Regulations on vehicle registration procedures

BASED ON THE LAW ON TRAFFIC ON ROADS 2008;
Based on Decree No. 77/2009/NĐ-CP dated September 15, 2009 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
The Ministry of Public Security stipulates the vehicle registration procedures as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular prescribes the procedures for issuing, replacing, and revoking vehicle registration certificates and license plates (collectively referred to as the vehicle registration procedures) for motor vehicles running on gasoline, diesel, electricity, gas, or other fuels, including automobiles, tractors, trailers, semi-trailers towed by automobiles or tractors; two-wheeled motorcycles, three-wheeled motorcycles, motorized bicycles, and similar types of vehicles; specialized police vehicles used for security purposes.
Article 2. Applicability
This Circular applies to public security units and localities; officers and soldiers responsible for vehicle registration tasks and related organizations and individuals.
Article 3. Requirements and standards for officers and soldiers performing vehicle registration tasks and registration locations
1. Officers and soldiers performing vehicle registration tasks must have a minimum education level of a mid-level police officer or equivalent; have at least three consecutive years of work experience in the traffic police force; be proficient in using computers and vehicle management programs; thoroughly understand and strictly comply with road traffic laws, vehicle registration regulations, and other relevant legal provisions.
2. Strictly adhere to legal provisions regarding the functions, duties, and authorities of people's police officers; strictly follow the People's Police Regulations.
3. Registration locations must be conveniently located, with appropriate space, sufficient seating and parking areas, clear signage, identification signs for officers performing registration tasks; publicly display regulations on registration procedures and fees, schedules for serving the public, and suggestion boxes.
Article 4. Responsibilities of agencies assigned vehicle registration tasks
1. The Director of the Highway Traffic Police Department has the responsibility:
a) To direct, guide, and inspect vehicle registration activities nationwide;
b) To organize and implement vehicle registration, sign relevant registration documents for cases registered at the Highway Traffic Police Department.
2. The Head of the Provincial Public Security Traffic Police Department (Provincial Public Security) has the responsibility:
a) To organize and implement vehicle registration according to legal provisions and assigned responsibilities;
b) To guide and inspect vehicle registration activities for district-level public security departments;
c) To advise and propose solutions to difficulties and issues in vehicle registration and management to the Provincial Public Security Director and the Highway Traffic Police Department Director;
d) To approve and sign relevant registration documents as prescribed.
3. The Head of the District Public Security Department (District Public Security) has the responsibility:
a) To organize and implement vehicle registration according to legal provisions and assigned responsibilities;
b) To cooperate with the Traffic Police Department to advise and propose solutions to difficulties and issues in vehicle registration and management to the Provincial Public Security Director and the Highway Traffic Police Department Director;
c) To approve and sign relevant registration documents as prescribed.
4. Responsibilities of the Head of the Vehicle Registration Team under the Provincial Public Security Traffic Police Department, and the Head of the Vehicle Registration Team under the District Public Security Department:
a) Directly organize and implement vehicle registration and management according to regulations.
b) Check vehicle registration files; if complete and compliant with procedures, approve and sign immediately on the Vehicle Registration Application Form to submit to the competent authority for approval and signing of relevant registration documents as prescribed.
If the vehicle file does not meet the prescribed procedures, report to the competent authority to issue a written response to the vehicle owner.
5. Responsibilities of officers performing vehicle registration tasks
a) Receive, check, and compare vehicle files with the vehicle; if complete and compliant with procedures, accept the file (responsible for the validity of the vehicle registration file); if the file does not meet the prescribed procedures, provide specific and detailed guidance on the back of the Vehicle Registration Application Form for the vehicle owner to supplement; sign and clearly write the name of the guiding officer and take responsibility for the guidance provided; stamp or photograph the engine number and frame number of the vehicle to affix to the Vehicle Registration Application Form;
b) Report and propose to the Team Leader (at the locality) or the Department Head (at the Bureau) about the received vehicle files for inspection and signing by the authorized person to approve the Vehicle Registration Certificate;
c) Issue license plates, vehicle registration certificates, and vehicle files (in case of transfer of ownership); certificate of vehicle registration cancellation and license plate cancellation (in case of cancellation of registration and license plate) to the vehicle owner as prescribed.
