Article 24stipulating functions, tasks, powers

Pursuant to the Law Tapproved by the Government on 18 the 2025;
At the proposal of the Minister of Education and Training;
The Government promulgates this Decree stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training.
Article 1. Position and Functions
The Ministry of Education and Training is an agency of the Government, performing the function of state management over preschool education, general education, vocational education, higher education, and continuing education; developing vocational skills; managing state affairs related to the Vietnamese language and ethnic languages; managing public services within the scope of the ministry's state management.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Education and Training performs the tasks and powers as prescribed in the Law on the Organization of the Government, the Government’s regulations on the functions, tasks, powers, and organizational structure of ministries, ministerial-level agencies, and implements the following specific tasks and powers:
1. On laws:
a) Submitting to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly, draft decrees of the Government, resolutions, projects, programs, draft decisions, directives of the Government, and other documents according to the division of labor by the Government and the Prime Minister; submitting to the Government for comments on draft laws and ordinances proposed by agencies, organizations, and National Assembly deputies related to the sector under the Ministry's state management;
b) Issuing circulars and other documents according to the Ministry's state management authority as prescribed by law;
c) Directing, guiding, promoting, disseminating, supervising the implementation, inspecting, and organizing the enforcement of documents after issuance as prescribed by law.
2. On strategies, planning, and plans:

b) Submit to the Prime Minister for approval the planning of the network of higher education institutions and teacher training institutions; the planning of the network of vocational education institutions; the system planning of specialized educational facilities for persons with disabilities and the system of integration education support centers.
3. Regarding objectives, curricula, and educational content:
a) Guide and organize the implementation of educational objectives appropriate to each level of education and training within the national education system;
b) Issue the preschool education curriculum; stipulate standards, procedures for compiling and revising the preschool education curriculum; stipulate tasks, authorities, methods of operation, standards, number, and structure of members of the National Council for reviewing the preschool education curriculum;
c) Issue the general secondary education curriculum; stipulate standards, procedures for compiling and revising the general secondary education curriculum; stipulate tasks, authorities, methods of operation, standards, number, and structure of members of the National Council for reviewing the general secondary education curriculum; stipulate the teaching of cultural knowledge in vocational education institutions;
d) Specify the program, content, and organization of implementing the national defense and security education program for students at high schools, higher education institutions, and vocational education institutions;
đ) Specify the continuing education program;
e) Specify regulations on building, reviewing, and issuing training programs and lists of majors and trades at various levels of higher education and vocational education; specify other vocational training programs according to vocational education laws;
g) Issue the preparatory university training program;
h) Guide the construction of a learning society and policies to promote lifelong learning;
4. Regarding state management of the Vietnamese language and ethnic languages:
a) Submit to the Government for issuance of regulations on policies for developing and preserving the Vietnamese language and ethnic languages;
b) Guide the learning of Vietnamese for foreign citizens and Vietnamese citizens abroad;
5. Regarding textbooks, teaching materials, and reference materials:
a) Stipulate standards and procedures for compiling guidance materials for implementing the preschool education curriculum and selecting toys and learning materials used in preschool education institutions;
b) Stipulate standards and procedures for compiling and revising general secondary education textbooks; stipulate tasks, authorities, methods of operation, standards, number, and structure of members of the National Council for reviewing textbooks and provincial review councils; stipulate the selection of textbooks in general secondary education institutions;
c) Stipulate regulations on textbooks, teaching materials, and reference materials for continuing education;
d) Stipulate the compilation, selection, review, approval, and use of teaching materials and teaching guides for higher education and vocational education; approve local educational materials;
đ) Set the maximum price for textbooks;
6. Regarding examinations, assessments, admissions, training, and diplomas, certificates:
a) Submit to the Government for issuance of the system of diplomas for higher education and vocational education and regulations on equivalent diploma levels for certain specialized majors and trades;
b) Stipulate regulations on examinations, assessments, admissions, training, joint training, and management of diplomas and certificates within the national education system;
c) Stipulate recognition of diplomas issued by foreign educational institutions for use in Vietnam; recognition of certificates used within the national education system;
7. Regarding teachers and educational management staff:
a) Prescribe standards for academic titles and working conditions for teachers and educational administrators; provide guidance on leadership positions, management positions, and specialized vocational titles, the structure of civil servants according to vocational titles, and staffing norms for public educational institutions as prescribed;
