CIRCULAR
Regulations on energy consumption standards in the plastic industry
CamendWHEREAS, đAccording to Decision No. 95/2012/N3. Amend Clause 3 Article 2 as follows:-CP dated November 12, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;amendPursuant to the Law on Rational and Efficient Energy Use dated June 28, 2010;
Pursuant to the Government Decree No. 21/2011/NĐ-CP dated March 29, 2011 detailing and providing solutions for implementing the Law on Rational and Efficient Energy Use;
At the proposal of the Director General of the National Energy Agency;
hereby regulates energy consumption standards in the plastic industry as follows.
4. Supplement Clause 7 following Clause 6 Article 2 as follows: 1. This Circular stipulates energy consumption standards in the plastic industry during the period up to the end of 2020 and from 2021 to the end of 2025 for the following products: a) Plastic packaging: including plastic bags, plastic bottles, and plastic wrapping materials. b) Construction plastic materials: including various types of plastic products used in construction produced through extrusion molding processes, excluding products combining different materials (such as steel-reinforced doors or aluminum-coated plastic sheets...).
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
c) Household plastics/Technical plastics: including household plastic products and technical plastics produced through injection molding processes.
This Circular applies to plastic product manufacturing facilities and other relevant agencies and organizations.
1. Specific energy consumption (SEC)
is the total amount of energy consumed to produce one unit of product volume.

2. In cases where the specific energy consumption of operating plastic product manufacturing facilities exceeds the corresponding energy consumption standards for each period as prescribed in Clause 1 and Clause 2 of Article 5 of this Circular, such facilities shall be responsible for developing and implementing measures to improve energy use efficiency to meet the energy consumption standards prescribed in Clause 1 and Clause 2 of Article 5 of this Circular.

Article 7. Some solutions to improve energy use efficiency in the plastic industry
1. Measures to improve energy use efficiency in the plastic industry must fully utilize management and technological solutions.
2. Encouragement is given to plastic product manufacturing facilities to apply advanced energy management standards and implement energy use efficiency improvement measures in the plastic industry as specified in Appendix II attached to this Circular.
Article 7. Certain measures to enhance energy efficiency in the plastic industry
1. The development and implementation of measures to improve energy efficiency in the plastic industry must fully utilize management solutions and technology.
2. Encourage plastic product manufacturing facilities to adopt advanced energy management standards and apply measures to enhance energy efficiency in the plastic industry as specified in Appendix II attached to this Circular.
Chapter III
IMPLEMENTATION
Article 8. Responsibilities of the General Department of Energy
1. Take the lead and coordinate with relevant agencies to guide, organize supervision, and inspect the implementation of the contents of this Circular.
2. Coordinate with provincial Departments of Industry and Trade to inspect the implementation of energy consumption standards, the feasibility of plans aimed at ensuring energy consumption standards according to the roadmap.
3. Based on the inspection results, the General Department of Energy shall report to the Minister of Industry and Trade in cases where the provisions of Article 5 of this Circular are not properly implemented and propose measures for handling in accordance with current laws.
Article 9. Responsibilities of Provincial Departments of Industry and Trade
1. Coordinate with the General Department of Energy to guide, urge, and inspect the implementation of energy use in a thrifty and efficient manner in accordance with the contents of this Circular.
2. Annually, take the lead in inspecting the implementation of energy consumption standards, the feasibility of plans aimed at ensuring energy consumption standards according to the roadmap (for production facilities that have not yet met the standards) of plastic product manufacturing facilities in the locality.
Article 10. Responsibilities of Production Facilities, Organizations, and Individuals
1. Organizations and individuals operating in the plastic industry must have plans to comply with the provisions of Article 6 of this Circular.
3. In cases where a plastic product manufacturing facility cannot determine the energy consumption rate during the reporting period, the facility must install complete electricity metering equipment to ensure the accuracy of the energy consumption rate of the unit and report the remaining year's energy consumption rate in accordance with Clause 2 of this Article.
Article 11. Effective Date
This Circular takes effect from December 10, 2017.
2. During the course of implementation, if there are any issues or difficulties, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Industry and Trade for study, amendment, and supplementation of the Circular./.
