DECREE

Provisions on the conditions for operating automobile driving training services and driving examination services

Decree No. 65/2016/ND-CP dated July 1, 2016 of the Government stipulates the conditions for operating automobile driving training services and driving examination services, which took effect from July 1, 2016, and was amended and supplemented by:

1. Decree No. 138/2018/ND-CP dated October 8, 2018 of the Government amending and supplementing certain articles of Decree No. 65/2016/ND-CP dated July 1, 2016 of the Government stipulating the conditions for operating automobile driving training service bases and driving examination services, which took effect from December 1, 2018.

2. Decree No. 70/2022/ND-CP dated September 27, 2022 of the Government amending and supplementing certain articles of decrees related to business operations in the road transport sector, which took effect from November 1, 2022.

3. Decree No. 41/2024/ND-CP dated April 16, 2024 of the Government amending and supplementing certain articles of decrees related to the management of road transport activities by motor vehicles, automobile driving training, and driving examination services, which took effect from June 1, 2024.

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Investment Law dated November 26, 2014;

Pursuant to the Road Traffic Law dated November 13, 2008;

Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;

Pursuant to the Vocational Education Law dated November 27, 2014;

At the proposal of the Minister of Transport;

The Government promulgates this Decree stipulating the conditions for operating automobile driving training services and driving examination services[1].

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the conditions for operating automobile driving training services and driving examination services.

Article 2. Applicability

This Decree applies to automobile driving training service bases, driving examination centers, organizations, and individuals conducting activities related to the operation of automobile driving training services and driving examination services in Vietnam.

Article 3. Explanation of Terms[2]

1. An automobile driving training service base is a vocational education institution performing the function of training automobile driving skills.

2. Training cars used for automobile driving training shall be equipped with two "TRAINING" signs front and rear according to the model prescribed at Seal Registration Certificate This Decree, shall be equipped with a device monitoring the time and distance of practical driving lessons on the road for trainees, and shall have a secondary braking system installed to ensure effective braking, located beside the instructor's seat, and shall be covered trucks with seats for trainees, and shall have a certificate of technical safety inspection and environmental protection for motor vehicles still valid.

3. Examination cars used for driving examinations shall be equipped with two "EXAMINATION" signs front and rear, and shall have a secondary braking system installed to ensure effective braking, and shall have a certificate of technical safety inspection and environmental protection for motor vehicles still valid.

4. Training capacity is the maximum number of trainees that a base is permitted to train at one time, determined by the total number of trainees training for various categories of driver’s licenses, including both theoretical and practical trainees at the time of determining the training capacity.

5. A driving examination center is a facility constructed in accordance with national technical standards, providing driving examination services, and classified as follows:

a) Type 1 Driving Examination Center: Conducts examinations to issue driver’s licenses for categories A1, A2, A3, A4, B1, B2, C, D, E, and category F (FB2, FC, FD, FE);

b) Type 2 Driving Examination Center: Conducts examinations to issue driver’s licenses for categories A1, A2, A3, A4, B1, B2, and category C;

c) Type 3 Driving Examination Center: Conducts examinations to issue driver’s licenses for categories A1, A2, A3, and category A4.

Chapter II. CONDITIONS FOR BUSINESS, ISSUANCE AND REVOCATION OF LICENSES FOR MOTOR VEHICLE DRIVER TRAINING

Article 5. General Conditions for Motor Vehicle Driver Training Institutions

1. It must be a vocational education institution established in accordance with the provisions of the law.

Article 6. Technical Infrastructure Conditions

1.[5] Specialized classroom system:

a) Theoretical classroom: Equipped with devices to support teaching on traffic laws, driver ethics, traffic culture, prevention of alcohol and drug harm when participating in traffic, fire prevention and rescue; road signal systems, road shape models designed in the form of paintings or electronic designs;