b) Prescribe standards for heads and deputy heads of educational institutions;
c) Issue professional standards for teachers; develop training programs based on occupational title standards for lecturers, teachers, and education sector staff;
d) Issue codes of conduct for teachers and educational institutions;
đ) Submit to the Prime Minister for the establishment of standards and procedures for appointing and dismissing titles of professor and associate professor;
e) Issue policies for teachers within its authority or submit to competent authorities for issuance; manage and guide the implementation of policies related to training, development, and remuneration for teachers and educational administrators;
g) Organize or delegate the organization of examinations for promotion of vocational titles of civil servants in the education sector according to regulations and delegated authority;
8. Regarding management and support for students:
a) Submit to the Government and the Prime Minister for the establishment of policies for students; build and submit to competent authorities for issuance of preferential credit policies for students;
b) Prescribe teaching activities, management, and education both inside and outside schools; prescribe evaluation criteria for learning outcomes and discipline; prescribe rewards and punishments for students;
c) Guide and organize school health work, protection, and care of children's health in schools; prescribe school nutrition education and organization of boarding meals in schools; guide the construction of safe schools and prevention of student accidents;
d) Prescribe, guide, and organize sports activities, competitions, and the development of physical education and sports movements in schools;
9. Regarding management of school facilities and equipment:
a) Develop and issue, or propose competent authorities to issue technical standards and specifications for school facilities, libraries, and equipment, and textbooks according to legal provisions;
b) Prescribe standards and usage norms for specialized machinery and equipment, and standards and usage norms for specialized area usage of state-owned works under the department’s management;
c) Organize the application of facility standards and equipment lists according to levels of education and training in the national education system;
10. Regarding financial management, assets, and public investment:
a) Prepare annual budget estimates, three-year financial plans for the Ministry of Education and Training; allocate detailed annual budgets for the ministry; exercise rights and responsibilities of state asset owners within the scope of management according to laws and government delegation; participate in building systems, standards, and norms for budget spending in the education and training and vocational education sectors; participate in compiling annual central budget allocation plans, five-year financial plans, three-year financial plans, and annual settlement reports in the education and training and vocational education sectors; monitor and oversee the implementation of budgets in these sectors;
b) Issue and guide the implementation of standards and norms for the use of state assets within the scope of management or delegated authority according to laws on the management and use of state assets; guide procedures and build, review, and issue economic and technical norms in the education and training sector according to delegated management; guide methods for establishing service prices for education and training and vocational education applicable in these sectors; publicly report and implement reporting systems on the management and use of state assets within the scope of management according to laws;
c) Prepare medium-term and annual public investment plans for the ministry; decide on investment policies and projects within the scope of management according to laws on public investment; manage and implement public investment projects within the scope of state management according to laws; monitor, inspect, evaluate, and supervise the implementation of plans, programs, and projects within the scope of management; report on the disbursement and settlement of tasks and projects using public investment funds according to laws;
d) Propose lists, investment policies, and approve decisions on investments for programs and projects using ODA funds, preferential loans from donors, and non-refundable aid not included in official development assistance provided by foreign agencies, organizations, and citizens for Vietnam according to laws; manage the monitoring and supervision of their implementation; perform the function of program and project management for programs and projects using ODA funds, preferential loans from donors, and non-refundable aid not included in official development assistance provided by foreign agencies, organizations, and citizens for Vietnam within the scope of management according to laws;
đ) Review the contents of pre-feasibility study reports and feasibility study reports for programs, projects, and proposals under the department's administrative management;
e) Exercise rights, responsibilities, and obligations of the state owner towards state-owned enterprises and state capital invested in other enterprises according to laws;
11. Regarding quality assurance in education:
a) Issue basic standards for higher education and vocational education, and training program standards for various levels of higher education; prescribe minimum knowledge volumes and ability requirements that students should achieve upon graduation for each level of higher education and vocational education;
b) Prescribe conditions, procedures, and processes for establishing, suspending operations of vocational training programs at various levels of higher education and vocational education;
c) Specify the criteria for determining enrollment quotas for various levels of higher education and vocational education;
d) Direct and guide quality assurance work and publicize activities in educational and training institutions;
12. Regarding educational quality assessment:
