Regulations on code number and qualification standards for career titles of civil servants in the field of natural resources and environment investigation

Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, employment, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces; and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

The Minister of Agriculture and Rural Development and the Minister of Home Affairs issue this Joint Circular stipulating job code and qualification standards for specialized aquatic product testing public officials.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Joint Circular stipulates job codes, qualification standards, and appointment and grading of job titles for specialized aquatic product testing public officials.

Article 2. This Joint Circular applies to specialized aquatic product testing public officials working in public service units.

Article 2. Job Code and Classification of Specialized Aquatic Product Testing Public Official Positions

Specialized aquatic product testing public official positions include:

1. Aquatic Product Testing Officer Level II - Job Code: V.03.08.22

2. Aquatic Product Testing Officer Level III - Job Code: V.03.08.23

3. Aquatic Product Testing Technician Level IV - Job Code: V.03.08.24

Article 3. General Professional Ethics Standards for Specialized Aquatic Product Testing Public Officials

1. Passionate about the profession, actively researching, modestly learning, applying scientific and technological achievements in work;

2. Having internal solidarity, listening to colleagues' opinions, proactively cooperating with colleagues to fulfill assigned tasks;

3. Strictly adhering to regulations and operational rules of the profession;

4. Continuously studying to improve professional knowledge and skills, foreign languages, and information technology to effectively complete assigned tasks.

Chapter II

QUALIFICATION STANDARDS FOR JOB TITLES

Article 4. Aquatic Product Testing Officer Level II - Job Code: V.03.08.22

1. Tasks

a) Leading the development of work plans for aquatic product testing, seedling inspection, product inspection, feed, chemical, and biological agent inspection used in aquaculture, and water environment inspection under provincial or key area management, including reviewing plans submitted by subordinate agencies and units;

b) Leading the organization of guidance, monitoring, and inspection to propose timely corrective measures for deviations during testing, inspection, and certification processes; continuously innovating and improving technical procedures, developing plans for technological innovation and improvement in testing, inspection, and certification methods;

c) Within the scope of authority granted, having the right to propose adjustments or suspension of activities that violate current regulations and bearing personal responsibility for such decisions;

d) Summarizing, analyzing, and reporting testing, inspection, and certification results;

đ) Leading the development of rapid and accurate detection procedures for bacteria and other factors causing testing, inspection, and certification result discrepancies, and proposing measures to prevent contamination during testing;

e) Leading or participating in the development of training programs and content for lower-level officers and subordinate units regarding aquatic product testing, inspection, and certification.

a) Graduated from university or higher in fisheries or related fields suitable for aquatic product testing, inspection, and certification;

b) Possessing a level 3 proficiency in foreign languages as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the Six-Level Foreign Language Proficiency Framework for Vietnam;

c) Meeting the basic information technology skills standard as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Skills Standards;

d) Holding a Level II Aquatic Product Testing Officer certificate.

a) Being thoroughly familiar with laws and regulations concerning fisheries;

b) Mastering technical procedures and norms for inspection, testing, and certification in the fisheries sector;

c) Proficient in technical operations for inspection, testing, and certification, skillfully using machinery, equipment, and tools during operations;

d) Capable of organizing and arranging personnel for inspection, testing, and certification activities, effectively utilizing the organizational strength under their supervision;

đ) Having the ability to draft professional documents, capable of promptly and accurately processing information;

e) Having extensive knowledge and understanding of inspection, testing, and certification in the fisheries sector;

g) Leading or participating in scientific research projects or proposals recognized and implemented effectively by a Ministry or provincial-level Scientific Council.

A public official promoted from the Aquatic Product Testing Officer Level III position to the Aquatic Product Testing Officer Level II position must have held the Aquatic Product Testing Officer Level III position or equivalent for at least nine years, including at least two years in the most recent period holding the Aquatic Product Testing Officer Level III position.

