Regarding the functions, tasks, powers, and organizational structure of the Inspectorate under the Posts and Telecommunications Ministry

THE MINISTER OF POSTS AND TELECOMMUNICATIONS
Pursuant to the Inspection Ordinance dated April 1, 1990;
Pursuant to the Posts and Telecommunications Ordinance dated May 25, 2002;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Posts and Telecommunications Ministry;
At the proposal of the Director of the Cadre and Civil Servant Department and the Inspector General.
DECISION
Article 1. The Inspectorate under the Posts and Telecommunications Ministry is an agency under the Ministry assisting the Minister in performing specialized inspection functions regarding postal services, telecommunications, information technology, electronics, Internet, broadcasting, radio frequency, and national communication infrastructure (hereinafter referred to collectively as postal services, telecommunications, and information technology) throughout the country; exercising state inspection powers over units and individuals directly managed by the Ministry.
Article 2. Tasks and powers of the Inspectorate under the Posts and Telecommunications Ministry:
1. Taking the lead or participating in drafting normative legal documents on inspection work, administrative violation handling, complaints, and reports regarding postal services, telecommunications, and information technology, anti-corruption efforts, and curbing malpractices within the industry;
2. Drafting annual inspection programs and plans for submission to the Minister for approval and implementation after approval by the Minister;
3. Supervising, guiding, and inspecting the heads of units under the Ministry's direct administrative management in implementing legal provisions on inspection work; inspection programs, plans, and operations of subordinate inspection organizations;
4. Inspecting and supervising the implementation of assigned plans, tasks, and powers; compliance with state policies and laws by units and individuals directly managed by the Ministry;
5. Inspecting and supervising the management and utilization of state capital at enterprises with state capital in the postal services, telecommunications, and information technology sectors where the Ministry is the representative owner as prescribed by law;
6. Inspecting compliance with state laws and regulations of the Ministry regarding postal services, telecommunications, and information technology by state agencies, economic and social organizations, and citizens throughout the country;
7. Proposing to the Minister of Posts and Telecommunications to request the Minister, head of other ministerial-level agencies managing other sectors to suspend or revoke regulations issued by those ministries or ministerial-level agencies that contravene normative legal documents on postal services, telecommunications, and information technology; suspending their enforcement and proposing the Prime Minister to revoke regulations of provincial People's Councils and People's Committees of centrally governed cities that contravene normative legal documents on sectors managed by the Posts and Telecommunications Ministry;
8. Imposing administrative penalties for violations of postal services, telecommunications, and information technology laws according to legal provisions;
9. Assisting the Minister in conducting citizen reception and complaint resolution, anti-corruption, and curbing malpractices, including receiving complaints and reports; investigating and concluding cases and recommending measures for complaint resolution to the Minister according to legal provisions;
10. Temporarily suspending or revoking decisions about inspection work made by heads of units under the Ministry's direct management that are incorrect;
11. Temporarily suspending employment, issuing warnings against inspected subjects under the Ministry's management who intentionally obstruct inspection tasks; if the subject is not under the Ministry's management, reporting and recommending competent authorities to make decisions;
12. Guiding and training inspection skills, specialized inspection work in postal services, telecommunications, and information technology, and people's inspection skills for inspectors, cooperating inspectors, and heads of units under the Ministry's direct management;
13. Serving as the central point of the Posts and Telecommunications Ministry in relations and coordination with central and local law enforcement agencies, state inspection organizations to resolve cases of law violations in postal services, telecommunications, and information technology;
14. Managing organization, civil servants, assets, files, and documents of the unit according to legal provisions and the Minister's delegation;
15. Performing other powers and tasks of the Ministry Inspectorate stipulated in Articles 9 and 14 of the Inspection Ordinance and other tasks assigned by the Minister.
Article 3. The Inspectorate under the Posts and Telecommunications Ministry is headed by the Inspector General, assisted by Deputy Inspector Generals, inspectors, and specialists engaged in inspection work.
The Inspector General is responsible to the Minister for all activities related to inspection work. Deputy Inspector Generals assist the Inspector General and are responsible to the Inspector General for the tasks delegated to them;
The tasks and powers of inspectors and specialists engaged in inspection work are defined and assigned by the Inspector General.
The organizational structure of the Inspectorate under the Posts and Telecommunications Ministry includes:
Article 4. - Postal Inspection Division,
- Telecommunications and Information Technology Inspection Division,
- Economic and Consolidation Inspection Division.
The functions, tasks, powers, and working relationships between divisions of the Inspectorate under the Posts and Telecommunications Ministry are defined by the Inspector General.
The Inspectorate under the Posts and Telecommunications Ministry has its own seal.
This Decision takes effect from the date of signature. Previous regulations contrary to this Decision are abolished.
Article 5. The Head of the Office, Directors of the Cadre and Civil Servant Department, Inspector General, Heads of units under the Posts and Telecommunications Ministry are responsible for implementing this Decision./.
Article 6. The Head of the Office, the Director of the Cadre Organization Department, the Inspector General, and the Heads of agencies and units under the Ministry of Posts and Telecommunications are responsible for implementing this Decision./.
