CIRCULAR

Repeals Circular No. 03/2008/TT-BNV dated June 3, 2008, issued by the Minister of Home Affairson guiding the implementation of non-examination grade promotion for officials, civil servants, and public employees who have received retirement notices department, civil servant, and public official have been notified of retirement

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Officials and Civil Servants and the Law on Public Employees dated November 25, [year missing];

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures to implement the Law on Legislative Regulatory Documents; Decree No. 154/2023/NĐ-CP dated December 31, 2023 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs.

At the proposal of the Director of the Salary Department;

The Minister of Home Affairs hereby issues this Circular to repeal Circular No. 03/2008/TT-BNV dated June 3, 2008, issued by the Minister of Home Affairs on guiding the implementation of non-examination grade promotion for officials, civil servants, and public employees who have received retirement notices.

This Circular takes effect from January 25, 2026.

Article 2. Implementation clause

1. This Circular takes effect from June 15, 2023.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular./.