Article 5. Fisheries Inspector Level III - Code: V.03.08.23

1. Tasks

a) Participate in building plans and schemes to implement fishery testing, inspection, and certification work for fish seed, fish products, feed, chemicals, and biological preparations used in aquaculture; aquaculture water environment;

b) Participate in drafting and providing comments on regulatory legal documents, procedures, standards, and testing methods related to fishery testing, inspection, and certification;

c) Carry out fishery testing, inspection, and certification tasks at localities, regions, or organizations and individuals when assigned; be responsible for the results of the assigned work;

d) Know how to organize or cooperate with other officers of the same level to perform inspection, testing, and certification tasks; guide lower-level officers in implementing their tasks;

đ) Propose measures to improve labor efficiency in assigned tasks; guide the application of initiatives and technical improvements in the workplace and organize professional activities of staff in a reasonable and scientific manner;

e) Organize monitoring and tracking of aquaculture processes, experiments serving testing, inspection, and certification processes;

g) Process, analyze, and synthesize results to serve testing, inspection, and certification work or management work in the specialized field;

h) Conduct scientific research topics at the grassroots level, propose technical solutions, and participate in scientific projects and programs at the ministry and sector levels;

i) Promote and guide necessary documents and materials on testing, inspection, and certification for lower-level officers and training activities of agencies and units;

a) Hold a bachelor's degree or higher in fisheries or relevant fields suitable for fishery testing, inspection, and certification;

b) Possess foreign language proficiency level 2 as stipulated in Circular No. 01/2014/TT-BGDDT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language competency framework for Vietnam;

c) Meeting the basic information technology skills standard as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Skills Standards;

d) Hold a Fisheries Inspector Level III certificate;

a) Be thoroughly familiar with the Fisheries Law and other necessary legal regulations for fishery testing, inspection, and certification work;

b) Be thoroughly familiar with testing method procedures and standards for indicators serving fishery testing, inspection, and certification work;

c) Have knowledge and the ability to recognize and classify farmed and wild aquatic species; understand diseases and environments in aquaculture, permissible limits for beneficial indicators in aquaculture or minimum permissible limits for indicators in fishery products according to specified standards;

d) Be proficient in laboratory techniques serving assigned tasks;

đ) Know how to direct and instruct inspection methods and have the ability to mobilize people, coordinate well with related factors to effectively implement tasks; simultaneously have the ability to work independently;

e) Be proficient in using machinery and equipment, standards, and testing methods for tests serving fishery testing, inspection, and certification work;

g) Have the ability to confirm the validity of testing methods serving fishery testing, inspection, and certification work;

An officer promoted from the position of Fisheries Technician Level IV to the position of Fisheries Inspector Level III must meet all the provisions of this Article's Clauses 1, 2, and 3 and have worked in the position of Fisheries Technician Level IV for the following period:

a) For initial recruitment cases with a college degree, must have at least two years of experience working in the position of Fisheries Technician Level IV;

b) For initial recruitment cases with a secondary vocational degree, must have at least three years of experience working in the position of Fisheries Technician Level IV;

Article 6. Fisheries Testing Technician Level IV - Code: V.03.08.24

1. Tasks

a) Directly supervise the technical cultivation of aquatic products in ponds, lakes, tanks, cages, and pools, carry out experiments to supply aquatic seed products for testing, trial, certification, or as corresponding products;

b) Understand the procedures, regulations, and standards for sample collection to serve the work of trials, testing, certification of aquatic products;

c) Use and maintain equipment in laboratories for testing, trials, certification, and other equipment serving these activities and ensuring their operational quality;

d) Know how to prepare chemicals according to standards and instructions of testing methods for each criterion;

đ) Directly conduct tests according to the guidelines of testing methods for each criterion;

e) Monitor and check each technical stage to ensure compliance with procedures, norms, standards, and economic-technical quotas as prescribed;

g) Record all laboratory logs, implement file storage, and manage documents as required;

h) Maintain the workplace to meet technical requirements, labor safety, and environmental hygiene.

a) Graduated from a college level or higher in a relevant field of fisheries testing;

b) Have a level 1 proficiency in foreign languages as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language competency framework for Vietnam;

c) Possess computer skills meeting the basic standard for information technology usage as stipulated in Circular No. 03/2014/TT-BTTTT dated March 11, 2014, issued by the Ministry of Information and Communications on Information Technology Usage Standards;

a) Master knowledge of chemistry and physics of materials and chemicals used in testing and sampling; knowledge of labor safety;

b) Understand the operating principles of machinery and equipment used in testing, trials, and certification laboratories for aquatic products;

c) Understand the content and technical procedures of basic aquaculture;

d) Have knowledge about protecting the working environment.

