PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 2. This Circular applies to civil servants specializing in inland waterway port services at inland waterway port service offices and related organizations and individuals.
Article 3. Code numbers for occupational titles of civil servants specializing in inland waterway port services

Chapter II
OCCUPATIONAL STANDARDS
a) Leading the implementation of specialized tasks within the jurisdiction of the inland waterway port service office in accordance with the law;
1. Duties:
b) Leading the study, proposal, and development of policies, guidelines, planning, and application of science and technology within the scope of tasks of the inland waterway port service office;
c) Leading the study and development of regulations, procedures, and professional manuals within the assigned field; compiling professional guidance materials for the inland waterway port service office; conducting specialized training, vocational training, disseminating knowledge and management experience within the scope of functions and tasks of the inland waterway port service office;
d) Leading the study and development of research topics, projects, and scientific works, management solutions to improve and perfect management mechanisms, enhancing the effectiveness of operations of relevant agencies and organizations related to the tasks of the inland waterway port service office;
đ) Organizing the dissemination and promulgation of specialized regulatory documents within the assigned field to management objects and organizing inspections of compliance with these regulations;
b) Holding a certificate of training according to the occupational standards for civil servants specializing in inland waterway port services.
e) Perform other tasks assigned by competent authorities.

Article 4. Criteria and conditions for registering to take the examination or be promoted to the occupational title of Inland Waterway Port Service Officer Grade I Civil servants may register to take the examination or be promoted to the occupational title of Inland Waterway Port Service Officer Grade I when they meet the criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants, and the following criteria and conditions:
a) Having served in the position of Inland Waterway Port Officer Level II or equivalent for at least six years. In cases where there is equivalent time, they must have at least one year (twelve months) of service in the position of Inland Waterway Port Officer Level II as of the deadline for submitting registration applications for the examination or promotion review.
b) During the period holding the rank of Inland Waterway Port Officer Level II and equivalent, have participated in building at least two (2) regulatory legal documents, topics, projects, initiatives at the ministry level, sectoral level, or provincial level assigned by the employing agency for research and construction, which have been issued or accepted by the competent authority.
Article 5. Inland Waterway Port Officer Level II - Code: V.12.52.02
1. Duties:
a) Lead or participate in implementing specialized tasks within the management scope of the Inland Waterway Port according to the provisions of the law;
b) Lead or participate in researching, proposing, and building policies, orientations, planning, development plans, and applying science and technology within the scope of tasks of the Inland Waterway Port;
c) Lead or participate in building regulations, rules, and professional procedures within the assigned field; compile professional guidance materials for the Inland Waterway Port; conduct specialized training, vocational training, disseminate knowledge and experience within the assigned tasks;
d) Lead or participate in researching and building topics, projects, and scientific research works, management solutions aimed at innovating and improving management mechanisms, enhancing the effectiveness of operations of related agencies and organizations within the scope of tasks of the Inland Waterway Port;
đ) Prepare reports, statistics, manage archival files, implement procedural tasks; synthesize, evaluate, and perfect management mechanisms and policies within the assigned fields;
e) Perform other tasks assigned by competent authorities.
2. Qualifications regarding education and training:
a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;
a) Mastering the Party's policies and state laws, strategies, planning, and development plans for the inland waterway sector; understanding economic and social realities;
3. Qualifications regarding professional expertise and skills:
a) Master the Party's guidelines, policies, state laws, strategies, planning, and development plans in the inland waterway sector;
b) Understand the situation and trends of development in the inland waterway sector; possess knowledge about the inland waterway sector; be capable of applying and deploying technology within the scope of assigned work;
c) Master the system of administrative management knowledge of the state; specialized management in the inland waterway sector and legal provisions regarding the regime for civil servants;
d) Possess the ability to analyze, synthesize, systematize, and propose methods to improve or resolve practical issues within the management scope of the Inland Waterway Port;
đ) Possess the ability to implement work ensuring progress, quality, and efficiency; have skills in drafting documents, presenting; effectively handle assigned tasks;
e) Possess the ability to research, summarize practical experiences, and propose solutions to enhance the quality and efficiency of work in the assigned industry and field;
g) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority regions as required by job positions;
a) Have held the rank of Inland Waterway Port Officer Level III and equivalent for at least nine (9) years (excluding probationary and trial periods). In cases with equivalent time, they must have held the rank of Inland Waterway Port Officer Level III for at least one year (12 months) up to the deadline for submitting registration applications for the examination or promotion;
b) During the period holding the rank of Inland Waterway Port Officer Level III and equivalent, have participated in building at least one (1) regulatory legal document, topic, project, initiative at the ministry level, sectoral level, or provincial level assigned by the employing agency for research and construction, which have been issued or accepted by the competent authority.
Article 6. Inland Waterway Port Officer Level III - Code: V.12.52.03
1. Duties:
a) Participate in implementing specialized tasks within the management scope of the Inland Waterway Port Service in accordance with the provisions of the law;
b) Participate in researching, proposing policies, orientations, planning, development applications, scientific and technological advancements within the assigned tasks; participate in building specialized mechanisms and regulations in accordance with the law, suitable to practical circumstances;
c) Promote, guide, monitor the implementation of regulations on port and inland waterway wharf activities, anchorage areas; inspect the operations of ports, inland waterway wharfs, and anchorage areas under the management scope of the Inland Waterway Port Service;
d) Guide, monitor, inspect, and propose measures to implement management regulations effectively; directly perform inspection and supervision tasks to ensure compliance with state management laws at ports, inland waterway wharfs, and anchorage areas within the assigned management scope;
đ) Summarize feedback from organizations and individuals regarding issues related to port and inland waterway wharf management, anchorage areas for research and proposals to improve related management activities;
e) Participate in inspections, collecting information, statistics, managing files, and storing data to serve work;
g) Perform other tasks when authorized by competent authorities;
2. Qualifications regarding education and training:
a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;
a) Mastering the Party's policies and state laws, strategies, planning, and development plans for the inland waterway sector; understanding economic and social realities;
3. Qualifications regarding professional expertise and skills:
a) Proficiently understand Party guidelines, policies, and state laws; industry and field policies and basic knowledge about the assigned professional and vocational fields;
b) Understand administrative state management systems; specialized state management systems in the waterway sector and legal provisions concerning civil servants;
c) Master principles, procedures, vocational processes, plans, and have presentation skills for assigned research and advisory tasks;
d) Have methods for research, summarization, proposal, and improvement of management practices; ability to implement work ensuring progress, quality, and effectiveness;
đ) Possess problem-solving skills, analysis, synthesis, communication, coordination; skills in using office equipment for professional work;
e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.
