REGULATIONS ON PROCEDURES AND FORMS FOR ANNOUNCING VIEWER MEASUREMENT DATA OF TELEVISION PROGRAMS TO EVALUATE THE EFFECTIVENESS OF TELEVISION CONTENT
BASED ON THE LAW ON PRESS"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the Government Decree No. 06/2016/NĐ-CP dated January 18, 2016 on management, provision, and use of radio and television services;
Article 1. Amending and supplementing some articles of Circular No. 19/2016/TT-BTTTT dated June 30, 2016 of the Minister of Information and Communications on forms for registration declaration, application for license, certificate, license, and business report as prescribed in Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
THE MINISTER OF INFORMATION AND COMMUNICATION ISSUES THIS CIRCULAR TO REGULATE THE PROCEDURES AND FORMS FOR ANNOUNCING VIEWER MEASUREMENT DATA OF TELEVISION PROGRAMS TO EVALUATE THE EFFECTIVENESS OF TELEVISION CONTENT.No. "7. GENERAL PROVISIONS
Article 1. Scope of Regulation
1. TELEVISION PROGRAM CHANNELS SERVING NATIONAL AND LOCAL POLITICAL TASKS AND ESSENTIAL INFORMATION AND PROPAGANDA AS PROVIDED IN CIRCULAR NO. 18/2016/TT-BTTTT OF JUNE 28, 2016 OF THE MINISTRY OF INFORMATION AND COMMUNICATION ON THE LIST OF TELEVISION PROGRAM CHANNELS SERVING NATIONAL AND LOCAL POLITICAL TASKS AND ESSENTIAL INFORMATION AND PROPAGANDA.
2. OTHER DOMESTIC TELEVISION PROGRAM CHANNELS THAN THOSE MENTIONED IN CLAUSE 1 OF THIS ARTICLE.
3. FOREIGN TELEVISION PROGRAM CHANNELS ON PAY RADIO AND TELEVISION SERVICES.
4. SPECIAL PROGRAMS WITHIN TELEVISION PROGRAM CHANNELS ON RADIO AND TELEVISION SERVICES.
THIS CIRCULAR APPLIES TO STATE ADMINISTRATIVE ORGANIZATIONS MANAGING RADIO AND TELEVISION, NEWS MEDIA ORGANIZATIONS WITH LICENSES FOR TELEVISION OPERATIONS, AND ORGANIZATIONS AND INDIVIDUALS RELATED TO RADIO AND TELEVISION SERVICE OPERATIONS AND TELEVISION VIEWER MEASUREMENT.
Article 2. Applicability
ARTICLE 3. DEFINITION OF TERMS
1. TELEVISION VIEWER INDEX IS THE PERCENTAGE (%) OF THE NUMBER OF HOUSEHOLDS WATCHING A TELEVISION PROGRAM CHANNEL OR A TELEVISION PROGRAM OVER THE TOTAL NUMBER OF HOUSEHOLDS WITH TELEVISION SIGNAL RECEIVERS IN THE TELEVISION VIEWER MEASUREMENT SCOPE DURING A SPECIFIED TIME PERIOD.
2. TELEVISION VIEWER MARKET SHARE INDEX IS THE PERCENTAGE (%) OF THE NUMBER OF VIEWERS OF A CHANNEL OR A TELEVISION PROGRAM OVER THE TOTAL NUMBER OF VIEWERS OF ALL CHANNELS OR TELEVISION PROGRAMS IN THE TELEVISION VIEWER MEASUREMENT SCOPE DURING A SPECIFIED TIME PERIOD.
3. TELEVISION VIEWER REACH INDEX IS THE NUMBER OF NON-DUPLICATE VIEWERS OF A TELEVISION PROGRAM CHANNEL OR A TELEVISION PROGRAM IN THE TELEVISION VIEWER MEASUREMENT SCOPE DURING A SPECIFIED TIME PERIOD.
4. ANNOUNCING TELEVISION VIEWER MEASUREMENT DATA IS THE ACTIVITY OF THE AUTHORIZED STATE ADMINISTRATION BODY PUBLICLY ANNOUNCING TELEVISION VIEWER MEASUREMENT DATA REGULARLY OR SPONTANEOUSLY FOR TELEVISION PROGRAM CHANNELS OR PROGRAMS WITHIN TELEVISION PROGRAM CHANNELS TO SERVE STATE ADMINISTRATION WORK.
5. TELEVISION VIEWER MEASUREMENT SAMPLE IS A SET OF HOUSEHOLDS SELECTED AS REPRESENTATIVE SAMPLES IN THE TELEVISION VIEWER MEASUREMENT SCOPE.