Chapter II
VEHICLE REGISTRATION PROCEDURES
Article 5. Preparation Work
1. Every day, officers performing vehicle registration tasks must arrive 15 minutes before working hours to listen to instructions on requirements, tasks, and new documents related to vehicle registration tasks, check computer operations, prepare books, forms, license plates, payment receipts, tools, and other equipment necessary for vehicle registration tasks.
2. Guide vehicle owners or authorized representatives to perform vehicle registration procedures in order, ensuring order and scientific process; park vehicles in designated areas in order.
Article 6. Vehicle Registration Implementation
1. Check the vehicle owner's documents and guide the vehicle owner to fill out the Vehicle Registration Application Form according to the prescribed model.
2. Inspect the actual vehicle
a) Directly compare the contents in the Vehicle Registration Application Form with the actual vehicle regarding brand, type, engine number, frame number, paint color, seating capacity, load capacity, and other technical specifications of the vehicle.
b) Stamp the engine number and frame number and sign over the stamped engine number and frame number, clearly recording the name and title of the staff member conducting the actual vehicle inspection, the date, month, and year of the vehicle inspection. For vehicles confirmed by the Customs Authority to have only the frame number but not the engine number, only having the VIN (located on the front windshield of the vehicle), then use the VIN instead of the engine number. If the Customs Authority confirms that there is only the VIN without the frame number and engine number, the vehicle registration authority shall take photos of the VIN for record in the file and use the VIN instead of the frame number and engine number.
c) Conduct safety and environmental protection technical inspections as prescribed for police force specialized motor vehicles.
3. Inspect the vehicle registration file and issue license plates
Receive the vehicle registration file; inspect and compare the vehicle owner's documents, the Vehicle Registration Application Form with the vehicle's documents (transfer certificates, tax certificates, and origin certificates) as prescribed. If the vehicle registration file is incomplete as prescribed, the staff receiving the file must guide the vehicle owner according to point a, Clause 4, Article 4 of this Circular.
In case the vehicle registration file is complete as prescribed, carry out the following steps:
a) Number the file and summarize the key information (Vehicle Registration Application Form, tax certificate, transfer certificate, origin certificate) on the cover of the file.
b) Enter the vehicle owner's name and address, and the vehicle's characteristics such as brand, type, engine number, frame number, paint color, load capacity, seating capacity into the computer registration and management program; record the license plate number on the Vehicle Registration Application Form.
In case the license plate has not been issued through the computer system, it must be issued in sequence without interruption; record the license plate number on the Vehicle Registration Application Form; enter the license plate number, the vehicle owner's name and address, and the vehicle's characteristics (brand, type, engine number, frame number, paint color, load capacity, seating capacity) into the vehicle registration management software on the computer.
c) Issue a receipt to the vehicle owner.
4. Collect the vehicle registration fee.
5. Return the license plate to the vehicle owner (guide the vehicle owner to install the license plate in the designated position according to the vehicle design; if the vehicle design allows only two long plates or two short plates, allow the exchange of plates, with the vehicle owner responsible for any additional costs).
6. Guide the vehicle owner to mark the license plate number, load capacity, gross weight, and vehicle owner's name on the vehicle as prescribed.
7. Stamp the heading "VEHICLE REGISTERED ON ... MONTH ... YEAR ... LICENSE PLATE NUMBER..." in the upper right corner of the Vehicle Registration Application Form, transfer certificate, tax certificate, and origin certificate.
8. Print the vehicle registration certificate.
For police force specialized motor vehicles, if they meet the safety standards as prescribed, print the Inspection Booklet, Inspection Certificate, and Inspection Sticker.