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES

Article 7. Principles for Appointment and Salary Classification for Professional Titles in Fisheries Testing

1. The appointment to professional titles for officials specified in this Joint Circular must be based on job positions and meet the criteria for professional titles in the fisheries testing field.

2. When appointing from the current rank of officials to a professional title in the fisheries testing field, it is not allowed to combine salary grade increases or promotions in professional titles.

Article 8. Salary Classification

1. The professional titles for officials in the fisheries testing field specified in this Joint Circular shall apply the Specialized Vocational Pay Scale for State-Owned Enterprise Staff (Table 3) promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on the Remuneration System for Officials, Civil Servants, and Military Personnel, as follows:

a) The professional title of Fisheries Testing Officer Level II applies the pay coefficient for Group A2, Category A2.2 (from coefficient 4.0 to coefficient 6.38);

b) The professional title of Fisheries Testing Officer Level III applies the pay coefficient for Group A1 (from coefficient 2.34 to coefficient 4.98);

c) The professional title of Fisheries Testing Technician Level IV applies the pay coefficient for Group B (from coefficient 1.86 to coefficient 4.06).

2. Salary classification upon completion of probation and appointment to a professional title:

After completing the probation period as prescribed and being appointed to a professional title by the competent authority managing officials, the following salary classification will be implemented:

a) In case of having a doctoral degree in fisheries, the salary grade 3, coefficient 3.00 of the professional title of Fisheries Testing Officer Level III (Code: V.03.08.23) will be applied;

b) In case of having a master's degree in fisheries, the salary grade 2, coefficient 2.67 of the professional title of Fisheries Testing Officer Level III (Code: V.03.08.23) will be applied;

c) In case of having a college degree in fisheries, the salary grade 2, coefficient 2.06 of the professional title of Fisheries Testing Technician Level IV (Code: V.03.08.24) will be applied.

3. Salary classification upon promotion or change of professional title:

The salary classification for officials appointed to a professional title in fisheries testing when promoted or changed to another professional title shall be carried out according to Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding salary classification when upgrading ranks, changing ranks, or changing types of civil servants and officials.

Chapter IV

IMPLEMENTATION PROVISIONS

Article 9. Effective Date

1. This Joint Circular takes effect from December 5, 2015.

Article 10. Implementation Organization

1. This Joint Circular serves as the basis for implementing recruitment, utilization, and management of officials specializing in fisheries testing working in public service units.

2. Non-public service organizations may apply these provisions for recruitment, utilization, and management of officials specializing in fisheries testing.

3. The head of public service units directly managing and utilizing officials specializing in fisheries testing shall be responsible for:

a) Reviewing job positions within the unit, developing plans for appointing professional titles of officials specializing in fisheries testing under their management authority, submitting them to the competent authority for examination and decision-making or deciding according to delegated authority;

b) Deciding on the appointment of professional titles for officials specializing in fisheries testing in public service units according to their authority or delegated authority after the appointment plan has been approved by the competent authority;

c) Reporting the implementation results to the superior management agency for monitoring.

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Direct subordinate units under their management to implement appointments to professional titles and salary classifications for officials specializing in fisheries testing;

b) Approve the plan for appointing occupational titles and determining salaries for specialized aquatic product inspection civil servants within their management scope from their current civil servant ranks to corresponding specialized aquatic product inspection occupational titles as stipulated in this Joint Circular; resolve any issues arising during the appointment of occupational titles and determination of salaries within their authority;

c) Decide on the appointment of occupational titles and determination of salaries for specialized aquatic product inspection civil servants under their management to corresponding specialized aquatic product inspection positions in units within their management scope;

d) Annually report the results of the appointment of occupational titles and determination of salaries for specialized aquatic product inspection civil servants within their management scope to the Ministry of Agriculture and Rural Development and the Ministry of Home Affairs;

Article 11. Responsibility for Implementation

1. The Minister, Head of a Ministerial Equivalent Agency, Head of an Agency under the Government; Chairpersons of People's Committees of provinces and centrally governed cities, and related agencies, organizations, and individuals are responsible for implementing the provisions of this Joint Circular;

2. In the course of implementation, if there are any issues, they are requested to reflect them to the Ministry of Agriculture and Rural Development and the Ministry of Home Affairs for consideration and resolution.
