Regulations on training, issuing, and revoking certificates of professional competence for marine pilots and certificates of pilotage areas for marine pilots

At the proposal of the Department,Deputy ministers of ministerial-level agencies,Director of the Vietnam Maritime Administration,June 2024;hereby promulgates regulations on training, issuing, and revoking Certificates of Professional Competence for Marine Pilots (hereinafter referred to as GCNKNCMHTHH) and Certificates of Pilotage Areas for Marine Pilots (hereinafter referred to as GCNVHĐHTHH).on Article 1. This Circular stipulates regulations on training, issuing, and revoking Certificates of Professional Competence for Marine Pilots (GCNKNCMHTHH) and Certificates of Pilotage Areas for Marine Pilots (GCNVHĐHTHH).

The Minister of Transport issues this Circular quArticle 2. The Certificate of Professional Competence for Marine Pilots and Completion of Course Certificate of Pilotage Areas for Marine Pilotst Ta) The GCNKNCMHTHH is a certificate issued to marine pilots who meet the provisions set out in Chapter II of this Circular. A marine pilot holding a GCNKNCMHTHH of a certain grade may lead ships within the limits of that grade.

CChapter I

GENERAL PROVISIONS

Article 1. Scopei Scope of application and adjustment

c) The validity period of the GCNKNCMHTHH is five years from the date of issuance. In cases where the working age of a marine pilot does not allow for a full five-year period, the validity period of the GCNKNCMHTHH shall correspond to the remaining working age of the marine pilot according to the laws on labor.

a) The GCNVHĐHTHH is a certificate specifying the operating area and ship routes that a marine pilot is permitted to work in. A marine pilot may only lead ships along the routes specified in the GCNVHĐHTHH.

b) A marine pilot who has completed practical training in leading ships in a specific operating area and route shall be issued a GCNVHĐHTHH for that area and route.u d) The format of the GCNVHĐHTHH is prescribed in Appendix 2 of this Circular. Certificate Article 3. Grades of Marine Pilots

b) The GCNKNCMHTHH includes grades Three, Two, One, and Extraordinary.

1. Grade Three Marine Pilot is a pilot holding a Grade Three GCNKNCMHTHH. A Grade Three Marine Pilot is authorized to lead ships with a total gross tonnage under 4,000 GT and a maximum length up to 115 meters.

d) The model of the GCNKNCMHTHH is specified in Appendix 1 of this Circular.

2. Grade Two Marine Pilot is a pilot holding a Grade Two GCNKNCMHTHH. A Grade Two Marine Pilot is authorized to lead ships with a total gross tonnage under 10,000 GT and a maximum length up to 145 meters.

a) The GCNVHĐHTHH is a certificate issued to marine pilots and shipmasters specifying the pilotage areas and routes where marine pilots are permitted to practice their profession and shipmasters are permitted to self-navigate their vessels. Marine pilots and shipmasters are only allowed to navigate ships along the routes specified in their GCNVHĐHTHH.

b) Marine pilots who have completed practical training in leading ships and shipmasters who have navigated ships in specific areas and routes are eligible to be issued a GCNVHĐHTHH for those areas and routes.

3. Grade One Marine Pilot is a pilot holding a Grade One GCNKNCMHTHH. A Grade One Marine Pilot is authorized to lead ships with a total gross tonnage under 20,000 GT and a maximum length up to 175 meters.

4. Distinguished Grade Marine Pilot is a pilot holding a Distinguished Grade GCNKNCMHTHH. A Distinguished Grade Marine Pilot is authorized to lead all types of ships.

3. Supplementing Clause 4 after Clause 3 of Article 4 as follows:

5. During the time a marine pilot leads a ship resulting in a serious maritime accident, the period for upgrading the pilot's grade will be extended by six months; in particularly serious cases, the period for upgrading the pilot's grade will be extended by twelve months.

TRAINING, TESTING, ISSUING CERTIFICATES OF PROFESSIONAL COMPETENCE FOR MARINE PILOTS AND CERTIFICATES OF PILOTAGE AREAS FOR MARINE PILOTS

Article 4. Training Program for Marine Pilots

a) The basic training program for marine pilots is the training program applicable to probationary marine pilots;

b) The advanced training program for marine pilots is the training program applied to upgrade a pilot from Grade Two to Grade One.

