CIRCULAR

Guidelines for implementing midday meal regulations for workers and officials constructing the Son La Hydropower Project

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government on the wage scale and wage system in state-owned enterprises; Circular No. 7248/VPCP-KGVX dated October 16, 2009 of the Government Office regarding midday meal regulations for workers and officials constructing the Son La Hydropower Project;

After receiving comments from the Ministry of Finance, the Ministry of Construction, and the Vietnam Electricity Corporation, the Ministry of Labor - Invalids and Social Affairs hereby issues guidelines for implementing midday meal regulations for workers and officials constructing the Son La Hydropower Project as follows:

Article 1. Scope of Application

This Circular provides guidelines for implementing midday meal regulations for workers and officials constructing the Son La Hydropower Project located in Son La Province.

Article 2. Applicability

1. Workers, staff, and officials directly involved in construction work;

2. Workers, staff, and officials under the project management board directly involved in construction work;

3. Workers, staff, and officials providing consulting and design services directly working at the construction site;

4. Workers, staff, and officials directly involved in surveying to support technical design of the construction project;

Article 3. Midday Meal Regulations

1. The midday meal allowance shall be VND 15,000 per person per day (including VND 5,000 per person per day as stipulated in Circular No. 28/2005/TT-BLDTBX dated October 4, 2005 of the Ministry of Labor - Invalids and Social Affairs guiding the implementation of wage systems and allowances for workers and officials constructing five hydropower projects).

2. Midday meal expenses shall be budgeted separately (prior to August 1, 2009, they were implemented according to the provisions of the aforementioned Circular No. 28/2005/TT-BLDTBX) and included in the total project budget but not within labor costs.

Article 4. Implementation of Midday Meal Regulations

The implementation of midday meal regulations shall be carried out in accordance with Section II of Circular No. 12/2008/TT-BLDTBX dated July 22, 2008 of the Ministry of Labor - Invalids and Social Affairs guiding additional measures for the implementation of midday meal regulations for workers, staff, and officials constructing hydropower projects.

Article 5. Implementation Provisions

1. This Circular shall take effect 45 days from the date of signature.

Point 1, Article 3 of this Circular shall take effect from August 1, 2009.

Any difficulties encountered during implementation should be reported to the Ministry of Labor - Invalids and Social Affairs for guidance and resolution./.
