JOINT CIRCULAR

GUIDELINES ON FUNDS FOR ORGANIZING AND DIRECTING THE PEOPLE'S SUPERVISION ACTIVITIES

OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT ALL LEVELS

Pursuant to Decree No. 99/2005/NĐ-CP dated July 28, 2005 of the Government detailing and guiding the implementation of certain provisions of the Inspection Law regarding the organization and operation of People's Supervision Committees;

Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing the implementation of the State Budget Law;

The Ministry of Finance and the Standing Committee of the Vietnam Fatherland Front Central Committee issue guidelines on funds for organizing and directing the people's supervision activities of the National Front for Unity and Solidarity at all levels as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. SCOPE OF APPLICATION:

These Guidelines apply to funds for organizing and directing the people's supervision activities of the National Front for Unity and Solidarity at all levels, including:

- People's Committees of Communes, Wards, and Towns (collectively referred to as People's Committees at the commune level);

- People's Committees of Districts, Counties, and Provincial Cities (collectively referred to as People's Committees at the district level);

- People's Committees of Provinces and Municipalities directly under the Central Government (collectively referred to as People's Committees at the provincial level);

- Central Committee of the Vietnam Fatherland Front.

2. FUNDS FOR ORGANIZING AND DIRECTING THE PEOPLE'S SUPERVISION ACTIVITIES SHALL BE ENSURED BY THE BUDGET OF THE SAME LEVEL AND MUST BE USED FOR THE INTENDED PURPOSE, IN ACCORDANCE WITH REGULATIONS, ECONOMICALLY AND EFFECTIVELY.

II. SPECIFIC PROVISIONS

1. Content of expenditure:

a) EXPENSES FOR PUBLICITY AMONG THE POPULATION REGARDING PARTY POLICIES AND STATE LAWS ON THE ORGANIZATION AND MANAGEMENT OF PEOPLE'S SUPERVISION ACTIVITIES INCLUDE: ORGANIZING MEETINGS, PRINTING AND PURCHASING MATERIALS, PUBLISHING PRODUCTS, AND PUBLICITY THROUGH MASS MEDIA ON THE ACTIVITIES OF PEOPLE'S SUPERVISION.

b) EXPENSES FOR TRAINING ON PEOPLE'S SUPERVISION ACTIVITIES.

c) EXPENSES FOR MONTHLY MEETINGS OF THE PEOPLE'S COMMITTEES AT THE PROVINCIAL, DISTRICT, AND COMMUNE LEVELS; AND GUIDANCE AND INSPECTION WORK DURING THE MANAGEMENT PROCESS FOR LOWER LEVELS ACCORDING TO PLANS.

d) EXPENSES FOR ANNUAL MID-YEAR AND YEAR-END MEETINGS ON THE ACTIVITIES OF PEOPLE'S SUPERVISION.

đ) EXPENSES FOR RECOGNITION AND REWARD FOR INDIVIDUALS AND ORGANIZATIONS WITH OUTSTANDING PERFORMANCE IN THE ACTIVITIES OF PEOPLE'S SUPERVISION EACH YEAR IN ACCORDANCE WITH CURRENT NATIONAL REGULATIONS ON COMPETITION AND RECOGNITION.

2. REGARDING EXPENSE REGULATIONS AND AMOUNTS: EXPENSES FOR THE ORGANIZATION AND MANAGEMENT OF PEOPLE'S SUPERVISION ACTIVITIES OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT ALL LEVELS AS STATED ABOVE SHALL BE IMPLEMENTED IN ACCORDANCE WITH THE CURRENT FINANCIAL EXPENSE STANDARDS AND REGULATIONS SET BY THE AUTHORIZED AUTHORITIES, SPECIFICALLY AS FOLLOWS:

a) FOR THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE COMMUNE LEVEL: - EXPENSES FOR THE PURCHASE OF OFFICE SUPPLIES BASED ON THE ACTUAL INVOICE OF THE PURCHASE; - EXPENSES FOR INFORMATION, PUBLICITY, TELEPHONE FEES, AND POSTAGE BASED ON THE ACTUAL INVOICE OF THE POST OFFICE; - EXPENSES FOR MEETINGS AND WORK TRAVEL FEES IN ACCORDANCE WITH THE REGULATIONS OF THE PROVINCE OR MUNICIPALITY'S PEOPLE'S COMMITTEE, BASED ON THE SPECIFIC IMPLEMENTATION OF THE EXPENSE LIMITS SET IN Circular No. 118/2004/TT-BTC dated December 8, 2004 of the Ministry of Finance on travel expenses and meeting regulations for administrative agencies and public service units nationwide. - PAYMENTS FOR REMUNERATION AND ALLOWANCES SHALL BE APPLIED IN ACCORDANCE WITH THE EXPENSE LIMITS DECIDED BY THE AUTHORIZED AGENCY. IN CASE THERE ARE NO SPECIFIC EXPENSE LIMITS, THE CHAIRMAN OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE COMMUNE LEVEL SHALL CONSULT WITH THE CHAIRMAN OF THE COMMUNE PEOPLE'S COMMITTEE TO MAKE A SUITABLE DECISION WITHIN THE ALLOCATED BUDGET FOR THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE COMMUNE LEVEL.

