidding and related legal provisions.
4. All economic transactions arising from the use of funds must have legal documentation as prescribed, adhering to the current financial system and the provisions of this Circular.
7. The implementing unit may receive advance payments according to the ratio and documents stipulated in Articles 13, 14, 15, and 16 of this Circular.
Article 13. Advance payment of project funding for the first time
1. Advance payment of 30% of the project support funding
a) For projects supporting: Construction of industrial zone infrastructure; construction of environmental pollution treatment systems at industrial zones.
b) Application documents for advance payment: Project implementation contract; support contract between the project implementing unit and the investor; contract between the investor and the contractor (in cases where the investor outsources); progress report from the project implementing unit confirming that more than 50% of the work volume of the supported item has been completed.
2. Advance payment of 70% of the project support funding
a) For projects organizing vocational training and skill transmission: Application documents for advance payment: Project implementation contract; vocational training and skill transmission plan of the implementing unit according to Model No. 11 in Appendix 1 of this Circular.
b) For projects supporting activities: Consulting, training, seminars, workshops, forums; site visits; brand registration; establishment of associations and industry unions; building industrial clusters; cleaner production assessment. Application documents for advance payment: Project implementation contract; implementation plan of the implementing unit (for training, seminars, workshops, site visits; brand registration).
c) For projects supporting: Trade fairs and exhibitions; participation in domestic trade fairs and exhibitions; television and radio programs; data and website development; brochures and other public information forms; detailed planning of industrial zones. Application documents for advance payment: Project implementation contract; support contract between the implementing unit and the investor (for detailed planning projects of industrial zones).
d) For projects supporting: Technical demonstration model construction; application of machinery and advanced technology transfer; construction of environmental pollution treatment systems at rural industrial facilities. Application documents for advance payment: Project implementation contract; progress report from the implementing unit confirming that the value of the work volume completed corresponds to over 70% of the total investment capital of the project.
a) For projects supporting the establishment of rural industrial production enterprises.
b) Application documents for advance payment: Project implementation contract; acceptance certificate according to Model No. 5b in Appendix 1 of this Circular; report on completed volume and contract implementation costs according to Model No. 3b in Appendix 1 of this Circular; valid copy of business registration certificate issued by the competent authority.
The remaining project implementation funding can be advanced after the project has been completed and accepted. To receive the advance payment of the remaining funding, the project implementing unit must submit to the Local Industry Department: Acceptance certificate according to Model No. 5a, 5b, or 5c in Appendix 1 of this Circular; summary report on project implementation results; report on completed volume and contract implementation costs (according to Model No. 3b in Appendix 1 of this Circular) and original or valid copies of the following documents:
1. For projects organizing vocational training and skill transmission, the application documents include: Decision on issuance of certificates or certifications; list of trainees receiving certificates or certifications (signed by the trainees); list of workers employed after training (confirmed by the rural industrial facility employing the workers and the project implementing unit); payment invoices or lists of trainee meal allowances and travel expenses (if applicable).
2. For projects supporting activities: Consulting, training, seminars, workshops, forums:
a) For consulting support projects: Contract; acceptance and settlement record of the consulting service contract with attached products or results of the consulting activity; payment voucher listing corresponding to 100% of the implemented funding.
b) For training projects: List of trainees receiving certification (signed by the trainees); training materials; payment invoices or lists of trainee meal allowances (if applicable).
c) For seminar, workshop, forum projects: List of attendees (signed by the attendees); materials; payment invoices or lists of attendee meal allowances, accommodation fees, and travel expenses (if not covered by government budget).
3. For technical demonstration model construction support projects: Payment invoices for supported items; list of attendees at the technical demonstration seminar (signed by the attendees) confirmed by the implementing unit and beneficiary; introduction materials; payment invoices or lists of attendee meal allowances, accommodation fees, and travel expenses (if not covered by government budget).
4. For advanced technology transfer support projects: Contract; acceptance and settlement record of the technology transfer contract.
5. For advanced machinery application support projects: Contract; acceptance and settlement record of the machinery purchase contract.
6. For cleaner production assessment support projects for industrial facilities: Cleaner production assessment report approved by the competent authority and related documents.
7. For brand registration and development support projects: Certificate of brand or trademark registration; rules for using the trademark (for collective trademarks); strategy or plan for brand development and promotion; payment voucher listing corresponding to 100% of the implemented funding.
8. For projects developing television and radio programs; data and website development; brochures and other public information forms: Contractor or service provider contract; acceptance and settlement record; list of products with samples (if applicable); operating license (for websites).
9. For projects supporting rural industrial facilities in establishing associations and industry unions: Establishment decision and operational regulations of the association or union approved by the competent authority; member list; payment voucher listing corresponding to 100% of the implemented funding.
