CIRCULAR

PLAN FOR THE USE OF FM BROADCAST FREQUENCY CHANNELS

Pursuant to the Law on Frequency Pursuant to Decision No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain articles of Decision No.

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. 22/2009/QĐ-TTg dated February 16, 2009 of the Prime Minister approving the "Plan for Broadcasting and FM Radio and Television Transmission until 2020";Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the "National Radio Frequency Band Plan" and Decision No. 02/2017/QĐ-TTg dated January 17, 2017 of the Prime Minister amending and supplementing the National Radio Frequency Band Plan issued together with Decision No. 71/2013/QĐ-TTg;

At the proposal of the Director of the Frequency Management Agency, the Minister of Information and Communications issues this Circular on the Plan for the Use of FM Broadcast Frequency Channels. frequency This Circular plans the use of FM broadcast frequency channels, including the arrangement and regulation of conditions for using FM broadcast frequency channels in the 87-108 MHz band and the regulation of conditions for using frequencies for wireless radio stations and FM rebroadcasting stations. frequency This Circular applies to organizations and units participating in the management and use of FM broadcast frequency channels.

Article 2. Principles for allocating frequency channels1. Taking into account the current usage status of Vietnam to ensure the transition from the current status to the plan with the lowest cost.

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

2. Allocating frequency channels reasonably and effectively to meet the coverage requirements for FM broadcasting channels of the Voice of Vietnam Radio Stations, FM broadcasting channels of provincial and municipal radio stations under the central government; minimizing overlapping coverage between FM broadcasting stations transmitting the same channel programs of the Voice of Vietnam Radio Station.

Article 3. Provisions on channel allocation and frequency channel allocation for FM broadcasting

1. The allocation of FM broadcasting frequency channels is specified in Appendix I attached to this Circular.

2. Specific frequency channel allocation for broadcasting the channels of the Voice of Vietnam Radio Station and provincial and municipal radio stations under the central government is specified in Appendices II and III attached to this Circular.

Article 4. Provisions on the assignment and use of radio frequencies

1. Based on Appendices I, II, and III attached to this Circular and the need for frequency channel usage, the transmission parameters are calculated and specifically defined in the Radio Frequency Usage Permit.

2. The FM broadcasting coverage area is calculated with the minimum field strength level specified in Point 1, and the signal-to-noise ratio protection level specified in Point 2 of Appendix IV attached to this Circular.

3. Provincial and municipal radio stations under the central government are covered by FM broadcasting and protected from harmful interference within the administrative boundaries of their respective provinces and cities. However, Hanoi City and Ho Chi Minh City may cover areas belonging to other provinces and cities but must not cause harmful interference to other FM broadcasting systems allocated frequency channels according to Appendices II and III attached to this Circular.

4. County-level FM broadcasting stations are covered by FM broadcasting and protected from harmful interference within the administrative boundaries of their respective counties.

5. On the basis of not causing harmful interference to FM broadcasting stations of the Voice of Vietnam Radio Station and those of provinces and municipalities currently operating or already allocated frequency channels in Appendices II and III, county-level FM broadcasting stations may be considered for frequency channel allocation at specific frequency bands in the order specified in Appendix V attached to this Circular.

6. FM broadcasting stations must use directional antennas suitable for effective coverage and without causing harmful interference to other FM broadcasting stations and other radio communication systems.

7. FM broadcasting stations in border areas must use directional antennas suitable to ensure coverage areas in compliance with agreements on border frequency coordination between Vietnam and neighboring countries.

8. Test broadcasting stations, special program channel FM broadcasting stations, and FM rebroadcasting stations covering remote, mountainous, and far-flung areas shall be assigned frequency channels on a case-by-case basis without causing harmful interference to other FM broadcasting stations that have been allocated frequency channels according to Appendices II and III attached to this Circular.

5. On the basis of not causing harmful interference to the FM broadcasting transmitters of Voice of Vietnam and those of centrally governed cities and provinces currently operating or allocated channels and frequencies listed in Appendix II and Appendix III, county-level FM broadcasting transmitters shall be assigned channel frequencies within the frequency bands in the order set forth in Appendix V issued together with this Circular.

6. FM broadcasting transmitters must use directional antennas suitable for effective coverage and without causing harmful interference to other FM broadcasting transmitters and other radio communication systems.

7. FM broadcasting transmitters located in border areas must use directional antennas suitable for ensuring coverage areas in compliance with the frequency coordination agreements between Vietnam and neighboring countries.