2. The training program for marine pilots includes the following main contents:

a) The Vietnam Maritime Code, the Law on Inland Waterway Transport, related legal documents concerning marine pilots, international conventions related to maritime safety, maritime security, and prevention of environmental pollution;

b) Marine pilotage operations;Ấc) Ship handling training; d) Compulsory pilotage areas of Vietnam;

3. Amend Clause 3 Article 2 as follows:iđ) Marine pilotage business English; hMarine Ports

1. The training program for marine pilots includes:

e) Bridge resource management;

g) Utilization of navigational equipment on the bridge;

h) International Regulations for Preventing Collisions at Sea;

i) Transportation of dangerous goods, passenger ships, and Ro-Ro vessels.

3. Implement the examination and promotion of grades from Grade Three to Grade Two and from Grade One to Distinguished Grade.

c) Training in the dispatching of ships;

d) The mandatory pilotage zone of Vietnam;

đ) Professional maritime pilot English;

e) Management of bridge resources;

g) Utilization of marine equipment on the bridge;

h) International regulations for preventing collisions at sea;

i) Transport of dangerous goods, passenger vessels, and Ro-Ro vessels.

3. Implement the examination for upgrading from Third Class to Second Class and from First Class to Master Class pilots.

Article 5. Training and practical training for marine pilotso "7. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability."in training and internship hmaritime pilot

1. Marine pilot training institutions (hereinafter referred to as training institutions) are maritime universities and colleges that have been approved by the Ministry of Transport to offer the specialized program of Marine Vessel Control.

2. Responsibilities of training institutions

a) Organize training according to the marine pilot training program approved by the Ministry of Transport.

b) Research and improve teaching methods, enhance training quality; propose to competent authorities to amend and supplement the marine pilot training program to be appropriate.

c) Collect and use tuition fees for marine pilot training in accordance with regulations.

3. Marine pilots and trainee marine pilots shall undergo practical training at marine pilot organizations.

Article 6. Examination Board for Marine Pilots

1. The Director of the Vietnam Maritime Administration decides on the establishment of the Examination Board for Marine Pilots.

2. The Examination Board for Marine Pilots consists of from five to seven members, including: The Chairman of the Board is the leader of the Vietnam Maritime Administration, other members are leaders of relevant functional departments of the Vietnam Maritime Administration, marine pilot organizations, and training institutions.

3. The Examination Board for Marine Pilots is responsible for organizing final examinations for basic marine pilot training courses and advanced marine pilot training courses.

4. The Examination Board for Marine Pilots has the following tasks:

a) Reviewing candidate lists based on conditions stipulated in Chapter II of this Circular;

b) Advising the Director of the Vietnam Maritime Administration on establishing question banks for each category of marine pilot and each pilotage area; proposing adjustments and updates to questions to better reflect reality;

c) Organizing, managing, and supervising examinations;

d) Handling incidents occurring during examinations (if any);

d) Establishing the Examination Committee for final examinations of basic marine pilot training courses and advanced marine pilot training courses (hereinafter referred to as the Examination Committee);

e) Summarizing examination results and reporting to the Director of the Vietnam Maritime Administration to decide on recognizing graduates of training courses;

g) Compiling opinions from training institutions, students, and pilot organizations regarding the organization, programs, and procedures of marine pilot training courses and reporting to the Director of the Vietnam Maritime Administration.

Article 7. Examination Committee for Final Examinations

1. The Examination Committee consists of from five to seven members, meeting one of the following professional standards:

a) Being a Superior Class Marine Pilot with at least 36 months of experience as a Superior Class Marine Pilot;

b) Being a Master of a vessel with a gross tonnage of 3,000 GT or more with at least 36 months of service in the corresponding position;

c) Being a reputable professional in maritime expertise and operations;

d) Representatives of Port Maritime Services; Inland Waterway Port Services.

2. The Examination Committee for Final Examinations has the following tasks:

a) Organize questioning, grading, and compiling examination result reports as prescribed;

b) Recommending the Examination Board for Marine Pilots to promptly correct errors in the examination questions;

c) Handling violations of examination rules within their authority and reporting to the Examination Board for Marine Pilots.

