OF THE PRIME MINISTER NUMBER 389/TTG DATED OCTOBER 27, 1959 REGULATING THE ISSUE OF PASSPORTS

 

PRIME MINISTER

AT THE PROPOSAL OF THE MINISTERS OF FOREIGN AFFAIRS AND PUBLIC SECURITY;

DECREE

PART I
GENERAL PROVISIONS

Article 1: CITIZENS OF THE DEMOCRATIC REPUBLIC OF VIETNAM GOING ABROAD MUST CARRY A PASSPORT.

Article 2: THERE ARE THREE TYPES OF PASSPORTS:

- DIPLOMATIC PASSPORT;

- SERVICE PASSPORT;

- ORDINARY PASSPORT;

IN ADDITION, CERTAIN DOCUMENTS HAVE THE SAME VALUE AS PASSPORTS AS PROVIDED BY THE MINISTRY OF FOREIGN AFFAIRS AND THE MINISTRY OF PUBLIC SECURITY.

Article 3: DIPLOMATIC AND SERVICE PASSPORTS ARE ISSUED INDIVIDUALLY TO SPECIFIC PERSONS.

ORDINARY PASSPORTS CAN BE ISSUED INDIVIDUALLY OR FOR GROUPS OF MORE THAN ONE PERSON TRAVELING TOGETHER.

Article 4: PASSPORTS ARE ISSUED TO CITIZENS OF THE DEMOCRATIC REPUBLIC OF VIETNAM WHO ARE 18 YEARS OLD OR OLDER.

CHILDREN UNDER 12 YEARS OLD TRAVELING WITH THEIR PARENTS OR GUARDIANS WILL BE LISTED ON THE PARENTS' OR GUARDIANS' PASSPORTS.

PERSONS BETWEEN 12 AND 18 YEARS OLD WILL BE ISSUED A DOCUMENT EQUIVALENT TO A PASSPORT.

 

PART II
AUTHORITY ISSUING PASSPORTS

Article 5: THE MINISTRY OF FOREIGN AFFAIRS ISSUES DIPLOMATIC, SERVICE, AND ORDINARY PASSPORTS FOR PERSONS TRAVELING ON GOVERNMENT BUSINESS.

THE MINISTRY OF PUBLIC SECURITY ISSUES ORDINARY PASSPORTS FOR PERSONS TRAVELING ON PRIVATE BUSINESS, WHICH MAY DELEGATE THIS POWER TO LOCAL PUBLIC SECURITY BUREAUS WHEN NECESSARY.

FOR VIETNAMESE CITIZENS ABROAD, THE FOREIGN REPRESENTATIVE OFFICES OF THE DEMOCRATIC REPUBLIC OF VIETNAM ISSUE:

- ORDINARY PASSPORTS

- DIPLOMATIC AND SERVICE PASSPORTS UPON AUTHORIZATION FROM THE MINISTRY OF FOREIGN AFFAIRS.

 

CHAPTER III
VALIDITY OF PASSPORTS

Article 6: INDIVIDUAL PASSPORTS CAN BE ISSUED FOR A PERIOD OF UP TO THREE YEARS AND CAN BE RENEWED MULTIPLE TIMES. THE TOTAL VALIDITY PERIOD OF THE PASSPORT, INCLUDING RENEWALS, SHALL NOT EXCEED FIVE YEARS FROM THE DATE OF ISSUE.

GROUP PASSPORTS CAN BE ISSUED FOR A PERIOD OF UP TO 18 MONTHS.

Article 7: PASSPORTS ARE ONLY VALID FOR TRAVEL TO COUNTRIES LISTED IN THE PASSPORT.

Article 8: WHEN NECESSARY, THE PASSPORT-ISSUING AUTHORITY MAY DECLARE A PASSPORT INVALID AND ORDER ITS RECALL. THE RECALL ORDER MUST BE ENFORCED PROMPTLY.

IN CASES OF EMERGENCY, THE FOREIGN REPRESENTATIVE OFFICES OR CONSULAR AUTHORITIES OF THE DEMOCRATIC REPUBLIC OF VIETNAM ABROAD MAY TEMPORARILY WITHHOLD PASSPORTS AND REQUEST THE PASSPORT-ISSUING AUTHORITY TO CANCEL SUCH PASSPORTS.

 

PART IV
RESPONSIBILITIES OF HOLDERS OF PASSPORTS

Article 9: HOLDERS OF ORDINARY PASSPORTS MUST PAY A PROCESSING FEE. THE AMOUNT AND METHOD OF PAYMENT OF THE PROCESSING FEE ARE SET BY THE MINISTRIES OF FOREIGN AFFAIRS, PUBLIC SECURITY, AND FINANCE.

ARTICLE 10: HOLDERS OF PASSPORTS MUST CARRY THEM AT ALL TIMES AND SHALL NOT LOAN THEM TO OTHERS OR ALLOW OTHERS TO KEEP THEM.

Article 11: UPON ARRIVAL ABROAD, HOLDERS OF PASSPORTS MUST REPORT TO THE FOREIGN REPRESENTATIVE OFFICE OR CONSULAR AUTHORITY OF THE DEMOCRATIC REPUBLIC OF VIETNAM IN THAT COUNTRY.

Article 12: UPON RETURNING TO THE COUNTRY, HOLDERS OF PASSPORTS MUST SUBMIT THE PASSPORT TO THE ISSUING AUTHORITY WITHIN SEVEN DAYS.

Article 13: IF A PASSPORT IS LOST, THE HOLDER MUST REPORT IT IN ACCORDANCE WITH THE PROCEDURES SET BY THE MINISTRIES OF FOREIGN AFFAIRS AND PUBLIC SECURITY.

Article 14: ANYONE USING OR MAKING FALSE PASSPORTS, ALTERING INFORMATION IN PASSPORTS WITHOUT AUTHORIZATION, LOANING PASSPORTS, OR USING OTHERS' PASSPORTS SHALL BE PROSECUTED.

Article 15: THE MINISTERS OF FOREIGN AFFAIRS, PUBLIC SECURITY, AND FINANCE ARE RESPONSIBLE FOR IMPLEMENTING THIS DECREE.