a) Prescribe standards for evaluating educational quality including educational institutions and training programs; the process and cycle of educational quality assessment at different levels and training degrees; principles of operation, conditions, and standards for organizations and individuals engaged in educational quality assessment; licensing for conducting educational quality assessment; issuing and revoking certificates of educational quality assessment;
b) Present to the Government for prescribing conditions and procedures for establishing, allowing operations, suspending, and dissolving quality assessment organizations; prescribe conditions and procedures for foreign quality assessment organizations to be recognized to operate in Vietnam;
c) Decide or delegate decision-making authority for establishing or allowing establishment, permitting operations, suspending operations, and dissolving quality assessment organizations; decide on recognition and revocation of recognition for foreign quality assessment organizations operating in Vietnam according to the law; prescribe supervision and evaluation of quality assessment organizations;
d) Manage the assessment of training programs and educational institutions. Guide organizations, individuals, and educational institutions to implement educational quality evaluations; inspect and evaluate compliance with regulations on educational quality assessment;
13. Regarding online education, scientific and technological activities, information technology, environmental protection education, and digital transformation in the education sector:
a) Fulfill state management responsibilities for online education concerning educational and training activities within the national education system;
b) Present to competent authorities for issuance or issue regulations, mechanisms, and policies on scientific and technological activities, innovation, and environmental protection education in educational institutions; application of information technology and digital transformation in education sector activities; manage and effectively utilize scientific and technological resources in education and training according to the law;
c) Guide, organize implementation, and monitor the application of science and technology, information technology, and digital transformation in the education sector according to the law; organize implementation of scientific and technological tasks and innovation, environmental protection education;
d) Organize and direct statistical work in education; collect, compile, analyze, manage, store, and publish statistical information in the education sector; establish and issue a statistical index system and reporting regime for the education sector;
đ) Build an education sector database; implement data connection and sharing according to the law; deploy common applications and platforms based on the education sector database;
14. Regarding skill development:
a) Prescribe regulations on training and upgrading skills and knowledge, enhancing occupational capabilities for workers;
b) Guide the organization of lectures and competitions at various levels; organize national-level lectures and competitions and participate in regional and world skill competitions;
c) Guide the construction, review, and publication of national skill standards; prescribe the issuance of national skill certificates;
15. Regarding management of educational and training institutions:
a) Issue charters and operational regulations for kindergartens, primary schools, secondary schools, high schools, multi-grade general education schools, regular education centers, specialized schools, colleges, technical colleges, vocational education centers, defense and security education centers, and other educational institutions as prescribed by law; guide and organize implementation of organizational structure regulations for higher education institutions and vocational education institutions;
b) Present to the Government for prescribing conditions, procedures, and authority for establishing or allowing establishment, registering or permitting operations, suspending educational operations, merging, splitting, dissolving educational institutions, branch campuses of higher education institutions, branch campuses of vocational education institutions; naming and renaming higher education institutions and vocational education institutions; converting universities into university systems and establishing schools under higher education institutions; linking universities into university systems; converting private higher education institutions into non-profit private higher education institutions; converting private vocational education institutions into non-profit private vocational education institutions;
c) Decide on establishing defense and security education centers under higher education institutions; decide on permitting operations and suspending educational operations for higher education institutions, branch campuses of higher education institutions, institutes established by the Prime Minister according to the Law on Science and Technology, defense and security education centers, and other educational institutions as prescribed by law; decide on establishing representative offices of foreign higher education institutions operating in the higher education field;
d) Decide on establishing, allowing establishment, splitting, merging, dissolving, renaming, permitting operations, and suspending operations for vocational education institutions and defense and security education centers under vocational education institutions; decide on establishing representative offices of foreign vocational education organizations in Vietnam; recognize principals of private college institutions within the scope of authority.
d) Perform the role of managing national universities; submit to the Government for detailed regulations on the functions, tasks, and authorities of national universities; submit to the Prime Minister for issuance of the Regulation on the organization and operation of national universities and member higher education institutions.
e) Specify criteria for classifying public vocational education institutions according to the provisions of the law.