b) Automotive Technology Classroom: Equipped with projection technology devices to support teaching on vehicle structure, basic repairs, and driving techniques; in cases where projection technology devices do not have video simulations of suspension systems, braking systems, steering systems, and basic driving maneuvers (seat adjustment, driving posture, steering wheel grip...), there must be diagrams or drawings; equipped with cutaway engine models, power transmission system models, and electrical system models; in cases where there are no cutaway engine models, power transmission system models, and electrical system models, video and image projection devices must be used for simulation. Tools for guiding students in practical tire changing, oil and coolant checks should be provided (which can be arranged separately); there should be safety-assured vehicles for cold and hot gear practice (which can be arranged separately); there should be simulation devices for training driving;

c) The motor vehicle driver training institution must arrange a number of theoretical classrooms and automotive technology classrooms appropriate to the number of trainees and training programs; for less than 500 trainees, at least 1 theoretical classroom and 1 automotive technology classroom must be available; for between 500 and 1,000 trainees, at least 2 theoretical classrooms and 2 automotive technology classrooms must be available; for more than 1,000 trainees, at least 3 theoretical classrooms and 3 automotive technology classrooms must be available.

2. Driving Practice Vehicles

a)[6] Must have driving practice vehicles of various categories legally owned by the training institution; these vehicles must be licensed by the competent authority for driving practice; if the training institution provides driving examination services, based on the usage time of examination vehicles for examination purposes, it may use examination vehicles for both examinations and training, but the number of examination vehicles used for training shall not exceed 50% of the total number of examination vehicles used for training;

d) For category B1 and B2 trucks used for training, the load capacity must be 1,000 kg or more, and their number must not exceed 30% of the total number of driving practice vehicles of the same category in the training institution;

3. Driving Practice Grounds

a)[15] Legally owned by the motor vehicle driver training institution;

b) A motor vehicle driver training institution with a training volume of 1,000 trainees or more must have at least 2 driving practice grounds as prescribed;

c) The driving practice grounds for motor vehicles must have sufficient road signal systems, sufficient scenarios for each lesson according to the training program content; the size of the driving practice areas must comply with the national technical standards for driving examination centers for each corresponding vehicle category;

d) The ground surface must have adequate elevation and drainage systems to prevent waterlogging; the surfaces of lanes and driving practice areas must be paved with asphalt or concrete, and must have sufficient painted lane markings; driving practice areas must be bordered;

đ) There must be waiting houses and seats for trainees during practical lessons;

e) Minimum area of the driving practice grounds: Category B1 and B2 is 8,000 m²; Categories B1, B2, and C is 10,000 m²; Categories B1, B2, C, D, E, and F is 14,000 m².

Article 7. Conditions for Teachers[17]

1. There must be a team of teachers who meet the standards specified in this Decree to teach theoretical and practical courses.

Article 8. Standards for Driving Instructor Teachers, Certificate, and Authority to Issue the Driving Instructor Teacher Certificate[19]

1.[20] General Standards: Driving instructor teachers must meet the standards prescribed by the law on vocational education.

2. Teachers teaching theory must have a diploma from a college level or higher in one of the following majors: law, automotive technology, automotive engineering technology, automobile assembly, or other professions with at least 30% of specialized training in automotive; teachers teaching the Driving Technique subject must hold a driver's license corresponding to the category of vehicle being trained or higher;

3. Practical driving instructors must meet the following standards:

a) Hold a driver's license corresponding to or higher than the category of vehicle being trained, but not lower than Category B2;

b) Instructors teaching Categories B1 and B2 must hold a driver's license for at least three years from the date of recruitment; instructors teaching Categories C, D, E, and F must hold a driver's license for at least five years from the date of recruitment;

c) Have completed training in practical driving instruction according to the program issued by the competent authority and obtained a Practical Driving Instructor Teacher Certificate according to the model prescribed in Appendix VI issued together with this Decree.

4.[21] The Department of Transport shall issue the Practical Driving Instructor Teacher Certificate to instructors belonging to training institutions managed by local authorities or individuals.

