Regarding the establishment of the National Council for Labor Protection

PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 06/CP dated January 20, 1995 of the Government detailing certain provisions of the Labor Code on occupational safety and health;
At the proposal of the Minister of Home Affairs and the Minister of Labor, Invalids and Social Affairs,
DECISION:
Article 1. Establish the National Council for Labor Protection to advise the Prime Minister on policies, directions, mechanisms, and policies and to coordinate activities among ministries and sectors regarding labor protection work.
Article 2. The National Council for Labor Protection shall have the following tasks to advise and assist the Prime Minister:
1. Determining directions, mechanisms, and policies related to labor protection.
2. Measures to direct and implement policies and the National Program on labor protection.
3. Serving as the focal point for coordinating activities between ministries, sectors, and mass organizations regarding labor protection work to ensure occupational safety and health and improve working conditions.
Article 3.
1. The National Council for Labor Protection consists of the following members:
- The Minister of Labor, Invalids and Social Affairs, Chairperson of the Council;
- The Vice Minister of Health, Deputy Chairperson of the Council;
- The Vice Minister of Science and Technology, Member;
- The Vice Minister of Planning and Investment, Member;
- The Vice Minister of Public Security, Member;
- The Vice Minister of Defense, Member;
- The Vice Minister of Industry, Member;
- The Vice Minister of Construction, Member;
- The Vice Minister of Education and Training, Member;
- The Vice Minister of Transport, Member;
- The Vice Minister of Agriculture and Rural Development, Member;
- The Vice Minister of Natural Resources and Environment, Member;
- The Vice Minister of Fisheries, Member;
- The Vice Minister of Home Affairs, Member;
- The General Director of Vietnam Social Security, Member.
Invite a representative of the Chairman's Board of the Vietnam General Confederation of Trade Unions to serve as Deputy Chairperson of the Council; invite representatives from the leadership of the Federation of Agricultural Cooperatives, the Vietnam Farmers' Association, the Vietnam Chamber of Commerce and Industry, and the Scientific and Technical Council for Safety and Health to participate in the Council.
The relevant ministries and agencies shall appoint specific members to participate in the Council.
2. The Standing Board of the Council includes: the Chairperson, Deputy Chairpersons, and the Head of the Secretariat.
3. The Council shall be assisted by a Secretariat consisting of: the Head of the Secretariat being the Director of the Department of Occupational Safety and Health (Ministry of Labor, Invalids and Social Affairs) and some part-time secretaries who are specialists from the Ministry of Labor, Invalids and Social Affairs appointed by the Chairperson of the Council.
Article 4. Members of the Council shall work on a part-time basis. The Council operates on the principle of democracy, open discussion, and majority voting on issues related to its assigned tasks.
The Council shall meet regularly every six months; in case of emergency, the Standing Board of the Council may convene a meeting. After each session, the Council shall report to the Prime Minister in writing on the content, program, and recommendations of the Council regarding labor protection matters. During sessions, representatives from relevant agencies involved in implementing labor protection tasks may be invited to attend. The Chairperson of the Council is responsible for directing the activities of the Council; guiding the development of regulations on operations, working relationships, and assigning responsibilities to each member of the Council.
Article 5. The National Council for Labor Protection shall use the seal of the Ministry of Labor, Invalids and Social Affairs; the common operating budget of the Council (excluding salaries) shall be guaranteed by the state budget and included in the annual budget estimate of the Ministry of Labor, Invalids and Social Affairs.
Article 6. The location for the Council's operations shall be arranged by the Ministry of Labor, Invalids and Social Affairs.
Ministers, heads of ministerial-level agencies, heads of agencies under the Government, and the members mentioned in Article 3 of this Decision, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
Article 7. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 8. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, members mentioned in Article 3 of this Decision, and Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision.
