On December 11, 2008, the Ministry of Agriculture and Rural Development issued the Inspection and Certification Regulation for the Quality and Food Safety of Aquatic Products under Decision No. 118/2008/QD-BNN (referred to as Regulation 118). This regulation was published in the Official Gazette on December 30, 2008 and took effect from January 15, 2009.
The Quality Management Agency for Agricultural, Forest and Fishery Products guides and requests units to implement the following contents:
Article 4, Clause 1, Point b, Point c: Forms of inspection
- Currently, markets requiring inspection and certification of quality and food safety by competent authorities in Vietnam include: EU, Norway, Switzerland, Serbia, China, South Korea, Russian Federation, French Polynesia, Brazil, Taiwan (for live crabs). Canada requires antibiotic residue testing in farmed aquatic products for enterprises listed in the registered agreement for inspection and certification.
- Markets that the Ministry of Agriculture and Rural Development stipulates must be inspected and certified for exported aquatic products: Currently, Japan is such a market.
The list will be updated and announced when there are changes.
Article 5: Inspection Authority
- Departments of Agriculture and Rural Development designate specialized agencies responsible for inspecting and certifying the conditions for ensuring food safety at production and business establishments for aquatic products according to Regulation 117, and conducting inspections and certifications of the quality of aquatic products before they enter domestic markets according to Regulation 118.
- The Quality Management Agency for Agricultural, Forest and Fishery Products assigns regional Quality Control Centers for Agricultural, Forest and Fishery Products to conduct inspections and certifications of the quality of exported aquatic products; imported aquatic products for processing, recall, and return as specified in Clause 2, Article 5, Regulation 118.
- The inspection authorities mentioned in Clause 1, Clause 2, Article 5 and those designated by law (Clause 11, Article 3) shall conduct inspections and certifications of aquatic products for cases requiring inspections and certifications as specified in Clause 2, Article 4. Inspection authorities designated by law have the responsibility to notify the inspection and certification authorities of production and business establishments for aquatic products according to Article 5, Regulation 117 to handle cases where batches of aquatic products are found not to meet food safety standards.
Article 9: Information on Packaging and Labels
- Current regulations in Vietnam regarding product labeling are Decree No. 89/2006/ND-CP dated August 30, 2006 of the Government on Product Labeling and Circular No. 09/2007/TT-BKHCN dated April 6, 2007 of the Ministry of Science and Technology guiding the implementation of certain provisions of Decree No. 89/2006/ND-CP and Circular No. 14/2007/TT-BKHCN dated July 25, 2007 of the Ministry of Science and Technology supplementing Circular No. 09/2007/TT-BKHCN.
- For exported aquatic products, in addition to the general requirements mentioned above, labeling must comply with additional requirements set out in Clause 2, Article 9, Regulation 118. Given the need for time for businesses to prepare new labeling on packaging, the mandatory application date will be May 1, 2009.
Article 27, Clause 1, Point i: Reporting System:
Before the 22nd day of the first month of each quarter, the inspection authority (as specified in Article 5) shall submit a consolidated report on inspection and certification activities for the quality and food safety of aquatic products; difficulties, obstacles, and recommendations sent to the Quality Management Agency for Agricultural, Forest and Fishery Products for handling and reporting to the Ministry.
5. Printing errors in Regulation 118:
Point c, Clause 1, Article 10 of the Regulation states "… as provided for in Article 12 of this Regulation" shall be amended to read "... as provided for in Article 15 of this Regulation".
During implementation, if there are difficulties or obstacles, units are requested to reflect them to the Quality Management Agency for Agricultural, Forest and Fishery Products for supplementary guidance.
