Regarding the establishment of the Management Board for the Chân Mây - Lăng Cô Economic Zone

in Thua Thien - Hue Province

PRIME MINISTER

Pursuant to the Law on Government Organization dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Pursuant to Decision No. 04/2006/QĐ-TTg dated January 5, 2006 of the Prime Minister regarding the establishment and issuance of the operational regulations for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province;

Considering the proposal of the Chairman of the People's Committee of Thua Thien - Hue Province and the Minister of Home Affairs,

Pursuant to …;

Article 1. The Management Board for the Chân Mây - Lăng Cô Economic Zone under the People's Committee of Thua Thien - Hue Province shall be established to manage investment construction and development of the Chân Mây - Lăng Cô Economic Zone according to its operational regulations, planning, and progress approved by competent state agencies.

The Management Board for the Chân Mây - Lăng Cô Economic Zone has legal personality, bank accounts, office premises, and a seal with the national emblem; it serves as the budget planning focal point of the People's Committee of Thua Thien - Hue Province, and is allocated separate capital for basic construction from the state budget. The staffing and operating expenses of the Management Board are included in the staffing and state budget allocated to Thua Thien - Hue Province.

Article 2. Tasks and Powers

The Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province shall have the following responsibilities and authorities:

- The tasks and authorities stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.

- Specific tasks and authorities stipulated in Article 27 of the Operational Regulations for the Chân Mây - Lăng Cô Economic Zone issued together with Decision No. 04/2006/QĐ-TTg dated January 5, 2006 of the Prime Minister.

Article 3. Organizational Structure and Staffing

1. Organizational Structure:

a) The Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province shall have a Director appointed by the Prime Minister; several Deputy Directors and some members appointed by the Chairman of the People's Committee of Thua Thien - Hue Province upon the recommendation of the Director.

b) The Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province shall have an administrative support staff as specified in Article 28 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, specifically including:

- Office;

- Inspection;

- Specialized departments.

c) Affiliated public service units.

Depending on the specific requirements for the development of the Chân Mây - Lăng Cô Economic Zone at each stage, the Director of the Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province shall decide within their authority.

2. Staffing:

The staffing of the Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province includes the Director, specialized Deputy Directors, and the staffing of the office, inspection department, and specialized departments, which are civil service positions.

The staffing of the Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province shall be decided by the Chairman of the People's Committee of Thua Thien - Hue Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on the delegation of management of administrative and public service staffing, and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on the management mechanism for staffing of public service units of the state.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Thua Thien - Hue Province, and the Director of the Management Board for the Chân Mây - Lăng Cô Economic Zone in Thua Thien - Hue Province are responsible for implementing this Decision./.