Article 9. Procedures for Issuing and Revoking the Practical Driving Instructor Teacher Certificate[22]

1. The application dossier for issuing the Practical Driving Instructor Teacher Certificate includes:

a) A request form according to the model prescribed in REGULATIONS ON THE CERTIFICATE DESIGN FOR OUTSTANDING RURAL INDUSTRIAL PRODUCTS this Decree;

b) A college diploma or higher (a copy accompanied by the original for verification or a certified copy or an electronically certified copy from the original);

c) A teaching qualification certificate (a copy accompanied by the original for verification or a certified copy or an electronically certified copy from the original);

d) One color photograph measuring 3 cm x 4 cm on a blue background, similar to an identity card photo, taken within six months.

If the documents specified in points b and c of this clause are integrated into the electronic identification account, presentation and verification can be conducted through the electronic identification account.

2. Procedures for Implementation

a) Individuals requiring issuance of the Practical Driving Instructor Teacher Certificate for the first time shall submit one set of application dossiers according to the provisions of Clause 1 of this Article directly or via postal service to the driving training institution;

b) The driving training institution shall accept the individual's application dossier, ensure the conditions for participants in training as stipulated in Article 8 of this Decree and organize training according to the training program for practical driving instructor teachers as prescribed by the Ministry of Transport;

c) Within no more than three working days from the end of the training program, the training institution shall send a letter according to the model prescribed in Appendix V this Decree and the individual's training dossier to the Department of Transport requesting inspection and issuance of the Practical Driving Instructor Teacher Certificate through one of the following methods: Directly, postal service, or electronic document;

d) The Department of Transport shall accept the list compiled by the training institution and the individual's dossier; if the dossier is incomplete or inaccurate, within two working days, it must issue a document specifying the content and reasons for the training institution to supplement and correct; within no more than five working days from receiving the complete dossier as prescribed, it shall organize inspection and evaluation. If the individual does not meet the requirements, the Department of Transport must respond in writing to the training institution and specify the reasons;

đ) Within no more than three working days from the date of passing the inspection, the Department of Transport shall issue the Practical Driving Instructor Teacher Certificate and deliver it directly to the individual or send it via postal service, record it in the tracking book according to the model prescribed in Appendix VI this Decree. If the individual fails, the Department of Transport must notify them in writing.

3. The Practical Driving Instructor Teacher Certificate shall be revoked in the following cases:

a) Engaging in fraudulent behavior to participate in training and examination to obtain the Practical Driving Instructor Teacher Certificate;

b) Issuing the certificate to individuals who do not meet one of the standards prescribed in Article 8 of this Decree;

c) Issued by an agency or person without authority to issue;

d) Erased or altered;

đ) Leased or lent to another training institution for use but not participating in teaching; or leased or lent to other organizations or individuals for use.

4. The competent authority issuing the Driving Instructor Certificate shall carry out the revocation procedure as follows:

a) Within five working days from the date of discovering the violation, the competent authority shall issue a decision to revoke, notify relevant agencies to coordinate implementation, and publish on the electronic information website of the competent authority;

b) The holder of the Driving Instructor Certificate must return the certificate to the issuing authority immediately upon discovery of the violation by the competent authority and cease participation in teaching.

Article 10. Procedures for Reissuing the Driving Instructor Certificate[23]

1. The Driving Instructor Certificate shall be reissued in cases of loss, damage, or changes in content.

a) The application dossier for reissuance in cases of loss or damage includes the components specified in point a and point d, Clause 1, Article 9 of this Decree;

b) The application dossier for reissuance in cases of content change includes the components specified in point a and point d, Clause 1, Article 9 of this Decree and related documents corresponding to the changed content, specifically as follows: Change of name of the individual applying for the Driving Instructor Certificate: A certified copy of the decision of the competent authority regarding the name change; change of date of birth, present identification card.