Article 8. Conditions for Participating in Marine Pilot Training Courses hMarine Ports

1. Students participating in basic marine pilot training courses must meet the following conditions:

a) Graduating from a maritime university with a degree in Marine Vessel Control or higher;

b) Having served as a Deck Officer on vessels with a gross tonnage of 500 GT or more for at least 12 months;

c) Meeting health standards as prescribed;

d) Holding a Maritime English Certificate of Proficiency Level 2 or an English Certificate of Proficiency Level B or equivalent or higher.

2. Students participating in advanced marine pilot training courses must meet the following conditions:

a) Holding a degree in Marine Vessel Control from a maritime university or higher;

b) Meet health standards as prescribed;

c) Holding a Maritime English Certificate of Proficiency Level 3 or an English Certificate of Proficiency Level C or equivalent or higher;

d) Holding a Second-Class Competency Certificate for Marine Pilot;

d) Independently leading ships safely for at least 300 times in the capacity of a Second-Class Marine Pilot or having served satisfactorily in the role of a Second-Class Marine Pilot for at least 24 months, confirmed by marine pilot organizations and local port maritime services.

3. Amend Clause 3 Article 2 as follows:iArticle 9. Application Documents for Basic Marine Pilot Training Courses and Advanced Marine Pilot Training Courses hbasic maritime pilot course and advanced maritime pilot course hadvanced maritime pilot training

1. Application documents for basic marine pilot training courses include the following papers:

a) Application form (for self-applicants) or a recommendation letter from the managing agency or organization;

b) Certified copies of graduation certificates;

c) Certified copies of certificates of professional competence and seafarer's books;

d) Certified copies of English proficiency certificates;

đ) Health certificate in accordance with the regulations;

e) A detailed resume with confirmation from management agencies or local authorities at the commune level where the applicant's household registration is located.

2. Application documents for advanced marine pilot training courses include the following papers:

In addition to the documents specified in Clause 1 of this Article, applicants must also provide the following documents:

a) Certified copies of Second-Class Competency Certificates for Marine Pilot;

b) Declarations about ship-leading activities as stipulated in Point d, Clause 2 of Article 8 and according to the model prescribed in Appendix 4 of this Circular.

Article 10. Recognition of Examination Resultsorganize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. examination results

1. Candidates who achieve the required standard in all subjects according to the regulations (scoring 5 or above on a scale of 10) shall be recognized as having completed the basic maritime pilot training course or the advanced maritime pilot training course. In cases where candidates only pass some subjects, the results of these subjects will be retained for a period of 01 year from the date of examination result announcement.

2. The Director of the Vietnam Maritime Administration decides to recognize completion of the basic maritime pilot training course and the advanced maritime pilot training course based on the recommendation of the Chairman of the Maritime Pilot Examination Board.

Article 11. Conditions for Issuingiconditions for issuance Certificate of Professional Competence for Maritime Pilotscertificate of professional competence for maritime pilots h1. Conditions for issuing a Certificate of Professional Competence for Maritime Pilots (CPMCMP) Class Three: h"Article 7. Specific Prices for Using Road Services

b) Having completed practical training as a Class Three maritime pilot with at least 400 safe vessel leads or a minimum of 36 months with at least 200 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

7. Supplementing Clause 3a after Clause 3 of Article 11 as follows:

In cases where a trainee pilot has held the position of master of a ship with a gross tonnage of 500 GT or more, they must have completed at least 200 safe vessel leads or a minimum of 24 months with at least 100 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

2. Conditions for issuing a CPMCMP Class Two for maritime pilots already holding a CPMCMP Class Three:

a) Having independently led at least 300 safe vessel leads as a Class Three maritime pilot or having satisfactorily performed the duties of a Class Three maritime pilot for at least 24 months with at least 200 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority;

b) Having completed at least 50 safe vessel leads for ships with a gross tonnage of 4000 GT and a maximum length of 115 meters, or having completed at least 12 months of practical training as a Class Two maritime pilot with at least 30 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

3. Conditions for issuing a CPMCMP Class Two for individuals holding a Certificate of Professional Competence for Master of Ships with a gross tonnage of 3000 GT or more and having held the position of master for at least 36 months:

b) Having completed at least 200 safe vessel leads for ships with a gross tonnage of 4000 GT and a maximum length of 115 meters as a Class Two maritime pilot trainee, or having completed at least 12 months of practical training as a Class Two maritime pilot with at least 100 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

