1. National Hero.
2. Hero of Labor during the Resistance War.
3. War invalids, persons enjoying benefits equivalent to war invalids, class B war invalids (hereinafter referred to collectively as war invalids).
4. Children of National Heroes, children of Heroes of Labor during the Resistance War.
5. Children of persons engaged in revolutionary activities before January 1, 1945.
6. Children of persons engaged in revolutionary activities from January 1, 1945 to August Revolution Day in 1945.
7. Children of martyrs.
8. Children of war invalids.
9. Children of disabled veterans.
10. Children of persons engaged in resistance warfare exposed to toxic chemicals.
Article 2. Subjects applying preferential policies
1. Preferential policies in education and training shall be applied to students as follows:
a) Children of persons who have rendered meritorious service to the revolution as specified in Article 1 of this Circular (hereinafter referred to collectively as students) currently studying at preschool educational institutions, general education schools, regular education centers (for learners following the junior secondary school and senior secondary school curricula), boarding schools for ethnic minorities, preparatory universities, specialized schools, and schools for persons with disabilities within the national education system (collectively referred to as general education institutions);
b) Persons who have rendered meritorious service to the revolution and their children as specified in Article 1 of this Circular (hereinafter referred to collectively as students) studying at vocational education institutions with courses lasting one year or more or higher education institutions within the national education system (collectively referred to as vocational education and higher education institutions);
2. Students eligible to enjoy multiple preferential policies in education and training shall only benefit from the highest level of preferential policy.
3. Students concurrently studying at multiple vocational education and higher education institutions or multiple departments/majors within the same institution shall only benefit from the highest level of preferential policy at one such institution.
4. The preferential policies in education and training shall not apply to students specified in Clause 1 of this Article in any of the following cases:
a) Receiving salary or living expenses while studying;
b) Already benefiting from preferential policies at a vocational education or higher education institution;
c) Persons who have rendered meritorious service as specified in Article 1 of this Circular having been suspended from receiving preferential treatment for persons who have rendered meritorious service to the revolution.
5. The preferential policies in education and training stipulated in this Circular do not replace scholarship policies, scholarship policies for academic and moral excellence as currently regulated.
5. The preferential regimes in education and training as prescribed in this Circular do not replace the scholarship regime for policy purposes, the scholarship regime for encouraging study and discipline as currently provided.
Article 3. Preferential Treatment System
1. Annual preferential allowance system.
2. Monthly preferential allowance system.
The levels of allowances shall be implemented in accordance with the provisions of Decree No. 20/2015/NĐ-CP dated February 14, 2015 of the Government on the levels of preferential allowances and subsidies for persons who have rendered meritorious service to the revolution.
Article 4. Documents for Receiving Preferential Treatment
1. Application form for preferential treatment in education and training (Form No. 01-ƯĐGD).
2. Confirmation letter from general education institution or vocational education institution, university (Form No. 02-ƯĐGD).
3. Decision on implementation of preferential treatment in education and training (Form No. 03-ƯĐGD).
Article 5. Management, Storage, and Transfer of Preferential Treatment Files
1. Files implementing preferential treatment in education and training shall be managed and stored like files of persons who have rendered meritorious service to the revolution.
2. When persons who have rendered meritorious service to the revolution or their dependents change their place of residence to another province or city, the files for receiving preferential treatment in education and training shall be transferred according to the provisions of Circular No. 05/2013/TT-BLĐTBXH dated May 15, 2013 of the Ministry of Labor, Invalids and Social Affairs guiding procedures for file establishment, file management, and implementation of preferential treatment for persons who have rendered meritorious service to the revolution and their dependents.