In cases where the documents specified in point b of this clause have been integrated into the electronic identity account, presentation and verification can be conducted through the electronic identity account.

2. Procedures for Implementation

a) The individual prepares one set of dossier and submits it directly, via postal service, or through the online public service system to the Department of Transport;

b) The Department of Transport receives the dossier. If the individual does not meet the conditions, within no more than three working days, the Department of Transport must respond in writing and specify the reasons;

c) Within no more than three working days from the date of receiving the complete dossier, the Department of Transport issues the Driving Instructor Certificate, delivers the result directly or through the public postal service, and records it in the tracking logbook as prescribed in Appendix VI Appendix to this Decree.

Article 11. Training Vehicle Permit and Authority to Issue Training Vehicle Permit[24]

1. The Department of Transport issues the Training Vehicle Permit for training vehicles of training institutions managed by localities according to Model No. 02 in Form No. 01, Appendix VII attached to this Decree; its validity corresponds to the period allowed for circulation recorded on the Safety Technical Inspection and Environmental Protection Certificate for Motor Vehicles but does not exceed the legal usage period for training vehicles.

2. The Training Vehicle Permit shall be revoked in the following cases:

a) Issued to a training vehicle that does not meet one of the conditions stipulated in Clause 2, Article 3 and Clause 2, Article 6 of this Decree;

b) Erased or altered;

c) Used by another organization or individual for driver training purposes;

d) The driving school is dissolved or has had its training permit revoked;

đ) At the request of the training institution;

e) The training vehicle is equipped with and uses two or more DAT devices to cheat during practical driving training.

3. The competent authority issuing the Training Vehicle Permit shall carry out the revocation procedure as follows:

a) Within five working days from the date of discovering the violation, the competent authority shall issue a decision to revoke, notify relevant agencies to coordinate implementation, and publish on the electronic information website of the competent authority;

b) The driving school holding the Training Vehicle Permit must stop using the automobile whose permit has been revoked in teaching activities immediately upon discovery of the violation by the competent authority and return the permit to the issuing authority immediately after the revocation decision takes effect.

Article 12. Procedure for Issuing Driving School Practice Vehicle Permits

1. The dossier shall include:

a) A list of vehicles applying for driving school practice vehicle permits according to the prescribed form. Appendix VIII this Decree;

b) Vehicle registration certificate (a copy with the original for verification or a certified copy).

2.[25] Implementation procedure

a) The organization submits the list specified in point a, Clause 1, Article 12 along with the application dossier directly or through postal service to the Department of Transport.

b) The Department of Transport organizes on-site inspections, prepares inspection reports according to the prescribed form in Appendix XIII attached hereto, and issues driving school practice vehicle permits to the applicant organization at the time of issuing the driving training permit.

c) Within no more than 01 working day from the date of issuing the driving training permit to the training institution, the Department of Transport shall issue the driving school practice vehicle permit. In case of non-issuance, a written response must be provided with clear reasons stated.

d) In cases of reissuing driving school practice vehicle permits or adding new practice vehicles: The training institution prepares 01 set of application files including the components specified in Clause 1 of this Article, and submits them directly or through postal service or via the online public service system to the Department of Transport.

e) Within no more than 03 working days from the date of receiving complete files as prescribed, the Department of Transport shall organize inspections and issue driving school practice vehicle permits to the training institutions. In case of non-issuance, a written response must be provided with clear reasons stated.

f) In cases where electronic driving school practice vehicle permits (with QR code) are issued and connected to the Department of Transport's electronic information website for accessing information about cars, driving routes, and validity periods recorded on the Certificate of Technical Safety Inspection and Environmental Protection for Motor Vehicles, the Department of Transport must comply with the provisions of the Law on Electronic Transactions, guiding documents, and issue electronic driving school practice vehicle permits on the electronic information website for the training institutions to print or store on electronic devices.