7. Supplementing Clause 3a after Clause 3 of Article 11 as follows:

4. Conditions for issuing a CPMCMP Class One:

a) Having completed the advanced maritime pilot training course;

b) Having completed at least 50 safe vessel leads for ships with a gross tonnage of 10,000 GT and a maximum length of 145 meters, or having completed at least 06 months of practical training as a Class One maritime pilot under the guidance of a maritime pilot holding a CPMCMP Class One or higher, with at least 30 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

5. Conditions for issuing a CPMCMP Extraordinary Class:

a) Holding a CPMCMP Class One;

b) Having independently led at least 300 safe vessel leads as a Class One maritime pilot or having satisfactorily performed the duties of a Class One maritime pilot for at least 36 months with at least 200 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority;

c) Having completed at least 50 safe vessel leads for ships with a gross tonnage of 20,000 GT or having completed at least 06 months of practical training as a Class One maritime pilot under the guidance of a maritime pilot holding an Extraordinary Class CPMCMP, with at least 30 safe vessel leads, confirmed by the pilot organization where the training took place and the local maritime port authority.

Article 12. Procedures for Issuing Certificates of Professional Competence for Maritime Pilots

3. Amend Clause 3 Article 2 as follows:i1. Application Documents for CPMCMP:

c) Three professional competence assessment forms for Class Three maritime pilots (two forms for Class Two, Class One, and Extraordinary Class maritime pilots) as prescribed in Appendix 5 of this Circular;

a) A letter from the marine pilot organization according to the model prescribed in Appendix 3 of this Circular;

b) A declaration form according to the model prescribed in Appendix 4 of this Circular;

d) Two recent color photographs measuring 3 x 4 cm taken within the last six months (the back of the photograph must clearly state the full name, date of birth, and place of birth);

đ) Health certificate as prescribed.

2. Organizations and individuals directly submit one set of application documents to the Vietnam Maritime Administration or send them through the postal service.

3. The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. If the application documents are incomplete, the Vietnam Maritime Administration returns the documents and guides organizations and individuals to complete the documents according to the regulations (in case of direct submission). In cases where the application documents are received through the postal service, if the documents are incomplete, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the documents.

4. Within seven working days from the date of receiving complete application documents according to the regulations, the Vietnam Maritime Administration issues the CPMCMP as prescribed in Appendix 1 of this Circular. In cases where the conditions for issuing the CPMCMP are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

5. The CPMCMP is issued in one original copy for the maritime pilot.

5. The Certificate of Competence for Maritime Pilots (GCNKNCMHTHH) shall be issued one original copy to the maritime pilot.

Article 13. Conditions for extending and reissuing the Certificate of Professional Competence for Marine Pilots

1. The Certificate of Professional Competence for Marine Pilots (GCNKNCMHTHH) may be extended if it has expired and must meet the following conditions:

a) Having a Health Certificate in accordance with regulations;

b) The marine pilot has held the position of marine pilot corresponding to the GCNKNCMHTHH issued for at least 24 months within five years. In cases where less than 24 months have passed, they must undergo at least three months of refresher training.

2. The GCNKNCMHTHH may be reissued in cases where it is damaged or lost but still within its validity period and must meet the following condition:

The marine pilot has held the position of marine pilot corresponding to the GCNKNCMHTHH issued for at least 24 months within five years. In cases where less than 24 months have passed, they must undergo at least three months of refresher training.

Article 14. Procedures for Extending the Certificate of Professional Competence for Marine Pilotsiquirements for h1. Conditions for issuing a Certificate of Professional Competence for Maritime Pilots (CPMCMP) Class Three: h"Article 7. Specific Prices for Using Road Services

1. Documents for extending the GCNKNCMHTHH:

a) A request for extension of the GCNKNCMHTHH, clearly stating the reasons and having confirmation from the head of the marine pilot organization or the competent authority according to the model specified in Appendix 6 of this Circular;

b) The original GCNKNCMHTHH to be extended;

c) A health certificate in accordance with regulations;

d) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

3. The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. If the application documents are incomplete, the Vietnam Maritime Administration returns the documents and guides organizations and individuals to complete the documents according to the regulations (in case of direct submission). In cases where the application documents are received through the postal service, if the documents are incomplete, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the documents.