8. Test broadcasting transmitters, FM broadcasting transmitters of special program channels, and FM rebroadcasting transmitters covering remote, mountainous, and sparsely populated areas shall be assigned channel frequencies on a case-by-case basis without causing harmful interference to other FM broadcasting transmitters already allocated channel frequencies pursuant to Appendices II and III issued together with this Circular.

Article 5. Supplementing frequency channels for special cases

Based on the National Radio Frequency Spectrum Plan, Broadcasting Operation Licenses, Domestic Radio Program Production Licenses, and the frequency availability at each location, the Radio Frequency Management Agency shall consider supplementing frequency channels in specific cases to meet the need for additional radio program channels and to expand the FM broadcasting coverage area for the Voice of Vietnam Radio Station, provincial and municipal radio stations, and provincial and municipal television and radio stations directly under the Central Government.

Article 6. Transitional Provisions

1. For the FM broadcasting station of the Voice of Vietnam Radio Station:

a) In the case where the Voice of Vietnam Radio Station implements a frequency channel change for its operating transmitter or invests in a new transmitter to broadcast on a frequency channel allocated in this Circular, causing harmful interference to provincial and municipal FM broadcasting stations and county-level FM broadcasting stations that have been licensed, the Voice of Vietnam Radio Station must take responsibility to assist affected stations in implementing the frequency change.

b) In the case where provincial and municipal FM broadcasting stations implement a frequency channel change from their current operational plan to a reserve frequency channel (to create conditions for the Voice of Vietnam Radio Station to implement the plan) and cause harmful interference to county-level FM broadcasting stations that have been licensed, the Voice of Vietnam Radio Station must take responsibility to assist affected stations in implementing the frequency channel change.

c) FM broadcasting stations of the Voice of Vietnam Radio Station currently operating on frequency channels not in compliance with the plan must switch to frequency channels according to the plan when such a change does not cause harmful interference to provincial FM broadcasting stations and county-level FM broadcasting stations that are currently operating.

2. For county-level FM broadcasting stations:

When investing in new transmitters to replace existing ones, they must operate on frequency channels designated in accordance with this plan to avoid causing harmful interference to FM broadcasting stations of the Voice of Vietnam Radio Station and provincial and municipal FM broadcasting stations that have been allocated frequency channels according to this plan.

3. For wireless public address stations:

a) New licenses for wireless public address stations operating in the 54-68 MHz band will be issued;

b) No new investment or issuance of new licenses for wireless public address stations in the 87-108 MHz band;

c) Wireless public address stations already licensed in the 87-108 MHz band must not cause interference and are not protected against harmful interference from FM broadcasting stations of the Voice of Vietnam Radio Station, provincial and municipal radio stations, provincial and municipal television and radio stations, and county-level FM broadcasting stations within the 87-108 MHz frequency range and other radio communication systems; if they cause harmful interference to FM broadcasting stations of the Voice of Vietnam Radio Station, provincial and municipal radio stations, provincial and municipal television and radio stations, and county-level FM broadcasting stations within the 87-108 MHz frequency range and other radio communication systems, the wireless public address station must immediately apply technical measures to eliminate harmful interference; if harmful interference cannot be eliminated, it must cease operation.

Article 7. Implementation Organization

1. The Radio Frequency Management Agency (Ministry of Information and Communications) is responsible for:

a) Promulgating and guiding the implementation of this Circular;

b) Taking the lead in coordinating with Provincial and Municipal Departments of Information and Communications to inspect, monitor, and supervise the implementation of this Circular.

2. The Voice of Vietnam Radio Station, provincial and municipal radio stations, provincial and municipal television and radio stations, county-level radio stations, village-level wireless public address stations, and related agencies and units shall develop plans for development in accordance with this Circular.

Article 8. Implementation clause

1. This Circular takes effect from January 23, 2018 and replaces Circular No. 04/2013/TT-BTTTT dated January 23, 2013 of the Ministry of Information and Communications.

2. The Director of the Office, the Director of the Radio Frequency Management Agency, the Heads of agencies and units under the Ministry of Information and Communications, the Voice of Vietnam Radio Station, provincial and municipal radio stations, and related organizations and units are responsible for implementing this Circular.

3. During the implementation process, if there are any difficulties, please report them to the Ministry of Information and Communications for consideration and resolution./.

Provinces with large areas or due to special terrain conditions, the location of the transmitter may propose using transmitters with higher power, but not exceeding 200% of the reference transmission power. The Radio Frequency Management Department calculates and determines the transmission power and specifies the use of directional antennas to ensure that it does not cause harmful interference to the coverage area of other provincial and city-level FM radio stations under the central government. The transmission power and directional antenna angle are specified in the frequency usage permit.
