ISSUING TECHNICAL REGULATIONS FOR TISSUE PAPER AND SANITARY PAPER PRODUCTS

Circular No. 36/2015/TT-BCT dated October 28, 2015 issued by the Minister of Industry and Trade on Technical Regulations for Tissue Paper and Sanitary Paper Products, which took effect from January 1, 2018, has been amended and supplemented by:

1. Circular No. 33/2016/TT-BCT dated December 23, 2016 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 36/2015/TT-BCT dated October 28, 2015 on Technical Regulations for Tissue Paper and Sanitary Paper Products, effective from January 1, 2017.

2. Circular No. 42/2019/TT-BCT dated December 18, 2019 issued by the Minister of Industry and Trade amending and supplementing certain provisions regarding periodic reporting requirements in Circulars issued by the Minister of Industry and Trade or jointly issued, effective from February 5, 2020.

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions

Article 1. Technical Regulations for Tissue Paper and Sanitary Paper Products

Issued together with this Circular is "Technical Regulations for Tissue Paper and Sanitary Paper Products". Code QCVN: 09/2015/BCT.

Article 2. Effectiveness[2] [3]

This Circular takes effect from January 1, 2018.

Article 3. Responsibility for Implementation

1. Organizations and individuals related to this matter shall be responsible for implementing this Circular.

2. In case of difficulties or obstacles, organizations and individuals shall promptly reflect them to the Ministry of Industry and Trade (Department of Science and Technology) for consideration and resolution./.

[1] Circular No. 33/2016/TT-BCT amending and supplementing certain provisions of Circular No. 36/2015/TT-BCT dated October 28, 2015 on Technical Regulations for Tissue Paper and Sanitary Paper Products is based on the following grounds:

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to the proposal of the Director of the Science and Technology Department,

Circular No. 42/2019/TT-BCT amends and supplements provisions on periodic reporting, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ,No. requirements in Circulars issued by the Minister of Industry and Trade or jointly issuedJune 2024;oJune 2024;o periodically pursuant to Circulars issued by the Minister of Industry and Trade or jointly issued is based on the following:

"Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Decree No. 09/2019/NĐ-CP Along with this Circular, the National Technical Regulation on structure and data format for connecting, integrating, and sharing data among information reporting systems in the National Information Reporting System (QCVN 125:2021/BTTTT) is issued.

[2] This provision is amended according to Clause 1, Article 1 of Circular No. 33/2016/TT-BCT amending and supplementing Circular No. 36/2015/TT-BCT dated December 28, 2015 issued by the Minister of Industry and Trade on Technical Regulations for Tissue Paper and Sanitary Paper Products, effective from January 1, 2017.

[3] Article 2 of Circular No. 33/2016/TT-BCT amending and supplementing Circular No. 36/2015/TT-BCT dated October 28, 2015 issued by the Minister of Industry and Trade on Technical Regulations for Tissue Paper and Sanitary Paper Products, effective from January 1, 2018, provides as follows:

“Article 2. Effective Date

This Circular takes effect from January 1, 2017./.”

Article 37 of Circular No. 42/2019/TT-BCT amending and supplementing certain provisions on periodic reporting requirements in Circulars issued by the Minister of Industry and Trade or jointly issued, effective from February 5, 2020, provides as follows:

Article 37. Effective Date

1. This Circular takes effect from February 5, 2020.

2. The following regulations are abolished:

a) Clause 6, Article 1 of Circular No. 33/2016/TT-BCT dated December 23, 2016 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 36/2015/TT-BCT dated October 28, 2015 on Technical Regulations for Tissue Paper and Sanitary Paper Products.

b) Article 4 of Circular No. 51/2018/TT-BCT dated December 19, 2018 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Joint Circular No. 47/2011/TTLT-BCT-BTNMT dated December 30, 2011 issued by the Minister of Industry and Trade and the Minister of Natural Resources and Environment on the management of import, export, and temporary import-reexport of ozone-depleting substances under the Montreal Protocol on Substances that Deplete the Ozone Layer..

c) Clause 20, Article 1 of Circular No. 31/2018/TT-BCT dated October 5, 2018 issued by the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 27/2013/TT-BCT dated October 31, 2013 on inspection of electricity activities and electricity usage, and resolution of disputes in power purchase contracts.

d) Article 29 of Circular No. 43/2013/TT-BCT dated December 31, 2013, issued by the Minister of Industry and Trade, stipulates the contents, procedures, and formalities for drafting, reviewing, approving, and adjusting the Power Development Plan.

3. The current periodic reporting systems in the industry and trade sector must ensure that the data for reports are finalized in accordance with Article 12 of Decree No. 09/2019/NĐ-CP.

4. In the course of implementation, if there are any difficulties, organizations and individuals shall report to the Ministry of Industry and Trade for guidance and resolution./.”