4. Within seven working days from the date of receiving complete application documents according to the regulations, the Vietnam Maritime Administration issues the CPMCMP as prescribed in Appendix 1 of this Circular. In cases where the conditions for issuing the CPMCMP are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

4. The Vietnam Maritime Administration shall extend the GCNKNCMHTHH no later than two working days from the date of receiving all required documents. If the conditions for extending the GCNKNCMHTHH are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

Article 15. Procedures for Reissuing the Certificate of Professional Competence for Marine Pilots

1. Components of the documents for reissuing the GCNKNCMHTHH:

a) A request for reissuance of the GCNKNCMHTHH, clearly stating the reasons and having confirmation from the head of the marine pilot organization according to the model specified in Appendix 6 of this Circular;

b) The original GCNKNCMHTHH to be reissued (in cases where the certificate is damaged);

c) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

3. The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. If the application documents are incomplete, the Vietnam Maritime Administration returns the documents and guides organizations and individuals to complete the documents according to the regulations (in case of direct submission). In cases where the application documents are received through the postal service, if the documents are incomplete, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the documents.

4. Within seven working days from the date of receiving complete application documents according to the regulations, the Vietnam Maritime Administration issues the CPMCMP as prescribed in Appendix 1 of this Circular. In cases where the conditions for issuing the CPMCMP are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

4. The Vietnam Maritime Administration shall reissue the GCNKNCMHTHH no later than five working days from the date of receiving all required documents. If the conditions for reissuing the GCNKNCMHTHH are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

5. The reissued GCNKNCMHTHH will be provided in one original copy to the marine pilot matching the number of the damaged or lost GCNKNCMHTHH.

Article 16. Conditions for Issuing the Certificate of Operating Area for Marine Pilots

1. Possessing the GCNKNCMHTHH.

2. For marine pilots guiding vessels at offshore oil ports to obtain the GCNVHĐHTHH, they must complete at least five safe vessel guidance practices on the route of the marine pilot operating area and receive confirmation from the marine pilot organization and the maritime port authority where the training took place.

Article 17. Procedures for Issuing the Certificate of Operating Area for Marine Pilots

1. Documents for issuing the GCNVHĐHTHH:

a) A letter from the marine pilot organization according to the model prescribed in Appendix 3 of this Circular;

b) A declaration form according to the model prescribed in Appendix 4 of this Circular;

c) A copy of the GCNKNCMHTHH;

d) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

3. The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. If the application documents are incomplete, the Vietnam Maritime Administration returns the documents and guides organizations and individuals to complete the documents according to the regulations (in case of direct submission). In cases where the application documents are received through the postal service, if the documents are incomplete, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the documents.

3. The Vietnam Maritime Administration shall accept the documents, check the components and quantity of documents in accordance with regulations, record them in the register, and schedule the return of results within the prescribed time limit. If the documents are incomplete according to regulations, they will be returned and the organization or individual will be guided to complete the documents according to regulations (in cases of direct submission). In cases of submission through postal services, if the documents are incomplete according to regulations, the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the documents.

4. No later than two working days from the date of receiving all required documents, the Vietnam Maritime Administration shall issue the GCNVHĐHTHH according to the model specified in Appendix 2 of this Circular. If the conditions for issuing the GCNVHĐHTHH are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

5. The GCNVHĐHTHH will be issued in one original copy to the marine pilot.

Article 18. Conditions for Issuing the Certificate of Navigation Area for Marine Pilots when Transferring Navigation AreasiClause 1. Marine pilots transferring navigation areas must have at least six months of practical training leading ships in the new navigation area with a minimum number of safe ship leads (confirmed by the pilot organization where the training takes place and the Maritime Branch in the region) as follows:No.vesớClause 2. The conditions for marine pilots holding a Certificate of Navigation Area for Marine Pilots in two or more areas, if returning to their previous navigation area after over twelve months, must undergo practical training with a minimum of thirty safe ship leads for each category of pilot.