10. Exhibition plan for industrial rural products and handicrafts: List of Commerce Departments, rural industrial bases, service organizations promoting industry participating in the exhibition, with confirmation from the organizing Commerce Department (original copy); lease contract between the supported entity and the event organizer for booth rental (which must clearly state the booth location, number of booths, booth rental price, and the level of national promotion support).
11. Plan to support participation in domestic exhibitions: List of rural industrial bases supported with national promotion funds to participate in exhibitions, confirmed by the organizing Commerce Department or by the Commerce Department where the rural industrial base is located if the exhibition is not organized by the Commerce Department (original copy); lease contract between the rural industrial base and the event organizer for booth rental (which must clearly state the booth location, number of booths, booth rental price, and the level of national promotion fund support); financial invoice from the event organizer collecting booth rental fees from the rural industrial base.
12. Plan to support the establishment of business clusters in industries: Decision approving the business cluster by the competent authority; payment voucher list accompanied by corresponding expenditure vouchers for 100% of the actual implementation costs.
14. Plan to support infrastructure investment in industrial clusters; support for building environmental pollution treatment systems in industrial clusters and at rural industrial bases: Completion acceptance record for project components or works (supported) put into operation by the investor, along with a table determining the value of completed work volumes; document confirming that the environmental pollution treatment system's output results meet the prescribed standards (for support in building environmental pollution treatment systems).
In cases where the infrastructure investor for an industrial cluster or the investor for an environmental pollution treatment system in an industrial cluster is a business enterprise: Add an audit report on the settlement of project components or works supported by an independent auditing unit.
15. Plan to organize contests and promotional campaigns: Decision establishing the Organizing Committee and the Judging Panel; decision with a list of award winners.
1. Interest rate subsidy for loans for rural industrial bases causing environmental pollution relocating to industrial zones or clusters: Project implementation contract; completion acceptance record of the facility according to Model No. 5a of Appendix 1 of this Circular; report on completed volume and implementation cost of the contract according to Model No. 3b of this Circular; certified copy of the credit agreement with the bank regarding investment in basic construction and purchase of machinery and equipment by the rural industrial base; proof of interest payment to the bank for the first two years as the basis for advance payment; certified copy of the contract and contract termination with the contractor for construction and purchase of machinery and equipment for the rural industrial base.
a) First advance payment: According to the ratio and advance payment procedures stipulated in Clause 1 and Clause 2 of Article 13 of this Circular, corresponding to each type of project.
b) Subsequent advance payments: Advance payments made according to the progress of implementation, approved budget estimates, and provisions in the project implementation contract.
c) Final advance payment: Documentation as specified in Article 14 of this Circular, corresponding to each type of project.
Article 16. Alteration of Proportions, Advance Payment Files, and Other Programs and Tasks
Article 17. Payment Vouchers
Payment vouchers include all payment documents such as payment orders, mandate payments, or requests for advance payment, along with original documents for each expenditure item as prescribed by current regulations. Appendix 4 of this Circular specifies the original documents for certain activities promoting industry.
Article 18. Contract Liquidation and Final Settlement
1. The unit implementing the program must complete the final settlement file within fifteen days from the date of the final program's acceptance inspection under the contract.
Article 19. Final Settlement File
a) The basic acceptance record according to Model No. 5a in Appendix 1 of this Circular.
b) The request form for program implementation expenses according to Model No. 9 in Appendix 1 of this Circular (if applicable).
c) The detailed final settlement expense form according to Model No. 7 in Appendix 1 of this Circular.
d) The list of vouchers requesting final settlement according to Model No. 8a in Appendix 1 of this Circular, accompanied by payment vouchers for each program as stipulated in Appendix 4 and all documents as stipulated in Articles 13, 14, 15, and 16 of this Circular. For programs supported by state funds at a percentage of total implementation expenses, the implementing unit must prepare a list of vouchers requesting final settlement, including the portion from other sources (according to Model No. 8b in Appendix 1 of this Circular), accompanied by all payment vouchers.
a) The basic acceptance record (according to Model No. 5b or 5c in Appendix 1 of this Circular).
b) Financial invoices.
c) All files, documents, and vouchers as stipulated in Articles 13, 14, 15, and 16 of this Circular.
3. When liquidating the final contract of the year, the program implementation unit must prepare the Expense Comparison Table according to Model No. 10 in Appendix 1 of this Circular.
Chapter IV
IMPLEMENTATION
1. Guide organizations and individuals in preparing proposals, budgets, and annual national promotion of industry plans. Organize and guide the implementation of approved national promotion of industry plans, advance payments, settlement, and final accounting of national promotion of industry funds.