9. Report to the leadership of the Vehicle Registration and Management Guidance Office under the Highway Police Traffic Department - Railway Traffic Police Bureau, and the head of the Vehicle Registration Team to review and approve the file for submission to the authorized leader to sign the vehicle registration documents as prescribed.
10. Laminating the vehicle registration certificate.
11. Collect the receipt, return the vehicle registration certificate to the vehicle owner, and guide the vehicle owner to purchase compulsory motor vehicle liability insurance from the insurance company as prescribed.
12. Transfer the vehicle registration file to the file manager; report the vehicle registration results as prescribed.
Article 7. Registration for transferring ownership within the same province or centrally governed city (referred to collectively as "province")
1. Check the vehicle owner's documents.
2. Compare the engine number and frame number stickers on the Vehicle Registration Application Form with the actual vehicle.
3. Accept the transfer application; enter the name, address of the vehicle owner, and characteristics of the vehicle, and follow the steps specified in point c, Clause 3; Clause 4, Article 6 of this Circular.
In cases where the vehicle owner has lost the registration certificate without having paid the stamp duty, issue a verification form for the buyer to complete the stamp duty payment procedures.
4. Write a withdrawal request form for the original file (if transferring ownership of motorcycles or motor vehicles between different districts, notify the file management authority).
5. Cut off the upper right corner of the front side of the vehicle registration certificate.
6. Follow the provisions set out in Clauses 7, 8, 9, 10, 11, and 12, Article 6 of this Circular. For vehicles currently using three-digit or four-digit license plates, change them to five-digit plates according to regulations.
In cases where motorcycles or motor vehicles are transferred and moved to a different district, the receiving authority must notify the current file management authority in writing within two working days to request a transfer form; upon receipt of the notification, the current file management authority must write and attach the transfer form to the file, seal it, and send it via inter-office mail to the new registration authority.
Article 8. Transfer and move to another province
1. Check the vehicle owner's documents, accept two Vehicle Transfer Applications, and the transfer files.
2. Reclaim the license plate and vehicle registration certificate.
3. Write a withdrawal request form for the original file.
4. Carefully compare the vehicle registration certificate with the vehicle transfer documents; note that transfer procedures should not be carried out for vehicles that have exceeded their service life according to the law.
5. Update the vehicle transfer information in the computer system, print two Transfer Forms and temporary vehicle registration certificates (if requested by the vehicle owner).
6. Cut off the upper right corner of the front side of the vehicle registration certificate.
7. Present the transfer application, Transfer Forms, and temporary vehicle registration certificate (if applicable) for leadership signature.
9. Seal the original file with a cross-stamp. The Transfer Form, transfer application, vehicle registration certificate, and vehicle transfer documents should be attached to the outside of the sealed file folder.
10. Return the Transfer Form, transfer application, and original file to the vehicle owner along with a temporary vehicle registration certificate, and instruct the owner to affix the temporary license plate as required (if applicable).
11. Hand over the transfer application, Transfer Form (retained copy) to the file management staff.
Article 9. Registration for transferring ownership from another province
1. Must have a Vehicle Transfer Application, Transfer Form, and registration file as prescribed.
2. Follow the steps specified in Article 6 of this Circular.
Article 10. Temporary Registration and License Plate Issuance
1. Check the vehicle owner's documents, Vehicle Registration Application, and compare the original file with the photocopy.
2. Follow the steps specified in point b, Clause 3, and Clauses 4, 8, 9, 11, and 12, Article 6 of this Circular.
3. Return the temporary vehicle registration certificate and original file to the vehicle owner, except for vehicles requiring the reclamation of the registration and license plate.
4. In cases of extending the validity period of the temporary vehicle registration certificate, reclaim the first issued temporary vehicle registration certificate and retain it in the file, then issue a new temporary registration certificate (no need for a Vehicle Registration Application).
Article 11. Changing, reissuing vehicle registration certificates, license plates, or modified vehicles, repainted vehicles.
