Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to the Government Decree No. 14/1998/NĐ-CP dated March 6, 1998 on state asset management;
Pursuant to Decision No. 122/1999/QD-TTg dated May 10, 1999 of the Prime Minister on issuing standards and quotas for the use of motor vehicles in administrative and public service agencies and state-owned enterprises;
Considering the proposal of the Director of the Ministry of Finance's Office,
DECISION:
Article 1. This decision promulgates the regulation on the use of motor vehicles for the Ministry of Finance's agencies attached hereto.
Article 2. This decision replaces Decision No. 1297/QD-BTC dated April 26, 2004 of the Minister of Finance and takes effect from the date of signature.
The Director of the Ministry's Office, Heads of units under the Ministry shall be responsible for implementing this decision./.

REGULATION ON THE USE OF MOTOR VEHICLES FOR THE MINISTRY OF FINANCE'S AGENCIES
(Issued together with Decision No.: 3707/QD-BTC dated October 20, 2005 of the Minister of Finance)
II- SUPPORT MEASURES FOR STATE-OWNED AGRICULTURAL FARMS AND FORESTRY COMPANIES IN THE FIELD OF SCIENCE AND TECHNOLOGY
Article 1.Means of transportation serving work needs within the Ministry include various types of motor vehicles (up to 15 seats) purchased or equipped from the State budget and other lawful sources, assigned by the Ministry to the Vehicle Unit under the Ministry's Office for management and use in accordance with general regulations on State asset management and specific provisions in this regulation.
Article 2.The Ministry's Office will allocate vehicles based on the number of existing motor vehicles to meet the work requirements of the Ministry according to rank, standards, and quotas prescribed.
The Vehicle Unit of the Ministry is responsible for informing the name of the driver and vehicle license plate number assigned for work trips to the using units before departure.
In cases where multiple units or civil servants apply to use motor vehicles at the same time, the Vehicle Unit must prioritize official duties and arrange in the order of which unit applied first, and inform the units or civil servants not yet allocated vehicles.
After using the motor vehicle, staff members are responsible for confirming on the vehicle dispatch order that the driver has completed the mission and provide feedback to the Ministry's Office regarding the driver's service if it does not meet the requirements.
Article 3.Motor vehicles of the Ministry shall not be used for personal purposes or rented out.
II - SPECIFIC PROVISIONS
Article 4Use of motor vehicles to serve the work of the Ministry's leadership.
The Ministry's leadership may use motor vehicles for work in accordance with current national regulations.
In cases where the Ministry's leadership travels to locations with difficult travel conditions or mountainous, remote, or far-flung areas, or when the Government requires a change of motor vehicle or dedicated driver to ensure safety, the Secretary of the Minister or the Secretariat of the Ministry's Office must notify the Vehicle Unit about the trip 24 hours in advance (except in emergencies) to arrange appropriate vehicles and drivers.
Article 5.Use of motor vehicles to serve the work of department-level officials and equivalent positions with a job allowance coefficient of 0.8 to 1.00:
For trips to provinces and centrally-administered cities (outside Hanoi) and airports, or places requiring a change of transportation, the head of the unit with officials using motor vehicles must submit a request for vehicle allocation for work (according to the attached form) to the Vehicle Unit at least 24 hours before departure (except in emergencies). The Vehicle Unit will pick up the vehicle at the location registered on the vehicle usage form.
For trips within Hanoi, officials and civil servants dispatched by the Ministry's leadership to attend meetings or represent the Ministry at foreign activities requiring the use of a motor vehicle must register directly with the Vehicle Unit at least 12 hours before departure (except in emergencies). The Vehicle Unit will pick up the vehicle at the Ministry of Finance.
Article 6.For delegations dispatched by the Ministry to attend conferences, seminars, etc., within Hanoi requiring centralized pick-up and drop-off services by motor vehicles, the organizing unit of the conference, seminar, or delegation must register directly with the Vehicle Unit (with a program approved by the Ministry). Registration should be made at least 24 hours before departure. The Vehicle Unit will pick up the vehicle at the Ministry of Finance or at a designated point.
