Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Decree on Thrift and Prevention of Waste dated February 26, 1998;
Pursuant to Decision No. 78/2001/QĐ-TTg dated May 16, 2001 of the Government Chairman regarding the issuance of "Regulations on Standards and Quotas for the Use of Official Telephones at Residences and Mobile Phones for Leaders in Administrative Agencies, Public Institutions, and Political-Social Organizations";
Pursuant to Decision No. 179/2002/QĐ-TTg dated December 16, 2002 of the Government Chairman regarding the amendment and supplementation of regulations on standards and quotas for the use of official telephones at residences and mobile phones for leaders in administrative agencies, public institutions, political organizations, and political-social organizations;
Based on the proposal of the Minister of National Defense.
DECISION:
Article 1. Fixed-line telephones installed at residences and mobile phones are state assets provided to cadres in the Vietnam People's Army for use in official activities.
Article 2
1. The installation of fixed-line telephones at the residences of senior cadres (as stipulated in Regulation No. 68-QĐ/TW dated October 21, 1999 of the Central Committee of the Communist Party of Vietnam) shall be implemented according to Regulation No. 68-QĐ/TW and Guidance No. 10 HD/TCTW dated December 29, 1999 of the Central Organization Department on the implementation of certain systems and policies for senior cadres.
2. Cadres in the military listed below shall be provided with one fixed-line telephone at their residence (excluding telephones installed by competent authorities based on special requirements):
a) Minister;
b) Deputy Minister;
c) Chief of General Staff, Director of the General Political Department;
d) Deputy Chief of General Staff, Directors of the Departments of Logistics, Engineering, Defense Industry, Intelligence, Commanders of Military Regions, Commanders of Military Services, Commanders of Border Guard Forces, Deputy Directors of the General Political Department, and equivalent positions;
đ) Deputy Directors of the Departments of Logistics, Engineering, Defense Industry, Intelligence; Deputy Commanders of Military Regions, Deputy Commanders of Military Services, Deputy Commanders of Border Guard Forces, Commanders of Corps, Commanders of Arms, and equivalent positions;
e) Deputy Commanders of Corps, Deputy Commanders of Arms, Chiefs of Provincial Military Commands, and Chiefs of Border Guard Forces in centrally governed cities and provinces, and equivalent positions;
g) Professors currently working in military units who meet one of the following criteria: - Awarded the Ho Chi Minh Prize by the State. - Honored with the title of Labor Hero or People's Armed Forces Hero by the State. For retired professors who still serve as heads of national-level, ministry-level scientific projects, if they meet any of the criteria mentioned above, they also fall under the scope of this Decision;
h) Cadres holding general rank not included in the positions mentioned above;
i) Division Commanders and equivalent positions;
k) Deputy Division Commanders, Chiefs of County Military Commands, and equivalent positions.
Article 3
1. The subjects specified in points a, b, c, d, đ, e, and g of Clause 2, Article 2 of this Decision, in addition to being provided with one fixed-line telephone at their residence, shall also be provided with one mobile phone.
2. The provision of telephones and the regulation of payment for the cost of purchasing, installing, and monthly fees for senior cadres within the scope of Regulation No. 68/QĐ-TW dated October 21, 1999 of the Central Committee of the Communist Party of Vietnam shall be carried out according to Guidance No. 10 HD/TCTW dated December 29, 1999 of the Central Organization Department.
Article 4
1. In addition to cadres provided with telephones and mobile phones as stipulated in Articles 2 and 3 of this Decision, the Minister of National Defense, based on the nature and requirements of actual work, may specifically provide telephones to cadres directly responsible for special tasks, but such provisions must be strictly limited.
2. Based on the provisions of this Decision, the Minister of National Defense shall coordinate with the Minister of Finance to issue a Regulation on the provision, use, and payment of telephone charges for cadres in the military (including cadres outside the established standards) and publicly announce it for implementation by relevant agencies and units.
Article 5. Cadres provided with fixed-line telephones at their residences and mobile phones shall be allocated a budget to cover initial costs as follows:
1. Purchase cost: VND 300,000 per unit for fixed-line telephones and VND 3,000,000 per unit for mobile phones.
2. Installation costs and network connection (or setup) costs shall be paid according to invoices from postal services at the time of equipment installation.
3. Costs for repairs and replacements when telephones are damaged beyond repair shall be covered by the state budget according to current regulations on state asset management.
Article 6. Monthly, the managing authority shall allocate funds to cadres provided with official telephones at their residences and mobile phones to cover telephone usage charges (including subscription fees) as follows:
1. For those specified in point a of Clause 2, Article 2 of this Decision: VND 300,000 per unit per month for fixed-line telephones and VND 500,000 per unit per month for mobile phones;
2. For those specified in points b, c, d, đ, e, and g of Clause 2, Article 2 of this Decision: VND 200,000 per unit per month for fixed-line telephones and VND 400,000 per unit per month for mobile phones;
3. For the remaining categories: VND 100,000 per unit per month for fixed-line telephones and VND 250,000 per unit per month for mobile phones. The aforementioned payment amounts shall be made through monthly allocations to the respective categories.

1. Officials who are provided with telephones, upon transferring to new positions that do not fall within the scope of telephone provision or when they have a decision to retire or cease working, shall not be reimbursed for telephone usage charges. However, officials falling under the categories specified in points a, b, c, d, đ, e, g, and h of Clause 2, Article 2 of this Decision shall continue to be reimbursed for fixed-line telephone usage fees for a period of three months from the date of their retirement or cessation of work.
2. The Minister of National Defense shall issue the Regulations on information security when using fixed-line telephones at home and mobile phones for officials provided with such equipment.
Article 8. The initial installation costs and reimbursement of fixed-line telephone usage fees at home and mobile phone usage fees for the designated subjects shall be included in the annual state budget estimate of the Ministry of National Defense.
Article 9. Heads of agencies under the Ministry of National Defense are responsible for implementing the provision and reimbursement of telephone usage fees in accordance with this Decision and the guidance of authorized agencies. Any person making a decision on the provision of telephones or reimbursement that does not comply with this Decision shall bear responsibility for material losses; in cases of serious violations, they will be dealt with according to the provisions of the law.
Article 10. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
The Minister of National Defense and the Minister of Finance, in coordination with relevant agencies, are responsible for guiding and enforcing this Decision.