Article 13. Driving School Training Permit for Passenger Cars and Authority to Issue Such Permits

1. The driving school training permit for passenger cars is issued by the competent authority to driving schools that meet the conditions stipulated in Articles 5, 6, and 7 of this Decree..

2. The driving school training permit for passenger cars, according to the prescribed form attached hereto, shall be reissued in cases of loss, damage, or changes related to the content of the driving school training permit. Appendix IX 3. The competent authority to issue driving school training permits for passenger cars

b) The Department of Transport shall issue new or reissue driving school training permits for passenger cars to driving schools managed by local authorities.

a)[26] (Repealed)

Article 14. Procedure for Issuing Driving School Training Permits for Passenger Cars

a) Documents accompanying the report requesting issuance of the driving school training permit according to the prescribed form.

1.[27] In cases of refusal, the State Bank will issue a document refusing approval to use foreign currency within the territory and clearly state the reasons.

b) Decision on establishment of vocational education institutions by the competent authority (a copy with the original for verification or a certified copy or an electronically certified copy from the original). ANNEX X this Decree;

c) Certificate of instructors teaching practical driving lessons (a copy with the original for verification or a certified copy or an electronically certified copy from the original).

d) Vehicle registration certificate (a copy with the original for verification or a certified copy or an electronically certified copy from the original).

If the documents specified in points b, c, and d of this clause have been integrated into the electronic identity account, presentation and verification can be conducted through the electronic identity account.

After completing the construction of physical facilities, investment in vehicles and equipment for driving lessons according to the technical and professional standards of driving schools; organizations or individuals prepare 01 set of application files and submit them directly or through postal service to the competent authority for issuing driving school training permits for passenger cars as stipulated in

2. Procedures for Implementation

Clause 3, Article 13 of this Decree. If the application files are incomplete, within no more than 02 working days from the date of receipt of the files, the Department of Transport must provide a written response to the organizations or individuals.;

b)[28] Within no more than 10 working days from the date of receiving complete files as prescribed, the Department of Transport shall take the lead and coordinate with the local vocational education management agency to conduct on-site inspections of the training institutions, prepare inspection reports according to the prescribed form in

c)[29] attached hereto, and issue driving school training permits for passenger cars to those meeting the conditions. In case of non-issuance, a written response must be provided with clear reasons stated. ANNEX XI together with this Decree and issue a Driving School Training Permit to eligible facilities. In case of non-issuance, a written response must be provided stating the reasons.

Article 15. Procedures for Reissuing Driving School Training Licenses for Motor Vehicles

1. A driving school training license for motor vehicles shall be reissued when there is a change in the category of vehicles being trained or the training volume.

a)[30] The dossier includes the components prescribed in point a, point c and point d Clause 1, Article 14 of this Decree (only supplementing contents that have changed from the most recent issuance).

b) Procedure

The training institution prepares one set of dossier to submit directly or via postal service to the competent authority issuing the driving school training license for motor vehicles as stipulated at If the application files are incomplete, within no more than 02 working days from the date of receipt of the files, the Department of Transport must provide a written response to the organizations or individuals.;

Within no more than five working days from the date of receiving the complete dossier as prescribed, the competent authority shall coordinate with the vocational education management agency to conduct on-site inspection of the training institution and prepare a record according to the model prescribed at ANNEX XI this Decree;

Within no more than three working days from the end of the inspection, the competent authority shall reissue the driving school training license for motor vehicles to the training institution. In case of non-reissuance, a written response must be provided along with the specific reasons.

2. A driving school training license for motor vehicles shall be reissued when it is lost, damaged, or there is a change related to other content.

a) The training institution submits a written request for reissuance of the driving school training license for motor vehicles and clearly states the reason for loss, damage, or the content requiring changes, to be sent directly or via postal service to the competent authority;

b) Within no more than three working days from the date of receiving the complete dossier as prescribed, the competent authority shall reissue the driving school training license for motor vehicles to the training institution. In case of non-reissuance, a written response must be provided along with the specific reasons.