1. Check the owner's documents; vehicle registration application form.
2. Retrieve the vehicle registration certificate (to issue a new one), license plate (to issue a new one).
3. Inspect the actual vehicle (for modified vehicles, repainted vehicles, advertising vehicles).
4. Write a proposal to withdraw the original file, inspect, and compare the vehicle file.
5. Update the content of changing, reissuing vehicle registration certificates, license plates into the computer system.
6. For cases of changing, reissuing license plates, follow the provisions set out in Clauses 3, 4, 5, 7, 9, 11, 12 of Article 6 of this Circular. For cases of changing, reissuing vehicle registration certificates, follow the provisions set out in Clauses 4, 7, 8, 9, 10, 11, 12 of Article 6 of this Circular.
7. Stamp "CHANGE, REISSUE NUMBER …" on the upper right corner of the Vehicle Registration Application Form. For cases of changing, reissuing vehicle registration certificates, stamp "CHANGE, REISSUE NUMBER …" on the front of the vehicle registration certificate (above the line of the vehicle registration certificate text).
8. If the vehicle file is used as a registration document for a complete engine or chassis to replace another vehicle, then the entire vehicle file used as a document for that complete engine or chassis (including both registered and unregistered vehicle files) will be utilized.
Article 12. Registering and issuing civilian license plates for vehicles of the People's Army and People's Public Security serving security and defense purposes.
1. Registering vehicles and issuing civilian license plates for vehicles of the People's Army.
a) Accept the letter from the leadership of the Ministry of National Defense with the approval opinion of the Minister of Public Security; a copy of the vehicle registration certificate (for vehicles already registered by the People's Army), if the vehicle has not been registered, the file must be complete according to regulations.
b) Follow the provisions of Article 6 of this Circular.
2. Registering vehicles according to operational requirements within the Public Security sector.
a) Accept the letter from the unit requesting vehicle registration according to operational requirements with the approval opinion of the Director of the Highway Police Corps under the Ministry of Public Security (for registration at the Highway Police Corps) or the Provincial Public Security Chief (for local registration); a copy of the vehicle registration certificate (for already registered vehicles), if the vehicle has not been registered, the file must be complete according to regulations.
b) Follow the provisions of Article 6 of this Circular.
3. Registering vehicles approved to use a different series of license plates according to regulations (applicable to vehicles eligible for white background, black lettering license plates now approved for blue background, white lettering license plates or vice versa).
a) Accept the letter from the agency or unit with the approval opinion of the Minister of Public Security.
b) Follow the provisions of Article 6 of this Circular.
4. Registering vehicles serving leaders of the Party and State who are designated as protected individuals under Clause 1 of Article 10 of the Guard Law 2005.
a) Accept the letter from the Guard Command; a copy of the vehicle registration certificate (for already registered vehicles), if the vehicle has not been registered, the file must be complete according to regulations.
b) Follow the provisions of Article 6 of this Circular.
Article 13. Retrieving vehicle registration certificates and license plates.
1. Check the owner's documents, accept the Application for Retrieval of Registration Certificate and License Plate.
2. Retrieve the license plate and vehicle registration certificate, print a receipt.
3. Write a withdrawal form for the original file.
4. Enter the retrieval information into the computer system. Print two copies of the Certificate of Retrieval of Registration Certificate and License Plate.
If retrieving the vehicle registration certificate to obtain a complete engine or chassis to replace another vehicle, print the Certificate of Retrieval of Registration Certificate and License Plate according to regulations; simultaneously, confirm on the back of the Certificate of Retrieval of Registration Certificate and License Plate issued for the chassis or complete engine.
5. Cut off the top right corner of the vehicle registration certificate.
6. Report to the authorized person specified in Article 4 of this Circular to sign the Certificate of Retrieval of Registration Certificate and License Plate.
7. Issue a temporary vehicle registration certificate for automobiles and process the retrieval of registration certificate and license plate for re-exportation or transfer within Vietnam; project vehicles exempted from import tax now transferred to other purposes; vehicles registered in economic and trade zones when re-exported or transferred into Vietnam.