Article 19. Procedures for Issuing the Certificate of Navigation Area for Marine Pilots when Transferring Navigation Areas

Clause 1. Documents for issuing the Certificate of Navigation Area for Marine Pilots for those transferring navigation areas:

Clause 4. Within no more than two working days from the date of receiving all required documents, the Vietnam Maritime Administration shall issue the Certificate of Navigation Area for Marine Pilots for those transferring navigation areas. In cases where the conditions for issuing the Certificate of Navigation Area for Marine Pilots for those transferring navigation areas are not met, the Vietnam Maritime Administration must respond in writing and clearly state the reasons.

Clause 5. The Certificate of Navigation Area for Marine Pilots for those transferring navigation areas shall be issued one original copy to the marine pilot.

Article 20. Conditions for Renewal and Reissue of the Certificate of Navigation Area for Marine PilotsDeputy ministers of ministerial-level agencies, Clause 1. The Certificate of Navigation Area for Marine Pilots may be renewed upon expiration of its validity period and must meet the following conditions:No.Clause 2. The Certificate of Navigation Area for Marine Pilots may be reissued if it is damaged or lost but still within its validity period and must meet the following condition:urinary catheterArticle 21. Procedures for Renewing the Certificate of Navigation Area for Marine Pilots

Clause 1. Documents for renewing the Certificate of Navigation Area for Marine Pilots:

a) A letter from the marine pilot organization according to the model prescribed in Appendix 3 of this Circular;

b) A declaration form according to the model prescribed in Appendix 4 of this Circular;

c) A copy of the GCNKNCMHTHH;

d) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

3. The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. If the application documents are incomplete, the Vietnam Maritime Administration returns the documents and guides organizations and individuals to complete the documents according to the regulations (in case of direct submission). In cases where the application documents are received through the postal service, if the documents are incomplete, the Vietnam Maritime Administration will notify in writing within two working days from the date of receipt of the documents.

3. The Vietnam Maritime Administration shall accept the documents, check the components and quantity of documents in accordance with regulations, record them in the register, and schedule the return of results within the prescribed time limit. If the documents are incomplete according to regulations, they will be returned and the organization or individual will be guided to complete the documents according to regulations (in cases of direct submission). In cases of submission through postal services, if the documents are incomplete according to regulations, the Vietnam Maritime Administration will notify in writing no later than two working days from the date of receipt of the documents.

Point a) A request for renewal of the Certificate of Navigation Area for Marine Pilots, specifying the reason and confirmed by the head of the marine pilot organization according to the form prescribed in Appendix 6 of this Circular;

Point b) The original Certificate of Navigation Area for Marine Pilots to be renewed;

Clause 4. The Vietnam Maritime Administration shall renew the Certificate of Navigation Area for Marine Pilots within no more than two working days from the date of receiving all required documents. In cases where the conditions for renewing the Certificate of Navigation Area for Marine Pilots are not met, the Vietnam Maritime Administration must respond in writing and clearly state the reasons.organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular. Article 22. Procedures for Reissuing the Certificate of Navigation Area for Marine Pilots

Clause 1. Documents for reissuing the Certificate of Navigation Area for Marine Pilots:

a) Having a Health Certificate in accordance with regulations;

b) The marine pilot has held the position of marine pilot corresponding to the GCNKNCMHTHH issued for at least 24 months within five years. In cases where less than 24 months have passed, they must undergo at least three months of refresher training.

Point a) A request for reissuing the Certificate of Navigation Area for Marine Pilots, specifying the reason and confirmed by the head of the marine pilot organization according to the form prescribed in Appendix 6 of this Circular;

The marine pilot has held the position of marine pilot corresponding to the GCNKNCMHTHH issued for at least 24 months within five years. In cases where less than 24 months have passed, they must undergo at least three months of refresher training.

Clause 5. The Certificate of Navigation Area for Marine Pilots shall be issued one original copy to the marine pilot corresponding to the number of the damaged or lost Certificate of Navigation Area for Marine Pilots.

a) Application for extension of the Certificate of Competence for Maritime Pilot (GCNVHĐHTHH), specifying the reasons and with confirmation by the head of the maritime pilot organization according to the model prescribed in Appendix 6 of this Circular;

b) Original GCNVHĐHTHH to be extended;

c) A health certificate in accordance with regulations;

d) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

Article 22. ProDeputy ministers of ministerial-level agencies, cedure for reissuing the Certificate of Operating Zone for Maritime Pilots

1. Documents for reissuing the GCNVHĐHTHH:

a) Application for reissuing the GCNVHĐHTHH, specifying the reasons and with confirmation by the head of the maritime pilot organization according to the model prescribed in Appendix 6 of this Circular;

b) Original GCNVHĐHTHH to be reissued (in case the certificate is damaged);

c) Two color photographs measuring 3 x 4 inches taken within six months (the back of the photograph must clearly state the full name, date of birth, and place of birth).