Article 16. Revocation of Driving School Training Licenses for Motor Vehicles

1. A driving school training license for motor vehicles shall be revoked indefinitely when the training institution violates any of the following cases:

a) Engaging in fraudulent behavior to establish or obtain a driving school training license for motor vehicles;

b) Not commencing training activities for motor vehicle drivers within twenty-four months from the date of issuance of the driving school training license for motor vehicles;

c) Being suspended from recruiting students for driver training two or more times within eighteen months;

d) The issued license does not correspond to the authority's jurisdiction;

đ) Altering, erasing, or tampering with the content on the issued license;

e) Leasing or lending the license;

g)[31] The driving school dissolves in accordance with the provisions of the law;

h)|||[32] The driving school does not organize training activities for motor vehicle drivers continuously for twenty-four months from the date of the notice of temporary suspension of operations without meeting the conditions for operating a driver training service;

i)[33] The driving school does not organize training activities for motor vehicle drivers continuously for twenty-four months.

2. The competent authority issuing the driving school training license for motor vehicles shall carry out the revocation process as follows:

a) Issuing a decision to revoke the driving school training license for motor vehicles, notifying relevant agencies to cooperate in implementation, and publishing on the electronic information portal of the Department of Transport;

b) The driving school must return the driving school training license for motor vehicles to the issuing authority immediately upon the effectiveness of the decision, while ceasing all training activities for motor vehicle drivers under the revoked license.

Chapter III. CONDITIONS FOR OPERATING, ISSUING AND REVOKING LICENSES FOR DRIVING TEST CENTERS MEETING THE REQUIREMENTS FOR OPERATION

Article 17.[34] (Repealed)

Article 18. Conditions regarding material infrastructure

1. General conditions

a) Area of the driving test center: Type 1 centers must have an area of at least 35,000 m²; type 2 centers must have an area of at least 20,000 m²; type 3 centers must have an area of at least 4,000 m².²; type 2 centers have an area not less than 20,000 m²²; type 3 centers have an area not less than 4,000 m²²;

b)[35] (Repealed)

c)[36] Number of motor vehicles used for testing: For driving tests in categories A1, B1, B2, and C, there must be a minimum of two vehicles per category (combining on-road and in-simulator testing), and these vehicles may not be used for other business purposes; for on-road driving tests, there must be a minimum of one vehicle per category. The testing vehicles belong to organizations or individuals legally owning the driving test center.

d) Equipment for theoretical testing: At least two servers; at least ten workstations for type 3 testing centers, and at least twenty workstations for type 1 or type 2 testing centers.

đ) Equipment for practical driving tests in simulators: At least two computers installed with software for managing and conducting tests for each type of testing center.

e) Equipment for practical driving tests on roads: At least two computers installed with software for managing and conducting tests, one computer serving as a server and controller with its own leased line and static IP address.

g)[37] Simulation equipment for driving tests of automobiles: Shared with the theoretical testing center's server and workstations; if separate installation is required, at least two servers and at least ten workstations installed with traffic simulation software as prescribed by the Ministry of Transport shall be provided.

2. Technical conditions

The testing center must meet technical requirements as stipulated in the National Technical Regulations on Driving Test Centers issued by the Ministry of Transport, including lanes, traffic signals, road marking systems, boundary lines, examination road markings, standard posts, and examination scenarios within the testing ground; motor vehicles used for testing; equipment for theoretical testing; equipment for practical driving tests in simulators; equipment for practical driving tests on roads; control rooms and auxiliary facilities.

Article 19. Certificate of Eligibility for Operation of Driving Test Centers

1. The Certificate of Eligibility for Operation of Driving Test Centers is issued by the competent authority to driving test centers that satisfy the conditions set forth in Article 18 of this Decree..