3. Take the lead and coordinate with relevant agencies and units, provincial Departments of Industry and Trade under the central government to organize inspections and evaluations of the implementation of national promotion of industry proposals and tasks, and the management and use of national promotion of industry funds.
1. Guide organizations and individuals in building plans and implementing national promotion of industry proposals at the local level upon approval. Be responsible for organizing acceptance at the grassroots level and supervising the use of national promotion of industry funds within the jurisdiction to ensure compliance with the intended recipients, purposes, and current regulations.
2. For proposals and tasks registered in the plan by the Department of Industry and Trade or those implemented by other units within its jurisdiction:
a) For proposals established in groups, the Department of Industry and Trade checks and reviews the files to ensure compliance with the intended recipients and regulations, and approves the implementation plans. Documents such as business registration certificates, balance sheets, and related materials are kept at the Department of Industry and Trade.
b) The Department of Industry and Trade is responsible for checking and reviewing the files, reasons for adjustments, supplements, suspensions, and actual conditions at industrial facilities before deciding on adjustments or recommending the Local Industry Department to adjust, supplement, or suspend the proposal (if applicable).
c) For certain promotional activities that must be conducted through bidding: After receiving the decision to assign the national promotion of industry plan from the Minister of Industry and Trade, the Department of Industry and Trade collaborates with relevant units to submit to the competent authority to organize bidding in accordance with regulations and send the Decision approving the bidding results to the Local Industry Department as the basis for signing the national promotion of industry contract.
4. The Department of Industry and Trade verifies the volume of work and expenses in progress reports to request advance payments and settlement documentation for the national promotion of industry contract expenses according to regulations.
6. The Department of Industry and Trade continuously monitors, inspects, supervises, and resolves issues related to the implementation of national promotion of industry proposals and tasks within its jurisdiction.
Article 22. Responsibilities of the National Handicraft Promotion Center in regions
1. Prepare project files, tasks, and detailed budget estimates for implementation in accordance with regulations. Coordinate with the Department of Industry and Trade and related units to organize the implementation and acceptance of assigned projects in accordance with regulations on handicraft promotion work and their assigned functions, tasks, and authorities.
3. Be responsible for retaining project files, documents, and accounting vouchers regarding national handicraft promotion projects in accordance with the law. Ensure and bear responsibility for the accuracy, truthfulness, and completeness of information in the files, documents, and texts during the preparation of project files and the organization of project implementation.
Article 23. Responsibilities of implementing units
1. Prepare project files and detailed budget estimates for project implementation in accordance with regulations. Ensure and bear legal responsibility for the accuracy, truthfulness, and completeness of information in the files and documents provided to management agencies in the planning, organizing implementation, and settlement of national handicraft promotion projects; various types of reports and related documents during the process of national handicraft promotion activities.
2. Organize the implementation of national handicraft promotion projects according to approved contents, contract terms, and current regulations. Implement advance payments and settlements in accordance with this Circular; use funds in accordance with the budget, ensuring efficiency and compliance with current regulations.
3. Responsibility for compiling reports
a) Implementing units must compile monthly progress reports on handicraft promotion projects according to prescribed forms (Model No. 3b of Appendix 1 of this Circular) to be submitted to the Local Industry Bureau and the Department of Industry and Trade before the 25th of each month. For progress reports related to requests for advance payments of promotion funds, they must have verification and confirmation from the Department of Industry and Trade where the project is being implemented.
b) Upon completion of project implementation, the assigned implementing unit must compile a comprehensive report on project results, volume of completed work, and contract implementation costs (with supporting documents when settling and finalizing the contract).
c) Compile ad hoc reports and reports serving inspections and audits as required by relevant state management agencies.
5. Coordinate with the Local Industry Bureau and the Department of Industry and Trade to organize the acceptance of handicraft promotion projects in accordance with regulations.
Article 24. Effective Date
1. This Circular takes effect from February 10, 2014, and replaces Decisions: Decision No. 08/2008/QĐ-BCT dated May 12, 2008, issued by the Minister of Industry and Trade on the issuance of regulations on the construction, organization of implementation, and management of national handicraft promotion programs, plans, and projects; Decision No. 17/2008/QĐ-BCT dated July 7, 2008, issued by the Minister of Industry and Trade on the issuance of regulations on the compilation of training materials funded by handicraft promotion funds; Decision No. 5918/QĐ-BCT dated November 24, 2009, issued by the Minister of Industry and Trade on the issuance of regulations on advance payments, contract liquidation, settlement of national handicraft promotion funds, and payment vouchers for certain activities under the Handicraft Promotion Program.
2. During implementation, if there are any difficulties, agencies and units are requested to reflect them to the Ministry of Industry and Trade for consideration and decision on amendments and supplements in accordance with regulations./.
