Circular No. 4/TT on the temporary regulations regarding the treatment for teachers teaching at Teachers' Training Universities

CIRCULAR

ISSUED BY THE MINISTRY OF EDUCATION DECREE NO. 4/TT ON FEBRUARY 27, 1975 TEMPORARILY REGULATING
LABOR REGIME FOR TEACHERS TEACHING IN TEACHER TRAINING UNIVERSITIES

BASED ON DECISION NO. 644/QĐ dated October 10, 1970 of the Ministry of Higher Education and Secondary Specialized Schools regarding the labor regime for university teachers, the Ministry of Education issues this circular to guide the consistent implementation of this issue in all Teacher Training Universities as follows:

I - TASKS AND WORKING TIME OF UNIVERSITY TEACHERS
UNIVERSITY

A year consists of 52 weeks, excluding 6 weeks for the following tasks: 4 weeks of summer vacation, 2 weeks of holidays and conducting annual congresses, leaving 46 weeks to be allocated to the following tasks:

1- N |||The main task of teaching and educating students includes 26 weeks, to conduct classroom activities (theoretical lectures, guiding exercises, practical work, experiments...); some pre-class and post-class activities (lesson preparation, practical preparation, internship, subject department meetings, observing classes, mutual visits, helping underperforming students, nurturing outstanding students, grading assignments, invigilating exams, grading exams, visiting secondary schools...) participating in ideological education, moral education, vocational training, building student collectives.

2- The task of studying, nurturing, scientific research, and disseminating science includes 12 weeks.

3- The task of participating in production labor according to Directive No. 237/TTg dated December 1, 1970 of the Prime Minister includes 6 weeks.

4- Military training tasks include 2 weeks taken from working hours and some other time outside regular working hours.

5- In addition to the main tasks mentioned above, each teacher also has the task of participating in certain administrative and organizational activities both within and outside the school.

II - SPECIFIC PROVISIONS REGARDING THE LABOR REGIME
FOR UNIVERSITY TEACHERS

1- Standard class hours for lecturing (converted to theoretical hours).

a) Teachers teaching subjects Vsuch as Lhistory, Geography, Cpolitics, Psychology-Education each year lecture from 180 to 200 hours.

b) Teachers teaching Mathematics, Physics, Chemistry, Biology, and other subjects in the Faculty of Industrial Engineering and Agriculture, and general cultural subjects at the Foreign Language Teacher Training University, each year lecture from 230 to 250 hours.

The maximum level applies to teachers with over five years of service at the university and those with a higher degree (associate doctorate, doctorate); the minimum level applies to teachers with five years or less of service at the university, calculated up to the date they were officially recognized as lecturers.

c) Teachers teaching foreign languages at specialized language schools each year lecture 270 hours. For teachers assigned to teach fifth-year classes (with teaching hours in these classes accounting for one quarter or more of the standard hours mentioned above), each year lecture 230 hours.

d) Teachers teaching foreign languages at non-specialized language schools each year lecture 360 hours. If teaching in part-time classes, each year lecture 330 hours.

e) Teachers teaching military subjects, Physical Education, Music, Art, Home Economics...each week lecture 14 hours (one year 420 hours), including both theoretical and practical sessions.

In addition to the aforementioned standard hours, these teachers also have the responsibility to divide tasks among themselves, take care of military lifestyle work, promote physical education, sports, cultural activities, and female student affairs throughout the school.

f) Probationary teachers participate in teaching annually from 1/5 to 1/4 of the standard hours for teachers in groups a and b; not exceeding 1/2 of the standard hours for teachers in groups d and e mentioned above.

g) Female teachers who have established families are entitled to a reduction of 1/10 of their standard hours annually.

2- Conversion of other types of hours to theoretical hours.

- Class hours for correcting exercises: 1.5 hours of class teaching is equivalent to 1 hour of theoretical teaching.

- Hours for guiding experiments and practical work: 1.5 hours of guidance is equivalent to 1 hour of theoretical teaching if there is no assistant staff.

- Guiding students' discussions in class (excluding evening discussions): 1.5 hours of guidance is equivalent to 1 hour of theoretical teaching.

- Guiding students on concentrated pedagogical internships, field trips with content aimed at improving students' skills, is counted as 9 hours of theoretical teaching per week for members and 12 hours of theoretical teaching per week for teachers leading the group.

In addition to assisting students with internships, this is a practical task serving the teaching of all teacher training school teachers. Therefore, the school must plan annually to arrange for all teachers to have time to immerse themselves in secondary schools, considering this as a task of teacher training teachers.

- Guiding students on large assignments, stipulated as follows:

+ Guiding 1-2 students counts as 6 hours of theoretical teaching.

+ Guiding 3-4 students counts as 8 hours of theoretical teaching.

+ Guiding 5-6 students counts as 10 hours of theoretical teaching.

To ensure the quality of the thesis and the health of the teacher, each teacher can only guide a maximum of 6 students. The hours above are calculated based on the number of students rather than the number of projects guided by the teacher.

- Guiding students on graduation theses is counted as 12 hours of theoretical teaching per project, regardless of how many students are involved. Each teacher can only guide a maximum of 4 projects. From the fifth project onwards (if assigned), it is counted as half of the specified hours.

- Guiding university teachers on master's theses (sometimes called "level 1") is counted as 30 hours of theoretical teaching per project. N |||If guiding doctoral dissertations (sometimes called "level 2"), it is counted as 50 hours of theoretical teaching per project.