Article 7.For staff members tasked with welcoming or seeing off Ministry leaders (on overseas trips) or foreign guests (with a reception program or approved by the Ministry), they must register with the Vehicle Unit at least 24 hours before departure. The Vehicle Unit will pick up the vehicle at the Ministry of Finance or at a designated point.
Article 8In cases where staff members need to deliver urgent documents, confidential materials, or transport money for the agency, the Head of the Administrative Department or the Financial Department of the Ministry must register directly with the Vehicle Unit at least 10 minutes before departure (except in special emergencies). The Vehicle Unit will pick up the vehicle at the Ministry of Finance or at a designated point.
Article 9.Organizations such as the Party Committee, Trade Union, Women's Union, Ho Chi Minh Communist Youth Union, Veterans' Association, and Self-Defense Militia of the Ministry's agencies, if they require the use of motor vehicles for work, must submit a request for vehicle allocation for work proposed by the person in charge of the organization and register directly with the Vehicle Unit at least 24 hours before departure (except in emergencies).
Article 10.Use of motor vehicles to serve funeral-related matters (for officials, civil servants, their fathers, mothers, fathers-in-law, mothers-in-law, fathers-in-law, mothers-in-law, children of officials, civil servants who have passed away).
Units with officials, civil servants, or employees in the mourning category who need to visit and pay respects must register for a vehicle directly with the Vehicle Unit (with a vehicle registration form signed by the unit head) at least 4 hours before departure (except in emergencies).
Officials, civil servants, or employees in the mourning category may use one vehicle trip if needed, and must register directly with the Vehicle Unit and submit a request for vehicle allocation for work proposed by the unit head and approved by the Ministry's Office (according to the attached form). Registration should be made at least 6 hours before departure.
Article 11.The use of automobiles to serve diplomatic work with governmental authorities, social organizations within the territory of Hanoi City, or to maintain working relationships with agencies and units of wards, districts... where the Ministry's office is located, or to visit sick or seriously ill officials and civil servants, the head of the unit must have a request for automobile allocation for work purposes (attached model) and the Ministry’s Office Leader approves and sends it to the Motor Pool at least 12 hours before departure time.
Governmental organizations, social organizations operating within the territory where the Ministry's office is located, if they need to borrow vehicles for a certain period of time, shall be considered and decided upon by the Minister's Office Director.
Article 12.For the use of automobiles in organizing recuperation activities, the General Trade Union of the Ministry, Women's Affairs, and the Ho Chi Minh Communist Youth Union of the Ministry and subordinate units organizing annual recuperation trips approved by the Ministry, if there is a need to use automobiles, they must register with the Motor Pool ten days before the trip date.
Article 13.Subordinate units of the Ministry that are self-managed in terms of budget allocation, and public service units under the Ministry, during their operations, if necessary to use automobiles to transport officials, civil servants, and employees on work trips (maximum three days) in localities (under conditions where the unit's own automobiles cannot meet the needs), and if there is a need to use automobiles from the Ministry, they must submit a request for automobile allocation for work purposes (attached model) from the unit head to the Motor Pool at least 48 hours before the planned departure time. Based on the number of available automobiles and actual usage, the Motor Pool will allocate the automobiles, and the unit using the automobiles must pay for fuel costs according to the Motor Pool's cost recovery pricing, bridge tolls, ferry fees, and parking fees (if applicable). In cases where allocation is not possible, the Motor Pool must immediately inform the unit head requesting the automobile upon receipt of the vehicle request form.
III- IMPLEMENTATION
Article 14.Heads of subordinate units of the Ministry and users of transportation vehicles must comply with this regulation and bear material responsibility for any damage to the Ministry's transportation assets due to improper use.
Article 15.The Minister's Office Director is responsible for organizing the management and use of the Ministry's automobiles in accordance with these regulations.
Article 16.Based on this regulation, heads of units and organizations under the Ministry that are allocated budget management or equipped with their own automobiles have the responsibility to establish regulations for managing and using automobiles within their units.