6. TELEVISION VIEWER MEASUREMENT SAMPLE SIZE IS A SET OF HOUSEHOLDS WITH TELEVISION SIGNAL RECEIVERS SELECTED AS REPRESENTATIVE SAMPLES IN THE TELEVISION VIEWER MEASUREMENT SCOPE.
7. ECONOMIC AND SOCIAL COMPONENT OF A HOUSEHOLD IS AN INDEX USED TO EVALUATE AND CLASSIFY HOUSEHOLDS ACCORDING TO THEIR STANDARD OF LIVING AND SOCIAL STATUS BASED ON MONTHLY INCOME, NUMBER OF DURABLE ASSETS, EDUCATIONAL LEVEL, AND OCCUPATION OF THE PRIMARY INCOME-EARNER IN THE FAMILY, AND IS DIVIDED INTO DIFFERENT LEVELS.
8. TELEVISION VIEWER MEASUREMENT EQUIPMENT IS SPECIALIZED DEVICES INSTALLED AND CONNECTED TO TELEVISION SIGNAL RECEIVERS OF HOUSEHOLDS TO COLLECT TELEVISION VIEWER DATA.
9. TELEVISION VIEWER MEASUREMENT SCOPE IS THE GEOGRAPHICAL AREA OR THE SERVICE DELIVERY AREA:
a) NATIONAL SCOPE IS THE AREA FROM THIRTY (30) PROVINCES AND CITIES TO SIXTY-THREE (63) PROVINCES AND CITIES UNDER THE CENTRAL GOVERNMENT;
b) REGIONAL SCOPE IS THE AREA FROM TWO (02) PROVINCES AND CITIES UNDER THE CENTRAL GOVERNMENT TO TWENTY-NINE (29) ADJACENT PROVINCES AND CITIES UNDER THE CENTRAL GOVERNMENT WITH SHARED BOUNDARIES;
c) PROVINCIAL SCOPE IS THE AREA WITHIN ONE (01) PROVINCE OR CITY UNDER THE CENTRAL GOVERNMENT.
REGULATIONS ON ACTIVITIES, PROCEDURES, AND RESPONSIBILITIES
Chapter II
IMPLEMENTATION OF TELEVISION VIEWER MEASUREMENT
ORGANIZATION AND IMPLEMENTATION OF AUDIENCE MEASUREMENT FOR TELEVISION
Article 4. Television audience measurement activities
1. Television audience measurement includes the following activities:
a) Collecting television audience measurement data for television channel programs or groups of television channel programs;
b) Collecting television audience measurement data for programs within a television channel program;
c) Analyzing, synthesizing, and evaluating the television audience measurement data collected according to Point a and b, Clause 1 of this Article;
d) Preparing reports on measurement data to serve the evaluation of the effectiveness of television content.
2. Television audience measurement activities shall be conducted regularly or on an ad hoc basis as follows:
a) Television audience measurement activities in five (05) centrally governed cities: Hanoi, Ho Chi Minh City, Da Nang, Hai Phong, and Can Tho shall be carried out every two (02) years;
b) Television audience measurement activities nationwide, at regional and provincial levels outside the five (05) centrally governed cities specified in Point a, Clause 2, of this Article shall be carried out every five (05) years;
c) Television audience measurement activities for television programs shall be carried out on an ad hoc basis upon request for management of broadcasting and television services when approved by the competent authority.
Article 5. Television audience measurement process
1. Conducting basic surveys
Basic surveys shall be conducted through face-to-face interviews using structured questionnaires to collect basic information from households in the survey area. Basic surveys must strictly adhere to sampling principles, random sampling methods, and a minimum sample size for television audience measurement that is five (05) times the number of household samples within the scope of television audience measurement to ensure accuracy and reliability.
2. Designing measurement samples and selecting households
Household measurement sample design shall be used to calculate and allocate the number of households meeting criteria within the scope of television audience measurement. The selected measurement household samples must ensure representativeness based on criteria affecting the level and habits of watching television, including:
a) Household size (number of people in the household);
b) Economic and social composition of the household;
c) Number of television sets in the household;
d) Type of broadcasting and television service used by the household.
3. Collecting measurement data consistent with the measurement sample
a) Television audience measurement data from households include information about the household, viewer information corresponding to the content viewed on television signal receivers and viewing time and date, which are automatically updated daily to the central data processing center for aggregation and analysis;
b) Standard signal sources for identifying television channel programs and television programs must be obtained from master control rooms or signal reception points from broadcasting and television service providers to ensure signal quality.
