ISSUING REGULATIONS ON UNIT PRICES FOR PREPARATION OF DETAIL PLANNING ZONES (POINTS) FOR RELOCATION PROJECT OF SON LA HYDROPOWER PLANT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No. 16/2005/NĐ-CP dated February 7, 2005 of the Government on project management for investment construction works;
Pursuant to Decree No. 08/2005/NĐ-CP dated January 24, 2005 of the Government on planning for construction;
Pursuant to Decision No. 207/2004/QĐ-TTg dated December 11, 2004 of the Government on the management mechanism and implementation of the Son La Hydropower Project;
Based on the proposal of the Director of the Planning Department, the Director of the Construction Management Department, the Director of the Legal Affairs Department, and the Head of the Specialized Sub-Committee on Relocation Work of the Son La Hydropower Project,
DECISION:
Article 1. These regulations on unit prices for preparation of detail planning zones (points) for relocation of the Son La Hydropower Project are hereby issued together with this decision.
Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 3. The Ministries, ministerial-level agencies, agencies under the Government, People's Committees of Son La, Dien Bien, and Lai Chau provinces shall be responsible for implementing this Decision.

PART I
GENERAL PROVISIONS
Article 1. Purpose and requirements.
Issuing norms and unit prices for preparation of detail planning zones (points) for relocation to expedite the work of preparing, reviewing, and approving detail planning zones (points) for relocation of the Son La Hydropower Project.
Article 2. Scope and objects of application:
1. Scope: Applied to detail planning zones (points) for relocation of the Son La Hydropower Project.
2. Objects: Various costs serving the work of preparing and reviewing detail planning zones (points) for relocation of the Son La Hydropower Project.
Chapter II
STANDARDS AND UNIT PRICES FOR PREPARATION OF DETAIL PLANNING
ZONES, POINTS FOR RELOCATION
Article 3. Provisions on standards and unit prices.
1. The standards prescribed in this decision serve as the basis for preparing budgets for the work of preparing and reviewing detail planning zones (points) for relocation of the Son La Hydropower Project, including:
- Detail planning for concentrated relocation zones (points).
- Relocation resettlement arrangement plans.
- Detail planning for urban relocation zones.
2. The unit prices prescribed in this decision serve as the basis for preparing budgets, reviewing, and finalizing settlement accounts for the costs of preparing and reviewing detail planning zones (points) for relocation within the Son La Hydropower Project.
3. Basis for establishing standards and unit prices for detail planning zones (points) for relocation of the Son La Hydropower Project.
Using unit prices issued by central ministries, sectors, and localities based on appropriate adaptation to the actual conditions of the Son La Hydropower Resettlement Project, specifically as follows:
- Decision No.: 02/2000/QĐ-BNN-KH dated January 4, 2000 of the Minister of Agriculture and Rural Development on issuing agricultural and rural planning prices.
- Decision No.: 06/2005/QĐ-BXD dated February 3, 2005 of the Minister of Construction on issuing construction planning cost standards.
- Circular No. 03/2005/TT-BXD dated March 4, 2005 of the Ministry of Construction guiding adjustments to basic construction project budgets.
- Decision No.: 519/2002/QĐ-BKH dated August 26, 2002 of the Minister of Planning and Investment on temporarily issuing a framework price and construction planning cost standards for overall economic and social development plans, industries, and territories.
- Decision No.: 62/2001/QĐ-UB dated January 9, 2001 of the People's Committee of Son La Province on issuing construction survey unit prices.
- Decision No.: 32/2001/QĐ-UB dated June 26, 2001 of the People's Committee of Lai Chau Province (former) on issuing construction survey unit prices.
- Decision No.: 7751/QĐ-UB dated December 14, 2001 of the People's Committee of Hanoi City on temporarily issuing unit prices for boundary marking, coordinate attachment, area calculation, lot division marking, and map digitization services for construction surveys in the Hanoi area.
Article 4. Unit prices for preparation of detail planning for concentrated relocation zones (points).