Article 6. Procedures and Formalities for Resolving Preferential Treatment
1. Procedures and Formalities
a) Persons who have rendered meritorious service to the revolution or their children as stipulated in Article 1 of this Circular shall fill out the application form along with confirmation letters from general education institutions or vocational education institutions, universities, and submit them to the People's Committee of the commune where the person who has rendered meritorious service resides at the beginning of each academic year or course;
b) The People's Committee of the commune shall verify the information in the application form within three working days from the date of receipt, prepare a list along with the required documents as specified in Point a of this Clause, and send it to the Department of Labor, Invalids and Social Affairs;
In cases where persons who have rendered meritorious service to the revolution are currently receiving monthly preferential allowances under the management of military agencies, public security agencies, centers for disabled veterans' care, and the Department of Labor, Invalids and Social Affairs, these agencies shall be responsible for verification (within three working days) and sending the results to the Department of Labor, Invalids and Social Affairs of the commune where the dependents of the person who has rendered meritorious service reside and are eligible for preferential treatment in education and training;
c) The Department of Labor, Invalids and Social Affairs shall review the files and prepare a list along with the required documents as specified in Point b of this Clause within five working days from the date of receipt of all valid documents, and send them to the Department of Labor, Invalids and Social Affairs of the province;
d) The Department of Labor, Invalids and Social Affairs of the province shall check the list and compare it with the files of persons who have rendered meritorious service within five working days from the date of receipt of all valid documents, issue a decision on resolving preferential treatment in education and training (Form No. 03-ƯĐGD) for eligible cases, and transfer the decision and one approved list to the Department of Labor, Invalids and Social Affairs of the commune.
2. Procedures and Formalities for Implementing Preferential Treatment
a) Persons who have rendered meritorious service to the revolution or their children as stipulated in Article 1 of this Circular shall submit confirmation letters from general education institutions or vocational education institutions, universities to the Department of Labor, Invalids and Social Affairs that resolves preferential treatment according to the payment schedule for preferential allowances in education and training.
If students are expelled due to disciplinary actions or leave school without permission, the general education institution or vocational education institution, university where the student is enrolled shall notify the Department of Labor, Invalids and Social Affairs to stop the preferential treatment.
When students are readmitted, the general education institution or vocational education institution, university where the students are enrolled shall notify the Department of Labor, Invalids and Social Affairs to continue providing preferential treatment according to regulations.
If students are not entitled to preferential treatment in education and training as stipulated in Point c, Clause 4, Article 2 of this Circular, the Department of Labor, Invalids and Social Affairs shall notify the general education institution or vocational education institution, university where the students are enrolled.
b) The Department of Labor, Invalids and Social Affairs shall directly pay or transfer the preferential treatment in education and training to the personal account of the students as stipulated in Article 1 of this Circular according to their request.
Article 7. Payment Methods
1. Payment Implementing Agency
The Department of Labor, Invalids and Social Affairs manages and organizes the payment of allowances to students who are entitled to preferential treatment.
2. Payment Time
a) Annual Preferential Allowance: paid at the beginning of the academic year or course
For students, payment is made in October or November
For university students, payment is made in November or December
In cases where students have not received the annual preferential allowance, they are entitled to claim it retroactively;
b) Monthly Preferential Allowance: paid twice a year
The first payment is made in October or November for students or in November or December for university students
The second payment is made in March or April
In cases where students have not received the monthly preferential allowance, they are entitled to claim it retroactively.
3. Study Period or Curriculum
The study period or curriculum is in accordance with the regulations on higher education, vocational training, and general education.
Article 8. Implementation organization
1. The People's Committee of the province directs the implementation of the preferential regime as stipulated in this Circular and organizes inspections, audits, and handling of violations in the implementation of the preferential regime in education and training.
2. The Department of Labor, Invalids and Social Affairs is responsible for implementing the provisions of this Circular; compiling and reporting annually as prescribed, and is also responsible for inspecting and auditing the implementation of the preferential regime in education and training in the locality.
Article 9. Effective Date
1. This Circular takes effect from November 12, 2015.
2. In case the referenced documents in this Circular are replaced or amended, the replacement or amended documents shall be implemented.
3. During the implementation process, if there are difficulties, agencies and units shall promptly report to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