2. The Certificate of Eligibility for Operation of Driving Test Centers follows the model specified in Appendix XII this Decree; it will be reissued in cases of loss, damage, changes related to the content of the certificate, or changes in testing equipment, types, and quantities of automobiles used for driving tests. The reissued certificate must include the cancellation of the previous certificate's validity.

3.[38] The Department of Transportation issues new or reissues Certificates of Eligibility for Operation of Driving Test Centers within the province or centrally-administered city.

Article 20. Approval of Overall Layout Plan for Type 1 and Type 2 Driving Test Centers

1. The dossier shall include:

a)[39] Investment decision of the competent authority for domestic investors, economic organizations with foreign investment (where foreign investors hold less than 51% of the charter capital), excluding projects that do not require approval of the investment decision or Investment Registration Certificate for foreign investors, economic organizations with foreign investment (where foreign investors hold 51% or more of the charter capital) (a copy accompanied by the original for verification or a certified copy);

b) Overall layout plan drawings;

c) Construction permit (a copy accompanied by the original for verification or a certified copy);

d) Design documentation for examination scenarios, list of motor vehicles used for testing, and automatic scoring equipment.

2.[40] Implementation procedure

a) Organizations or individuals submit a request letter along with one set of documents directly or through postal service to the Department of Transportation;

b) Within no more than five working days from the date of receipt of complete documents as prescribed, the Department of Transportation sends a written approval to the organization or individual; in case of disapproval, the organization or individual must be notified in writing with specific reasons provided.

Article 21. Procedures for Issuing Certificates for Driving Test Centers of Type 1 and Type 2 Meeting Operating Conditions[41]

1. After completing the construction of the driving test center, organizations and individuals shall submit a request to the Department of Transport for inspection and issuance of a certificate confirming that the driving test center meets operating conditions.

2. Within no more than ten working days from the date of receipt of the request, the Department of Transport shall organize inspections, prepare records according to the model prescribed in Appendix XIV attached to this Decree, and issue certificates to driving test centers meeting operating conditions. In cases where a certificate is not issued, a written response must be provided with clear reasons stated.

Article 22. Procedures for Issuing Certificates for Driving Test Centers of Type 3 Meeting Operating Conditions

1. The dossier shall include:

a) Construction permit (a copy accompanied by the original for verification or a certified copy);

b) Overall layout drawings, design files for the dimensions and types of motor vehicles used for driving tests.

2. Procedures for Implementation

a) After completing the construction of the driving test center, organizations and individuals shall directly submit or send by post one set of application documents to the Department of Transport requesting issuance of a certificate confirming that the driving test center meets operating conditions;

b) Within no more than five working days from the date of receipt of complete application documents, the Department of Transport shall organize inspections and issue certificates. In cases where a certificate is not issued, a written response must be provided with clear reasons stated.

Article 23. Procedures for Reissuing Certificates Confirming That Driving Test Centers Meet Operating Conditions

1. The certificate of a driving test center has changes in testing equipment, types, or quantities of motor vehicles used for driving tests.

a) The driving test center shall directly submit or send by post a request for reissuance of the certificate confirming that the driving test center meets operating conditions to the authority responsible for issuing such certificates according to Clause 3, Article 19 of this Decree;

b)[42] Within no more than ten working days from the date of receipt of the request, the Department of Transport shall organize inspections and prepare records according to the model prescribed in Appendix XIV attached to this Decree, and issue certificates to driving test centers meeting operating conditions. In cases where a certificate is not issued, a written response must be provided with clear reasons stated.

2. The certificate of a driving test center will be reissued when it is damaged, lost, or there are changes related to the content of the certificate.

a) The driving test center shall have a written request for reissuance of the certificate and clearly state the reason for damage or loss, and directly submit or send by post to the authority responsible for issuing the certificate according to Clause 3, Article 19 of this Decree;

b) Within no more than three working days, the authority shall reissue the certificate for the driving test center. In cases where a certificate is not issued, a written response must be provided with clear reasons stated.