1. Costs for the work of preparing detail planning for concentrated relocation zones (points) include:
1.1. Costs for building the outline (design task) and budget for planning:
The construction cost for the outline (design task) and budget for detailed planning of relocation zones is calculated at 10% of the cost of preparing the detailed planning design document (according to Decision No.: 06/2005/QĐ-BXD dated February 3, 2005 of the Minister of Construction), specified in Sections I, II, III - Appendix 01 attached to these regulations.
1.2. Costs for investigation, survey, creation of current socio-economic status maps, and socio-economic planning maps of the relocation zone (commune):
Applying the unit prices in Table 1 of Decision No.: 02/2000/QĐ-BNN-KH dated January 4, 2000 of the Minister of Agriculture and Rural Development, specified in Section I - Appendix 01 attached to these regulations.
1.3. Costs for preparing detail planning for relocation zones (points):
Applying the unit prices in Table 5 - Part IV of Decision No. 06/2005/QĐ-BXD dated February 3, 2005 of the Minister of Construction on construction planning cost standards, specifically as follows:
- Costs for detail planning of production land for relocation points: Specified in Section II - Appendix 01 attached to these regulations.
- Costs for preparing detail planning for residential areas within relocation points: Specified in Section III - Appendix 01 attached to these regulations.
1.4. Costs for topographic survey work to create 1:2,000 scale topographic maps:
Including control point establishment, elevation control, and 1:2,000 scale topographic map drawing costs: Specified in Appendix 02 attached to these regulations.
1.5. Costs for topographic survey work to create 1:500 scale topographic maps: Specified in Appendix 02 attached to these regulations.
1.6. Costs for lot division marker installation: Specified in Appendix 02 attached to these regulations.
1.7. Other costs:
- Costs for reviewing detail planning for relocation zones (points): Calculated at 9% of the cost of preparing the detailed planning document for relocation zones (points);
- Costs for reviewing the outline (design task) and budget: Calculated at 10% of the cost of reviewing detail planning for relocation zones (points).
- Planning management costs: Calculated at 6% of the cost of preparing the detailed planning project for the resettlement area (point);
- Publication costs: Calculated at 3% of the cost of preparing the detailed planning project for the resettlement area (point) (when settling accounts, there must be a detailed budget approved), this funding is assigned to the project investor responsible for organizing its implementation.
2. The price of the detailed planning project for the concentrated resettlement area includes the following items: Costs for collecting related materials, labor costs, material costs, depreciation costs of machinery and equipment, management costs, conference costs to approve the results of the planning project, training and professional development costs, health insurance, social insurance, trade union fees, and pre-tax income (excluding value-added tax).
3. The unit price stipulated in Section 1, Article 4 of this regulation shall be increased by the following factor:
Detailed planning for resettlement areas in villages in Zone 1: factor K = 1.0.
Detailed planning for resettlement areas in villages in Zone 2: factor K = 1.1.
Detailed planning for resettlement areas in villages in Zone 3: factor K = 1.2.
Article 5. Unit price for preparing the resettlement arrangement plan with interwoven resettlement.
Includes the following items: Costs for collecting related materials, labor costs, material costs, management costs, conference costs, and construction costs for the plan. When settling accounts, there must be a detailed budget approved by the People's Committee of the district or town.
The price for preparing the resettlement arrangement plan with interwoven resettlement is calculated at VND 1.5 million per resettled household accepted.
Article 6. Unit price for preparing the urban resettlement arrangement plan (towns, market towns, central communes).
The work of preparing urban resettlement planning shall apply the norms and unit prices issued together with Decision No. 06/2005/QĐ-BXD dated February 3, 2005, of the Minister of Construction.
Chapter III
IMPLEMENTATION
1. The People's Committees of Son La, Lai Chau, and Dien Bien provinces shall implement the application of unit prices and norms for preparing and reviewing detailed plans as stipulated herein, accelerate the review and approval process for detailed plans for the resettlement areas of the Son La Hydropower Project, to meet the set schedule.
2. During the implementation process, if there are any difficulties requiring adjustments and supplements, the People's Committees of Son La, Lai Chau, and Dien Bien provinces are requested to promptly report in writing to the Ministry of Agriculture and Rural Development for consideration, adjustment, and supplementation to ensure appropriateness./.
