Amending and supplementing certain articles of Decree No. 36/2025/NĐ-CP
dated February 25, 2025, of the Government stipulating functions, tasks, powers, and organizational structure of the Government Office.
On the basis of the Law on Organization of the Government No. 63/2025/QH15;
At the proposal of the Minister, Chairman of the Government Office;
The Government promulgates this Decree amending and supplementing certain articles of Decree No. 36/2025/NĐ-CP dated February 25, 2025, of the Government stipulating functions, tasks, powers, and organizational structure of the Government Office.
Article 1 Amending and supplementing certain articles of Decree No. 36/2025/NĐ-CP dated February 25, 2025, of the Government stipulating functions, tasks, powers, and organizational structure of the Government Office
1. Delete the phrase "control administrative procedures" from Article 1.. 2. Abolish the task and power to control administrative procedures at Clause 3, Article 2.
3. Delete the phrase "handling administrative procedures in an electronic environment" at Point d, Clause 4, Article 2.
4. Amend Clause 8, Article 2 as follows:
"8. Implement self-inspection of normative legal documents, inspect documents and handle cases involving illegal documents according to the authority and provisions of the law."
5. Delete the term "inspection" at Clause 10, Article 2.
6. Amend and supplement Article 3 as follows:
"Article 3. Organizational Structure
The organizational structure of the Government Office includes the following units:
1. General Department for Synthesis.
2. Legal Affairs General Department.
3. General Department for Comprehensive Economy.
4. Industry General Department.
5. Agriculture General Department.
6. Education, Science, Culture, and Society General Department.
7. International Relations General Department.
8. Internal Affairs General Department.
9. Civil Service Organization General Department.
10. Supervision of Inspection Work General Department (General Department I).
11. General Department for Parliamentary, Local, and Mass Organizations Work.
12. Secretariat and Editing General Department.
13. Administrative General Department.
14. Cadre and Civil Service Organization General Department.
15. Digital Transformation Bureau.
16. Management and Finance Bureau.
17. Government Electronic Information Portal.
Units within the organizational structure of the Government Office are administrative organizations whose functions, tasks, powers, and organizational structures are prescribed by the Minister, Chairman of the Government Office.
The Government Electronic Information Portal shall use the National Emblem seal.
The Administrative General Department has three divisions.
The Minister, Chairman of the Government Office shall submit to the Prime Minister for issuance of the list of public service establishments directly under the Government Office."
Article 2. Transitional Provisions
1. The Enterprise Reform General Department shall perform its functions, tasks, and powers according to current regulations until the Minister, Chairman of the Government Office issues a Decision stipulating the functions, tasks, and powers of the General Department for Comprehensive Economy.
2. The Administrative Procedure Control Bureau (as stipulated at Clause 16, Article 3 of Decree No. 36/2025/NĐ-CP dated February 25, 2025, of the Government stipulating functions, tasks, powers, and organizational structure of the Government Office) shall continue to perform its assigned functions, tasks, and powers according to current regulations until the competent authority issues a Decision stipulating the functions, tasks, powers, and organizational structure of the Digital Transformation Bureau under the Government Office and the Administrative Procedure Control Bureau under the Ministry of Justice takes effect.
Article 3. Effectiveness and Responsibility for Implementation
1. This Decree shall take effect from January 1, 2026.
2. The Minister, Chairman of the Government Office, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally-run city People's Committees shall be responsible for implementing this Decree./.