Article 7. Inland Waterway Port Officer Level IV - Code: V.12.52.04
1. Duties:
a) Participate, support, and assist in the implementation of public service activities and tasks based on management regulations of the Inland Waterway Port Service;
b) Carry out assigned tasks; compile, analyze, evaluate effectiveness, and report promptly according to requirements and management objectives;
c) Identify and propose solutions to adjust deficiencies in the execution of public duties by managed entities to ensure strict and effective enforcement of policies, decisions, and management regulations;
d) Implement file and document management systems; organize comprehensive and accurate statistical storage of documents and data as required by tasks;
đ) Participate in drafting internal procedures, regulations, and rules;
e) Perform other tasks when authorized by competent authorities;
2. Qualifications regarding education and training:
a) Hold a college degree or higher in a relevant field that meets the requirements of the position;
a) Mastering the Party's policies and state laws, strategies, planning, and development plans for the inland waterway sector; understanding economic and social realities;
3. Qualifications regarding professional expertise and skills:
a) Proficiently understand Party guidelines, policies, state laws; principles, systems, procedures, and vocational guidance, management objectives of the assigned industry and field;
b) Proficiently understand procedures, steps, and processes for performing tasks within the assigned scope;
c) Possess the ability to carry out tasks according to responsibilities and assignments given by authorized bodies;
d) Proficiently use office equipment and other tools necessary for task requirements.
Chapter III
SALARY RANK FOR THE PROFESSIONAL TITLE OF INLAND WATERWAY PORT SERVICE CIVIL SERVANT
Article 8. Principles for setting salaries for professional positions of specialized port service civil servants in inland waterways
1. The appointment and setting of salaries for professional positions of specialized port service civil servants in inland waterways must be based on the job position, responsibilities, and professional qualifications currently held, and must fully meet the standards as prescribed in this Circular.
2. When transferring from the current professional position of a civil servant to a corresponding specialized port service professional position in inland waterways, it shall not combine with salary grade increase or promotion of professional position of civil servant.
Article 9. Transfer and setting of salaries for professional positions of specialized port service civil servants in inland waterways
1. From the date this Circular takes effect, in cases where civil servants do not yet meet the conditions and standards for appointment to the professional positions of specialized port service civil servants in inland waterways as stipulated in Articles 4, 5, 6, and 7 of this Circular, the following measures shall be implemented:
a) If the civil servant has less than five years (60 months) until retirement, they shall continue to hold their current rank or professional position level and be paid according to the current salary grade.
b) If the civil servant has five years (60 months) or more until retirement, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the civil servant meets the standards of the professional position level of specialized port service civil servants in inland waterways as prescribed in this Circular. After the period specified herein, if the civil servant does not meet the prescribed standards, the head of the public institution shall consider assigning other suitable work or implementing policies as prescribed.
2. The professional positions of inland waterway port service officers prescribed in this Circular shall apply the Table of Professional and Vocational Salaries for State Officials and Civil Servants in Public Institutions (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for state officials, civil servants, and armed forces personnel, as follows:
a) The professional position of Inland Waterway Port Service Officer Level I shall apply the civil servant salary coefficient type A3, group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;
b) The professional position of Inland Waterway Port Service Officer Level II shall apply the civil servant salary coefficient type A2, group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;
c) The professional position of Inland Waterway Port Service Officer Level III shall apply the civil servant salary coefficient type A1 from coefficient 2.34 to coefficient 4.98;
d) The professional position of Inland Waterway Port Service Officer Level IV shall apply the civil servant salary coefficient type A0 from coefficient 2.10 to coefficient 4.89.
3. The setting of salaries for civil servants in specialized port services in inland waterways who are currently holding civil servant grades and ranks and transferring to the professional positions of port service civil servants in inland waterways as prescribed in this Circular shall be carried out in accordance with the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary setting when upgrading, changing grades, or changing types of civil servants, specifically as follows:
a) Setting the salary for Inland Waterway Port Service Officer Level I, code V.12.52.01, for civil servants currently holding salary type A3, group 1 (A3.1);
b) Setting the salary for Inland Waterway Port Service Officer Level II, code V.12.52.02, for civil servants currently holding salary type A2, group 1 (A2.1);
c) Setting the salary for Inland Waterway Port Service Officer Level III, code V.12.52.03, for civil servants currently holding salary type A1;
d) Setting the salary for Inland Waterway Port Service Officer Level IV, code V.12.52.04, for civil servants currently holding salary type A0.
Chapter IV
IMPLEMENTING PROVISIONS
Article 10. Effective Date
1. This Circular takes effect from March 1, 2023.
2. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the provisions of the amended, supplemented, or replacing documents.
Article 11. Implementation Organization
The Director of the Office of the Ministry, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Inland Waterway Administration, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