8. Return the Certificate of Retrieval of Registration Certificate and License Plate to the owner.
9. Hand over the file, Certificate of Retrieval of Registration Certificate and License Plate (retained copy) to the file management officer.
Chapter III
IN PATROL AND SUPERVISION WORK
1. Large electricity consumers or retail electricity suppliers in authorized zone or cluster models may purchase electricity from the Electricity Corporation to meet their entire demand.
1. The Traffic Police Department of the Provincial Public Security shall guide the resolution of difficulties and issues in vehicle registration work of the County Public Security. For newly arising issues without guidance documents, they shall advise and assist the Provincial Public Security Chief in reporting to the Ministry (through the General Administration of Public Order Management).
2. For difficulties related to local departments such as Finance, Customs, Transportation, Courts, Prosecution Offices, Civil Enforcement Agencies, agencies authorized to confiscate administrative violation assets and means, Asset Auction Centers, etc., the Traffic Police Department of the Provincial Public Security shall advise the Provincial Public Security Chief to exchange letters with these departments to reach a consensus on resolving them.
Article 15. Numbering of Engine Numbers and Frame Numbers
1. Prepare a proposal form to number engine numbers and frame numbers for submission to the Director of the Highway Police Department under the Ministry of Public Security (for vehicles registered with the Department); the Head of the Traffic Police Division of the Provincial Police Force or the Head of the County Police (for vehicles registered locally) to approve.
2. Implement the numbering of engine numbers and frame numbers.
3. Enter the numbered engine numbers and frame numbers into the vehicle registration application form and affix them at designated positions.
Article 16. Cases Where Vehicle Origin Documents Show Signs of Erasure or Forgery; Vehicles Have Duplicate Engine Numbers and Frame Numbers or Signs of Welding, Erasure, or Re-engraving
1. Report to the Director of the Highway Police Department under the Ministry of Public Security (for vehicles registered with the Department), the Head of the Traffic Police Division of the Provincial Police Force, or the Head of the County Police (for vehicles registered locally) for instructions; if the leadership decides to temporarily detain the vehicle and the registration file, then prepare a temporary detention record. The temporary detention decision and the temporary detention record must be prepared in two copies, one copy handed over to the vehicle owner, and one copy retained by the registration authority.
2. Within two working days from the date of issuance of the temporary detention decision, the registration authority receiving the vehicle registration file must send a request to the Criminal Technical Appraisal Agency under the Ministry of Public Security to conduct an appraisal. Within ten days from the date of receipt of the appraisal request, the appraisal agency must respond in writing.
a) In cases where the appraisal agency concludes that the vehicle origin documents have not been forged or erased, and the engine numbers and frame numbers remain original, proceed with vehicle registration.
b) In cases where the appraisal agency concludes that the import origin documents are fake, have been erased, or the engine numbers and frame numbers have been welded, erased, or re-engraved, transfer the case to the competent investigative agency for resolution and notify the vehicle owner.
If the investigative agency concludes that the import origin documents of the vehicle are fake and it is not stolen or illegally appropriated property, the registration authority shall transfer the case to the Customs Department or the local Tax Department for tax recovery. After obtaining the tax recovery documents, proceed with vehicle registration.
If the investigative agency concludes that the imported vehicle has had its frame and engine numbers altered abroad before the Government's ban on imports (for vehicles with frame and engine numbers altered abroad) and the original numbers and legitimate origin documents can be verified without commercial fraud, and the year of manufacture is clearly determined by the Vietnam Inspection Center, impose administrative penalties according to the law and proceed with vehicle registration.
If the imported vehicle has had its engine numbers and frame numbers altered after the Government's ban on imports or if there is a conclusion from the investigative agency that the engine numbers and frame numbers have been cut or welded, do not proceed with vehicle registration.