3- Reduction in teaching hours for teachers performing兼任职务的教师授课时间减少。

- 学科主任每年减少标准课时的1/3至1/2，

- 副学科主任每年减少标准课时的1/4至1/3。

最高限额适用于学生人数超过500人的学科，最低限额适用于学生人数不超过500人的学科。

- 专业组长每年减少标准课时的1/4至1/3。

最高限额适用于直属校长的公共部门组和成员超过15人的组。最低限额适用于成员不超过15人的组以及成员不少于7人的专业组长。

The establishment of the specialized team (and such specialized group must be decided by the school principal).

- Teaching assistants of the department shall have their standard hours reduced by one quarter per year.

In cases of real necessity, the school principal may propose to the competent authority to appoint additional assistants such as probationers, scientific researchers, etc. These assistants shall also have their standard hours reduced by one quarter. B- Class advisors (one per class) shall have their teaching hours reduced by 30 hours per year.

- Teachers responsible for the Communist Youth League branch secretary of the department shall have their teaching hours reduced weekly like the deputy head of the department. If they hold both positions of head or deputy head of the department and this position, they will not have further reductions in teaching hours.

- Teachers responsible for the Secretary of the Ho Chi Minh Communist Youth League branch, the Party Branch Secretary, the Teacher's Youth League Branch Secretary, the Department Trade Union Secretary, each shall have their teaching hours reduced by 30 hours per year.

To facilitate teachers in completing their assigned teaching tasks and concurrent duties well, the school shall only assign no more than two concurrent duties to each teacher.

4- The task of participating in ideological education, moral education, and building student collectives.

This is a regular task of all teachers towards students during the teaching process of their subjects. In addition, all teachers are required to participate in certain activities aimed at directly educating students' ideology, morals, and building student collectives (such as attending, guiding political activities among students, educating individual students, etc.). The time allocated for this task is 60 administrative hours per year and is taken from the time of the first task mentioned in Section I of this Circular.

5- The task of scientific research, self-study, and training.

The time allocated for self-study and training to improve political and professional qualifications (including concentrated training time) within one year is 400 hours for teachers with up to five years of work experience at universities and 200 hours for those with over five years of work experience at universities.

The time allocated for scientific research and dissemination (including textbook compilation time) is 400 hours for teachers with over five years of work experience at universities and 200 hours for those with up to five years of work experience at universities.

Based on the time specified above, at the beginning of each academic year, each teacher is tasked with developing a study, training, and research plan for the entire academic year, clearly stating the level and necessary time for each task, and is responsible for completing the programs and plans set out. The school and departments need to have specific plans to assist each teacher in completing their study, training, and research tasks.

6- The task of participating in production labor and military training.

- According to Directive 237/TTg dated December 1, 1970 of the Prime Minister regarding the system of participation in production labor for university and vocational college teachers (and Circular 30/TT dated December 17, 1970 of the Ministry of Universities and Vocational Colleges guiding the implementation of Directive 237/TTg), the time for university teachers to participate in production labor is six weeks, including:

+ Two weeks of labor serving the initial construction needs of the school.

+ Two weeks (one session per week) for production according to the direction outlined in Directive 237/TTg.

+ Two weeks of public welfare labor and voluntary labor (including travel days).

- The time for military training for university teachers still applies according to Decision 644/QĐ of the Ministry of Universities and Vocational Colleges.

7- Other provisions regarding the use of working hours for university teachers.

In addition to teaching duties, all teachers must complete the tasks of participating in production labor, study, training, scientific research (and dissemination), and military training (as stipulated in terms of time and workload).

To make good use of the above time, the Ministry specifies as follows:

a) In cases where teachers do not fully utilize the hours allocated for the tasks mentioned in Points 2, 3, and 4 of Section I, the school principal will assign additional teaching hours (or concurrent duties) equivalent to the unused time.

For example, if a teacher does not participate in labor for one week, they will be assigned additional teaching hours equal to one twenty-sixth of the standard hours (since the time allocated for teaching is 26 weeks per year).

b) For teachers who need to concentrate significant time on scientific research (such as compiling university textbooks, completing large scientific projects) beyond the time already allocated for research, they may reduce some time from other tasks for research purposes (this must be approved by the principal and reported to the Ministry).

8- The payment system for overtime teaching for university teachers.

Teachers who teach beyond the standard hours (after completing tasks 2, 3, and 4 mentioned in Section 1) shall be paid for overtime teaching according to the current regulations. Now, the Ministry stipulates as follows:

Based on the labor system stipulated in this Circular (and other factors such as the number of current students, teaching programs, etc.), the school must develop a plan for using teacher labor at the beginning of the academic year and report it for approval by the Ministry.

On this basis, at the end of the academic year (after reporting on labor usage and adjustments during the academic year), the Ministry will proceed to pay for overtime teaching for cases exceeding standard hours. The number of hours paid shall not exceed half of the standard hours of that teacher. Specifically, teachers detached from teaching for management roles such as principals, vice-principals, or department heads, if they engage in teaching, shall be compensated for direct teaching hours at 65% of the rate table. The number of hours paid shall not exceed one-third of the standard hours of teachers in the same category.

On this basis, at the end of the academic year (after receiving the report on the use and adjustment of labor during the academic year from the school), the Ministry will proceed to pay overtime teaching fees for cases where the number of hours taught exceeds the standard. The number of hours to be paid shall not exceed half of the teacher's standard hours. For teachers who are exempted from teaching duties to perform administrative work such as principal, vice-principal positions, or work in departments and offices, if they participate in teaching, they will be compensated for the actual teaching hours at a rate of 65% of the tariff. The number of hours to be paid shall not exceed one-third of the standard hours of a teacher of the same type.

The above are the necessary issues that the Ministry needs to guide for uniform implementation in all teacher training universities. Other contents not mentioned in this Circular shall still be implemented according to previous documents. In case there are any difficulties during the implementation process, schools are requested to reflect them so that the Ministry can study and supplement accordingly.

This Circular takes effect from the date of signature.