b) FOR THE CENTRAL COMMITTEE OF THE VIETNAM FATHERLAND FRONT, THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE PROVINCIAL AND DISTRICT LEVELS: - EXPENSES FOR MEETINGS AND WORK TRAVEL FEES IN ACCORDANCE WITH THE REGULATIONS OF THE STANDING COMMITTEE OF THE CENTRAL COMMITTEE OF THE VIETNAM FATHERLAND FRONT OR THE CHAIRMAN OF THE PROVINCE OR MUNICIPALITY'S PEOPLE'S COMMITTEE (FOR THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE PROVINCIAL AND DISTRICT LEVELS), SPECIFICALLY IMPLEMENTING THE REGULATIONS SET IN Circular No. 118/2004/TT-BTC dated December 8, 2004 of the Ministry of Finance on travel expenses and meeting regulations for administrative agencies and public service units nationwide. - OTHER EXPENSES FOR INFORMATION, PUBLICITY, AND THE PURCHASE OF OFFICE SUPPLIES, AND OTHER EXPENSES SHALL BE BASED ON THE ACTUAL INVOICE OF THE PURCHASE OR THE POST OFFICE OR CONTRACTS WITH THIRD PARTIES WITHIN THE BUDGET ALLOCATION APPROVED BY THE AUTHORIZED AUTHORITIES.

3. REGARDING THE SOURCE OF FUNDS: - FUNDS FOR THE ACTIVITIES OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE COMMUNE LEVEL SHALL BE ENSURED BY THE COMMUNE BUDGET. - FUNDS FOR THE ACTIVITIES OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE DISTRICT LEVEL SHALL BE ENSURED BY THE DISTRICT BUDGET. - FUNDS FOR THE ACTIVITIES OF THE NATIONAL FRONT FOR UNITY AND SOLIDARITY AT THE PROVINCIAL LEVEL SHALL BE ENSURED BY THE PROVINCIAL BUDGET. - FUNDS FOR THE ACTIVITIES OF THE CENTRAL COMMITTEE OF THE VIETNAM FATHERLAND FRONT SHALL BE ENSURED BY THE NATIONAL BUDGET.

4. PREPARATION OF BUDGET ESTIMATES, ALLOCATION, EXECUTION, AND SETTLEMENT OF FUNDS:

a) For the People's Committee of the United Front Federation at the commune level: The establishment, implementation, and settlement of operating funds shall be carried out in accordance with Circular No. 60/2003/TT-BTC dated June 23, 2003, issued by the Ministry of Finance on the management of commune budgets and other financial activities of communes, wards, and towns. This circular provides detailed guidance on the following points: - Establishment and implementation of budget estimates: For the first year of the local government budget stabilization period, based on the tasks of organizing and directing the people's inspection work at the commune level for the planned year, the current financial expenditure standards and regulations, the People's Committee of the United Front Federation at the commune level shall establish a budget estimate to ensure the operation of the People's Committee of the United Front Federation at the commune level, including the task of organizing and directing the people's inspection work, which will be submitted to the Financial Board at the commune level for consolidation into the commune-level budget revenue and expenditure plan to be submitted to the competent authority for approval in accordance with current regulations. Based on the local government budget capacity, upon the request of the People's Committee of the United Front Federation at the commune level, the Chairman of the People's Committee at the district level shall submit a proposal to the People's Council at the same level to balance the commune-level budget to ensure funding for the operation of the People's Committee of the United Front Federation at the commune level, including funding for organizing and directing the people's inspection work. For subsequent years within the local government budget stabilization period, based on the assigned budget estimates and the actual local government budget capacity, the allocation shall be made in accordance with the provisions of the State Budget Law. - Regarding the settlement of operating funds: Quarterly and annually, the Standing Board of the People's Committee of the United Front Federation at the commune level shall be responsible for consolidating the settlement of operating funds for organizing and directing the people's inspection work together with the operating funds of the People's Committee of the United Front Federation and submitting them to the Financial Board at the commune level for consolidation into the report on the settlement of expenditures of the People's Committee at the commune level in accordance with current regulations.

b) For the Central Committee of the United Front Federation of Vietnam, the People's Committee of the United Front Federation at the provincial and district levels: - The establishment, implementation, and settlement of operating funds for organizing and directing the people's inspection work shall be carried out in accordance with Circular No. 59/2003/TT-BTC dated June 13, 2003, issued by the Ministry of Finance guiding the implementation of Decree No. 60/2003/NĐ-CP dated June 6, 2003, issued by the Government detailing and guiding the implementation of the State Budget Law; - Quarterly and annually, the Central Committee of the United Front Federation of Vietnam, the People's Committee of the United Front Federation at the provincial and district levels shall be responsible for settling the operating funds for organizing and directing the people's inspection work together with the regular income and expenditure operating funds of their units and submitting them to the financial authorities at the same level in accordance with current regulations.

III. IMPLEMENTATION

1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.

This Circular replaces Circular Joint Circular No. 51/2003/TTLT-BTC-BTTĐCTUBTWMTTQVN dated May 23, 2003, issued by the Ministry of Finance and the Standing Board of the Central Committee of the United Front Federation of Vietnam guiding the funding for directing and activities of the People's Inspection Boards at communes, wards, and towns.

2. In the course of implementation, if there are any difficulties, agencies and units are requested to reflect these issues to the Ministry of Finance and the Standing Board of the Central Committee of the United Front Federation of Vietnam for consideration and resolution.