Article 17. Cases Where Fake Vehicle Origin Documents or Erased Documents Are Discovered During Name Transfer, Relocation, Change, Replacement Registration, or License Plate Procedures, or Through File Review
1. Follow the provisions of Article 16 of this Circular.
2. In cases where the investigative agency concludes that the vehicle is smuggled but not evidence in a criminal case, proceed as follows:
a) Propose to the Director of the Highway Police Department under the Ministry of Public Security or the Provincial Police Chief to issue a letter and transfer the file to the Customs Department or the local Tax Department for tax recovery according to regulations;
b) Guide the vehicle owner to contact the Customs Department or the local Tax Department to resolve the matter;
c) After the vehicle owner pays taxes according to the law, accept the file and proceed with registration according to the provisions of Article 6 of this Circular.
Article 18. Vehicle registration with decisions on asset disposal or auction issued by competent authorities
1. Implement as prescribed in Article 6 of this Circular. In case of complaints, guide the vehicle owner to the authority that issued the decision on asset disposal or auction for resolution.
2. For vehicles confiscated and transferred to the state treasury which already have license plates, the vehicle registration authority shall notify the Public Security agency where the vehicle was previously registered to cancel the vehicle's file (this notification shall be kept in the vehicle's file).
3. Vehicles with decisions confiscating them for the state treasury (original copies issued for each vehicle) do not need original files, but the confiscation decision or the decision on disposing of confiscated evidence must include all characteristics of the vehicle such as brand, type, chassis number, engine number, complete technical specifications. If the confiscation decision or the decision on disposing of confiscated evidence does not fully record the vehicle's characteristics, registration will not be accepted and the vehicle owner shall be guided to the issuing authority for resolution.
Article 19. Issuance and affixing of control stickers for special economic zones and international border economic zones' motor vehicles operating domestically as prescribed by the Government
1. Accept the declaration form for temporary import and re-export of road transport vehicles; check the vehicle registration certificate, Identity Card or Passport still valid or other documents substituting for Passport.
2. Check and compare with the list of vehicles applying to operate domestically, record in the tracking book, issue the control sticker immediately to the vehicle owner, and guide the owner to affix the control sticker inside the upper right corner of the front windshield of the vehicle according to regulations.
Article 20. Cases where a vehicle changes ownership or moves but loses the original file or the file managed by the owner before is lost or damaged
1. In cases where the entire original file or transfer file is lost:
a) Guide the vehicle owner to write a letter or submit a statement committing responsibility for the loss of the original file;
b) Verify the owner's documents according to regulations;
c) Guide the vehicle owner to the Public Security agency where the transfer procedures were handled to confirm the transfer on the copy of the Transfer Certificate;
d) The Public Security agency receiving the registration file must publicly announce the license plate number, chassis number, engine number, brand, and type of the vehicle whose file is lost at its office. After thirty days, if there are no complaints or accusations, proceed with the registration and report to the Highway Police Traffic Management Bureau; in case of suspicion, report to the Director of the Highway Police Traffic Management Bureau (at the Ministry) or the Provincial Public Security Chief (locally).
2. In cases where part of the documents in the original file of the vehicle (registration application, recovered registration certificate [corner cut], vehicle modification file, transfer application, transfer documents, stamp duty payment receipt managed by the owner) are lost:
a) The vehicle owner writes a letter or submits a report of loss;
b) Verify the owner's documents according to regulations;
c) The Public Security agency receiving the registration file must publicly announce the vehicle with chassis number, engine number, brand, and type whose file is lost at its office. After fifteen days, if there are no complaints or accusations, proceed with the transfer registration.
Article 21. Cases where vehicle registration files transferred are incomplete
1. In cases where the file is missing procedures due to the fault of the vehicle owner, guide the vehicle owner to supplement the file in accordance with regulations.