Article 24. Revocation of Certificates Confirming That Driving Test Centers Meet Operating Conditions

1. A driving test center shall have its certificate confirming that it meets operating conditions revoked without a time limit in the following cases:

a) Engaging in fraudulent activities to obtain a certificate confirming that the driving test center meets operating conditions;

b) Not commencing driving test activities within twenty-four months from the date of issuance of the certificate confirming that the driving test center meets operating conditions;

c) Having its certificate confirming that it meets operating conditions revoked twice or more within eighteen months;

d) The certificate was issued beyond the authority's jurisdiction;

đ) Altering or tampering with the content on the certificate;

e) Lending or renting out the certificate;

g)[43] The driving test center is dissolved in accordance with the law;

h)|||[44] The driving test center does not organize driving test activities for twenty-four consecutive months.

2. The authority responsible for issuing certificates confirming that driving test centers meet operating conditions shall carry out revocation procedures as follows:

a) Issue a decision to revoke, notify relevant agencies to cooperate in implementation, and publish on the electronic information website of the competent authority;

b) The driving test center must return the certificate to the issuing authority and immediately cease all driving test activities under the revoked certificate upon the decision taking effect.

Chapter IV. IMPLEMENTATION PROVISIONS

Article 25.[45] (Repealed)

Article 26. Responsibility for Implementation

1. The Ministry of Transport

a) Provisions on technical standards and professional criteria for classroom systems, driving training vehicles, practice fields, teaching materials, and training programs;

b) Organization of inspections, supervision, and handling of violations in the implementation of the provisions of this Decree.

c)[46] Prescribe standards, timelines for equipping simulation devices for driver training and examination, devices to monitor practice driving time and distance; guide the application of information technology in managing and supervising theoretical study time for trainees at driving schools.

d)[47] Prescribe and guide the management and use of data from devices monitoring practice driving time and distance.

2. The Vietnam Road Administration[48]

a)[49] Organize the implementation, inspection, and supervision of compliance with the conditions stipulated in this Decree; organize training and guidance for provincial Departments of Transport on inspection procedures and issuance of certificates for driving test centers meeting operational requirements;

b) Regularly organize standardization checks of driving test centers to ensure compliance with national technical standards for motor vehicle driving test centers;

c) Announce and update the list of automobile driving schools and driving test centers that have been granted or revoked licenses nationwide on the Vietnam Road Administration's electronic information website.[50].

3. Provincial People's Committees, Municipalities directly under the Central Government

a)[51] (Repealed)

b) Direct relevant agencies to organize inspections and supervision of compliance with the conditions stipulated in this Decree.

4. Departments of Transport

a) Organize the implementation, inspection, and supervision of compliance with the conditions stipulated in this Decree; direct driving test centers to conduct examinations for automobile driving schools under their management. In cases where the locality does not have a driving test center meeting operational requirements, organize examinations at other locations;

b) Announce and update the list of automobile driving schools and driving test centers that have been granted or revoked licenses within their jurisdiction on the Department of Transport's electronic information website.

5. Driving Schools

a) Organize new training and license upgrade courses according to the volume, duration, location, and license category specified in the driving school permit;

b)[52] Maintain and enhance teaching facilities and equipment; manage the teaching staff to meet the required conditions; ensure sufficient means and equipment to maintain environmental hygiene and fire safety as prescribed by law; organize refresher training for practical driving instructors every three years as prescribed by the Ministry of Transport.

6.[53] Driving Test Centers shall ensure material and equipment for testing and scoring, sufficient means and equipment to maintain environmental hygiene and fire safety as prescribed to conduct examinations accurately and impartially.

Article 27. Effectiveness and Responsibility for Implementation[54]

1. This Decree takes effect from July 1, 2016.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of Provincial People's Committees, Municipalities directly under the Central Government, organizations, and individuals related to this Decree shall be responsible for its implementation./.
