JOINT CIRCULAR

Guidelines on funding for organizing and directing the people's inspection work of the People's Councils at all levels

Decree No. Decision No. 99/2005/NĐ-CP dated July 28, 2005 of the Government detailing and guiding the implementation of certain provisions Inspection Law concerning the organization and operation of the People's Inspection Committees;

Decree No. Decision No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing the implementation State Budget Law;

Joint Circular of the Ministry of Finance and the Standing Committee of the Central Committee of the National Front for Unity and Progress of Vietnam guiding funding for organizing and directing the people's inspection work of the People's Councils at all levels as follows: 

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope of application:

This circular guides the funding for organizing and directing the people's inspection work of the People's Councils at all levels, including:

- People's Councils at commune, ward, town level (referred to collectively as People's Councils at commune level);

- People's Councils at district, county, city directly under province level (referred to collectively as People's Councils at district level);

- People's Councils at provincial, centrally governed city level (referred to collectively as People's Councils at provincial level);

- Central Committee of the National Front for Unity and Progress of Vietnam.

2. Funding for organizing and directing the people's inspection work shall be guaranteed by the budget at each respective level and must be used for its intended purpose, in accordance with regulations, economically and effectively.

II. SPECIFIC PROVISIONS

1. Content of expenditure:

a) Expenses for propaganda among the people regarding the Party's policies and State laws on organizing and directing the activities of people's inspections include: organizing meetings, printing, purchasing materials, publishing products, and publicizing through mass media about the people's inspection work.

b) Expenses for training in people's inspection work.

c) Expenses for regular monthly coordination meetings of People's Councils at provincial, district, and commune levels; guidance and supervision work during the process of directing the People's Councils at lower levels according to plans.

d) Expenses for annual mid-year and year-end conferences on people's inspection work.

đ) Expenses for rewarding individuals and organizations with outstanding achievements in people's inspection work annually in accordance with current national regulations on commendation and reward.

2. Regarding expenditure regulations and expenditure limits:

The expenditures for organizing and directing the activities of people's inspections by the People's Councils at all levels mentioned above shall be implemented in accordance with the financial expenditure standards and regulations currently prescribed by the competent authority, specifically as follows:

a) For People's Councils at commune level:

- Expenses for purchasing office supplies based on actual purchase invoices;

- Expenses for information dissemination, propaganda, telephone charges, postal charges based on actual invoices from the post office;

- Expenses for meetings and travel expenses in accordance with the regulations of the provincial or centrally governed city People's Committee, based on the specific implementation of the expenditure limits stipulated in Circular No. 118/2004/TT-BTC dated December 8, 2004 of the Ministry of Finance on travel expenses and meeting regulations for administrative agencies and public institutions nationwide.

- Payment for remuneration and allowances applied according to the expenditure limits decided by the competent authority.

In cases where there are no specific expenditure limits, the Chairman of the People's Council at commune level shall coordinate with the Chairman of the People's Committee at commune level to consider and decide accordingly within the allocated budget for the People's Council at commune level.

b) For the Central Committee of the National Front for Unity and Progress of Vietnam, People's Councils at provincial and district levels:

- Expenses for meetings and travel expenses in accordance with the regulations of the Standing Committee of the Central Committee of the National Front for Unity and Progress of Vietnam or the Chairman of the provincial or centrally governed city People's Committee (for People's Councils at provincial and district levels), specifically implementing the provisions stipulated in Circular No. 118/2004/TT-BTC dated December 8, 2004 of the Ministry of Finance on travel expenses and meeting regulations for administrative agencies and public institutions nationwide.

- Expenses for information dissemination, propaganda, and other expenses for purchasing office supplies, other expenses based on actual purchase invoices or actual invoices from the post office or contracts with external parties within the approved budget.

3. Regarding sources of funding guarantee:

- Funding for the activities of organizing and directing the people's inspection work of People's Councils at commune level shall be guaranteed by the commune budget.

- Funding for the activities of organizing and directing the people's inspection work of People's Councils at district level shall be guaranteed by the district budget.

- Funding for the activities of organizing and directing the people's inspection work of People's Councils at provincial level shall be guaranteed by the provincial budget.

- Funding for the activities of organizing and directing the people's inspection work of the Central Committee of the National Front for Unity and Progress of Vietnam shall be guaranteed by the central budget.

4. Preparation, allocation, execution, and settlement of funding:

a) For People's Councils at commune level: The preparation, execution, and settlement of funding for activities shall be carried out in accordance with the provisions of Circular No. 60/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance on management of commune budgets and other financial activities of communes, wards, and towns.

This circular provides detailed guidance on the following points:

- Establishing and implementing the budget: For the first year of the local government budget stabilization period, based on the tasks of organizing and directing the people's inspection work at the commune level for the planned year, the current financial expenditure standards and regulations, the People's Committee of the Commune-level United Front Committee shall establish a budget to ensure the operation of the Commune-level United Front Committee, including the task of organizing and directing the people's inspection work, to be submitted to the Commune Finance Board for consolidation into the commune-level budget revenue and expenditure plan for approval by the competent authority in accordance with current regulations. Based on the local budget capacity, and upon the proposal of the Commune-level United Front Committee, the Chairman of the Commune People's Committee shall submit to the Commune People's Council for coordination to allocate funds to the commune budget to ensure operating costs for the Commune-level United Front Committee, including costs for organizing and directing the people's inspection work. For subsequent years within the local government budget stabilization period, based on the allocated budget estimate and the actual local budget capacity, the allocation shall be made in accordance with the provisions of the State Budget Law.

- Regarding finalizing expenses: Quarterly and annually, the Standing Committee of the Commune-level United Front Committee shall be responsible for consolidating the finalization of expenses for organizing and directing the people's inspection work together with the operating expenses of the United Front Committee and submitting them to the Commune Finance Board for consolidation into the final report on expenditures of the Commune People's Committee in accordance with current regulations.

b) For the Central Committee of the National Front for Unity and Progress of Vietnam, People's Councils at provincial and district levels:

- The establishment, implementation, and finalization of expenses for organizing and directing the people's inspection work shall be carried out in accordance with the provisions of Circular No. 59/2003/TT-BTC dated June 13, 2003, issued by the Ministry of Finance, guiding the implementation of Decree No. 60/2003/NĐ-CP dated June 6, 2003, of the Government detailing and guiding the implementation of the State Budget Law.

- Quarterly and annually, the Central United Front Committee of Vietnam, the Provincial and District-level United Front Committees shall be responsible for finalizing expenses for organizing and directing the people's inspection work together with the regular income and expenditure of their units and submitting them to the finance authorities at the same level in accordance with current regulations.

III. IMPLEMENTATION

1. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.

This Circular replaces Joint Circular No. 51/2003/TTLT/BTC-BTTUBTWMTTQVN dated May 23, 2003, of the Ministry of Finance and the Standing Committee of the Central United Front Committee of Vietnam guiding the expenses for directing and activities of the People's Inspection Boards at the commune, ward, and town levels.

2. In the course of implementation, if there are difficulties, agencies and units are requested to reflect these issues to the Ministry of Finance and the Standing Committee of the Central United Front Committee of Vietnam for consideration and resolution./.