2. In cases where the file is missing procedures due to the fault of the registration authority transferring the file, the receiving authority must issue a letter to the transferring authority, clearly stating the reasons for requesting to supplement the missing procedures. Within three working days from the date of receipt of the request letter, the transferring authority must provide a written response along with the supplementary file; in special cases where it is not possible to fully supplement the file according to regulations, a written statement explaining the reasons must be made and reported to the Director of the Provincial Public Security for a directive from the General Traffic Police Department on administrative management of public order and social security.
Article 22. Cases where a vehicle has been transferred but the vehicle owner has not completed the transfer registration procedure and the vehicle registration certificate is lost.
1. Guide the transferee to prepare a letter or application for vehicle registration.
2. Verify and compare the identity documents of the transferee and the vehicle transfer documents.
3. Publicly announce at the registration office the name, address of the vehicle owner, license plate number, chassis number, engine number of the vehicle; after fifteen days, if there are no complaints or reports, process the registration in accordance with Articles 7 and 8 of this Circular; in cases where the vehicle is transferred within the province or centrally-administered city, print out the verification reply form for the buyer to complete the stamp duty payment procedures.
Article 23. Cases where the registration file retained at the registration office is lost, damaged, or misplaced.
1. The staff managing the vehicle registration file must write a self-criticism report, clearly stating the reasons and bearing responsibility for the loss, damage, or misplacement of the file.
2. Establish a Committee to determine the cause of the lost vehicle registration file, consisting of:
a) The Committee at the Highway Police Traffic Management Bureau, chaired by the Director; the Heads of the Force Construction and Logistics Department and the Vehicle Registration and Management Guidance Department are members;
b) The Committee at the Provincial Public Security, chaired by the Provincial Public Security Director; the Heads of the Traffic Police Department and the Inspectorate of the Provincial Public Security are members; in cases where the vehicle registration file managed by the County Public Security is lost, the Head of the County Public Security is also a member.
3. The Committee to determine the cause of the lost vehicle registration file is responsible for examining and concluding each specific case of file loss. The meeting minutes and conclusions of the Committee have the value of replacing the original vehicle file.
Article 24. Handling of registration file for vehicle deregistration and license plate recovery.
1. In cases where the vehicle registration file has exceeded its usage period; homemade vehicles that have exceeded their circulation period as prescribed; vehicles involved in accidents and rendered unusable which have completed the deregistration and license plate recovery procedures; temporary registration files should be stored, and after one year, a Committee should be established to cancel the license plates and registration forms.
2. Recovered license plates and damaged registration forms must be managed according to the file system of the Ministry of Public Security. Every six months, the registration authority must report to the competent authority to establish a Committee to cancel license plates and registration forms as follows:
a) The Committee at the Highway Police Traffic Management Bureau, chaired by the Director, with members including the Heads of the Force Construction and Logistics Department and the Vehicle Registration and Management Guidance Department;
b) The Committee at the Provincial Public Security, chaired by the Deputy Director of the Provincial Public Security; the Heads of the Traffic Police Department and the Inspectorate of the Provincial Public Security are members; at the county level, the Head of the County Public Security is also a member.
3. The registration authority at any level is directly responsible for canceling license plates and registration forms.
Article 25. Management, exploitation, supply, and use of vehicle registration databases
1. The local authority where the license plate bears the registration symbol of that locality shall be responsible for responding to inquiries about the vehicle.
2. Procedures for responding to inquiries about vehicles at the request of police forces:
a) Accept the introduction letter from the agency or unit requesting to search and verify license plates, and print the verification response form on the same day;
b) In cases where agencies or units send a letter requesting to search and verify license plates, within five days from the date of receipt of the request letter, the vehicle file management agency must issue a written response.
3. Extracting copies or lending vehicle registration files to serve operational requirements:
a) Accept the official letter requesting to borrow or extract copies of vehicle registration files to serve operational requirements with the consent of the leader of the Highway Police Traffic Police Corps (at the Ministry level) or the provincial public security leader (at the local level);
b) Prepare a record of borrowing and returning vehicle files, the borrowing period shall not exceed thirty days from the date of receiving the files.