4. Analyzing, synthesizing, and evaluating measurement data
Television audience measurement data received from households must be processed as follows:
a) Filtering data to detect and remove unreasonable data affecting the results of television audience measurement;
b) Filtered data must be combined with demographic information about the household, transmission infrastructure information, and other necessary information for analyzing television audiences;
c) Supplementing and completing data formats before using software to analyze television audience measurement indices within the measurement scope.
5. Preparing measurement reports
Measurement reports must be prepared using software tools and must include all indices according to television channel programs and programs within television channel programs within the measurement scope, as follows:
a) Television audience index;
b) Television audience market share index;
c) Television audience reach index.
Article 6. Responsibilities for Implementing Television Audience Measurement
1. The Radio, Television, and Electronic Information Administration shall be responsible for:
a) Developing plans for implementing television audience measurement nationwide, by region, by province, and by topic to submit to the Ministry of Information and Communications for approval;
b) Sending the plan to relevant Provincial Departments of Information and Communications within seven (07) days from the date the plan is approved by the Ministry of Information and Communications;
c) Selecting units with expertise in surveying, sociological research, and modern technology-based television audience measurement in Vietnam to implement television audience measurement nationwide, by region, by province, and by topic to serve the evaluation of television content effectiveness;
d) Compiling and completing files to submit to the Ministry of Information and Communications for approval of national, regional, provincial, and topic-specific television audience measurement data;
đ) Developing annual financial plans to ensure funding for the implementation of Point b, Clause 1 of this Article to submit to the Minister of Information and Communications for approval;
2. Provincial Departments of Information and Communications under centrally governed cities shall be responsible for:
a) Cooperating with the Radio, Television, and Electronic Information Administration to implement television audience measurement plans within their provinces according to Point a, Clause 1 of this Article;
b) Developing plans and budgets to cooperate with the Radio, Television, and Electronic Information Administration to submit to competent authorities for approval to ensure the implementation of television audience measurement plans within their provinces;
Chapter III
PROVISIONS ON APPROVAL, ANNOUNCEMENT, AND MANAGEMENT OF TELEVISION AUDIENCE MEASUREMENT DATA
TELEVISION AUDIENCE MEASUREMENT
Article 7. Documents for Approval of Television Audience Measurement Data
1. A request for approval of television audience measurement data consistent with the plan already approved by the competent authority;
2. A comprehensive report on television audience measurement data serving the evaluation of television content effectiveness; television audience measurement data by topic;
3. A basic index table for measuring television audiences for channels and programs within channels to serve the announcement of television audience measurement data;
Article 8. Content of Announcing Television Audience Measurement Data
The content of announcing television audience measurement data must be consistent with the plan already approved by the competent authority and include the following results:
1. A comprehensive report on television audience measurement data serving the evaluation of television content effectiveness; television audience measurement data by topic;
2. A basic index table for measuring television audiences that has been approved by the competent authority;
Article 9. Time for Reporting and Announcing Television Audience Measurement Data
1. The deadline for submitting reports on television audience measurement data of the previous period is no later than March 15 (03/15) of the first year of the next period;
2. The deadline for submitting reports on television audience measurement data by topic is carried out according to specific requirements of the plan already approved by the competent authority;
3. Television audience measurement data shall be publicly announced on the electronic information website of the Radio, Television, and Electronic Information Administration no later than fifteen (15) days from the date the competent state authority decides and approves.
Article 10. Archiving Television Audience Measurement Data
1. National, regional, provincial, and thematic television audience measurement data shall be stored in two (02) copies (paper and electronic versions) at the Radio, Television, and Electronic Information Administration.
2. The archival files for television audience measurement data shall include the documents specified in Article 7.
Article 11. Management and Use of Television Audience Measurement Data
1. Television audience measurement data published by authorized agencies belong to the State.
2. Organizations and individuals shall have equal access to exploit and utilize publicly disclosed television audience measurement information in accordance with this Circular.
3. Organizations and individuals citing and using publicly disclosed television audience measurement data must ensure accuracy and clearly indicate the source of the data being used.
Chapter IV
IMPLEMENTING PROVISIONS
Article 12. Effective Date
This Circular takes effect from July 1, 2017.
Article 13. Implementation Organization
The Director of the Office; Heads of Departments: Legal Affairs, Planning-Finance; Director of the Radio, Television, and Electronic Information Administration; Heads of agencies and units under the Ministry of Information and Communications; Directors of Provincial and Central City Departments of Information and Communications; General Directors and Directors of press agencies with broadcasting licenses; related organizations and individuals are responsible for implementing this Circular.