16. Regarding international cooperation:
a) Submit to the Government and the Prime Minister for decisions on policies and measures to strengthen and expand relations with foreign countries and international organizations; the signing, ratification, approval, or accession to and measures to ensure the implementation of international treaties on behalf of the State or the Government within the scope of the Ministry's management;
b) Organize negotiations and sign international treaties under the authorization of competent state agencies and implement plans for international cooperation and international treaties that Vietnam is a member of within the scope of the Ministry's management;
c) Participate in international organizations as assigned by the Government and the Prime Minister; sign and organize the implementation of international agreements on behalf of the Ministry in accordance with the law;
d) Submit to the Government for issuance of regulations on international cooperation and investment in the field of education;
d) Manage and guide educational institutions under the Ministry’s state management authority to carry out international cooperation in teaching and training;
e) Issue or submit to competent authorities for issuance of regulations on the management of foreign-invested educational institutions in Vietnam;
g) Issue regulations on the management and guidance of educational institutions under the Ministry’s state management authority regarding the acceptance of training and management of foreign students studying in Vietnam;
h) Implement state management over Vietnamese citizens studying, teaching, conducting scientific research, and academic exchanges abroad within the scope of the Ministry’s state management;
17. Regarding commendation and reward in the education sector:
a) Regulations on commendation and reward work in the education sector; regulations on commendation and reward work of educational institutions;
b) Submit to the Government for regulations on awarding titles of People's Teacher and Outstanding Teacher;
c) Organize commendation movements and carry out commendation and reward work in the education sector;
18. Regarding public services:
a) State management of public service prices in the fields of education, training, and vocational education in accordance with the law;
b) Develop and issue, amend, and supplement economic and technical norms, cost standards (if applicable) as the basis for issuing unit prices and public service prices funded by the state budget within the scope and fields managed by the Ministry in accordance with the law on prices and other related laws to serve as the basis for assigning tasks, ordering or tendering for public service provision in accordance with the law;
c) Guide the implementation of policies and laws and support organizations in providing public services in fields under the Ministry’s state management;
19. Regarding inspection and supervision:
a) Inspect and supervise ministries, ministerial-level agencies, government agencies, provincial people's committees at all levels, and relevant agencies and units in the implementation of laws on education within the scope of the Ministry’s state management;
b) Resolve complaints, denunciations, suggestions, and reflections from organizations and individuals related to education within the scope of the Ministry’s state management; organize citizen reception in accordance with the law;
c) Carry out responsibilities for administrative violation handling work in education in accordance with the law;
20. Decide and direct the implementation of the program for administrative reform of the Ministry in accordance with the goals and content of the national administrative reform program approved by the Government;
21. Implement state management over associations and non-governmental organizations under the Ministry’s jurisdiction in accordance with the law;
22. Manage organizational structure; positions, staffing, and job grade structures for civil servants; positions, number of staff, and job grade structures for officials; number of workers under labor contracts within the scope of the Ministry’s management authority. Decide and delegate authority to decide on recruitment, utilization, and management of cadres, civil servants, officials, and workers under the Ministry in accordance with the Party and legal regulations; decide on the allocation of civil servant staffing for specialized party and mass organization work; train, provide professional and vocational training, and implement other systems and policies for cadres, civil servants, and officials under the Ministry’s state management in accordance with the law. Implement specific measures to strengthen administrative discipline among cadres, civil servants, officials, and workers under the Ministry; practice thrift, combat waste, prevent corruption, negative practices, bureaucracy, arrogance, and abuse of power in organizations and units under the Ministry’s management;
23. Perform other tasks and authorities assigned by the Government and the Prime Minister or as provided by law;
Article 3. Organizational Structure

The units specified from Clause 1 to Clause 15 of this Article are organizations under the Ministry assisting the Minister in performing state management functions; the units specified from Clause 16 to Clause 18 of this Article are public service establishments serving the Ministry's state management functions.
The Minister of Education and Training shall submit to the Prime Minister for issuance of a list of other public service establishments directly under the Ministry.
The Minister of Education and Training shall issue a Decision stipulating the functions, tasks, authorities, and organizational structure of subordinate units under the Ministry in accordance with the law, except for units within the Government and Prime Minister's decision-making authority.
Article 4. Transitional Provisions
The General Department of Vocational Education and the Department of Continuing Education shall continue to perform their duties and powers as prescribed by law until the Minister of Education and Training issues a Decision stipulating the functions, tasks, powers, and organizational structure of the Vocational Education and Continuing Education Bureau. The deadline for completion is before March 31, 2025.
Article 5. Effective Date
1. This Decree shall take effect from March 1, 2025.
2. This Decree replaces Decree No. 86/2022/NĐ-CP dated October 24, 2022, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training.
Article 6. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