The Vietnam Maritime Administration receives the application documents, checks the components and quantity of the documents according to the regulations, registers them in the logbook, and sets a deadline for returning the results as prescribed. In cases where the conditions for reissuing the GCNVHĐHTHH are not met, the Vietnam Maritime Administration must respond in writing and specify the reasons.

5. The GCNVHĐHTHH shall be issued one original copy to the maritime pilot corresponding to the number of the damaged or lost GCNVHĐHTHH.

Article 23. Circumstances for revoking the Certificate hRecovery of Certificates

The issued Certificates shall be revoked if there is a violation of any of the following circumstances:

1. Forgery or alteration, erasure, distortion of the content of the Certificate;

2. Buying, renting, lending the Certificate;

3. Intentionally misreporting information or using falsified or forged documents in the application for issuance, extension, or reissuance of the Certificate.

4. Other cases as prescribed by law.

Article 24. Fees for issuing various types of"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." Article 25. Responsibilities of the Vietnam Maritime Administration

1. To take the lead in compiling the maritime pilot training program to be submitted to the Ministry of Transport for approval; to establish and issue the maritime pilot internship program.

2. Annually, based on planning, training needs, and internships for maritime pilots, the Director of the Vietnam Maritime Administration assigns training and internship activities for maritime pilots to relevant training institutions and organizations.

3. To issue, extend, reissue, and revoke GCNKNCMHTHH and GCNVHĐHTHH in accordance with this Circular's provisions.

Article 26. Responsibilities of maritime pilot organizations

Article 26. Responsibilities of the, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP 1. To organize internships for maritime pilots; to examine maritime pilots during their internship period; to confirm the actual time spent piloting vessels and the number of safe piloting operations for maritime pilots or pilot trainees.

2. To assign maritime pilots appropriately according to GCNKNCMHTHH and GCNVHĐHTHH.

3. To temporarily suspend work and handle disciplinary actions in accordance with the law when maritime pilots cause accidents due to piloting errors.

4. To regularly provide professional updates, English language, maritime safety, maritime security, and environmental protection training to maritime pilots.

5. To promptly propose rewards to competent authorities for outstanding collectives and individuals in maritime pilot work.

Article 27. Effectiveness

Chapter III

IMPLEMENTING PROVISIONS

1. This Circular takes effect from January 1, 2014. Six Appendices are attached to this Circular.i ADJUSTMENT

Abolish Circular No. 06/2009/TT-BGTVT dated June 18, 2009, issued by the Minister of Transport regarding the training, issuance, and revocation of certificates of competency for maritime pilots and certificates of areas of operation for maritime pilots, and Circular No. 10/2011/TT-BGTVT dated March 25, 2011, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 06/2009/TT-BGTVT dated June 18, 2009, issued by the Minister of Transport regarding the training, issuance, and revocation of certificates of competency for maritime pilots and certificates of areas of operation for maritime pilots.

3. Certificates of competency for maritime pilots and certificates of areas of operation for maritime pilots issued under Circular No. 10/2011/TT-BGTVT dated March 25, 2011, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 06/2009/TT-BGTVT dated June 18, 2009, issued by the Minister of Transport regarding the training, issuance, and revocation of certificates of competency for maritime pilots and certificates of areas of operation for maritime pilots will remain valid until the expiration date indicated on the certificates.

4. The maritime pilot training programs stipulated in Article 4 of this Circular shall be applied from July 1, 2014.

5. The English language proficiency requirements specified in Article 8 of this Circular shall be mandatory maritime English from July 1, 2017.

2. The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Heads of agencies, organizations, and individuals related to this Circular are responsible for its implementation.

Article 28. Implementation Organization

1. The Vietnam Maritime Administration shall be responsible for implementing this Circular.

2. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of the Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Heads of agencies, organizations, and individuals related to this Circular shall be responsible for its implementation.
