Amending and supplementing Circular No. 23/2009/TT-BTTTT dated July 20, 2009
of the Ministry of Information and Communications on the support standards for maintaining and developing public telecommunications services
The Circular supplements Clause 2.3 and Clause 2.4 to Part II, Appendix 1 attached to Circular No. 23/2009/TT-BTTTT dated July 20, 2009 of the Ministry of Information and Communications on the support standards for maintaining and developing public telecommunications services as follows:

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
2.3. Procedures for individuals and households to benefit from the State's policy supporting the use of public telecommunications services
a) Individuals and households using fixed telephone and internet services benefiting from the State's policy supporting the use of public telecommunications services
- A household is a social subject that has been issued a separate Household Registration Booklet by the competent authority, with a specific residential address.
- An individual eligible for support to develop and maintain the use of public telecommunications services in areas where such services are provided is someone who has a permanent residence registration at one locality (ward, commune, town) but works, does business, or lives in another ward, commune, or town (not belonging to the ward, commune, or town where the permanent residence registration is located).
c) Enterprises may be granted permission for no more than one block out of the total three dual-frequency blocks (FDD) B
Article 1. b) Procedures for individuals and households to benefit from the State's policy supporting the use of public telecommunications services
- A copy of the Household Registration Booklet (for households) or a temporary residence registration certificate (for individuals), certified by the People's Committee of the commune or by a Notary Office.
- A contract for developing subscriber accounts with a telecommunications service provider clearly stating the date, month, and year of signing the contract and fully recording the name of the head of the household, the household registration number, the identification card number of the head of the household, and the residential address of the household (for households); the name, identification card number, and temporary residence address of the individual (for individuals). In the contract for developing subscriber accounts benefiting from the State's policy supporting the use of public telecommunications services, the head of the household (for households) and the individual named in the temporary residence registration (for individuals) are the representatives signing the contract.
2.4. Procedures for notifying the subsidy amount to subscribers benefiting from the State's policy supporting the use of public telecommunications services
To inform subscribers of the amount of State support for the use of public telecommunications services, enterprises must include the following information on the billing notice (or statement) for subscribers:
a) For the subsidy for terminal equipment for new subscribers, deducted from the service usage fee, it should be stated separately as follows:
"The amount of State support for terminal equipment (deducted from the service usage fee) this period is ... dong."
b) For the monthly maintenance subsidy for subscribers according to the State standard, it should be stated separately as follows:
"The State supports the maintenance fee for the subscription account is ... dong."
c) For public telecommunications services not subject to value-added tax, it should be stated separately as follows:
"The public telecommunications service fee not subject to value-added tax according to the State policy is ... dong."
This Circular takes effect from February 1, 2010.
The Head of the Ministry's Office, the Director of the Department of Planning and Finance, the Director of the Telecommunications Department; the Management Board, the Chairman of the Supervisory Board, the Director of the Public Telecommunications Service Fund; the Directors of Provincial Departments of Information and Communications; the Boards of Directors, General Directors, Directors of public telecommunications service providers and heads of relevant units are responsible for implementing this Circular.