4. Responding to inquiries about vehicles at the request of the person executing the judgment or the representative authorized by the person executing the judgment.
a) The person executing the judgment or the authorized representative must present one of the following documents: Judgment of the Court or enforcement decision; official letter or introduction letter from the enforcement agency accompanied by a valid ID card, power of attorney with notarization or certification;
b) Print the Verification Response Form for the vehicle.
Chapter IV
MANAGEMENT OF VEHICLE REGISTRATION FORMS AND LICENSE PLATES, INFORMATION REPORTING REGIME
Article 26. Management of vehicle registration forms and license plates
1. Vehicle registration forms; model Certificate of Technical Safety Inspection and Environmental Protection for Motor Vehicles; inspection stickers; inspection books; license plates must be strictly managed according to the file management regime of the Ministry of Public Security.
2. Based on the actual needs of the locality, the Provincial Public Security Traffic Police Department shall budget and register with the Highway Police Traffic Police Corps regarding the number of registration forms used for vehicle registration by their unit and distribute them to the Public Security Departments of districts, counties, towns, and cities under the province.
The Highway Police Traffic Police Corps is responsible for printing various types of vehicle registration forms and models of the Certificate of Technical Safety Inspection and Environmental Protection for Motor Vehicles, inspection stickers, inspection books (for vehicles of the People's Public Security force) to distribute to local public security departments. Specifically, registration forms from form number 09 to form number 16 issued together with Circular 06/2009/TT-BCA-C11 dated March 11, 2009, by the Minister of Public Security stipulating the issuance and revocation of registration certificates and license plates for various types of motor vehicles have been printed and can continue to be distributed and used until December 31, 2011.
3. Each vehicle is issued one set of license plates bearing the management number of the registration authority; license plates that are recovered according to regulations shall not be reissued to other vehicles.
4. Issuing new series of license plates at the local level may only be carried out after obtaining written approval from the Highway Police Traffic Police Corps.
Article 27. Management of Vehicle Registration Programs on Computers
1. The vehicle registration program shall be uniformly applied for vehicle registration on computers nationwide.
2. The Highway Police Traffic Safety Department under the Ministry of Public Security shall be responsible for managing the vehicle registration program and vehicle registration data on computers in accordance with regulations.
3. Provincial Public Security Departments shall be responsible for receiving, managing the vehicle registration program and license plate data installed on computers; directing the Traffic Police Departments at provincial and district levels to install and manage the use thereof in compliance with regulations.
Article 28. Information Reporting System
The management, exploitation, provision, and use of vehicle registration databases shall be connected through a network nationwide. In cases where infrastructure has not yet been connected to the network, the information reporting system shall be implemented as follows:
1. On a weekly and monthly basis, the District Public Security Departments shall compile vehicle registration data and transfer it to the Traffic Police Departments of the Provincial Public Security Departments.
2. On a monthly basis, the Traffic Police Departments of the Provincial Public Security Departments must transfer their local vehicle registration data onto CDs, floppy disks, or transmit the data to the Highway Police Traffic Safety Department.
Chapter V
IMPLEMENTATION
Article 29. Effective Date
This Circular takes effect from December 6, 2010, and replaces Circular No. 31/2009/TT-BCA dated May 25, 2009, issued by the Minister of Public Security, concerning standards, responsibilities of officers handling vehicle registration tasks, and procedures for organizing the issuance and revocation of various types of vehicle registration certificates and license plates.
Article 30. Responsibility for Implementation
1. The Director of the Administrative Police General Department for Social Order and Safety shall be responsible for organizing the implementation and guiding, directing, and inspecting the implementation of this Circular.
2. The Directors of the General Departments, Heads of units directly under the Ministry, Provincial Public Security Directors, Directors of Fire Prevention, Firefighting, and Rescue Services shall be responsible for implementing this Circular.
3. During the implementation process, if any difficulties arise, the Public Security units and localities shall report to the Ministry (through the Administrative Police General Department for Social Order and Safety) for timely guidance./.
